ROLL CALL Present were Planning Commission Chairman Garth El lard and Planning Commissioners , Dick Halley , David Gilmour and Chuck Piland. Absent Karolyne Hugo , who had called in to report that she would be unable to attend because of an illness in her family . Commissioner Bob Matthews arrived at approximately 7 : 10 and was present for the remainder of the meeting . Also present were City Administrative Assistant , George Rubaloff , Fire Chief/Building Official Mark Servatius , Public Works Director Larry Blanchard and Secretary Cecelia Gordon . APPROVAL OF MINUTES Commissioner Halley made a motion to approve the minutes 'of the Planning Commission meetings January 2 , and January 16 , 1990 as presented . Commissioner Gilmour seconded the motion . Roll call vote : Gilmour , yes ; Halley , yes ; and Piland , yes ; and the Motion carried unanimously. CORRESPONDENCE AND PUBLIC APPEARANCES City Administrative Assistant, George Rubaloff, requested that the letter from Ronald Grimes , Architect be presented at the end of the meeting under Miscellaneous . BUSINESS Review and recommend City Council Approval of a minor land partition request submitted by Johnnie L . Scott on property located at 334 and 338 North 10th Street . (Resolution No. 182 . There were no conflicts of interest expressed by the Planning Commission , Chairman Ellard opened the Public Meeting . City Administrative Assistant, George Rubaloff, summarized his Staff Report submitted on February 2 , 1990 stating that the minor land partition met all the zoning , and lot size requirements . City of Central Point Planning Commission Meeting February 6 , 1990 Page 2 Chairman Ellard asked if there was anyone present that wanted to come forward in favor or in opposition to this minor land petition . There were none present. Chairman Ellard closed the public meeting . George Rubaloff responded to a question from the Commissioners regarding the division of the property . He explained that if an applicant had asked to divide it into four parcels , it would require going through a subdivision process rather than a minor land partition process . Commissioner Pi land moved that the Commission adopt Resolution 182 , as presented . Commissioner Matthews seconded the motion . Roll call vote : Gilmour, yes; Halley , yes ; Matthews , yes ; and Piland , yes ; and the motion carried unanimously. Review and determine name change for Cambridge Court Subdivision 1 located in the vicinity of Pittview Avenue east of Bursell Road . There were no conflicts of interest expressed by the Commissioners on this matter. City Administrative Assistant, George Rubaloff gave a brief background on the reason for the request for change of name and that City staff had researched to make sure that there would be no duplication or confusion with existing City street names. Commissioner Halley moved that the Commission approve that Cambridge Court Subdivision be renamed Sydney Estates and that the proposed street be renamed Sydney Circle. Commissioner Gilmour seconded the motion . Roll call vote: Gilmour, yes ; Halley , yes ; Matthews , yes; Piland ,, yes; and the motion carried unanimously . Designation of a non-conforming use classification at 150 North Front Street (Resolution No. 183 ) . No one came forward in favor of opposition to this resolution . City Administrative Assistant, George Rubaloff reviewed the resolution with the Commission and answered their questions. He stated that this resolution was to classify the property at 150 North Front Street for the record, and that once this structure was removed or the nonconforming use stops for a period of six months or more, the property shall be used according to the zoning regulations . City of Central Point Planning Commission Meeting February 6 , 1990 Page 3 Commissioner Piland made a motion that they adopt Resolution #183 classifying a Class B nonconforming use at 150 North Front Street within the City of Central Point . Commissioner Matthews seconded the Motion . Roll call vote : Gilmour , yes ; Halley , yes ; Matthews , yes ; Piland , yes ; and the motion carried unanimously . Review and recommendation on approving a Conditional Use Application submitted by Zeeb' s Investment Company and Northwest Commercial Construction . Inc . for a State Police Facility (Resolution No. 184 ) . There were no conflicts of interest expressed by the Commissioners. Commission Chairman Ellard opened the Public Meeting . Dr . Gilmour was excused from the meeting because of a prior commitment . George Rubaloff reviewed his February 1 , 1990 staff report and ' requested that the February 6 , 1990 ' fax ' letter from Zeeb ' s Investment Inc be entered into the record as part of the attachments . Mr. Rubaloff also presented a more current version of the Conditions of Approval ( Exhibit A ) which included two additional planning conditions relating to Phase III of the project. Commissioner Halley moved that the Site Plan Review be approved as presented . Commissioner Matthews seconded the motion . Roll call vote: Halley , yes ; Matthews , yes ; Piland , yes ; and the Motion carried unanimously . Commission Chairman Ellard closed the Public Meeting and opened the Public Hearing . Major Lynn Hillman , Oregon State Police , 2700 N. Pacific Hiway , Medford , Oregon came forward . As a representative of the Oregon State Police , he expressed his appreciation for the work the City Staff was doing in implementing the process for this facility. He also responded their concerns regarding the health , safety, noise, patrol car lights , sirens , laboratory environment. He assured the Commission that all precautions will be taken and were considered in the planning of this facility. Zeeb ' s Investment Company would be the owners, leasing to the Oregon State Police, thereby contributing to the property tax support system of the area. No one came forward to express opposition to this resolution . Commission Chairman Ellard closed the Public Hearing . City of Central Point Planning Commission Meeting February 6 , 1990 Page 4 Commissioner Piland moved that the Commission adopt Resolution #184, approving a conditional use application submitted by Zeeb' s Investment Company and Northwest Commercial Construction , Inc . for a State Police Facility as presented . Commissioner Halley seconded the Motion . Roll call vote : Halley , yes ; Matthews , yes ; Piland , yes , all the commissioners voted in favor of the motion and the motion carried unanimously. Chairman Ellard asked if there were any other items to discuss that were not included in the Agenda. City Administrative Assistant , George Rubaloff handed out copies of a letter from the Ronald L . Grimes , Architect , which contained a request to the Planning Commission to address a proposed commercial development on Freeman Road. The Commission requested that staff prepare findings that would support the similar and compatible use of this type of aevelopment in a C-4 zone . ( There was also discussion on whether to use the term "Supermarket" or "Shopping Center" ) . The Commission also requested that they have these findings in hand in time to adequately review them in advance of the next regularly scheduled Planning Commission Meeting . George Rubaloff stated that the Developer had chosen to keep the names of the tenants confidential at this time . There were no further items under miscellaneous. Commissioner Piland made a Motion to adjourn , Commissioner Piland seconded , and the Motion was carried unanimously. The meeting was adjourned at 9 : 15 p.m.
