I. MEETING CALLED TO ORDER at 7:02 p.m.
II. ROLL CALL Present were: Chuck Piland, Jan Dunlap, Herb Farber, Candy
Fish, Lloyd Governor. Randy Graves and Karolyne Johnson did not attend.
Others attending were, George Rubaloff-Planning Administrator, Larry R.
Blanchard-Public Works Director, and Cecelia Gordon-Public Works Secretary.
III. CORRESPONDENCE - George handed out copies of his July 28, 1994 letter to
Mark Grenz concerning the shutters to be placed on the units at Willow Glen,
and copies of the Planning Department Memorandum, dated August 18, 1994
concerning the Planning Department inspection of the Central Point Medical
Center and acceptance of the minor changes.
oIV. APPROVAL OF MINUTES:
A. Review and Approval of August 16, 1994 Planning Commission Minutes.
Commissioner Fish moved to approve August 16, 1994 Planning Commission
Minutes as written, Commissioner Farber seconded the Motion. Roll Call Vote:
Dunlap, abstain, Farber, yes; Fish, yes, and Governor, yes and the Motion
carried.
V. PUBLIC APPEARANCE - None
VI. BUSINESS
A. Review and recommendation regarding vacation of a oortion of Marilee Street
located between Beall Lane and Forest Glen Drive.
o As surveyor for the applicant, Herb Farber declared a conflict of interest and left
his seat on the Commission and remained in the audience.

George Rubaloff, Planning Administrator, reviewed the Staff Report dated
September 1, 1994 including the Preface, Request, Background, Discussion,
Conclusion (and finding of facts) and entered Vacation Application into the
record by reference.
Craig Stone, 708 Cardley Avenue, Medford, Oregon, agent for the applicant
came forward to answer any questions from the Commission. There were no
questions.
George Rubaloff asked if Larry Blanchard knew if the U.S. West lines were
going to be relocated.
Larry Blanchard stated that the latest information (2 weeks ago approximately)
was that the overhead lines would be placed underground.
Commissioner Governor moved to recommend the soolication for vacation of a portion
of Marilee Street located between Beall Lane and Forest Glen Drive Commissioner Fish
seconded the motion Roll Call Vote: Dunlap yes: Fish.yes: Governor.ves, and the
Motion carried unanimously.
Commissioner Farber returned to his seat on the Commission.
B. Review and determination regarding Final Plat for Land Partition on a .35*
parcel located at 316 North Sixth Street generally located on the northeast
corner of Sixth and Maple Streets (Kassel[).
George Rubaloff reviewed the Planning Commission Memorandum dated
September 2, 1994, including the Preface, Criteria, and Review and entered a
Copy of the Tentative Plan (approved on December 21, 1993, Planning
Commission Resolution No. 270, Application for Final plat and Memorandum
from Public Works Director, dated September 2, 1994 into the record by
reference.
Larry Blanchard reviewed his Memorandum of September 2, 1994, including the
Options for Consideration. George Rubaloff handed out a copy of the Final Plat
for the Commission's review.
Commissioner Farber moved that the Final Plat for Land Partition on a 35 t parcel
located at 316 North Sixth Street, generally located on the northeast corner of Sixth
and Maple Streets based on all remaining conditions being done and monitored
through the permit process Commissioner Governor seconded the Motion Roll Call
Vote: Dunlap yes; Farber, yes; Fish ves• Governor, yes and the Motion carried
unanimously.

C. Report regarding Site Plan for Castle Court Condominium proiect located on
Hopkins Road between Primrose and Coachman Drive.
Herb Farber, surveyor for the project, declared a conflict of interest and
removed himself from his position on the Commission and took a seat in the
audience.
George Rubaloff gave some history concerning the stages of completion, and
the fact that some Certificates of Occupancy had been issued in error. George
also reviewed Larry Blanchard's revised Memorandum with the Planning
Commission including options available to the Planning Commission to either
request the applicant to re-apply for site plan approval for Phase 1 of Castle
Court (also the Developer could submit a'Development Plan for all phases of the
project. The other option would be for the Developer to enter into a
Development Agreement with the City submitting security in a form acceptable
to the City for completion of these improvements. This option would require
a Public Hearing. Larry Blanchard stated that the Developer could amend the
Site Plan through a Public Hearing,
Ben Zaire, developer, 339 W. Valley View Road, Ashland came forward to state
that he had talked to his bank and was willing to bond for the remaining
conditions. He also stated that he did not understand why the Certificates of
Occupancy were issued and then recalled. Mr. Zaire also stated that he is
losing .money because he cannot sell the property without Certificates of
Occupancy.
George Rubaloff stated that the Certificates of Occupancy were issued by staff .
prematurely, and that the developer could either go ahead and complete the
conditions of site plan approve, or propose an amendment to the Site Plan,
which would require a public hearing.
Mr. Zaire stated that he would appreciate anything the Commission could do
to help him move ahead with the sale of property, that if he did the
improvements in the conditions in this phase, he would just have to reopen the
street and tear it up for the next phase.
Larry Blanchard stated the site plan submitted was for all 104 units, and the
adopting resolution was worded to address the entire 104 unit development.
It was the City's understanding that the condominiums would be built at a fairly
rapid pace negating the need for phasing.
Commissioner Fish stated that it was either resubmit or go do conditions.

Commissioner Dunlap asked if there were a way to bond for the remaining
improvements?
John Miller, agent for the developer asked if they could post bond without
resubmitting the plans at a public hearing?
Larry Blanchard stated that the City attorney stated that either resubmitting a
site plan or placement of a security deposit on the project would require a
public hearing.
George Rubaloff stated that the codes CPMC 17.72 allow a Final Plat to be
amended without a hearing, but did not have a procedure for amending the Site
Plan without a hearing.
After consulting the calendar, George Rubaloff stated that the next regularly
scheduled Planning Commission Meeting after the 21 day noticing period would
be October 4, 1994.
Larry Blanchard stated sometime in the future,the City may want to include the
same bonding agreement language in the code for a Site Plan, as they have for
the Final Plat.
The Commissioners asked for guidance as to what their role is tonight.
George Rubaloff stated that any direct communication regarding a proposed
amendment to the Site Plan by any Commissioner would be considered ex-pane
communication, that all communication should take place during the public
hearing.
Herb Farber, surveyor for the Developer asked if the security agreement
between the Developer and City could be presented to the Council for approval,
without another public hearing, in order to shorten the process.
George Rubaloff stated that he would consult the City's attorney on
Wednesday, September 7, 1994, regarding that suggestion.
Farber returned to his seat on the Commission.
VII. MISCELLANEOUS. Chairman Piland welcomed Jan Dunlap to the Planning
Commission for the remainder of term left vacated by Duane Christensen.

Commissioner Fish asked if there was going to be a Planning Commission
seminar sometime in the near future similar to the one given in Ashland a
couple of years ago. George Rubaloff said he did not know of one, but would
investigate.
Commissioner Fish stated that it would be good training for all of them and
helpful for new members.
VIII. ADJOURNMENT - Commissioner Farber moved to adjourn, Commissioner
Governor seconded the motion, and all commissioners entered their voice vote
by signifying "AYE" and the meeting adjourned at 8:15 pm.
