ROLL CALL - Those present were: Chuck Piland, Jan Dunlap, Herb Farber, Candy Fish, Randy Graves and Valerie Rapp. Karolyne Johnson had informed the Commission that she would be gone for the June 6 and June 20th Meetings. III. CORRESPONDENCE - None IV. MINUTES Commissioner Fish moved to approve the May 16, 1995 Planning Commission Minutes. Commissioner Dunlap seconded the Motion. ROLL CALL VOTE: Dunlap, yes; Farber, yes; Fish, yes; Graves, yes; and Rapp yes, and the Minutes were approved as written, V. PUBLIC APPEARANCES - None VI. BUSINESS A. Public Hearing - Review and Determination regarding the Site Plan for Commercial Office Building on southeast corner of Pine and Seventh Streets. (Applicant: Karolyne Johnson) 37 2W 2CC Tax Lot 7200. Chairman Piland opened the Public Hearing. George Rubaloff, Planning Administrator, reviewed the Planning Department 's Notice of Public Hearing dated May 17, 1995 including the Nature of Hearings, Criteria for Decision, Public Comments, and Summary of Procedure. CITY OF CENTRAL POINT Planning Commission Minutes June 6, 1995 - Page Two Commissioner Fish declared a conflict of interest, as real estate agent for the project and took a seat in the audience. There were no other conflicts of interest or ex-parte communication. George Rubaloff reviewed the Planning Department Staff Report dated June 2, 1995, including the Background, Review Highlights, and Conclusion. He entered the following exhibits into the record by reference: (A)Notice of Public Hearing, (B)Mailing List for Notice 100 foot radius (C)Assorted Maps, (D) Application, (E) Public Works Department review dated June 1, 1995, (F)Public Safety Review dated June 2, 1995, and (G)Public Works Standards relating to spacing between driveway access and intersections. The following handouts were also entered into the record by reference: (H)Letter from Central Point Chamber of Commerce, dated June 3, 1995, expressing support for the project, (1) Letter from Karolyne Johnson, dated June 5, 1995 asking for an exception, and (J)Letter from Karolyne Johnson, dated June 3, 1995, expressing her reasons for not going with an alternative plan. Chairman Piland declared a few minutes break in order to give the Commissioners the opportunity to review the Exhibits (H, I and J) just handed out. After reviewing the new exhibits, Commissioner Graves asked staff where the authority for the requirements for the driveway access distance from the intersection came from. Susan Wilson Broadus, Public Works Director, stated that in general, Central Point's safety and engineering principles are based on the American Public Works Association Standards. George Rubaloff illustrated the shape of the lot and the Applicant's proposed driveway access on the blackboard, stating the proposal did not conform with the Public Works Standard which requires the driveway to be the farthest distance away from the street intersection. Susan Wilson Broadus stated that any number of plans could address the farthest distance from intersection, with the intent of promoting safety. CITY OF CENTRAL POINT Planning Commission Minutes June 6, 1995 - Page Three Tom Malot, agent for the Applicant, 150 Manzanita Street, Central Point, came forward in support of the Site Plan. Mr. Malot cited other commercial driveway accesses in Central Point that he felt did not conform to the Public Works Standards. He drew an illustration of the lot on the blackboard, showing the building in the back of the lot and the parking lot and driveway access in the front portion of the lot. Malot stated that the small lots available on E. Pine in Central Point are small (55' x 140' lots) and don't leave much room for a commercial building and a driveway access placed at the farthest point away from the intersection. Mr. Malot stated that the City was promoting a plan that would not work for the Applicant. George Rubaloff stated that he would like to correct the record, that the City was not promoting a "plan" of their own, but that staff had suggested that the Applicant redesign the site plan to come into compliance. Commissioner Farber asked Mr. Malot if there were any time constraints placed on the Applicant. Mr. Malot answered that the Applicant needed to have the building completed by September, 1995 to meet requirements for the tax deferment. Commissioner Rapp asked if the Applicant had design criteria placed on her by the Insurance Company. Mr. Malot stated that parent insurance company did require certain placement of computers, etc. in the design of the building. Herb Farber stated that at the request of the Developer, in a past Planning Commission meeting, the placement of the street light for the Malot Office Building had been changed to the north side of E. Pine Street. Tom Malot stated that he will be resubmitting a site plan for the Malot Office Building and will show installing a street light on the Malot Property on the south side of E. Pine Street. He also added that it would make sense to also place the Applicant's proposed street light on the south side of E. Pine Street. Susan Wilson Broadus stated that according to the standards, the proposed street light should be spaced no more than 200' from the nearest street light. CITY OF CENTRAL POINT Planning Commission Minutes June 6, 1995 - Page Four George Gilman, 452 Beall Lane, Central Point, came forward to support the Applicant's site plan. Lee Edwards, 209 Windsor Way - works with the Chamber of Commerce, came forward to support the Applicant's site plan. Rusty McGrath, Mayor, came forward in support of the present site plan. He stated that he would like to see mistakes taken care of before the process gets so far along. He stated that staff should be working to help commercial development take place. Candy Fish, real estate agent for the Applicant, stated that she felt the present site plan was the only way the building would work, and that putting the parking lot in front of the building would be better than a back parking area, where vehicles could be broken into, etc. because they were next to the alley and out of view of people in the building. Gladys Edwards, 209 Windsor Way, also works for the Chamber of Commerce stated she supported the present site plan. Chairman Piland asked when the Public Works Standards were put into effect. George Rubaloff stated that the standards have been evolving since the 1970's and have been updated by City Council several times over the past 6 years. Susan Wilson Broadus added that the current Public Works Standards were adopted by the City of Central Point Council in January 1993. Commissioner Rapp stated that she thought the City could change standards so that these small existing lots on Pine Street could be developed commercially. Commissioner Farber stated that the Public Works Standards are written subjectively to maximize safety, not intended to inhibit development. He also stated that the site plan application before the Planning Commission was the one to be decided upon, that development on other small lots on Pine Street should be addressed at a later date. Commissioner Rapp moved that they approve Resolution 322 for the Site Plan for Commercial Office building on southeast corner of Pine and Seventh Streets (Ap_plicant: Karolyne Johnson). according to conditions in the staff reports, with a modification of Condition No. 8 relating to street lighting and excepting Condition No. 14 relating to s acing between driveway access and intersections. Commissioner Dunlap seconded the Motion. ROLL CALL VOTE: Dunlap, vest Farber, yes: Graves, abstains Rapp, yes and the Motion carried. Commissioner Fish returned to her seat on the Planning Commission. B. Public Hearing - Review and Determination regarding Site Plan for zoning variance for reduction of setback at 537 Laurel located between Fifth and Sixth Streets (Applicant: Shannon Lenz). Chairman Piland opened the Public Hearing. George Rubaloff reviewed the Planning Department Notice of Public Hearing, dated May 17, 1995, including the Nature of Hearings, Criteria for Decision, Public Comments, and Summary of Procedure. There were no conflicts of interest or ex-parte communication. George Rubaloff reviewed the Planning Department Staff Report dated June 2, 1995, including the Description of Application, History, Review Discussion and Conclusion, and entered the following exhibits into the record by reference: Notice of Public Hearing, Maps, and Application for Zoning Variance. Rubaloff further stated that staff's conclusion was that the proposal conformed to safety requirements. Scott Lenz, Applicant, 537 Laurel Street described his application for a detached accessory building, and a proposed fence on the property line. No one else came forward in support of or in opposition to the application. Chairman Piland closed the Public Hearing. CITY OF CENTRAL POINT Planning Commission Minutes June 6, 1995 - Page Six Commissioner Rapp moved for aooroval of Resolution 323. for Zoning Variance for property located at 537 Laurel Street Relating to Setback Requirements (Applicant/Property Owners Shannon Lenz and Scott R. Lenz) (372W 3DA TL 12300.) Commissioner Fish seconded the Motion. ROLL CALL VOTE: Dunlap. yes: Farber. yes; Fish ves• Graves yes Rapp yes and the Motion carried unanimously. C. Review and Recommendation relating to Zoning Text Amendment to various sections of CPMC pertaining to side and front setbacks on corner lots. George Rubaloff referred to his Memorandum of June 2, 1995 including General City Policy, Background, and Discussion. The following exhibits were entered into the record by reference: Planning Commission Resolution No. 320, Request and Findings Submitted by Developers, Notice of Public Hearing (Council) for June 15, 1995, Draft Ordinance, CPMC 17.60.090 Special Setback Requirements (Arterial Streets), and Pave xii of Public Works Standards (Site Triangle and Site Distance). Rubaloff stated staff from Building, Fire, Public Works and Planning Departments had studied the proposed rule change and determined that specific rules should be preserved: arterial 1 setback, site distance, vision clearance, and location of driveway approaches. Commissioner Fish moved to recommend the Zoning Text Amendment to various sections of CPMC pertaining to side and front setbacks on corner lots as represented in the June 2 1995 Planning Memorandum Commissioner Rapp seconded the motion: ROLL CALL VOTE: Dunlap, ves: Farber, yes; Fish, yes: Graves, yes, and Rapp, yes and the Motion carried unanimously. VII. MISCELLANEOUS - Commissioner Dunlap stated that she will be gone from June 19 until July 16. The Commission is to consider the dates of the Planning Commission Meetings in July since Tuesday July 4, 1995 is a legal holiday. The dates will be discussed at the June 20, 1995 Planning Commission Meeting. VIII. ADJOURNMENT - Commissioner Fish moved that the meeting adjourn, Commissioner Dunlap seconded the Motion, and all said Aye, and the meeting was adjourned at 9:20 p.m.
