I. MEETING CALLED TO ORDER - 7:04 p.m.
ll. ROLL CALL: Present were: Chuck Piland, Duane Christensen, Candace Fish,
Herb Farber, Lloyd Governor, Randy Graves and Karolyne Johnson. Also
present were George Rubaloff-Planning Administrator, Larry R. Blanchard-Public
Works Director, and Cecelia Gordon-Public Works Secretary/Department
Assistant. Randy Graves had called in with a time conflict. Duane Christensen
was also absent. Tom Giordano, consultant was present for part of the
meeting.
III. CORRESPONDENCE - None
IV. APPROVAL OF MINUTES - Commissioner Fish moved to approve the Minutes
of the March 1, 1994 Planning Commission Meeting. Commissioner Governor
seconded the Motion. Roll Call Vote: Farber, yes; Fish, yes; Governor, yes; and
Johnson, yes, and the Motion passed unanimously.
V. BUSINESS
A. Public Hearing Review and Recommendation regarding concurrent application
for Plan Amendment and Zone Text/Map Amendment located in the vicinity of
Freeman Road, Bigham Road and S 9th Street (37 2W 2CD Tax Lots 2500.
and 3100 (Applicant: Blue Sky Partnership, Inc.)
Chairman Piland opened the Public Hearing.
George Rubaloff fully outlined the Notice of Public Hearing, dated February 23,
1994, which included the nature of hearings, public participation, and summary
of procedure. He also noted that there should be a minor correction on the
location map, that Tax Lot 2400 should NOT have been hash marked.
It was determined that Candy Fish did not have a conflict of interest, just because she
carries the note on one of the properties noticed. Therefore there were no conflicts of
interest or ex-parte communication.
George Rubaloff reviewed his Memorandum of March 10, 1994, which included
the Request by the applicant, procedure, Commission action, background and
conclusion and entered the following exhibit into the record by reference:

March 11, 1994, and provided each of the Commissioners with a copy of a
letter received in City offices on March 14, 1994 from Kenneth Adams, 55 S.
9th Street, Central Point, Oregon, and entered this letter into the record by
reference. Mr. Adams' letter expressed a concern for the zoning change.
Mike Lanier, Consultant, 2730 Stonebrook, Medford, Oregon, and Bob
MacLellan, 2660 Bullock Road, Suite A, Medford, Oregon, agents for Blue Sky
Partnership came forward in support of the applications for Comp Plan and Zone
Amendments.
Mr. Lanier stated that he felt that the applicants application was in full
compliance with City ordinances. Mr. MacLellan stated that they had hope to
rezone the properties from an R-3 to C-4, and also utilize some parcels already
zoned commercial.
Chairman Piland inquired as to the proposed use for the property. Mr.
MacLellan stated that they would like to construct lodging with food service.
Mr. MacLellan in answer to Mr. Adams' letter, stated that they were sensitive
to neighbor's, and that they would make every effort to provide the necessary
screening and landscaping. Mike Lanier stated that Mr. MacLellan had done the
building for Blockbusters in Medford, and had gone beyond the City of Medford
requirements for landscaping on that property.
No one else came forward in support of or in opposition to the application.
Chairman Piland also asked about the impact of traffic in the area, and where
the access into the property would be.

Larry R. Blanchard stated Bigham and South 9th Streets would be the primary (JJ
access points. He also stated that a motel alone would not be cause a large n
traffic but that the a restaurant would be a greater impact, but that this issue
would be addressed at the time of the Site Plan Review, and that this would (�
require a traffic study, preferably done by a traffic engineer. In answer to the
question about traffic having to cross the street, Larry stated that there would
probably be a turn restriction to a right hand turn only.

Commissioner Fish moved that they recommend City Council approval of the
Plan Amendment and Zone Text/Map Amendment for property located in the
vicinity of Freeman Road, Bigham Road and South Ninth Street (37 2W 2CO
Tax Lots 2500, and 3100) to rezoned from R-3 to C-4. (Applicant: Blue Sky
Partnership, Inc.).Commissioner Johnson seconded the Motion, Roll Call Vote:
Farber, yes; Fish, yes; Governor, yes; and Johnson, yes, and the Motion carried
unanimously.
B. Public Hearing - Review and Recommendation regarding concurrent application

Hopkins Road and Forest Glen Drive and on Bursell Road south of Pittview
Avenue (37 2W 11 and 37 2W 12) (Apolicant: Pacific Crest Properties).
Chairman Piland opened the Public Hearing.
George Rubaloff fully outlined the Notice of Public Hearing, dated February 23,
1994, which included the nature of hearings, public participation and summary
of procedure.
Because of a conflict of interest Herb Farber excused himself and took a seat in the
audience.
There were no other conflicts of interest or ex-parte communication.
George Rubaloff reviewed his Memorandum of March 10, 1994, which included
the background and conclusion, and entered the following exhibit into the
record by reference: Notice of Public Hearing dated February 23, 1994,
Applications (Plan and Zone Map Amendment), Staff Review dated February 9,
1994, Colored Map showing proposed amendment, and Staff Report from
Public Works Department dated March 10, 1994. He also handed out a Map
from the Comprehensive Plan and entered it into the record as exhibit F.
George Rubaloff also stated that the Planning Department's land use consultant
raised a concern about cumulative impact on the street system when there is
full build out in the area and further that traffic analysis should be validated by
a qualified traffic engineer. The land use consultant commented that the
applicant's findings did not prove that there was adequate need for additional
multiple family land. He also stated that there was a need for buffering along
1-5 for noise and visual impact.

Larry Blanchard stated that the available land for the City to purchase for Parks
in the south east quadrant was dwindling quickly, as more and more
development was taking place. He also stated that the land the City originally
had counted on purchasing from Gilman, had been sold to a developer.
Chairman Piland asked if the School District had some land set aside.
Larry Blanchard said no, and that the School District was studying where
another school site could be, that would require 15 to 20 acres. He also
echoed Mr. Rubaloff's statement that there is a need to have the Traffic
Analysis evaluated by a traffic engineer.
Mike Lanier, 2720 Stonebrook, Medford, agent for the applicant, came forward
in support of the application for Comp. Plan and Zoning Text amendments.
Mr. Lanier stated that in his opinion, all criteria had been met and the
application was in compliance with Central Point City Ordinances.
He stated that their plans shown the traffic analysis to be site specific, and
does not address cumulative effect, that he felt the City of Central Point has to
be responsible for the collective blue print and making cumulative plans. He also
cited the storm drain construction under 1-5 which was required of the
developer. LaNier stated that he believed that the City should hire the traffic
engineer. He also stated that he felt the fast growth does not excuse the City
from its responsibility of exercising their option for park land, since the City
now has money collected through park fees. (since the City does not require
dedication of land for parks).

Tom Giordano, City planning consultant, stated that the traffic plan should look
at circulation and cumulative effect of full build out, how street will function, n
and show that detail. As far as the vacancy rate, the applicant's findings were
too general, should state facts about the available R-3 and the need for more N
multiple family buildings. 01
Commissioner Johnson wanted to know what the connection was between the
issue of recommending approval of the Comp. Plan and Zoning Amendments,
and the need for park land.
George Rubaloff suggested that at this particular time, there may be a higher
public need for park lands than there is for more multiple family zoned land.
Staff is merely pointing out this concern along with the fact that available
properties in this area are dwindling.

Larry Blanchard stated that the City has funds for park properties, but finds
itself competing with developer's in purchasing such property.
Commissioner Governor asked about the impact on traffic in the area.
Larry Blanchard stated that as more detail comes in on the City's Master
Transportation Plan, the City can address more specific traffic
recommendations.
Mr. LaNier stated that they want to build in the safety and traffic features that
will not only affect their development, but other users in the area as well.
Gary Whittle, 908 E. Jackson, Medford, Applicant, came forward in support of
the application and stated that some existing R-2 will not be used for duplexes
but for single family residences, and indicated one piece where the R-2 zoning
will be abandoned. Whittle stated that there was still some land left on the
Gilman property available for the City to purchase. Larry Blanchard said that
it was his understanding that the City and Gilman were still in the negotiating
stage. Whittle suggested that the City act quickly while land is still available.
Whittle said they needed to know the City's intention, as they are still designing
their street patterns, and whether a park will be built in the area directly
impacts their design.
Gary Whittle asked that the Commission go on with the recommendation on the
Comp. Plan Amendment and Zoning Amendment at tonight's meeting and then
when the developer brings in a Plan (8 or 9 months from now) then do a traffic
study. Mike LaNier stated that the best time to put a traffic study condition
would be on the Plat.
Mike Lanier stated that the focus of the Plat for the R-3 area with the
abandonment of the R-2 zone would most likely provide traffic impact figures
on the low side.
Herb Farber, 675 Glenn Way, Central Point, surveyor for the Applicant came
forward and indicated the Gilman property on the map. He stated that he felt
the property still available was better for schools and parks. He also stated that
the park and school issue should be discussed later, and that he believed the
cost of a traffic engineer's study could be shared between all the developers in
that area.

Larry Blanchard stated that staff's intentions are to make the Commission
aware of the different concerns that would be a part of the whole process of
reviewing this significant zoning changes before the actual Site Plan application.
No one else came forward in support of, or in opposition to the application.

Commissioner Johnson moved that they recommend approval by the City
Council of the Comp. Plan Amendment and Zone Text/Map Amendment for the
property located in the vicinity of Hopkins Road and Forest Glen Drive (37 2W
11 and 37 2W 12) (Applicant: Pacific Crest Properties) Commissioner Governor
seconded the Motion: Roll Call Vote: Fish, yes; Governor, yes; and Johnson,
yes, and the Motion carried unanimously.
C. Public Hearing - Review and Determination regarding Tentative Plan for Unit No.
2 of Forest Glen Subdivision located generally west of 1-5 Freeway where
Hopkins Road Coachman Drive and Glengrove Avenue intersect Applicant:
Gary Whittle for Crown West Development).

application, zoning review and conclusion, and entered the following exhibits

Larry Blanchard referred back to the review of the park situation which
prompted him to take a look at the Master Plan, which lays out a street pattern.
As shown the Master Plan there is an extension of Coachman. During the
construction of Phase I of Forest Glen, there was no determination as to how
that property was to be served, and did not include it as a street. He also
stated that the Plan needs to be modified to do away with the street, or the
street needs to be built in conformance with the development plan. He stated
that he had corrected his staff report, (which was handed out to the
Commission) and that according to the development plan, Coachman Drive shall
be extended north to the vacant property which is currently zoned R-1-6.
Coachman was originally intended to continue north to Glengrove Drive and
was shown as such in the development plan. Larry indicated that in the
Corrected page 5, under Item 16.20.02g follows a master plan, basically our
consultant checked off as meet standards, however in this case it does not
follow the master plan (does not meet standards). and a condition item was
entered for Exhibit A in the corrected version.
Herb Farber, 908 E. Jackson, Medford, Oregon, Surveyor for the Applicant
' came forward in support of the Tentative Plan for Unit #2 of Forest Glen
Subdivision. Farber stated that until such time that the developer does a layout
of the use of that land, they do not know what the access requirements will be,
and that there is adequate room to provide a looped access through the
proposed zone change. He also stated that the lot would not be sold until the
developer decides the type of use for the land to the north.
Larry Blanchard asked if the note could be placed on the Final Plat that would
state that no construction shall be allowed on Lot #51 until the use of the land
was decided.
Herb Farber agreed and that the City Attorney could come up with language to
put note to the effect that until approval of the site plan for Parcel 1 , building
on this lot will be restricted.
Larry Blanchard stated that one of the conditions in the Final Plat would be to
require a letter of credit for the street if it is built, and the only other thing
would be to provide for the purchase of the lot if the City had to cash in the
letter of credit and buy the lot. Larry stated that the development plan could be
corrected to show no street there, or the developer assure that the street would
be built (or build the street).

Herb Farber stated that historically the development plans are not followed
totally, because some parts of the plan can be subject to change.
George Rubaloff stated that CPMC 15.16 requires the applicant's plan to be in
compliance with the development plan according to CPMC 17.08. He
acknowledged that there were already changes in the development plan, but
wasn't certain how much flexibility was built into that regulation.
Gary Whittle stated that it was their intent that the road does not go into the
development, if necessary they would build another road as a private driveway,
and that as it appears on the plan that it was not the place to put in a public
street with curb and gutter, but that the applicant would agree in writing to
NOT sell the lot pending further study.
No one else came forward in support of the Tentative Plan for Unit No. 2 of
Forest Glen Subdivision.
Chairman Piland closed the Public Hearing.
Commissioner Fish moved to approve Resolution #281, to recommend approval
the Tentative Plan for Unit No. 2 of Forest Glen Subdivision, subject to staff
recommendations with wording by the City Attorney placed in the Resolution
and on the Tentative Plan that Lot #51 would not be sold until the Development
to the north takes place. Commissioner Johnson seconded the Motion. Roll
Call Vote: Fish, yes; Governor, yes; and Johnson, yes, and the Motion carried
unanimously. D

Larry Blanchard handed out his corrected Exhibit B, to the Memorandum on the
Final Plat, dated March 11 , 1994.
Commissioner moved to approve Resolution #282 approving the Final Plat for
Unit No. 2 of Forest Glen Subdivision, located generally west of 1-5, where
Hopkins Road, Coachman Drive and Glengrove Avenue intersect (applicant:
Gary Whittle for Crown West Development), with an improvement agreement
(CPMC 16.12.080) for the extension of Coachman Drive and also subject to
staff recommendations relating to bonding for improvements to Coachman
Drive, with language by the City attorney for restricting development on Tax Lot
51 . Commissioner Governor seconded the Motion. Roll Call Vote: Fish, yes;
Governor, yes; and Johnson, yes, and the Motion carried unanimously.

Commissioner Johnson seconded the motion, Roll Call Vote: Fish, yes;
Governor, yes; and Johnson yes. The motion carried.

One Subdivision located at 3435 Snowy Butte Lane, south of Joseoh Street
and north of Timothy Street (applicants: Robert and Dixie Youngs).
Chairman Piland opened the Public Hearing. (Herb Farber returned to his position on
the Commission).
George Rubaloff fully outlined the Notice of Public Hearing dated February 23,
1994, including the nature of hearings, criteria for decision, public comments
and summary of procedure.
There were no conflicts of Interest or ex-parte communication.

Larry Blanchard addressed the remaining conditions on the proposed Tentative
Plan were for the surveyor needs to show the storm drain easement on the
plans, which is a 10' storm easement to where the catch basin ends under Lot
1 , and for the surveyor to provide the 100 year flood plain finished floor
elevation on the tentative plan.
Robert Youngs of 13405 D, NW 10th Avenue, Vancouver, Washington,
applicant, came forward in support of the Tentative Plan and stated that the 10'
easement was shown on the updated drawings. Mr. Youngs stated that the
reason this was a two lot subdivision was because of the calendar year
restriction on partitions.
No one else came forward in support of or in opposition to the Tentative Plan
for Dixie One Subdivision.
Chairman Piland closed the Public Meeting.
Commissioner Governor moved that they approve Resolution # 283 approving
the Tentative Plan for Dixie One Subdivision located at 3435 Snowy Butte Lane,
south of Joseph Street and north of Timothy Street (Applicants: Robert and
Dixie Youngs.) subject to the staff report. Commissioner Farber seconded the
Motion. Roll Call Vote: Farber, yes; Fish, yes; Governor, yes, and Johnson, yes
and the Motion carried unanimously.
F. Review and Determination regarding Final Plat for Dixie One Subdivision located
at 3435 Snowy Butte Lane, south of Joseph Street and north of Timothy
Street. (Applicants: Robert and Dixie Youngs).

Larry Blanchard stated that there are two separate processes, improvement
agreement and the letter of credit, and that the City attorney would need to
determine how to secure the remaining conditions in the staff report.
Commissioner Farber moved to approve Resolution # 284 approving the Final
Plat for Dixie One Subdivision located at 3435 Snowy Butte Lane, south of
Joseph Street and north of Timothy Street (Applicants: Robert and Dixie
Youngs). providing forsecurity from the Developer to perform all improvements,
in a form acceptable to the City attorney. Commissioner Fish seconded the

Motion. Roll Call Vote: Farber, yes; Fish, yes; Governor, yes; and Johnson,
yes, and the Motion passed unanimously.
VII. MISCELLANEOUS - George Rubaloff stated that there would be a joint meeting
with the City Council on March 30, 1994 in the Council Chambers beginning
at 7:00 p.m. He also referred to some the future items the Planning Commission
will be reviewing - - Miller Annexation, Lathrop Annexation, Final Plat - Kassel
Partition, Unit IV of Forest Glen, and the Moore partition.
VIII. ADJOURNMENT
Commissioner Fish moved for adjournment, Commissioner Governor seconded
the Motion. All voted aye and the meeting was adjourned at 10:34 p.m.
