7 : 35 P .M.
The Planning Commission meeting was called to order at 7 : 35 P .M . by
Chairman Don Banks . Roll call found the following members present :
Hillyer, Loveland , McDowell , McManama, Waldron . Absent being
Commissioners Mann , Emery and Zander.-' Als'o present - were Janice
Corbett, Secretary, and a few interested citizens .
The minutes of April 20 , 1976 and the Study Session minutes of
May 12 , 1976 were presented for- approval. . Motion Was• made' by
McManama, and seconded to approve both sets of minutes as presented.
With all in favor, motion carried.
Chairman -Banks presented the plan review , Ordinance #1068 , Robert
Smith Apartments , 'Assessor ' s 'Parcel Tax Account #37-2W-2CC , Lot 8400 ,
between 7th , Sth and 9th Streets , for discussion,. Motion was made
by McManama-, seconded by Loveland to approve the Smith -Apartments
with the recommendations 'made at the study 'session and Fire Marshal ' s
Report . -Roll call vote : Hillyer ; yes ; Loveland , yes ; McDowell , yes ;
McManama, yes ; Waldron , yes ; Banks , yes . With all in favor, motion
carried.
Chairman Banks opened the public hearing on the Gary- Yost minor
partitioning and variance -to yard requirements in R-3 zone,
Assessor ' s Parcel Tax Account #37-2W-2CB ,• Lot 7301 , North 10th Street
extension . Chairman Banks asked if there were any opponents . Mr .
Vern Oberg , 200 N . 9th was recognized. He said the area should be
zoned for single family residential and not multiple dwellings .
Chairman Banks stated that this areas has had an R-3 zone there for
years and cannot be changed back to something more restrictive.
Mr. Oberg said he thinks the lots are too small to put apartments on .
Mr . Gary Yost , proponent , said that in regards to the R-3 zoning,
the lots as shown will- handle 12. units , adequate parking needed to
satisfy the requirements and will have the proper setback and yard
requirements for a 12 unit building . Mr.- Yost s:tated .there were too
reasons why the lots should be divided : (1) Apartment financing is
almost impossible these days but is available for 4-plexes and under.
(2) Three 4-plex buildings would look more attractive than onellong
building . Mr . Thomas Hodgson , 849 Laurel Street, was recognized.
He would like to see the area single -family dwellings . Mr. Oberg
asked Mr. Yost if the exit from the apartments would be on 10th
Street . Mr. Yost said it Would. There is additional land to the
south of this piece of property that follows 10th Street which is
also zoned R-3 and is also planned to be built into apartments .
Mr . Bob Knight was recognized and said that he is not against this
but would like to say that if a variance is granted what is going
to be done about the many illegal lots already existing around town .
Chairman Banks stated not much can be done with existing illegal
lots . Chairman Banks asked Mr . Yost why he needs to have a variance
now. Mr . Yost said three 4-plexes are more attractive than one
long building and they can be divided up so that one 4-plex faces '
one direction and the others face another direction with greenery
between them. By cutting them into three lots the density is a
little bit higher than each lot separately . Commissioner McDowell
asked Mr . Yost if the apartments would be restricted to adults only.
Mr . Yost said they would not be restricted just to adults as the
apartments will be two bedroom units . Chairman Banks asked Mr . Yost
how much variance is needed . Mr. Yost stated that he is 2 ' short
of staying within the requirements of the City on the two end lots .
With no further comments , Chairman Banks closed the public. hearing .
Motion was made by Waldron , seconded by Loveland to deny the variance.
Roll call vote : Hillyer, yes ; Loveland , yes ; McDowell , yes ; McManama,
yes ; Waldron , yes ; Banks , yes . With all in favor, motion carried.
Chairman Banks recognized Mr. Jim Hudson , Manager, Grange Co—Op. Mr .
Hudson stated that there is an existing space problem for the Grange
trucks and they are interested in purchasing the tract of land next
to the Arcade Drive—In for the purpose of storing the trucks . The
piece of property is 70 ' ( frontage) by 100 ' (deep) and is in a C-2
zone . Chairman Banks asked Mr . Hudson how far the lot is from the
Grange CopOp . Mr . Hudson replied the distance is approximately 120 '
plus the width of the street from the Grange Co—Op property line.
The Planning Commission decided to set this matter off to a study
session . The date was. set for Tuesday , May 25, 1976 at 7 : 30 P .M .
Commissioner Mann entered at 8 :25 P .M .
Chairman Banks opened the public hearing on the request of a home
occupation by Mr . Wallace Lewis , Jr. , 528 Freeman Road, Assessor ' s
Parcel Tax Account #37-2W-11BA , Tax Lot 2500 , for an Upholstery Shop.
Chairman Banks asked if any proponents were present. Mr . Wallace
Lewis , Jr. was recognized. Commissioner McDowell asked Mr. Lewis the
' following questions :
(1) Would there be a lot of traffic? Lewis — No . Most of his work is
done for a man from Ashland .
(2) Would there be any heavy equipment stored in the garage? Lewis —
The only equipment stored in the garage would be a saw machine .
( 3) Would there be any advertisement of the business? Lewis — No .
(4) Would there be any employees? Lewis — No, just himself.
Commissioner Hillyer asked Mr. Lewis if there would be any trucks
involved. Mr. Lewis said the only truck would be his pickup.
Chairman Banks asked if there were any opponents present . No one came
forth.
Mr . Leonard Hoffer and Mr. Alexander Alvarez , Sr. , neighbors of Mr. Lewis ,
were recognized as backing Mr. Lewis in his request for an Upholstery
Shop .
With no further comments , Chairman Banks closed the public hearing .
Motion was made by Waldron , seconded by McDowell to approve the home
occupation for a period of one year. Roll call vote : Hillyer , yes ;
Loveland, yes ; Mann , abstained ; McDowell , yes ; McManama, yes ; Waldron ,
yes ; Banks , yes . With all in favor, motion carried.
Meeting adjourned at 8 :40 P .M.
