U Galley, Lloyd Governor, and Karolyne Johnson. Randy Graves did not attend,
m his temporary residence is outside the City Limits. Also present were George
Q Rubaloff-City Administrative Assistant, Larry R. Blanchard-Public Works
Director, and Cecelia Gordon-Planning Commission Secretary.

IV. APPROVAL OF MINUTES - Johnson moved to approve the June 1, 1993
Planning Commission Minutes, Fish seconded the Motion. Roll Call Vote:
Farber, abstained; Fish, yes; Galley, yes; Governor, yes and Johnson, yes, the
Motion passed on a majority vote. Chairperson, Piland pointed out that the
next Resolution number should be 257 (not 256 as appeared on the agenda,
It was so noted and changed for the record).

Chairman Piland opened the Public Meeting.
Rubaloff reviewed his Memorandum of June 29, 1993 and highlighted the five
(5) areas that the Development Plan did not address as of the date of his
Memorandum. Rubaloff referred to the following exhibits (including the
supplemental items) and entered them into the record by reference: (A)
Certificate of Posting of Public Meeting (which he reviewed with the Council)
(B) Maps, (C) Development Plan, (D) Development Agreement (Instrument No.
92-09180), (E) Public Works Staff Report (dated June 14, 1993, (F) Narrative-
Development Plan for Forest Glen prepared by Farber Surveying (dated: June
30, 1993), (G) Revised Tentative Plan for Partition (dated June 30, 1993), (H)
Revised Page 1 of Development Plan for Forest Glen (dated: June 30, 1993),
and (1) traffic analysis prepared by J. Michael Lanier (Dated July 1, 1993) and
(J) May 7, 1993 Letter to Mike Thornton from O.D.O.T. re: Permits for Storm
Sewer construction.
Blanchard outlined his Staff Report of June 14, 1993, which included the
questions the Developer needs to address for completing the transportation
portion of the Development Plan. Blanchard indicated that because of the late
arrival of the Mike Lanier's traffic analysis just arriving today, that he would
further clarify traffic flow requirements. Blanchard stated that Mr. Lanier would
need to bring the Commission up to speed on what is happening traffic wise,
and explained the different street classifications (Major arterial, secondary
arterial and collector streets. Blanchard displayed the 1991 Development Plan
from the overhead projector and pointed out the differences between the two.
Blanchard also said that because of the major impact of the traffic flow in the
proposed development it may be necessary to obtain a more detailed traffic
engineer's plan (traffic engineering study).
Blanchard also addressed,.concerns on the future 12" water pipe crossing 1-5,
the future connect for the sanitary sewer (18" regional or BCVSA main trunk)
recommending connecting to the regional to reduce the overall cost; storm
drainage (ODOT's letter to Thornton-Exhibit J, shows that there should be no
problem for the developer to obtain a permit to install a storm sewer under 1-5);
Crossing Elk Creek, sizes need to be determined; and the Park system, a 10
acre park should be located somewhere in this Development. Applicant asked
that the park be located on the Gilman property. The Dark land issue would
have to go back to the Council for decision.
Commissioner Farber had a Conflict of Interest, and removed himself from the
Commission during this action. There was no further conflict of interest or ex-
parte communication.

Mike Lanier, 2720 Stonebrook, Medford, Gary Whittle, 908 E. Jackson,
Medford, and Herb Farber, 908 E. Jackson (Applicants) came forward in
support of the Development Plan for the proposed Forest Glen development.
Lanier said that the Developer felt that the most serious issue was not the
traffic plan but the storm drainage issue. He also stated that the applicant
believed that any other properties outside of their development, accessing the
storm drainage system installed by the Forest Glen developer should pay back
a pro-rata share of the basic cost.
Lanier described the proposed development as a total of 365 dwelling units,
which he estimated would take 3 to 5 years to build out. He stated that the
first phase would be 44 single family residences, the 2nd would be 40 single
family residences, the 3rd phase would be 28 duplexes ( Lanier realizes that
land use action/rezoning would be required before building the duplexes and
multi-family units), Phases 4, 5, 6 and 7 would be the balance of properties
which would include single family and multi-family units.
Lanier stated that the extension street and Marilee Street did not line up, and
that the Applicant had designed it this way to balance the corner, and not lose
property. After researching the Marilee (strip, street, row,?) that it is a 60' strip
of land but can not find a record showing that it has been dedicated as a public
street. Lanier then discussed the street plan, and the proposed extension of
Columbine Street. (not included in traffic analysis). The applicant felt that they
were responsible for what is on the land. Applicant admitted that their traffic
analysis was not an official traffic engineering study, because Mr. Lanier is not
a traffic engineer, but a Planning Consultant, but traffic counts were estimated
when the development reached full build out.
Lanier referred to the Bursell Road matter, and stated that the Applicant
believed it was the City Planning Department's issue since the Bursell Road is
significantly off-site, that they would be using Hopkins Road as the major vent.
He further reviewed the applicant's traffic analysis report, (design, traffic
control, anticipated vehicle trips per day, etc.). Traffic Counts on Bursell now
1722 vt/d and anticipate an additional 3130 vt/d (full build out) for a total of
4852 vt/d, (not quite major arterial designation.)

Lanier addressed each of the concerns in the Public Works Staff Report, dated
June 14, 1993.
Gary Whittle was concerned about the cost sharing on the 12" waterline (SDC?
Payback,). Blanchard said that this issue would need to go before the City
Council for decision. Whittle asked if the developer was just to take the line to
the end of the Applicant's property, and that the applicant would not have to
extend the line across the Freeway. Blanchard stated that the 12" water line
would end adjacent to the freeway and would not be extended across the
freeway by the applicant.
Whittle also wanted to see if there were any concerns about the Mayfair,
Marilee intersection. Blanchard's concern was a letter from Rogue Valley
Transit District concerning the route for bus service. Whittle said he felt that
Marilee could hook into Mayfair when developed. Blanchard said that staff's
concern is that Marilee should align either with curvatures or straight alignment,
but that it should connect.
Herb Farber stated that Marilee does not fit the development very well and as
it exists will create a safety problem. Farber, stated Marilee will make most
sense, as shown on Applicant's plan.
Mr. Farber stated that Applicant and Mr. Gilman have discussed working
toward a satisfactory plan for park land for the development.
The Commission wanted to know the City's preference for the Development's
connection to Sanitary Sewer. Blanchard indicated that BCVSA would not
allow the City to connect to BCVSA's 42" without paying a surcharge,and this D
was the City's motive for tying into the regional intercepter (18"). City would
be open to tying into the 42" line, if there is no additional surcharge by BCVSA, C7
however, the Joint Trunk Agreement with BCVSA would have to be modified �J
and approved by the City and BCVSA. Lanier stated they are negotiating with
BCVSA. Cn
Lanier explained that the purpose of the Applicant's development concept and
to make the Commission aware of the development in the conceptual stage.
Rubaloff stated that the Forest Glen Development Plan is the first phase of a
six or seven phase process, involving Tentative Plans, Final Plats and perhaps
other land use applications, and that the Planning Commission has the authority
to adopt such development plans to use as a planning guide for reviewing those
future land use applications.

Blanchard outlined options to Planning Commission as: accept the plan as
provided, approve or deny the development plan, and/or could request
additional information. If the Commission is satisfied with the information, then
the Commission could approve it today. The Plan as it exists now, has a few
items to be corrected such as the 50' right of way shown on Hopkins Road
would need to be changed to Wright of way.
Rubaloff stated that if the Commission approved the Development Plan, the
individual exhibits, minutes, evidence, in effect, the record, would become part
of the Development Plan. Lanier explained that they have agreed to the 60'
width, and that any items needing corrections can be addressed through a
specific tentative plan.
Blanchard wanted to make sure the Planning Commission has as much
information as possible to make a decision on the Forest Glen Development
Plan. Rubaloff stated that certain features of the proposed Development Plan
have not yet been determined, i.e. park location, and proposed rezoning. Those
concepts could change on the plan depending upon the outcome of those
future decisions.
Farber stated that the Forest Glen Development Plan will change, and will be
back for amendments as they proceed and that this is just the first phase in
many phases to achieve full development, and that the Commission will be able
to review and make a determination on each phase.
Blanchard stated that the City street plan is put in place, not just for this
development, but to make sure the streets in the area are the correct design,
so that there will be no surprises down the line. Blanchard said that it was
important to design a Development Plan as close to what you think is going to
happen. The changes shouldn't be so drastic that it will change the concept of
the plan and the process allows the concerns to the Development Plan to be
discussed for the record.
Rubaloff stated that if revisions are made to the Fore Glen Development Plan,
the opportunity would again need to be given to the public (neighborhood) for
input.
The Commission asked about the warrant process for determining the need for
traffic signals. Blanchard explained that there are several items to consider,
when warranting signals, and based on these items, the only intersection in
the City which could currently warrant a signal is the (4 way) intersection of
Scenic, Bursell, N. 3rd. Street and 10th Street.

George Gilman, 452 Beall Lane, Central Point, Oregon, property owner of lard
adjacent to the proposed development (neither in support of or in opposition to
the Development). He said that when he got his Notice that he was a little
shocked to see his property outlined as land set aside for the park. He said he
and his wife were willing to make some kind of arrangement with the City for
a 10 acre park, but that he would like to have some options, and made some
suggestion that a park along Elk Creek might make sense, and that he would
like to work with the planners and the City sometime this winter.
Rubaloff asked if there would be a Letter of Agreement (re: parks) from Mr. and
Mrs. Gilman included in the record as mentioned in the Applicant's Narrative
dated June 30, 1993. Mr. Gilman said that he has not formulated such a
letter, nor is he willing to do so until he knows what ground is included.
Blanchard said that Mr. Gilman stated that he is open and willing to enter into
discussion on this matter.
No one else came forward in support of, or in opposition to the Development
Plan. Chairman Piland closed the Public Meeting.
Blanchard stated that Hopkins is designed as a collector street, and as phases
are built, the City will take a look at traffic counts, and if traffic patterns
change a lot, it is possible that we could ask the developer to put in another
collector street. The only time when we can address street issues, is at the
land use application stage and when property abuts a street, or if the impact
is such that it creates a need for an off-site improvement. (Signal, etc). The
Development Plan needs to be as accurate as possible. If changes are
requested by the developer, they can be reviewed based on the impact to the
remainder of the Plan when the Development Plan is requested to be modified. D

B. Public Hearing Review and Determination for Tentative Plan for Land
Partition relating to Forest Glen Development on property located in the
southeast quadrant west of 15 east of Hopkins Roads and Pittview
Avenue at 37 2W 12C TL 3200 and 3300 (Applicant Gary Whittle for
Pacific Crest Properties Inc.).
Chairman Piland opened the Public Hearing.
Rubaloff said that this partition is done as a housekeeping action for the
developer and seller of the property so that it is for the sale and purchase. He
referred to the Criteria for Decision listed in the Notice of Public Hearing, dated
June 16, 1993. He also covered the process for Public Comments in that same
Notice. He also reviewed his Memorandum dated June 29, 1993, along with
the attachments, maps, Notice of Public Hearing, dated June 16, 1993, Mailing
List for Hearing Notices, Application for Tentative Plan, Public Works Staff
Report dated June 14, 1993, and entered them into the record by referenced.
Blanchard asked if there were any questions on the conditions listed in his Staff
Report.
Farber continued to remove himself from the action, declaring a conflict of
interest. There were no further conflicts of interest or ex-parte communication.
Herb Farber, 908 E. Jackson, Medford, Oregon and stated that the easement
goes away. He referred to Item #5 in Public Works Exhibit "A", concerning the
existing dwelling on Parcel 3, water and sewer service. As long as the existing
house remains will continue to use the septic tank and well . As the
development progresses, the existing house will probably go away.
Farber didn't think the minor land partition did not warrant a traffic study.
Blanchard answered .....that prior to any FURTHER land use action, this study
would be required. Lanier stated that having "shall" in the wording was
detrimental to the land use action at this time. Blanchard stated that the
language could be modified, and finally agreed to take out condition #1 of
Exhibit "A". Lanier stated that in condition #3 in Exhibit "A", and the word
"this" was changed to the word "future" (land use action.)
Farber said that when the City approves a Public Street to Parcel 1 , during
Phase 3, street extensions to Parcel 1, the Easement for ingress and egress will
be deleted. Blanchard explained that the options available for the dwelling on
Parcel 3.

Commissioner Fish moved to approve Resolution #257, and Commissioner
Galley seconded on the Tentative Plan for Land Partition with the following
changes, deleting Condition #1 on Exhibit "A", changing the word "this" to
"future" in Condition #3, and Condition #5 to read " In the event that the well
or the septic system fail, the developer will either replace the system or
discontinue use of the dwelling." relating to Forest Glen Development on
property located in the southeast quadrant, west of 1-5, east of Hopkins Road
and Pittview Avenue at 37 2W 11A TL 1800, 37 2WS 11D TL 100, 37 2W
12B TL 500 and 37 2W 12C TL 3200 and 3300 (Applicant: Gary Whittle for
Pacific Crest Properties, Inc.)Roll Call Vote: Fish,yes; Galley, yes; Governor,
yes; and Johnson, yes. The Motion carried by a majority.
An amendment was entered to have the Chairman sign the Resolution when
prepared, and bring it back to the Planning Commission at a future meeting for
their review.

of Four Unit Apartment Building located at the northwest corner of Glenn
Way and Snowy Butte Road on 37 2W 10AC TL 600 (Agent: Joseph

Rubaloff reviewed his Notice of Hearing and the criteria for decision. Rubaloff 0
stated that the Commission could approve or deny the site plan, they could
continue the hearing. If they come to a decision to approve or deny, that N
decision is summarized and taken to the City Council. Rubaloff referred to his Ul
Memorandum dated June 29, 1993 and the attached exhibits: Notice of Public
Hearing dated June 16, 1993, Mailing List of Property Owners of Record within
100 foot Radius, Maps, Site Plan Application, Staff Report from Planning and
Zoning Department dated June 21, 1993, Staff Report from Public Works
Department, dated June 14, 1993 and Chronology of previous land use
actions, and entered them into the record by reference. Rubaloff stated that

include maneuvering, parking, stalls be located in the front yard set back. (20'
along Glenn Way, 20' along Snowy,Butte). Staff discovered that when this
partition was finalized there was a variance granted along Snowy Butte Road
which allowed the Applicant to place parking within 10 feet of the required set
back. For the record, that variance, most likely is in place right now. Rubaloff
referred to page 53 A, which was handed out to the Commission and entered
into the record.
Blanchard referred to the fact Snowy Butte Road as an unimproved Right of
Way dedicated to the Public. Snowy Butte should be improved to a City Street
Standard. Rubaloff stated that the improvement required back in 1979, for the
Minor Land Partition, the street was to be a one-half street improvement. (36'
of pavement, curbs and gutters). Blanchard said this was a little bit more than
one-half street.
Farber stated that Oregon Revised Statutes state that substantial changes
cannot be made to a Land Use Action decision, unless the City and Developer
agree after Final Plat is recorded. Separate deeds had to be recorded to
0 establish parcels.
Rubaloff said the City did not have any record of deeds.
There were no conflicts of interest or ex-parte communication.
Applicant's Agent, Joe LaValle came forward in support of the Site Plan.
He stated that he realized that they would not be able to do the Four Plex, but
would probably come back a revised site plan for a tri-plex.
No one else came forward in support of, or in opposition to the Site Plan.
Rubaloff said that if the applicant wants to apply for a tri-plex that with the
existing variance, there should be room for parking.
Commissioner Farber moved to continue the Public Meeting on the Proposed
Site Plan for construction of Four Unit Apartment Building located at the
northwest corner of Glenn Way and Snowy Butte Road on 37 2W 10AC TL600
(Agent: Joseph LaValle for Property Owner Dan Renard) to July 20, 1993.
Commissioner Johnson seconded the Motion. Roll Call Vote: Farber, yes; Fish,
yes; Galley, yes; Governor, yes; and Johnson, yes, the motion carried
unanimously.

D. Public Meeting - Review and Determination for Final Plat for Land Partition
located on Highway 99, North of Crater High School. 372W 3B TL 1500.
1503. & 1504 (Applicants: Northwest Commercial Construction and State of
Oregon).
Chairman Piland opened the Public Meeting.
Rubaloff reviewed his Memorandum of May 24, 1993, and the attachments,
Tax Assessor Map, Application for Final Plat, Public Works Staff Report dated
June 24, 1994 and Resolution #571 Approving Minor Partition (372W 36 TL
1500)(The original Resolution) and entered them into the record by reference.
Rubaloff also referred to the condition that the Developer install Highway 99
improvements. The approach that Staff has agreed upon is that the practical
way that this be done is through a Deferred Improvement Agreement. Rubaloff
gave a brief history. and background, and that this land action does not
necessarily indicate that the development is just around the corner, but that
they are back to the Planning Commission to finalize the Land Partition.
Applicant Doug McMahan, Hoffbuhr and Associates, 1062 E. Jackson, e
Medford, Oregon, Agent representing the State of Oregon and Northwest
Commercial Construction, commented on the Public Works Conditions, Item 2,
Condition b. that Parcel 2 provide a 15' Storm Drainage and Easement to
benefit Parcel 1, that he had a copy of the Bargain Sale Deed from N.W.
Commercial that conveys to the State of Oregon the 15' easement for Sanitary
and Storm Drain purpose. He pointed out that the Deed has not be recorded,
but handed in a copy to the Commission for the record, and that the Applicant D
will provide the City with the Original Deed, so that it can be recorded at the
same time the Final Plat is recorded.

Rubaloff handed out copies of the Deferred Improvement Agreement and -NJ
proposed Resolution 258. That Item 2, Condition #b in the Public Works N
Memorandum of June 24, 1993, be changed to read that Parcel 2 shall provide
one 15 ft. easement which would include both sanitary sewer and storm
sewer.
No one else came forward in support of or in opposition to the Final Plat.

Commissioner Fish moved to approve the Resolution 258 granting Final Plat
Approval for a Land Partition with the condition that the Applicant sign the
Deferred Improvement Agreement on the 15' Easement. (Applicant: Northwest
Commercial Construction) 37 2W 3B Tax Lots 1500, 1503 and 1504.
Commissioner Governor seconded the Motion. Roll Call: Farber, yes; Fish, yes;
Galley, yes; Governor,yes; and Johnson yes. The Motion carried unanimously.
E. Public Meeting Review and Discussion regarding Annexation of Property
located on Chicory Lane north of Timothy Street (37 2W 1 ODA TL 100)
Chairman Piland opened the Public Meeting.
Rubaloff gave a brief report covering his Staff Report of June 29, 1993, and
referred to the attachments, a Map, Excerpt of May 20, 1993 Council Minutes,
and Letter from Virginia Brown, dated June 11, 1993, and entered them into
the record by reference. That the City is notifying all the agencies prior to the
Public Hearing on July 15, 1993. The City has a plat (not in Planning
Commission Packet) this property is in a R-1-6 Zone.
There were no conflicts of interest, Commissioner Fish declared a possible ex-
parte communication.
No one came forward in favor of or in opposition to the proposed annexation.
Chairman Piland closed the Public Meeting.
Commissioner Farber moved that the Annexation of Property on Chicory Lane north
of Timothy Street(37 2W 1 ODA TL 100) be recommended to the Council for further
Action. Commissioner Johnson seconded the Motion. Roll Call Vote: Farber,yes; Fish,
Galley, yes; Governor, yes; and Johnson, yes. The Motion carried unanimously.
V. MISCELLANEOUS - None
VI. ADJOURNMENT - There was a minute motion to adjourn. There was a
unanimous Aye vote. The Motion carried.The meeting adjourned at 11:20 p.m.
