Planning Commission Minutes
November 15, 1994
I. MEETING CALLED TO ORDER at 7:01 pm
IL ROLL CALL - Those present were: Chuck Piland, Jan Dunlap, Herb Farber,
Candy Fish, Lloyd Governor, Randy Graves, Also present were George Rubaloff,
Planning Administrator, Mark Servatius - Fire Chief/Building Official, Larry
Blanchard, . Public Works Technician, and Cecelia Gordon, Public Works
Secretary. Karolyne Johnson called to state that she would not be able to
attend.

IV. MINUTES
Commissioner Graves moved that the minutes of November 1, 1994 be
approved as written. Commissioner Fish seconded the motion. Roll Call Vote:
Dunlap, yes; Farber, yes; Fish, yes, Governor, abstain, and Graves, yes, and the
Minutes were approved.
V. PUBLIC APPEARANCES - None
VI. BUSINESS
A. Public Hearing - Review and Determination of Site Plan for a Conditional
Use Permit Application for an expansion of the Greenbriar Terrace Mobile
Community, a mobile home park. Located at 301 Freeman Road.lAgent:
Carl Biskebornl.
Chairperson Piland opened the Public Hearing.
George Rubaloff referred to the Notice of Public Hearing dated October 20,
1994, including the Nature of Hearings, Criteria for Decision, Public Comments
and Summary of Procedure.
There were no conflicts of interest or ex-parte communication.

George Rubaloff reviewed his Staff Report dated November 8, 1994, including
the Land Use History, Discussion and Conclusion. He entered the following
exhibits into the record by reference: Notice of Public Hearing dated October
20, 1994, Mailing List to every space in the park and (100 foot radius by
reference only), Maps,Application, Public Works Department Staff Reportdated
October 25, 1994, Public Safety Department Staff Report dated November 9,
1994. He stated for the record, that the applicant and staff had met on Monday
November 14, 1994.
Larry Blanchard referred to his Staff Report of November 9, 1994 and stated
that in Exhibit "A", Item 5 the Applicant needs to obtain a development permit
from the City prior to placing any structures or fills within special flood hazard
areas. He also explained the procedures for obtaining the development permit.
Mark Servatius referred to the Public Safety Department Staff Report and stated
that the fire flow requirement was met, as there were enough fire hydrants
already installed in close proximity.
Larry Blanchard referred to the DIA that was submitted in 1989, which shows o
work to be done by owner according to City Standards in effect at the time the
DIA is requested to be fulfilled. He stated that most likely a modification to the
DIA or a separate agreement would be required to provide for the necessary
dedication for the 80' right of way required by the City for widening of Freeman
Road in the future.
George Rubaloff stated that the City Attorney would look into the matter for
procedure and determine the appropriate instrument by which to ensure a
dedication of right of way.
Carl Biskeborn, 301 Freeman, Space 38, Central Point, applicant, came forward
in support of the Conditional Use Permit. He stated that he had met with staff
and understood the conditions set forth in the staff reports.
No one else came forward in favor or in opposition to the proposed site plan.
Chairperson Piland closed the Public Hearing.
Commissioner Farber moved that they approve the Application for Conditional
Use Permit (Resolution 309) as per the Staff Report§ with the condition that
the City Attorney determine the appropriate means for securing right of way
dedication and embracing the Applicant's Findings which support that the
laundry facility provided is adequate Commissioner Fish seconded the Motion:
Roll Call Vote: Dunlap. yes; Farber. ves: Fish ves• Governor. Yes; Graves yes
and Johnson, ves, and the Motion carried unanimously.

B. Review and Recommendation regarding withdrawal from Fire District No 3 &
BCVSA of Annexed Territory (two parcels Chicory and Freeman)
George Rubaloff reviewed his memorandum dated November 8, 1994 including
the Notice of Public Hearing for the Council Meeting on November 17, 1994,
the Proposed Ordinance and Maps.
There were no questions or concerns. Commissioner Fish moved recommend
withdrawal of the two annexed parcels from Fire District No. 3 and BCVSA.
Commissioner Dunlap seconded the Motion. Roll Call: Dunlap, yes; Farber, yes;
Governor, yes, and Graves yes, and the Motion carried unanimously.
VII. MISCELLANEOUS - George Rubaloff stated that CPMC 17.72 required a site
plan whenever there was a Commercial Building Permit or change of use. In
talking with the City Attorney, staff was given the discretion to waive the
requirement for a Site Plan Applications in cases such as the Cookhouse Cafe's
' building permit for a new roof. The new language would state that the
requirement for a site plan application may be waived by City staff if staff
determines that only structural repairs will be made to an existing building and
that no modifications are necessary to the existing access, parking, driveway,
signs or any other facilities on the site.
Commissioner Farber moved to recommend to the City Council that CPMC
17.72 be amended to include the new language allowing the staff to waive the
site plan requirement for commercial building permits. Commissioner Dunlap
seconded the motion. Roll Call Vote: Dunlap, yes; Farber, yes; Governor, yes,
and Graves, yes, and the motion passed unanimously.
VIII. ADJOURNMENT
Commissioner Graves moved that the meeting adjourn, Commissioner Governor
seconded the motion. All voted aye by voice vote and the meeting adjourned
at 8:15 p.m.
