ROLL CALL: Present were: Chuck Piland, Duane Christensen, Herb Farber, Candy Fish, and Randy Graves. Lloyd Governor and Karolyne Johnson has informed the Commission that they would not be able to attend. Commissioner Randy Graves was also absent. Also present were George Rubaloff-Planning Administrator, Larry R. Blanchard-Public Works Director, and Cecelia Gordon- Public Works Secretary/Department Assistant. III. CORRESPONDENCE - None IV. APPROVAL OF MINUTES - Commissioner Christensen moved to approve the Minutes of the April 5, 1994 Planning Commission Meeting. Commissioner Fish seconded the Motion. Roll Call Vote: Christensen, yes; Farber, yes; Fish, yes; and the Motion passed unanimously. V. PUBLIC APPEARANCE - None VI. BUSINESS A. Public Hearing - Review and Determination of Tentative Plan aoolication for Valley Point Subdivision generally located west of Marilee Street, north of Beall Lane 1 Aoplicant: Burkhalter). Chairman Piland opened the Public Hearing. George Rubaloff fully reviewed the Notice of Public Hearing dated March 30, 1994, which included the nature of hearings, criteria for decision, public comments, and summary of procedure. Commissioner, Herb Farber, declared a conflict of interest and left his position on the Commission and sat in the audience. There were no further conflicts of interest or ex-parte communication. George Rubaloff reviewed his Memorandum of April 15, 1994, including land use history, zoning review and conclusion and entered the following exhibit into the record by reference: Notice of Public Hearing dated March 30, 1994, Mailing list for notice 100 ft. radius (by reference) maps and plans, application,��E and Public Works Department Staff Report dated April 13, 1994. CITY OF CENTRAL POINT Planning Commission Minutes April 19, 1994 - Page Two Larry Blanchard referred to the Public Works Staff Report dated April 13, 1994, and made a couple of corrections, in Item 2 on Page 26, to include Westrop Drive under the list of streets, with an average daily traffic of 1000 VT/D, and the percent of trucks would be 2%. He also referred to Item 4, that the access control strip would not be required on the east side of Marilee. Larry went to the overhead where he showed a view of the Forest Glen Master Plan, that was developed in 1993 and compared it to the Meadowcreek Plan from 1990. These master plans are different and do not show proper street connection. Since Green Park and Forest Glen were master planned, the remaining area includes Valley Point Subdivision. The City is asking that the developer look at the connection of streets, and update this portion of the master plan. (Condition #14). The Meadowcreek master plan was created for developing a storm drain plan. Then in 1993 Forest Glen came through with their master plan and developed where streets would go in most cases with a more detailed look at storm drainage, water, sewer and transportation in that area. Larry Blanchard corrected condition #10 to now read: Marilee Street shall be constructed to a 40' curb to curb width from Beall Lane to 75' north of Beall Lane, from this point Marilee shall be 30' wide with curb and gutters on the west side of Marilee Street and include pavement transitions on the east side of Marilee Street. Isaac Way shall be constructed to a 30' width with curbs and gutters on the south side of Isaac Way, east of Lot 141, and 75' west of the intersection of Marilee and Isaac Way. Isaac Way shall be constructed to a 36' curb to curb width with curbs and gutters on both sides D of Isaac Way from the intersection of Heather Lane to the east end of Lot 141 , Q� and 75' west of the intersection of Marilee Street. n Herb Farber, surveyor and agent for Applicant, 908 E. Jackson, Medford Oregon came forward in support of the application for Tentative Plan. Farber (f1 stated that the developer concurred with the Public Works Staff Report and explained that there will be no problem with fixing the short lots 6, 9, 20 and 23, that there was adequate area between corner lots to adjust the length to make the minimum 7000' frontage. He also agreed to the new language in item #10. He also mentioned that he was working on a computer generated map showing all of Forest Glen and Valley Point and the street layout on one page. Farber also discussed TL 2400 as a potential for taking Heather Lane through to tie in to Beall Lane at that point, and that Magruder Court is a cul-de-sac because there is not adequate distance between Marilee and Magruder Court to have a street intersection. Herb stated that there is a potential for a future TEE flag strip or half street to serve these properties between Bursell and Heather. Larry Blanchard stated that at this point the City is not requiring this. Herb Farber stated that this street is only 100' in length. Larry stated that when 2 lots or less take access from the dead end street, a temporary turn around would not normally be required. Chairman Piland asked for the correct spelling of Isaac Way. Herb Farber said it is spelled I s a a c for the record. In response to a question concerning the storm drainage, Larry Blanchard stated that in condition #12, it states that if Phase III of Forest Glen is not completed prior to Valley Point final plat approval, that developer would provide off site drainage improvements and easements meeting the City's public work standards in order to provide drainage through this development. Commissioner Fish asked if back yard of lots 15 and 14 would have a brick wall. Larry Blanchard stated that fencing is the developers responsibility, however, a fence condition was not placed on the developer by either staff or the Planning Commission. Also there would be no access to those lots and that is already in our Code. No one else came forward in support of, or in opposition to the application for Tentative Plan for Valley Point Subdivision. Chairman Piland closed the Public Hearing. Commissioner Fish moved to approve Resolution #287, for approval of the Tentative Plan Application for Tentative Plan for Valley Point Subdivision, subject to the conditions in the amended Staff Reports, generally located west of Marilee Street, north of Beall Lane. (Applicant: Burkhalter) Commissioner Christensen seconded the Motion, Roll Call Vote: Christensen, yes; Fish, yes, and the Motion passed. B. Public Hearing - Review and Determination of a Tentative Plan Application for Countryside Subdivision Unit No 2 generally located south of The Meadows, north of Hopkins Road and West of Countryside Drive (Applicant: Terry Buntin). Chairman Piland opened the Public Hearing. George Rubaloff fully reviewed the Notice of Public Hearing, dated March 30 1994, which included the nature of hearings, criteria for decision, public comments and summary of procedure. Commissioner Herb Farber returned to his position on the Commission. There 0 E were no conflicts of interest or ex-parte communication. CITY OF CENTRAL POINT Planning Commission Minutes April 1.9, 1994 - Page Four George Rubaloff reviewed his Memorandum of April 15, 1994, which included descriptions of the tentative plan, the process, standards, land use history, application, zoning review and conclusion, and entered the following exhibit into the record by reference: Notice of Public Hearing dated March 15, 1994, CPMC 16.24.050, Lot size and determination, mailing list for notice, 100 ft. radius (by reference), maps and plans, application and Public Works Staff Report dated April 13, 1994. Larry Blanchard referred the Public Works Staff Report dated April 13, 1994, demonstrating a copy of the original storm drainage plan on the overhead projector. He stated that when The Meadows was constructed, that a part of the construction, The Meadows picked up the storm drainage upgraded the size of the storm drainage system, for not only carrying the storm drainage from their development, but also to pick up the drainage from the property on Hopkins, Primrose, Juanita Way and Pittview. Larry stated that some of the adjacent property owners had also paid for the storm drainage system. Larry stated that he would be researching the storm drainage easements in order to determine whether those easements were owned by The Meadows Homeowners or if those easements were public easements. Larry had asked Bill Stults from the Meadows to write a letter to Larry Blanchard addressing their concern about the storm drainage system being private or public, that this concern should be addressed by the City Council. Larry also discussed the connections that need to be made to carry off storm water from all new development. George Rubaloff made a procedural comment about the mailing list for the owners within 100' radius, that they had missed TL 2500 CA (which was D property owned by the Meadows Homeowners Association). George Rubaloff Q� stated that he had personally given Mr. Miller a notice, and that any mail (7 directed to the association should be directed to the President, The Meadow's Homeowners Association, 555 Freeman Road, Central Point, Oregon 97502. N Terry Buntin, 2811 Leonard, Medford Oregon, applicant came forward in support of the application for Tentative Plan. Mr. Buntin stated that he was in agreement with the staff reports and recommendations and would make a adjustment on the short lot. Mr. Buntin showed on the overhead how their storm drainage easement would complete connection onto the storm drainage system at Briarwood. Chairman Piland asked if the old sign which reads "Country Drive" would be changed to read "Countryside Drive". Larry Blanchard stated that it would. 6I� CITY OF CENTRAL POINT Planning Commission Minutes April 19, 1994 - Page Five Herb Farber asked if Hopkins is recorded as a 60' right of way. Larry Blanchard stated that the City did have documentation, and that he will send him the information that the City has. (in the form of recorded dedications). Larry Blanchard stated that street lights will be 200' apart (maximum), on the north side of the street. Larry Blanchard stated that Mr. Lucas from The Meadows Homeowner Association had requested for information concerning the storm sewer easement being private or public. Larry stated again that a letter should come from The Meadows to Larry for consideration by the City Council. No one else came forward in support of, or in opposition to the application. Chairman Piland closed the Public Hearing. Commissioner Farber moved that they approve Resolution # 288, for approval of the Tentative Plan application for Countryside Subdivision Unit #2, generally located south of The Meadows, north of Hopkins Road and West of Countryside Drive subject to the conditions in the staff reports. (Applicant: Terry Buntin). Commissioner Fish seconded the Motion: Roll Call Vote: Christensen, yes; Farber, yes; Fish, yes, and the Motion carried unanimously. C. Public Hearing - Review and Determination for concurrent application for Site Plan and Conditional Use Permit for proposed City Shop expansion located generally on the northeast corner of Fifth and Cedar Streets (Applicant: City of Central Point, Agent: Bruce Abeloe) Chairman Piland opened the Public Hearing. George Rubaloff reviewed the Notice of Public Hearing dated March 29, 1994 which included the nature of hearings, criteria for decision, public comments, and summary of procedure. There were no conflicts of interest or ex-parte communication. George Rubaloff referred to his Memorandum of April 15, 1994 stating that there is no applicable land use history, he also covered the conclusion and the following exhibits which he entered into the record by reference: Notice of Public Hearing, dated March 29, 1994, Mailing List for Notice, 100 ft radius by reference, Maps, Application, Planning Department Review Document dated April 6, 1994, and Public Works Staff Report dated April 13, 1994. George also added two exhibits, which he handed out; Exhibit G, a letter from Fred and Ann Britt of 15 Ashely Place, Central Point, Oregon, and Exhibit H, a letter from Dominic and F. Lorain Tate of 447 Cedar Street, Central Point, Oregon. sic CITY OF CENTRAL POINT Planning Commission Minutes April 19, 1994 - Page Six George Rubaloff reviewed both of the exhibit letters with the Commission. Larry Blanchard covered some history of the existing structure and covered the proposed addition to the structure, stating that the Public Works Shops were in use before many of the homes were built in the area. He stated that the reservoir was built in 1963, but the use of the shop hasn't changed since the 50's. He also stated that the Federal and State Laws require the City to provide adequate restroom, separated eating area and a shower area (where staff can shower after being exposed to chemicals, sanitary sewer systems, etc.). The expanded facility will not generate additional traffic or additional uses, but just bring the existing facility up to modern day standards. The City anticipates that the site will probably be adequate until the year 2020 before considering a move to a larger site. (These issues will be addressed during the Five Year Plan and the Capital Improvements Plan). Blanchard stated that this will be a metal shell building with a block exterior to match the existing structure. Although this is in an R-1 Zone, the proposed expansion will only be 23' tall, where the zone allows for a height of 35'. Also existing trees were planted about 3 years ago that will grow to a height of over 30 feet in height in about 10 years, virtually buffering the view of the Public Works shop. Blanchard stated that parking will be relocated to the interior of the shop area, and will reduce parking in front of the shops on Fifth Street. He also stated that the shop hours are normally 8 a.m. to 5 p.m. with the exception of on-call hours for emergency repairs). Some residents had suggested that the shop facilities be moved to another site. Mr. Blanchard stated that moving the facilities to another site would be very costly, while the proposed expansion is anticipated to cost approximately D $80,000. He also stated that with the new expanded space, material stored OD outside will be then be stored inside. n Chairman Piland asked Larry about the concern that radios are left on at night. N Larry answered that radios in vehicles parked outside occasionally are left on.. (jl He stated that the department will strive to turn off radios. If the radios are left on, call dispatch and one of the Public Works on-call personnel will come down and turn it off, if it becomes a nuisance. Larry Blanchard stated that the 40 acres north of town is leased as farm land and may be looked at for other purposes. Bruce Abeloe, Architect, 827 Alder Creek, agent for the City came forward in support of the concurrent applications for Site Plan and Conditional Use Permit for the City Shop expansion. LIE CITY OF CENTRAL POINT Planning Commission Minutes April 19, 1994 - Page Seven Mr. Abeloe stated that the structural part of the building will be metal but the exterior will be done with block, painted to match the existing facilities. He also stated that there would be landscaping all the way around the exterior of the Public Works property. Mr. Abeloe stated that parking in the proposed expansion would be behind the fence, with a controlled driveway and no backing into the street. Herb Farber wanted to know if the alley had been vacated, and Larry Blanchard answered that it had been. Also Mr. Farber wanted to know if the facility was on the property line. Mr. Abeloe said that the drawing was in error, and that the facility is NOT on the property line. Ann Britt, 15 Ashely Place came forward and stated her concerns about safety for children who walk by the shops, since Central Point Elementary School is so close by. Ann Britt requested that Larry Blanchard and give a safety talks to the children explaining the safe way to walk past a facility where vehicles are coming and going. Also she expressed her concern about one of the trees around the shop being dead. Larry Blanchard stated that they were aware of the tree and would be taking it out and replacing it with a healthy tree in the near future. Mrs. Britt commended staff and the Commission for their dedication and hard work for the City. Chairman Piland asked what percentage of the lot would be covered by the facility. George Rubaloff answered that it would be 16% with building and structures including the reservoir, leaving quite a bit of open space. Chairman Piland asked if the shops would continue to park impounded vehicles for the Police Department, and how long were they usually parked there. Larry answered that they are there several months until they are sold by the Police Department. Commissioner Farber suggested that Public Works employees should park off the street, so that this would make the area safer. Larry Blanchard also said that it would be feasible to back in equipment, so that vehicles and equipment would be headed out and would not have to back on to the street. No one else came forward in support of or in opposition to the Tentative Plan. Chairman Piland closed the Public Hearing. 9TE CITY OF CENTRAL POINT Planning Commission Minutes April 19, 1994 - Page Eight Commissioner Fish moved to approve Resolution # 289 for approval of concurrent applications for Site Plan and Conditional Use permit for proposed City Shop expansion located generally on the northeast corner of Fifth and Cedar Streets including signing for no parking in front of bay door, add off street parking for employees, and paint curbs according to Central Point Municipal Code. (Applicant: City of Central Point, Agent: Bruce Abeloe). Commissioner Farber seconded the motion, Roll Call Vote: Christensen, yes; Farber, yes; Fish, yes and the motion passed unanimously. VII. MISCELLANEOUS - George Rubaloff stated the Council agenda for two public hearings for Unit II of Forest Glen, and a minor text amendment to clarify the language in the CPMC (for pw shop), and that there would be a combined meeting of the Commission and the City Council on Thursday, April 28, 1994 in the Council Chambers at 7:00 p.m. He also stated that the next Planning Commission Meeting on May 3rd, would hear an concurrent application for site plan, and zoning variance for the assisted living facility (Terrace Corporation), and two final plats: McKibben, and Mark Haynes land partition. There was some discussion on City parks. Larry Blanchard stated that the City had a Master Plan for Parks, with neighborhood parks. He also stated that the Council is discussing purchasing property in the S.E. Quadrant. VIII. ADJOURNMENT Commissioner Fish moved for adjournment, Commissioner Farber seconded the Motion.
