MEETING CALLED TO ORDER at 7:02 p.m. 11. ROLL CALL: Present were: Chuck Piland, Herb Farber, Candace Fish, Lloyd Governor, Randy Graves and Karolyne Johnson. Also present were George Rubaloff-Planning Administrator, Larry R. Blanchard-Public Works Director, and I;V Cecelia Gordon-Public Works Secretary/Department Assistant. (� 111. CORRESPONDENCE - NONE m Q IV. APPROVAL OF MINUTES Commissioner Farber moved to approve the Minutes of the December 7, 1993 Planning Commission Meeting. Commissioner Johnson Seconded the Motion. Roll Call Vote: Farber, yes; Fish, yes; Governor, yes; Graves, abstain; and Johnson, yes, and the Motion passed. V. BUSINESS A. Continued Public Hearing - Review and Determination of a corrected Site Plan Application for a Multiple-Family Apartment Project located on the Corner of 10th and Laurel Streets (37 2W 2CB TL 7301 , 7303, 7305 and 7306) (Applicant John Ross and Assigns). Chairman Piland re-opened the Public Meeting. Commissioner Fish removed herself from the Commission and took a seat in the audience, as she had been sent a Notice as a resident within 100 ft. radius. George Rubaloff, Planning Administrator, referred to Exhibits A through H which were entered into the record on November 16, 1993.He reviewed the Planning Memorandum of 12/15/93 entered the following items into the record by reference as Exhibits I through L: Corrected Site Plan, Zoning Review dated December 15, 1993, the new Public Works Staff Review, dated December 13, 1993, and the December 15, 1993 Memorandum from the Public Safety Department. Rubaloff also handed out to the Commission, the Public Safety Department Memorandum in which some corrections had been made, and this letter became the new Exhibit L for the record. 442 CITY OF CENTRAL POINT Planning Commission Minutes December 21, 1993 - Page Two Larry Blanchard, Public Works Director, made some corrections in his Staff Review for the record. Item #4, Exhibit A, where it states North Laurel Street, remove the word "North" and Item #B, Exhibit A, should read "A No Parking Zone shall be created along the westerly curb/gutter of 10th Street from Laurel Street to Maple Street. Blanchard showed a diagram on the blackboard and showed the access at the southwest corner of the property. This will provide access from the local street, instead of the arterial street, thereby enhancing traffic circulation. He commented on the widening requirements of Laurel Street for curbs and gutters and sidewalks on the north side and curb and gutter on the south side. He stated that in the Staff Review concerning off-site improvements, that the traffic impact did not justify paving all the way to the existing paving on Laurel Street. This would leave a small portion of Laurel Street, east of this property, unpaved. John Ross 1530 Modoc Road, Medford, came forward in support of the Site Plan Application and stated that he had been working with Staff, and understands and agrees with the conditions in the Staff Report. He also stated that he is going to attach the parking structure to the primary structure to meet zoning regulation. Chairman Piland asked what was going to happen with the corner where the existing apartment on adjacent property. Mr. Ross said he was going to try to work with that property owner, and that the landscaping done for Ross's new development would not allow anyone to cross that property. Commissioner Johnson asked Mr. Ross if he had any problems with the patch of dirt road. Mr. Ross said he did not. Candy Fish (as a resident) 9th and Laurel, Central Point, came forward with a with a safety concern (reckless drivers) about the section of dirt road which was west of the proposed project site, and asked it somehow it could be paved. Commissioner Johnson also expressed a concern, and asked staff how this could be paved. Larry Blanchard said that in the original Staff Report, the City required only the improvements on north side of Laurel (1/2 street). The City is now recommending that curb and gutter also be on the south side of Laurel, with paving Laurel Street its full width (36'). 443 CITY OF CENTRAL POINT Planning Commission Minutes December 21 , 1993 - Page Three Blanchard also stated that paving that patch of dirt road would be considered off-site improvements, and that according to the Institute of Traffic Engineer's traffic manuals, the low traffic volume on Laurel did not warrant the developer to do off-site paving. Commissioner Farber inquired as to the response of property owners on the dirt strip and if they would be interested in paving. Larry Blanchard stated that in N the past when those property owners were contacted they did not express an interest in paving this area. Another question was asked, if the City had funds () to complete paving this area of Laurel Street. Funds this year had already been [Q allocated to one (1) project-Glenn Way. However, the City Council and Budget Q Committee members are reviewing how to fund street repairs and overlays. No one else came forward in support of, or in opposition to the Site Plan. Chairman Piland closed the Public Hearing. Commissioner Farber moved to approve Resolution 268 for corrected Site Plan Application for a Multiple-Family Apartment Project located on the Corner of 10th and Laurel Streets (37 2W 2C6 TL 7301 , 7303, 7305 & 7306) (Applicant: John Ross & Assigns) as per conditions in the Staff Reports (as revised). Commissioner Johnson seconded the motion. Roll Call Vote: Farber, yes; Governor, yes; Graves, yes; and Johnson, yes. The Motion carried unanimously. (Commissioner Fish returned to her seat in the Commission). B. Public Hearing - Review and Determination of an Aoolication for Tentative Plan for Suburban Subdivision, a 33-Lot division located on north side of Hookins Road near the intersection of Hookins and Primrose. (Aoolicant: Terry L. Buntin . Chairman Piland opened the Public Hearing. George Rubaloff fully outlined the Notice of Public Hearing, dated December 1 , 1993, including the nature of hearings, criteria for decision, public comments and summary of procedure. There were no conflicts of interest or ex-parte communication. Rubaloff reviewed his Memorandum, dated 12/16/93 including the description of a tentative plan, decision process, standards, land use history, description 444 CITY OF CENTRAL POINT Planning Commission Minutes December 21, 1993 - Page Four of application, and specific public comment from residents at 874 Hopkins Road. He also entered the following exhibit items into the record by reference: Notice of Public Hearing dated December 1, 1993, Owner of Record within 100 feet radius, Maps, Application, Public Works Staff Report dated November 29, 1993, and Written Comment from Mr. Galel and Ms Evans of 874 Hopkins. (Reviewed 12/10/93). Rubaloff stated for the record that there was a discrepancy on the Map on Page 30 which shows Columbine continuing through, which is different than the official (folded) copy of the Tentative Plan. Larry Blanchard provided a diagram of Suburban Subdivision on the blackboard and showed the proposed sanitary sewer line. Blanchard stated that the City of Central Point has a "Joint Trunk Agreement" with BCVSA. In order to avoid the surcharge, the City proposes to connect the sanitary sewer lines serving Suburban Subdivision to the Regional Trunk Line. Mr. George Cota, 1070 S. Mountain, Ashland, Oregon, (Terry Buntin's Partner) came forward in support of the Tentative Plan. There were no questions from either staff or the audience, so Mr. Cota returned to his seat. No one else came forward in support of or in opposition to the Tentative Plan. Chairman Piland closed the Public Hearing. Commissioner Graves asked about how this would impact the intersection of Hopkins and Bursell. Larry Blanchard stated that the City does not anticipate the traffic at that intersection to exceed 5000 vt/d. However, this issue will be addressed in the Master Transportation Plan, which will consider traffic projections from Suburban Subdivision (1,000 vt/d) and Village Subdivision (900 vt/d). Blanchard also stated that costs for future intersection improvements may become a City wide obligation, and paid for through future funding sources such as SDC's. Commissioner Governor moved that they approve Resolution 269 for the Tentative Plan, subject to conditions in City Staff Reports, for Suburban Subdivision, a 33 Lot Division located on the north side of Hopkins Road near the intersection of Hopkins and Primrose. (Applicant Terry L. Buntin). Commissioner Fish seconded the Motion. Public Hearing - Review and Determination of an application for Tentative Plan for land division at 4969 Upton Road (36 2W 34D TL 203) northeast corner of Upton Road and Teresa Way (Applicants: Laurie Moore and Mark Shawn Moore. Chairman Piland opened the Public Hearing. () George Rubaloff outlined the Notice of Public Hearing of December 1, 1993, (�] covering the nature of hearings, criteria, public comments and summary of Q procedure. There were no conflicts of interest or ex-parte communication. Rubaloff then reviewed his Memorandum of December 14, 1993 which included the process, standards, land use history, and description of application. He also entered the following items into the record by reference: Notice of Public Hearing, dated December 1, 1993, Owner of Record within 100 Foot Radius, Maps, Application and Public Works Department Staff Report dated December 13, 1993. Larry Blanchard referred to his Staff Report of December 13, 1994 and stated that a correction needed to be made in Item 3 of Exhibit "A" to read Teresa Way and Upton Road. He stated that the improvements such as curbs and gutters would be impractical to do now, that the Commission had the option to require these improvements now or to require the Developer to sign an irrevocable consent to enter a Local Improvement District (L.I.D) in the future, if an L.I.D. is formed. Jacqueline Starks residing at 4969 Upton Road, informed the Commission that Laurie Moore could not stay for the Meeting. In response to the Commission asking her if she had been officially designated as the Applicant's agent in the matter, Ms. Stark replied, "no". Rubaloff stated that it is necessary to have an agent or someone authorized to represent the Applicant. The applicant would be informed that they should contact him or Mr. Blanchard before coming back on the January 18th, 1993 Planning Commission Meeting. That hopefully at the time of the continued hearing, Surveyor, Mark Boyden, the agent of record, could be present. 446 CITY OF CENTRAL POINT Planning Commission Minutes December 21 , 1993 - Page Six Commissioner Farber moved that they continue hearing the Tentative Plan for land division at 4969 Upton Road and Teresa Way, until the January 18, 1993 Planning Commission Meeting when the applicants and/or agent could be present. (Applicants: Laurie Moore and Mark Shawn Moore). Commissioner Graves seconded the Motion. Roll Call Vote: Farber, yes; Fish, yes; Governor, yes; Graves, yes; and Johnson, yes. The Motion carried unanimously. D. Public Hearing_ Review and Determination of an application for Tentative Plan for land partition on orooerty located at 316 N 6th Street northeast corner of 6th Street and Maple Street (37 2W 34D TL 10,800) (Applicant: Agent Ken Harris for Elven and Norma Kassell. Chairman Piland opened the Public Hearing. George Rubaloff outlined his Notice of Public Hearing, Dated December 1 , 1993, which included the nature of hearings, criteria for decision, public comments, and summary of procedure. There were no conflicts of interest or ex-parte communication. George Rubaloff reviewed his Memorandum of December 14, 1993, including the process, standards, land use history, description of application, and discussion. He also entered the following items into the record by reference: Notice of Public Hearing dated December 1 , 1993, Owners of Record within 100 feet, Maps, Application, and Public Works Department Staff Report dated November 30, 1993. Larry Blanchard illustrated on the blackboard a sketch of the property and location, including Parcel A and Parcel B. He stated that access to Parcel "A" shall be by a separate driveway. (the access can not be off the alley, it must be off 6th Street), and that the rules come from the City Ordinances. Ken Harris, Agent, of 2744 Tanya Circle, Medford, came forward in support of the Tentative Plan. Mr. Harris was concerned that they could not use the alley for an access, because the alley was designated a street. 447 CITY OF CENTRAL POINT Planning Commission Minutes December 27, 1993 - Page Seven Mr. Harris said the plan was to drive into the duplex property from the alley, but maneuvering could be done on the property. Rubaloff stated that the parking standards allow backing and maneuvering in the right of way for single family and two family residential use. This rule may be in conflict with another rule, which prohibits primary alley access. Since this conflict was not relevant to the Tentative Plan decision, it was decided that staff would research to clarify the issue by the time the Applicant submitted a Site Plan Application for the two family dwelling. U No one else came forward in support of, or in opposition to the Tentative Plan m Application. Q Chairman Piland closed the Public Hearing. Commissioner Farber moved that they approve Resolution 270 approving the Tentative Plan Partition on property located at 316 N. 6th Street, northeast corner of 6th Street and Maple Street (37 2W 03DA TL 10,800) subject to the Staff Reports' Conditions. (Applicant: Agent Ken Harris for Elven and Norma Kassell). Commissioner Fish seconded the Motion. Roll Call Vote: Farber, yes; Fish, yes; Governor, yes; Graves, yes; and Johnson, yes. The Motion carried unanimously. E. Review and Determination on Application for Final Plat on land partition located on Snowy Butte north of where Timothy and Snowy Butte Lane intersect: (Applicant: Robert and Dixie Youngs). George Rubaloff reviewed his Memorandum of December 15, 1993, including the preface, the criteria, and a review of the most current activities. Rubaloff handed out a copy of the Letter of Credit on the Applicant, which had been received at 5:00 pm that evening and approved and accepted by the City's attorney. He also entered the following items into the record by reference: Location Map and Tentative Plan (approved on August 17, 1993), Planning Commission Resolution No. 260, Application for Final Plat and Public Works Staff Report dated December 13, 1993. Commissioner Farber wanted to know where the storm drain would go. Larry Blanchard stated that it would be west across Griffin Creek property. It is not necessary to obtain an easement through the property. This can be a private storm drain system. 448 CITY OF CENTRAL POINT Planning Commission Minutes December 21 , 1993 - Page Eight It could be an easement, but not necessarily dedicated to the City of Central Point. Rubaloff stated that the City was still refining the Development Agreement. Commissioner Farber moved that they approve Resolution 271 approving the Final Plat on land partition located on Snowy Butte Lane where Timothy and Snowy Butte Lane intersect 37S 2W 10DB TL 8200, depending on approval and execution of all documents. (Applicant: Robert & Dixie Youngs). Commissioner Fish seconded the Motion. Roll Call Vote: Farber, yes; Fish, yes; Governor, yes; Graves, yes; and Johnson, yes; and the Motion carried unanimously. Mr. Youngs publicly stated that he appreciated staff working with him on getting this done in time for the meeting. VI. MISCELLANEOUS - Rubaloff gave the Commission a schedule of future items to be covered by the Planning Commission, including the Periodic Review of the City's Comprehensive Land Use Plan (Public Hearing) scheduled for January 4, 1994 Planning Commission Meeting. VII. ADJOURNMENT: Commissioner Graves moved that the meeting adjourn. Commissioner Farber seconded the Motion. All voted by signifying "Aye". The Meeting adjourned at 9:40 p.m. PLCMTSDEC.21
