Planning Commission Meeting Minutes
January 18, 1994
I. MEETING CALLED TO ORDER
at 7:03 p.m.
II. ROLL CALL: Present were: Chuck Piland, Herb Farber, Candace Fish, Lloyd
Governor, and Karolyne Johnson. Also present were George Rubaloff-Planning
Administrator, Larry R. Blanchard-Public Works Director, Mark Servatius, Fire
Chief/Building Official and Cecelia Gordon-Public Works Secretary/Department
N Assistant. Randy Graves did not attend.
UIII. CORRESPONDENCE - None
QBusiness Not on Agenda:
Rick Bettenburg, Council Member, 5075 Del Mar Drive, Central Point, came
forward to report on Council's response to Planning Commission comments
made during the January 4, 1993 Planning Commission meeting. Rick
Bettenburg also suggested that Council and Planning Commission meettogether
during the Period Review process (perhaps a Study Session). He also
suggested that the Planning Commission and the City Council send a
representative to the other body's meetings.
IV. APPROVAL OF MINUTES
Commissioner Fish moved to approve the Minutes of the January 4, 1994
Planning Commission Meeting. Commissioner Johnson seconded the Motion.
Roll Call Vote: Farber, yes; Fish, yes; Governor, yes; and Johnson, yes, and
the Motion passed unanimously.
V. BUSINESS
A. Continued Public Hearing - Review and Determination of an application for
Tentative Plan for Land Partition at 4969 Upton Road (36 2W 34D TL 203).
Northeast corner of Upton Road and Teresa Way (Applicants: Laurie Moore and
Mark Shawn Moore).
Chairman Piland re-opened the Public Meeting.
George Rubaloff, Planning Administrator stated that this was a continuation of
a Public Meeting held January 4, 1994. He highlighted the December 14, 1994
Planning Department Memorandum which he stated had been entered into the
record on January 4, 1994.

He stated that there was now an additional item to enter into the record, which
is the proposed resolution for approval, which includes all conditions listed in
the Staff Reports and the Agreement for Consent for an L.I.D. which was
incorporated into the resolution.This Agreement is processed in lieu of requiring
the applicant to complete the required improvements now. He entered this
resolution into the record by reference.
There were no conflicts of interest or ex-parte communication.
Laurie Moore, Applicant, 4969 Upton Road, Central Point, and Mark Boyden,
Applicant's agent, 108 Mistletoe, Medford Oregon, came forward in support of
the Tentative Plan for Land Partition.
Laurie Moore stated that as of January 11 , 1994, she became the sole owner
of the property at 4969 Upton Road, Central Point. She also said that the legal
papers had been recorded at Jackson County.
George Rubaloff asked Mrs. Moore if she would provide the City attorney with
a copy of the recorded document that shows she is now the sole legal owner
of this property. She stated that she would.
Mr. Boyden was supportive of Mrs. Moore's proposed partition. He stated that
he felt it would be an improvement in the area.
Commissioner Farber asked how the storm drainage would be handled on the
property. Larry Blanchard, Public Works Director answered that because that
area does not have curbs and gutters, storm drainage would tie into the ditch,
and when curbs and gutters are installed, it would connect to the future storm
system.
No one else came forward in support of, or in opposition to the Site Plan.
Chairman Piland closed the Public Hearing.
Commissioner Farber moved to approve Resolution 273 for Tentative Plan for
Land Partition at 4969 Upton Road (36 2W 34D TL 203), Northeast corner of
Upton Road and Teresa Way, as stated in the Staff Reports, and in accordance
with the Agreement for Consent to an LID (Applicants; Laurie Moore and Mark
Shawn Moore.) Commissioner Fish seconded the motion. Roll Call Vote:
Farber, yes; Fish, yes; Governor, yes; and Johnson, yes. The Motion carried
unanimously.

B. Continued Public Hearing - Review and Determination of concurrent
Applications for Site Plan for building addition to the First baptist Church at 100
Oak Street and zoning variance for lot coverage and (added) setback standards
The First Baptist Church is located in the C-2 Zone on the southeast corner of
Oak and First Streets (Agents: Richard Stevens Company for First Baptist
Church, Applicant.

QGeorge Rubaloff referred to the fact that this is a continuation of the January
4, 1994 Public Hearing and that Exhibits A through G had been entered into the
record at that Hearing. He reviewed the Planning Memorandum dated January
13, 1994, which he entered into the record. He also entered the following items
into the record by reference: Exhibit H - Map from the Applicant, Exhibit I -
Supplemental Findings dated January 4, 1994, Exhibit J - Maps showing the
clear vision triangle, Exhibit K-Table J-2, Exhibit L - Resolution #249 -
(previously denying Site Plan.) and Exhibit M - Section 17.72.030 of Central
Point Municipal Code.
Mr. Rubaloff stated that staff and the applicant's agent had met earlier that day.
Mr. Rubaloff stated that the application for set back variance met the City's
criteria, but that without a vacation of the alley, that the criteria for the clear
vision triangle requirement would not be met. Staff recommended that there
be an abandonment and actual closure of the alley to First Street.
Mike Lanier, 2720 Stonebrook, Medford, Oregon, agent for the Applicant, came
forward in support of the Site Plan. Mr. Lanier referred to his Supplemental
Findings and the xerox copy of the aerial photograph showing other properties
on First Street illustrating the setbacks for Sentry Market and the Central Point
Care Center (Terrace Retirement Home). He mentioned the fact that the street
width was dedicated more than 50 years ago, and felt that the City would not
be widening the street to the full width anytime in the near future.
In addressing the alley vacation, Mr. Lanier, with City Staff assistance, called
the Care Center's office in Portland. The personnel in Portland agreed in
principal that the first street entrance of that alleyway would be closed and the
Care Center would only utilize the balance of the property for an exit on the
other side. Mr. Lanier pointed out that there would be no changes in the

structure shown in the site plan, but that the applicant would gain
approximately 10 feet of property, (1/2 of the alley) which would be landscaped
in grass. The Care Center would gain 1/2 of the alley (10') as well.
Commissioner Johnson asked that if the alley vacation should not happen,
could the applicant modify the building to meet the clear vision requirements.
Mr. Lanier answered that they probably could, but that they do not anticipate
any problems with the alley vacation. However, the applicant prefers to keep
the proposed addition to the building as designed.
George Rubaloff stated that when an alley (or driveway) is vacated that all the
utilities should be notified. (Easement provided if necessary).
Mark Servatius stated that there would need to be a 20' wide access for a fire
lane from First Street.
George Rubaloff stated that when there is no driveway apron, but simply
sidewalks, curb and gutter, a driveway would not exist. Also he stated that
there the type landscaping should not interfere with emergency/fire vehicles
from accessing the property.
Mike Lanier, stated that the sidewalk, curb and gutters would remove the
driveway access on First Street. He also stated that the existing easements
would not be vacated. Mr. Lanier stated that the Care Center would access and
exit their parking area from the other side. Lanier stated that the Applicant
would be comfortable with landscaping their portion of the vacated area in
grass.
Commissioner Farber asked why the City could not vacate 5' of the First Street
right of way width from Pine Street to Alder Street in order to avoid setting a
precedent of approving variances.
Larry Blanchard stated that the Council, on its own motion, would need to do
this at their level.

Mr. Lanier, said the City vacating 5' of that portion of First Street made good
sense, but since the Applicant needed to move quickly, that he preferred that
the Planning Commission approve the existing applications, and then sometime
in the future, the City could work on the vacation process for that part of First
Street on their own motion.
NNo one else came forward in support of or in opposition to the concurrent
applications.
Chairman Piland closed the Public Hearing.
Q Commissioner Fish moved to approve Resolution #274, modifying conditions
set forth in the Staff Reports, for concurrent applications for Site Plan for
building addition to the First Baptist Church at 100 Oak Street, and zoning
variance for lot coverage and (added) setback standards, which will embrace
the applicant's Findings, contingent on alley vacation, abandonment and
closure, retaining all easements and allowing for a 20' fire access.

Motion passed unanimously.
VI. MISCELLANEOUS - Commissioner Fish asked about the Mitrany fence (clear
vision problem). George Rubaloff stated that this item is on the City Council
agenda for January 20, 1994.
After a brief discussion, the Commission's consensus for a possible time to
meet with the City Council, was a Wednesday, February 2, 1994 at the Council
Chambers with a Study Session starting at 7:00 p.m.
Herb Farber will be the Commission's representative at the January 20, 1994
City Council meeting.
VII. ADJOURNMENT:
Commissioner Fish moved that the meeting adjourn. Commissioner Johnson
seconded the Motion. All voted by signifying "Aye". The Meeting adjourned at
8:10 pm.
