Planning Commission Meeting Minutes

I. MEETING CALLED TO ORDER - 7:07 p.m.
11. ROLL CALL: Present were: Chuck Piland, Duane Christensen, Candace Fish,
Herb Farber, Lloyd Governor, Randy Graves and Karolyne Johnson. Also
present were George Rubaloff-Planning Administrator, Larry R. Blanchard-Public
Works Director, and Cecelia Gordon-Public Works Secretary/Department
Assistant.
III. CORRESPONDENCE - None
IV. APPROVAL OF MINUTES - Commissioner Fish moved to approve the Minutes
of the March 15, 1994 Planning Commission Meeting. Commissioner Johnson
seconded the Motion. Roll Call Vote: Christensen, abstain; Farber, yes; Fish,
yes; Governor, yes; Graves, abstain, and Johnson, yes, and the Motion passed
unanimously.
V. PUBLIC APPEARANCE - None
VI. BUSINESS
A. Public Hearino - Review and Recommendation for Tentative Plan for Unit No.
3 of Forest Glen Subdivision located generally north and south of an easterly
extension of Pittview Avenue (Applicant: Gary Whittle for Crown West
Development),
Chairman Piland opened the Public Hearing.
George Rubaloff fully reviewed the Notice of Public Hearing dated March 15,
1994, which included the nature of hearings, criteria for decision, public
comments, and summary of procedure.
Commissioner, Herb Farber, declared a conflict of interest and left his position
on the Commission and sat in the audience. There were no further conflicts of
interest or ex-parte communication.
George Rubaloff reviewed his Memorandum of March 31 , 1994, including
descriptions of the tentative plan, process, standards, land use history,
description of application, zoning review and conclusion and entered the
following exhibit into the record by reference: Notice of Public Hearing dated
March 15,1994, Mailing list for notice 100 ft. radius (by reference) maps and
plans, application, and Public Works Department Staff Report dated March 31 ,
1994.

Larry Blanchard referred to the Public Works Staff Report dated March 31,
1994, Items 8 and 9 under Exhibit "A", concerning the developer securing the
necessary right of way south of the development in order to connect the
proposed alignment of Marilee Street with the existing Marilee Street and
requiring the Developer to extend the 12" waterline through Phase IV, in order
to provide adequate fire flow.
There were some concerns about the impact of traffic on Bursell and Hopkins.
Larry Blanchard stated that Phase III does not connect directly to the
intersection of Bursell and Hopkins.
Commissioner Graves was concerned about general impact of traffic when
there is full build out of all phases of Forest Glen. Larry Blanchard discussed
the traffic split, that traffic would be carried on Pittview, Coachman and
Marilee.
Herb Farber, surveyor and agent for Applicant, 908 E. Jackson, Medford
Oregon came forward in support of the application for the Tentative Plan.
Farber stated that there would be no problem with acquiring the additional right
of way for aligning Marilee, and that there were negotiations under way with
the existing property owners.
Farber stated that as far as the requirement for the 12" waterline, that since the
developer planned to build Phase III and Phase IV simultaneously and if not, that
they see no problem with complying with tieing into the 12" waterline.

Mike Casey, 664 Pittview (north side) and his father Harold Casey came OD
forward, not in opposition to the development but opposed to through traffic (�
on the existing cul-de-sac that will become a through street. Also they were
concerned about traffic control on Pittview and Bursell. N
Larry Blanchard stated that the City adopted a Comprehensive Plan in 1982 and
and is being updated right now. The Public Works Standard states that no dead
end streets can serve greater than 12 lots or be more than 400' long. The
Pittview cul-de-sac was originally designed for temporary use only. He stated
that traffic control devices normally installed only after a warrant study
determines that traffic control devices should be installed. Traffic devices on
Bursell may be warranted because it has a higher traffic volume than other local
streets in the area.

Frank Schwager], 3413 Bursell, (on west side in Jackson County) spoke from
the audience with concerns about speed on Bursell. Larry Blanchard stated that
the State is scheduled to do another traffic speed study for Bursell, and that
taking increased traffic counts in another year would make more sense.
Chairman Piland stated that in the future the fully developed street south of
Bursell, with turn lanes would attract the most use, and eventually another
street connecting into Beall which would also relieve traffic on Bursell.
Herb Farber addressed the Casey's concern, that 150-200 vehicles per day
were not enough on Pittview which does not cause adequate negative impact
to require off-site improvements.
No one else came forward in support of, or in opposition to the application for
Tentative Plan for Forest Glen Unit #3.
Chairman Piland closed the Public Hearing.
Commissioner Governor moved that they recommend Resolution #285, for
approval of the Tentative Plan Application for Unit No. 3 of Forest Glen
Subdivision, subject to the conditions in the Staff Reports. located west of 1-5
Freeway, generally north and south of an easterly extension of Pittview
Avenue. Commissioner Fish seconded the Motion, Roll Call Vote: Christensen,
yes; Fish, yes; Governor, yes; Graves, yes, and Johnson, yes, and the Motion
carried unanimously.
B. Public Hearing Review and Determination of a Tentative Plan Application for
unit No 4 of Forest Glen Subdivision located on the east side of Bursell Road
where the westerly extension of Forest Glen Drive would intersect with Bursell
Road.
Chairman Piland opened the Public Hearing.
George Rubaloff fully reviewed the Notice of Public Hearing, dated March 15,
1994, which included the nature of hearings, criteria for decision, public
comments and summary of procedure.
Commissioner Herb Farber remained in the audience as he continued to have
a conflict of interest in this matter. There were no other conflicts of interest or
ex-parte communication.

Larry Blanchard referred to Items 8 and 12 in Exhibit A of the Public Works
Staff Report dated March 31, 1994, requiring the developer to widen the
narrow portion of Bursell Road, and if Phase 4 is finished ahead of Phase 3, to
make sure the storm water will drain out of the subdivision, to provide for storm
drainage easements to connect to the existing system, then when Phase III is
done, then connect up the storm drainage for this phase (Phase IV.)
Chairman Piland asked if they would need to widen Bursell. Larry stated that
they would need to widen to a collector street standard (40'), from the existing
23' width, so they would have to widen it 8' along the 2 lots on the west side.
Commissioner Christensen asked if there would be a left turn pocket on Bursell
Road. Larry Blanchard said that there would be a need for a right turn pocket
for traffic north on Bursell and plan for a left turn lane if there is enough
pavement to provide for it.
Herb Farber, 908 E. Jackson, Medford, Oregon, representing Noel Moore, the
applicant, came forward in support.of the application for Tentative Plan.
Mr. Farber stated that Charles Olson was no longer a part of this property, that
the developer had purchased all the property, and this will be shown on future D
documents. He also stated that the developer would do a lot line adjustment
on Lot #141 . Farber stated that the fact that lots 132, 133, 134 and 135 n
exceeded the allowable 2 1/2 times the width got by him. One option is to give J
back part of the land to reduce the lot lengths, and the other option for the N
Planning Commission to approve the Tentative Plan that between now and Final
Plat that the developer come back with an exception/variance to the length
being 2 1/2 times the width. He stated that giving back property would cause
future jogs in the property lines.
Farber addressed #9 of Exhibit "A" in the Public Works Staff Report concerning
attaching the sanitary sewer line. He stated that in the previous days meeting
with City Staff that staff agreed that it would be acceptable for some of the lots

to attach part of their sanitary sewer to the north through Sidney Estates. He
also stated that they fully expected to finish Phase III and Phase IV at the same
time, but in the event that they did not, they would make sure that storm
drainage will be forthcoming.
Farber also stated that Lot 141 is now an interior lot and does not become a
corner lot until the street is created. At that time, the developer will do a lot
line adjustment adding 8' plus, to make it a 70' lot and therefore it will meet
Central Point's requirements.
George Rubaloff stated that before the Final Plat, one of the conditions could
be that the lot line adjustment be made on lot #141 .
Larry Blanchard stated that they could tie in some of the lots to the 8" line that
is extended out of the Sidney Estates, so the Condition #9 can stay as it is.
Commissioner Graves wanted to know the status of the two mobiles on the
property. Farber stated that the one mobile on the partition is gone, and the
existing driveway to the house on the small parcel is going to have its driveway
moved around to come off of Forest Glen Drive. (not Bursell) The mobile that
is on the subdivision has made an agreement that they remain there a minimum
of one year, and at that time it will be removed.
No one else came forward in support of, or in opposition to the application.
Chairman Piland closed the Public Hearing.
George Rubaloff said that in order to keep the requirement for Lot #141 from
getting lost in the shuffle, that he would like to see it on some type of approval
check list, so that the City could monitor to make sure it happens.
Commissioner Graves moved that they approve Resolution # 286, for approval
of the Tentative Plan Application for Unit No. 4 of Forest Glen Subdivision,
located on the east side of Bursell Road where the westerly extension of Forest
Glen Drive would intersect with Bursell Road, according to the Staff Reports
and that the Lot Line adjustment be made on Lot #141 (minimum width), and
a recorded lot variance be obtained for Lots 132, 133, 134 and 135 before
Final Plat, Commissioner Johnson seconded the Motion: Roll Call Vote:
Christensen, yes; Fish, yes; Governor, yes; Graves, yes and Johnson, yes, and
the Motion carried unanimously.

C. Review and Determination to proposed minor zoning text amendment to revise
language in (R-1) Single-Family Residential zone so as to make public storage
or repair yards, or public warehouses a Conditional Use.
Commissioner Farber returned to his position on the Commission.
George Rubaloff compared the existing CPMC 17.20.030- Conditional Uses, to
the new proposed 17.20.030 - Conditional Uses, with Item B. being proposed
to read, "Public and public utility buildings, structures and uses.
Larry Blanchard stated that when the Comp Plan was done, this was not
included. This minor zoning test amendment would only apply to PUBLIC and
PUBLIC utility buildings, structures and uses. (definition of public, Government
entity only).
Commissioner Fish moved to approve Ordinance amending Section 17.20.030
of the Central Point Municipal Code pertaining to conditional uses in the R-1
District to include public utility buildings and structure uses (Item B).
Commissioner Christensen seconded the Motion. Roll Call Vote: Christensen,
yes; Farber, yes; Fish, yes; Governor, yes; Graves, yes; and Johnson, yes, and
the Motion passed unanimously.
VII. MISCELLANEOUS - Herb Farber stated that the developer has requested the
City Council to review Phase II on its own motion (Zone change - Council
Meeting in May, 1994.)

George Rubaloff referred to future items for the Planning Commission: CUP for Q7
Shop expansion, Valley Point Subdivision, Countryside II (88 Units) and in May (7
- Terrace Assisted Living Facility....and also announced a combined �J
Council/Commission meeting on April 28, 1994. N
There was some general discussion about securing park land for the City.
VIII. ADJOURNMENT
Commissioner Fish moved for adjournment, Commissioner Governor seconded
the Motion. All voted aye by voice vote and the meeting adjourned at 8:53
p.M.
