I. MEETING CALLED TO ORDER
at 7:00 p.m.
II. ROLL CALL: Present were: Chuck Piland, Herb Farber, Candace Fish, Lloyd
Governor and Karolyne Johnson. Also present were George Rubaloff-Planning
N Administrator, Mark Servatius-Fire Chief/Building Official, Larry R. Blanchard-
Public Works Director, and Cecelia Gordon-Public Works Secretary-Department

111. CORRESPONDENCE- George Rubaloff stated that unless Commission members
felt they needed mailboxes at City Hall, that they would receive any City Hall
Communication at the same time the packets are delivered.
George Rubaloff also handed out a memo and attachments on the status of the
Planning Commission, and asked that the members look it over and make sure
the information is still current, in reference to their occupations, etc. He also
stated that Diane Galley had entered her letter of resignation from the
Commission effective September 1, 1993.
IV. APPROVAL OF MINUTES
Commissioner Fish moved to approve the Minutes of the August 17, 1993
Planning Commission Meeting. Commissioner Farber seconded the Motion. Roll ,
Call Vote: Farber, yes; Fish, yes; Governor,yes, and Johnson, abstain, and the
Motion passed by a majority vote.
V. BUSINESS
A. Public Meeting - Review and recommendation for Annexation of 5.21 acre
territory on Grant Road 1100 feet from where Taylor and Grant Road intersect
(Applicants: Snow - Christian)
Chairman Piland opened the Public Meeting.
George Rubaloff, Planning Administrator, reviewed his Memorandum of August
31, 1993, and the attachments, which were a Certificate of Posting, Maps,
' Annexation Application, Planning Department (Consultant) Staff Report dated
August 10, 1993, Public Works Staff Report dated August 25, 1993 and
entered them into the record by reference. He also referred to the issue

concerning annexation, and who would provide the sanitary sewer service to
the newly annexed area. As the statutes stand now, it appears that the Bear
Creek Sanitary Authority would most likely meet Jackson County's criteria for
providing such service.
George Rubaloff also outlined some options that the Commission could use:
postpone the review; recommend annexation but not annex unless the City can
provide the sanitary sewer service; or recommend annexation, regardless of
who provides the sanitary sewer service.
Commissioner Governor asked if the Commission's role was advisory. George
Rubaloff answered that it was, that this would just be a recommendation for
annexation to the Council, that any future development would need to go
through-the entire land use process.
Commissioner Fish asked why the change, as the City used to annex, and
withdraw from BCVSA automatically. George Rubaloff answered that the new
State Statute has changed this.
Larry Blanchard stated that the City provides sanitary sewer service rates at a
level that provides for future growth and for a replacement program.
There were no conflicts of interest or ex-parte communication.
Doug McMahan, Hoffbuhr Surveying, 1082 E. Jackson, Medford, Oregon,
representing the applicants, came forward in support of the proposed
annexation.
Mr. McMahan referred to the map in the packet, stating the BCVSA line does
run along Grant Road. He asked the Planning Commission to make a
recommendation for annexation, as there is a good possibility of developing this
property and adjacent properties at the same time.
Mr. McMahan also expressed his appreciation for all the work City staff has
done.
Larry Blanchard stated that this new area may need a new main sanitary sewer
line, regardless of who provides sanitary sewer service.

There were no further questions or discussions. Chairman Piland closed the
Public Meeting.
Commissioner Farber moved to recommend the annexation of 5.21 acre

co Commissioner Fish moved to recommend that the Planning Commission
Q Chairperson write a letter to the City Council referring to the backlog of
annexations. Commissioner Farber seconded the Motion. Roll Call Vote:
Farber, yes; Fish, yes; Governor;yes, and Johnson,yes, and the Motion carried
unanimously.
B. Review of Proposed Revisions to Deferred Improvement Agreement required for
a Land Partition located on N Highway 99 (Northwest Construction Company
and State of Oregon).
George Rubaloff referred to the Planning Department Memorandum dated
August 31, 1993, and the Deferred Improvement Agreement as prepared and
revised and entered those items into the record by reference. Mr. Rubaloff also
reviewed the revisions with the Commission.

Under #2. of the Agreement, the State of Oregon did not want to be tied to a
certain time limit for making improvements because the State may need
additional time to establish spending authority.
Also under #2, the State of Oregon uses standard process for putting it to bid.
Under #3(b), the State of Oregon is bound by ORS 279.029 for bonding
procedure.
Under #4, the City will not have the spending authority to make changes to the
scope of the project if the City modifies the design.
Under #7, language has been changed to state that both parties will be bound
by the Council's decision, provided the State of Oregon shall have the right to
seek judicial review of such decision.

Commissioner Governor moved to approve the Proposed Revision to the
Deferred Improvement Agreement required for Land Partition located on N.
Highway 99 (Northwest Construction Company and State of Oregon),
Commissioner Johnson seconded the Motion. Roll Call Vote: Farber,yes; Fish,
yes; Governor, yes and Johnson, yes and the Motion passed unanimously.
C. Review and Determination of Final Plat Application for Land Partition Located
in the Southeast Quadrant West of 1-5 east of Hopkins Road and Pittview
Avenue (Applicant Gary Whittle of Pacific Crest Properties Inc.)
Commissioner Farber declared a conflict of interest, and took a seat in the
audience.
George Rubaloff referred to the Planning Department Memorandum dated
September 2, 1993, along with the map, copy of Planning Commission
Resolution #258, Application for Final Plat, and entered the items into the
record by reference. Mr. Rubaloff stated that Final Plat approval is based upon
the plat conforming with the tentative plan and the completion of any required
conditions of approval. George outlined the four remaining conditions and
stated that since the requirements Condition #3 and Condition #4 do not have
a time factor, that those two Conditions could be covered in an Agreement.
Commissioner Fish moved to approve Resolution #264 for the Final Plat
Application for Land Partition Located in the Southeast Quadrant, West of 1-5,
east of Hopkins Road and Pittview Avenue (Applicant: Gary Whittle of Pacific
Crest Properties, Inc.) Commissioner Johnson seconded the Motion. Roll Call
Vote: Fish,yes; Governor, yes; and Johnson, yes, and the Motion passed by
majority vote.
Commissioner Farber rejoined the Commission.
D. Discussion relating to Proposed Zoning Amendments Applicable to Accessory
Buildings (Letter to Dewane Hood, 363 N. Tenth Street).
George Rubaloff referred to the Planning Department Memorandum of August
31, 1993, and the Letter to Dewane Hood from the Planning Department dated
August 23, 1993, the Topography Map of 363 N. 10th Street and entered
these items into the record by reference.

The Commissioners and Mr. Rubaloff reviewed the letter to Mr. Hood and
discussed several options available to Mr. Hood for constructing a accessory
building, since his property does not have a back property line, and is
surrounded on three sides by streets.
Commissioner Fish suggested that perhaps a variance would be the way to
Iq handle this unique situation.

Larry Blanchard stated that the Transportation Master Plan is still in transition
U and could possibly establish standards for future streets. These standards
m could change size of streets, and right of ways, alley ways could become
Q private property, etc. Commission Farber suggested that before acting on
Dewane Hood's request for amending zoning, that the Commission wait for the
Transportation Plan and then perhaps look at a variance.
VI. MISCELLANEOUS - Commissioner Governor stated that earlier in the April 1993
Planning Commission Meeting, that he took part in the voting process for the
Tentative Plan for Jackson Creek Unit #5 Subdivision. He then later discovered
that his employer was part of the lending process. (Governor was not
personally involved).
Announcement - On the matter of the fence around Jackson Creek Unit #5,
there will be a City Council Study Session at 7:00 pm, on September 9, 1993,
on the issue of the City's general policy for fences built in the right of way.
Announcement - The next scheduled Planning Commission Meeting will be
September 21, 1993. Jackson Creek Unit #5 is on the Agenda.
Announcement - Larry Blanchard will be on vacation most of the Month of
October, 1993. Commissioner Farber also announced that he will be gone on
October 5, 1993.
VII. ADJOURNMENT:
Commissioner Fish moved that the meeting adjourn. Commissioner Farber seconded
the Motion. All voted by signifying "Aye" in favor of adjourning. The Meeting
adjourned at 8:50 p.m.
