ROLL CALL: Present were: Chuck Piland, Duane Christensen, Candace Fish, Herb Farber, Lloyd Governor, Randy Graves and Karolyne Johnson. Also present were George Rubaloff-Planning Administrator, Larry R. Blanchard-Public Works Director, Mark Servatius, Fire Chief/Building Official and Cecelia Gordon- Public Works Secretary/Department Assistant. III. CORRESPONDENCE - There was no correspondence. IV. APPROVAL OF MINUTES - Commissioner Christensen moved to approve the Minutes of the April 19, 1994 Planning Commission Meeting. Commissioner Fish seconded the Motion. Roll Call Vote: Christensen, yes; Farber, yes; Fish, yes; Governor, abstain; Graves, abstain, and Johnson, abstain, and the Motion passed. V. PUBLIC APPEARANCE - None VI. BUSINESS L Public Hearing_Reviewand Recommendation regarding concurrent applications for Site Plan Conditional Use Permit and Zoning Variance for construction and operation of an Assisted Living Facility in the Residential Multiple Family District (R-3) and the Commercial Professional District (C-2) generally located on the southern portion of the block adjacent to First Oak Second and Alder Streets (Applicant: R Gary Clark Agent: Terrace Corporation). Chairman Piland opened the Public Hearing. George Rubaloff fully reviewed the Notice of Public Hearing dated April 12, 1994, which included the nature of hearings on the concurrent applications for Site Plan, Conditional Use Permit and a Zoning Variance for parking, criteria for decision, public comments, and summary of procedure. Lloyd Governor declared a conflict of interest, and removed himself from the Commission and sat in the audience, there were no other conflicts of interest or ex-parte communication. George Rubaloff reviewed his Staff Report of April 29, 1994, including a descriptions of land use history, zoning review and conclusion and entered the following exhibit into the record by reference: Notice of Public Hearing dated April 12, 1994, Mailing list for notice 100 ft. radius (by reference) maps, application, Public Works Department Staff Report dated April 28, 1994, Public Safety Department Staff Report dated April 25, 1994 and Parking Standards 08f referenced in CPMC 17.64.100 B. CITY OF CENTRAL POINT Planning Commission Minutes May 3, 1994 - Page Two Larry Blanchard referred to the Public Works Staff Report dated April 28, 1994, he stated that he had reviewed the conditions with the applicant, and that he did not have any comments, but would be glad to answer any questions from the Commission. Mark Servatius, Fire Chief/Building Official, stated that his concerns about the required gallons per minute fire flow were satisfied, as the building would be fully sprinklered, therefore requiring a 1500 gallons per minute flow, and the existing fire hydrant would more than meet that flow. Chip Gabriel, 8601 S.E. Causey, Portland, Oregon, agent for Applicant, came forward in support of the concurrent applications. Chip described the concept of assisted living, gave some background of Terrace Corporation, and then gave some detailed descriptions of the types of rooms in the building. He stated that each of the residents would have their own apartment with private bath, and kitchenette (for snacks, etc.) and that the building would also have a common area for dining, with meals prepared in the facilities kitchen. He explained that their philosophy was to help the residents remain as independent as possible, but that the residents would receive assistance at their required level of need. Candy Fish asked about parking spaces. Chip Gabriel stated that the most staff they would have at a time would be 8 persons at changing of shift, and that in the history of their assisted living centers, no resident had ever brought a vehicle with them to the center. Also that the center would have a van to transport the residents to shopping, parks, clinics, and that the residents are encouraged to venture out. He also stated that the average age of residents is in the late 70's through their 80's, and that the center is designed to let them ]> age in place, until the residents or families felt they needed a different level of QJ care. n Chip Gabriel addressed the Planning Department's Staff Report of April 29, (V 1994, and went through the Zoning Review, and reported how the applicant would meet the corrections as follows: On Item 1 . they would ask the City for a variance on the requirement of a minimum of 20 feet for the set back, as the variance would be less than 20%. Also that the trash enclosure in fact is a landscaped shield only, not a structure. On Item 2. they would shift 5' in the other direction to gain the necessary minimum landscaped setback area on Second Street. G4f CITY OF CENTRAL POINT Planning Commission Minutes May 3, 1994 - Page Three On Item 3. they would dedicate a 10' x 30' parking space in the north west portion of the parking lot for a 'flat uncovered' loading berth, and designate it for loading, unloading only. On Item 4. applicant is asking for a parking variance, for 18 (more or less) parking spaces, since typically, residents in an assisted living facility do not bring their cars to the facility. Applicant will change the plan to allow for a full 66 feet full parking section and move the disabled parking spot to the general parking area. On Item 5, George Rubaloff stated that the proposed ingress/egress will work just fine, and that it does meet the requirements. Greg Evans, Construction Manager for the applicant came forward to discuss the calculations for the percentage on the variance for the setbacks on the turrets,-as a total of 436.5 square feet divided by 52,000 square feet as .084 or 8%. Herb Farber asked if the eave overhang was figured in the encroachment. Greg Evans stated that the setbacks were figured from the foundation, not the eaves. Candy Fish expressed a concern about the lighting around the building and in the parking lot. Greg Evans stated that there would be plenty of lighting, with halogen lighting on the buildings and the lights in the parking areas. Herb Farber inquired if the building is sold and/or turned into another type of use, would the Conditional Use Permit no longer apply. George Rubaloff stated that if the use changes in the future, said change or use would trigger a review. The permit would become invalid or would have to be amended. Chip Gabriel stated that there was a reciprocal agreement with Sentry Market that Terrace Corporation would pave the 5' unpaved strip between the Terrace Parking Lot and Sentry's Parking Lot in exchange for using it as part of the Terrace parking area. George Rubaloff asked if the document had been recorded. Chip Gabriel stated that it had not, but that he would make sure that the document is recorded right away. No one else came forward in support of or in opposition to the applications. Chairman Piland closed the Public Hearing. CITY OF CENTRAL POINT Planning Commission Minutes May 3, 1994 - Page Four B. Commissioner Graves moved that they approve Resolution No. 290, A Resolution approving the Site Plan. Conditional Use Permit and Zoning Variance construction and grant an administrative variance for the setbacks on the turrets, for operation of an Assisted Living Facility in the R-3 and C-2 zones, generally located on the southern oortion of the block adjacent to First. Oak. Second and Alder Streets, subject to the conditions in the staff reports, as follows: 1 . All conditions recommended in the City's Public Works Staff Report, a copy of which is attached hereto as Exhibit "A" and by this reference incorporated herein. 2. The parking area currently positioned on the easterly property line of the project must be moved back 5' so as to comply with the C-2 zoning standards setback. 3. q loading berth at least 10 by 30 feet in size shall be added to the site plan, as to comply with CPMC 17.64.020(a)(2). 4. The site plan shall be modified so as to provide for a 66' wide full parking section in the main parking lot. 5. Applicant shall record an agreement with Sentry Market giving applicant the right to utilize 16 feet of Sentry's property so as to meet the 26' parking maneuvering area requirement north of the court yard. MISCELLANEOUS - George Rubaloff stated that the agenda for the May 17, N 1994 Planning Commission Meeting does not have anything scheduled as of yet. He also stated that the next combined meeting with Council would be in July. George stated that the May 19, 1994 Council would probably work on the City's Comp Plan, Blue Sky, Forest Glen zoning, and Dale Bartley's application for 9th and Pine. VIII. ADJOURNMENT Commissioner Graves moved for adjournment, Commissioner Farber seconded ��� the Motion. All voted aye by voice vote and the meeting adjourned at 8:18 p.m.
