I. MEETING CALLED TO ORDER at 6:59 p.m.
II. ROLL CALL Present were: Chuck Piland, Herb Farber, Candy Fish, Lloyd
Governor, Randy Graves and Karolyne Johnson. Others attending were,
George Rubaloff-Planning Administrator, Larry R. Blanchard-Public Works
Director, and Cecelia Gordon-Public Works Secretary.
111. CORRESPONDENCE - None
IV. APPROVAL OF MINUTES:
A. Review and Approval of July 19, 1994 Planning Commission Minutes.
Commissioner Fish moved to approve July 19, 1994 Planning Commission
Minutes with the addition of the excerpt of the portion of Public Hearing
which included Lloyd Mann's testimony.
Commissioner seconded the Motion, Roll Call Vote: Farber, yes; Fish, yes;
Governor, yes; Graves, yes, and Johnson, abstain and the Motion carried.
B. Review and approval of August 2, 1994 Planning Commission Minutes.
Commissioner Farber moved to approve the August 2, 1994 Planning
Commission Minutes, Commissioner Fish seconded the Motion. Roll Call
Vote: Farber, yes; Fish, yes; Governor, abstain; Graves, yes, and Johnson,
yes and the Motion carried.
V. PUBLIC APPEARANCE - Bill Kettler, reporter from the Mail Tribune, came
forward to introduce himself to the Commissioners and Staff.
VI. BUSINESS
A� Public Hearing Review and determination regarding a Tentative Plan
Aoolication for Phase II of Valley Point Subdivision located on the northside
of Beall Lane west of Marilee Street and adjacent to Phase I of Valley Point
Subdivision which is currently under construction. (Applicant Mark
Burkhalter).
Chairman Piland opened the Public Hearing.
O George Rubaloff, Planning Administrator, reviewed the Notice of Public
Hearing, dated July 27, 1994 including the nature of hearings, criteria for
decision, public comments and summary of procedure.

Herb Farber declared a conflict of interest, because he is the surveyor for the
developer and took a seat in the audience. Candy Fish declared that one of
the interested parties worked in her office. There were no other conflicts of
interest or ex-parte communication on the part of any member of the
Planning Commission.
George Rubaloff reviewed his Memorandum of August 11, 1994, including
the zoning review, revisions, conclusion and entered the following items into
the record by reference: Notice of Public Hearing dated July 27, 1994,
Maps and Plan, Application, Public Works Department Staff Report dated
August 10, 1994 and Copy of CPMC 16.36.040 (A) Flag Lot Requirements.
Larry Blanchard, Public Works Director referred to his Staff Report of August
10, 1994, which listed the conditions required of the Applicant. Larry stated
that there needed to be.a couple of corrections in Exhibit "A", which were:
Item #6 should read " The applicant shall install a minimum 3/4" water
service to each lot," and Item #12 should be corrected to read "The
developer shall extend the proposed storm drain line to Beall Lane sized to
pick up the drainage from the roadside ditch, and upstream properties
already draining towards this subdivision. Larry Blanchard stated that he was
available to any questions from the Commission. There were no questions.
Herb Farber, 908 E. Jackson, Medford Oregon, surveyor for the applicant,
came forward in support of the proposed application. He stated that the
developer had shifted Lot 56 and Lot 57 5' to the West and adjusted by
taking 5' off the 2 lots in Phase I.
In answer to the question concerning the school district for Phase II, Herb
Farber stated that the lines were defined on the Tax Assessor's Map, and
the subdivision is entirely in the Medford School District.
Chairman Piland stated that the zoning was R2, which would permit building
duplexes and asked if the developer would be building any 2 family units.
Herb Farber stated that the CC and R's did not allow for any with the
exception that Mrs. Close could build a duplex sometime in the future.
Randy Graves stated that in his experience, the school district information
was not necessarily correct on the assessors map.
No one else came forward in favor of or in opposition to the proposed
Tentative Plan Application. Chairman Piland closed the Public Hearing.

Randy Graves asked Larry Blanchard if there was a current traffic count on
Beall Lane. Larry stated there was no current information, but that the
Master Transportation Plan will project traffic volumes to the year 2015 and
will include the Greenpark development and Central Point interchange.
Randy Graves asked if Beall Lane was County jurisdiction. Larry Blanchard
stated that it is the County's road, but the City will widen to City standards,
and is responsible to maintain additional width of the street. The City could
ask the County to transfer Beall Lane to the City, however, the City's policy
has been to require the County to bring the street up to City Standards
before acceptance. The County may not have the funds to pay for these
improvements.
George Rubaloff stated Council had directed staff to explore annexing the
north side of Beall Lane in order to familiarize jurisdictional responsibility for
police and fire departments.
Commissioner moved that they approve Resolution 300 approving the
Tentative Plan Application for Phase 11 of Valley Point Subdivision located on
the northside of Beall Lane. west of Marilee Street and adjacent to Phase I of
Valley Point Subdivision which is currently under construction as amended
according to the conditions in the corrected staff reports (Applicant Mark
as _______d and revised by the Owner and subiect to the owner
meeting the conditions in the staff report Commissioner Johnson seconded
the motion Roll Call Vote; Fish yes; Governor, yes Graves. yes, and
Johnson yes and the Motion passed unanimously.
Commissioner Farber returned to his seat on the Commission.
VII. MISCELLANEOUS.
Commissioner Johnson stated that Duane Christensen would still like to
serve on the Commission when he gets matters straightened with the State.
VIII. ADJOURNMENT - Commissioner Farber moved to adjourn, Commissioner
Graves seconded the motion, and all commissioners entered their voice vote
by signifying "AYE" and the meeting adjourned at 7:35 pm
