ROLL CALL: Those present were: Chuck Piland, Jan Dunlap, Herb Farber, Candy Fish, Randy Graves, and Karolyne Johnson. Valerie Rapp had called saying she would not be able to attend. III. CORRESPONDENCE: - None IV. APPROVAL OF MINUTES: Minutes were not available, therefore approval of the Minutes of the Combined Meeting on April 18, 1995 was rescheduled for the May 16, 1995 Planning Commission Meeting. V. PUBLIC APPEARANCES - None VI. BUSINESS A. Public Hearing - Review and Determination regarding zoning variance for setback of a proposed parking structure at 250 N. 5th Street, located 70 t feet south of the southeast corner of Fifth and Maple Streets (37 2W 3DA TL 11901) (Agent: Ted Fletcher, Owner-John McCulloch). Chairperson Piland opened the Public Hearing. George Rubaloff, Planning Administrator, referred to the Notice of Public Hearing dated April 11, 1995 and reviewed the Nature of Hearings, Criteria for Decision, Public Comments and Summary of Procedure and the paragraph to the attention of the Mortgagee, Lienholder, Vendor or Seller referencing this land use proposal. CITY OF CENTRAL POINT Planning Commission Minutes May 2, 1995 - Page Two There were no conflicts of interest or ex-parte communication. George Rubaloff, reviewed his Staff Report of April 24, 1995, including the Authority, Description of Application, History, Review Discussion and Conclusion and entered Exhibit "A"-Notice of Public Hearing, Exhibit "B"-Maps, and Exhibit "C"-the Application for Zoning Variance into the record by reference. Ted Fletcher ,491 Murphy Road, Medford Oregon, Agent for the Applicant, came forward in support of the application. He referred to the map in the packet, showing the position of the proposed carport structure on the site. There were no questions from the Planning Commission. No one else came forward in support of or in apposition to the application. CHAIRPERSON PILAND CLOSED THE PUBLIC HEARING. COMMISSIONER JOHNSON MOVED THAT THEY APPROVE RESOLUTION #319 APPROVING AND ZONING VARIANCE FOR SETBACK OF A PROPOSED PARKING STRUCTURE AT 250 N. 5TH STREET, LOCATED 70 t FEET SOUTH OF THE SOUTHEAST CORNER OF FIFTH AND MAPLE STREETS (37 2W 3DA TL 11901)AGENT TED FLETCHER -OWNER JOHN MCCULLOCH. COMMISSION DUNLAP SECONDED THE MOTION. ROLL CALL VOTE: DUNLAP. YES:FARBER, YES: FISH, YES: GRAVES, YES: AND JOHNSON, YES, AND THE MOTION CARRIED UNANIMOUSLY. B. Public Meeting- Review and Recommendation regarding a minor text amendment of CPMC 17.46.020 to include sit-down restaurants (including alcohol). Chairperson Piland opened the Public Hearing. George Rubaloff reviewed his Memorandum of April 25, 1995, stating the requirement for the Planning Commission was to review amendments to zoning text. He referred to the fact that Poncho and Lefty's restaurant had sold and the new restaurant El Albinil had applied for an OLCC license to serve beer, wine and liquor. CITY OF CENTRAL POINT Planning Commission Minutes May 2, 1995 - Page Three Commissioner Graves requested that staff check on the OLCC foot rule concerning this application. Chairman Piland closed the Public Meeting. Commissioner Fish moved that they recommend approving the minor text amendment of CPMC 17 46 020 to include sit-down restaurants including alcohol (C-5 Zone).Commissioner Farber seconded the Motion: ROLL CALL VOTE: Dunlap ves• Farber, ves• Fish yes• Graves yes; and Johnson Yes and the Motion passed unanimously. C. Review and Determination regarding withdrawal from Fire District No. 3 for property located at 3124 Merriman Road. George Rubaloff reviewed his Memorandum of April 25, 1995 stating the requirements for Planning Commission was to review and make recommendations on withdrawals from Districts. He also stated that City Council had passed Resolution No. 718 approving annexation, and that the City is processing a withdrawal from Fire District No. 3. Commissioner Fish moved to recommend withdrawal from Fire District #3 for property located at 3124 Merriman Road (37 2W 12 Tax Lot 700) Commissioner Johnson seconded the Motion. ROLL CALL VOTE: Dunlap. yes; Farber, ves• Fish ves• Graves yes. and Johnson yes and the Motion passed unanimously. VII. MISCELLANEOUS - It was announced that there would be another City/C.O.G. Transportation Meeting in the Council Chambers, 7:00 p.m., Tuesday, May 9, 1995. There was some general discussion concerning the City requiring the Developer's to do off-site improvements, system development charges, and street repair priorities. VIII. ADJOURNMENT - Commissioner Farber moved that the Meeting Adjourn, Commissioner Fish seconded the Motion, all agreed by voice vote and the Meeting adjourned at 7:40 p.m.
