Re: May 20,1975 Planning Commission Meeting
I. Explanation of approval of minutes, August 20, 1974. The City
Planning Commission minutes failed to recognize a motion to
accept the minutes of August 20, 1974. Therefore, the Planning
Commission should make such a motion now.
II. Conditional Use Permit, Clarence Beinart -
2oning: C-4, Commercial Tourist District Conditional Use: Taverns,
Restaurants, Dance Halls, etc. Code Section 17.44.030
The Staff has petitions with 34 signatures of residents opposing
the location of the lounge in this area due to residential nature.
The Planning Commission's decision is to weigh the benefits versus
liabilities pointed out by the citizens.
III. Pittview Annexation Study -
The Mayor has referred the proposed annexation to the Commission for
a recommendation. The annexation was instigated by the desire of a
property-owner to subdivide into single-family residential lots, and
the need for city water. As part of the Comprehensive Land Use Plan,
the area is designated medium density which will, under our proposed
update, allow 8,000 square foot lots. The Rutter Property must be
annexed to make the proposed Pittview annexation a contiguous parcel
to Central Point.
IV. Public Hearing - Weather's Property -
Comprehensive Iane Use Plan indicates medium density. Annexation
zoned property R-1-8. Proposed zoning R-3 which is allowed under
Conditional Use - Code Section 17.28.030 - Mobile Home Parks.
The Planning Commission will have to consider the public opposition
compared to benefits.
V. Home Occupation - Bob Barrow -
Code Section 17.60.180 and 17.20.030 - Conditional Use for office
to conduct business.
The Planning Commission must determine whether requirements of
Section 17.60.180 can be met by the applicant.
A. The occupation shall be carried on within a dwelling or building
normally accessory thereto, only by members of the family occupying
the dwelling.
B. The residential character of the building shall be maintained and
the occupation conducted in such manner as not to give an outward
appearance nor outwardly mahifestt any characteristic of a business
in the ordinary meaning of the term.
C. Ido sign- larger than one square foot in area identifying the business
shall be permitted except as required by law.

V. Home Occupation - Bob Barrow - (con't)
D. No occupation creating loud and unusual sounds, or causing
emoke or odors or other nuisances detrimental to the resi-
dential character of the neighborhood shall be permitted.
VI. Lynn Haven Rest Home Plan Review
Ordinance #1068 - Conditions recommended by Staff:
(a) Fire Marshal's Report must be complied with.
(b) Sliding doof changed to exit swinging out.
(c) Storage �r6n revision.
(d) 1-hour throughout, sprinkler system.
(e) City Building regulations. -
(f) State and City regulations must be complied with.
VII. 7-11 Southland Corporation Store Plan Review, Front and Ash.
Conditions recommended by Staff:
(a) Architectural review by commission.
(b) Concrete curb, gutter and sidewalks fronting Ash and Front
streets.
(c) All atandardecof construction of the City be complied with.
(d) State and City Regulations must be complied with.
(e) All interior walls and ceiling to be 1-hour fire rated.
(f) Type construction is III-1 hour in Fire Zone 1.
(g). 12 parking spaces-adequate.
(h) Fire MarBhalts approval.
VIII. Pine Court Subdivision Preliminary Plat -
Conditions recommended by Staff:
Via) 2" asphalt concrete paved driveway.
(b) Minimum lot line length 70, after 101 dedication of R/W on
Pine Street. .
(c) Dedication of 10, of R/W Pine Street.
(d) Frontage improvements - curb, gutter, sidewalk and conform
paving on Pine Street.
(e) 101 sewer easement on lots 42 and #3.
(f) Park Dedication Fee $150.00.
(g) All standards of construction of the City must be complied with.
(h) State and City regulations must be complldd?,v.Lh.
IX. Myra Lynne Subdivision Final Play -
The Final Plat and improvement drawings were not submitted prior to
the meeting. This project will have to be continued.

The Planning Commission was called to order at 7:40 P.M. by Chairman
Don Banks. Before roll call was taken, Del Curry was sworn in by Mayor
McBee to the office of Planning Commissioner. Roll call found the foll-
owing members present: Lees, Loveland, Emery, Phillips, Mc Manama, Griffin,
and Curry. Also present were Building Inspector R. J. Ritchey, City Admin-
istrator Ron Young, Councilman Bowers, Councilman Mills, Secretary Janice
Corbett, City Attorney John DuBay, Mayor Jim McBee and the Council room was
filled to capacity.
The minutes of August 20, 1974, April 15, 1975 and the special study session
meeting of April 29, 1975 were brought up for approval. By no questions or
corrections made, a motion was made by Mc Manama, seconded by Emery to approve
the minutes as presented. With all in favor, motion carried.
At this time Chairman Don Banks opened the public hearing regarding Mr. Clarence
Beinart's conditional use ermit for a lo un a and ame roon at 825 East Pine
Street, Councy Assessor's Parcel Number - - CC, Tax Lots and 4300.
Chairman Banks asked if there were any opponents to the proposed lounge and game
roon. Many.:-qf the citizens present raised their hands in opposition. Chairman
Banks said there was not enough time to hear everyone but that the Planning
Commission would recognize a few people opposing the tavern. The first opponent
1 to be recognized was Mr. Pierson who resides at 733 East Pine Street. He
stated that there are too many little children who play around the property in
question. Mr. Pierson said that he lives in a nice home and a tavern would
lowerihis property value. Chairman Banks thanked Mr. Pierson. for coming forth.
The next opponent was Mr. Pierce who resides at 841 East Pine Street. Mrs.
Pierce stated that this type of an establishment is too, close to Jewett School.
She told the Commission that she bought :her property for residential purposes
and wants to keep it that way. ,Chairman Banks thanked Mrsz Pierce for her
comments. Mr. Ray Mitchell who resides at 45 North 9th Street spoke in oppo-
sition. Mr. Mitchell stated that the property in question adjoins a part of
his property. He stated that he bought him home for residential purposes and
that a tavern would create a considerable amount of traffic and noise in the
alleyway. Chairman Banks thanked Mr. Mitchell for his comments. Mrs. Ruth
Arndt from the Corner Club was recognized by Chairman Banks. She said she does
not know who Mr. Beinart is and wants to know what be means by a game room.
At this time Mr. Beinart was recognized by Chairman Banks speaking in favor for
the tavern. Mr. Beinart stated that he is now residing in Phoenix, Oregon
but will shortly be residing in Central Point. He stated the tavern would be
a 2800 square foot building with facilities for lunches and meeting rooms if
desired. Mr. Beinart said the alley would not be used for cars but for deli-
very use only. Chairman Banks thanked Mr. Beinart for coming forth and the
public hearing was ordered closed. Chairman Banks asked the Planning Commission
if they had any questions to ask Mr. Beinart. Commissioner, Griffin asked what
age group the tavern would cater to. Mr. Beinart replied the tavern would cater
1 to people 21-45 years of age. Commissioner Emery asked Administrator Young if

there was an ordinance or law stating the distance a tavern must be from
a school. Administrator Young replied there must be a 500 foot distance
and that the proposed tavern meets the 500 foot distance requirement.
With no further questions raised a motion was made by Curry, seconded by
Emery to deny the conditional use permit based on the showing of hands
opposing the proposed tavern and the seven or eight valid reasons brought
forth by the citizens present. Roll call vote: Curry, yes; Emery, yes;
Griffin, yes; Lees, yes; Loveland, yes; Mc Manama, yes; Phillips, yes;
Banks, yes. With all in favor, motion carried.
The Pitt View annexation and study was brought up for discussion. Adminis-
trator Young sa�the annexation would be east of Bursell Road along Pitt
View Avenue. Chairman Banks asked if there was anyone present opposing or
favoring this issue. Mr. Walter Drennen who resides at 789 Pitt View and
who petitioned for the annexation said that the people who oppose this annex-
ation live at the ends of the HT', shaped area. Mr. McKibben who resides at
3672 Bursell Road was recognized by the Commission and said he wants to know
how far south of Pitt View this annexation would go. Mr. Walser who resides
at 3159 Pitt View said he was not in favor of the annexation. Mr. Thumler
who resides at 3558 Bursell Road said there are too many small parcels and too
many people are affected by this annexation: Mr'. LeBaron who resides at
666 Pitt View said that everybody has farms, livestock and there is no fire
hazard. He also stated that everyone he'-:has talked to is opposed to this
annexation. Administrator Young said there can- be no annexation whithout annexing
the Rutter property to make the proposed Pitt View annexation a contiguous parcel
to Central Point. There being no further discussion, a motion was made by
Griffin, seconded by McManama to delay this issue and recommend to the Council
further study on the proposed annexation. 'With all in favor, motion carried.
The public hearing regarding the zone change from R-1-8 to R-3 for purpose of
a conditional use permit to construct a mobile home park as proposed by Mr.
Ervin Weathers was opened by Chairman Banks. Chairman Banks asked if there was
anyone present who opposed the mobile home park. Many of the citizens present
raised their-hands in opposition. Mr. Hobein who resides at 906 Hopkins Road
said he does not want to live next to 4railer park. He -stated that the
residents who are affected by the mobile hone park never received notice of the
zone change. M= Dot Thompson who resides at 926 Hopkins Road said she wanted
to come into the City but is very much against a trailer'park: Mr. Boyle said
that the area in question is farming land and he does not want to live next to
a trailer park. Attorney Bob Boyer was presnet representing Mr. Weathers.
Mr. Weathers approached the Planning Commission as a propoNent to the trailer
Park. He said there are more attributes than detiments to have &:trailak park
located in that area. With no further discussion, Chairman Banks ordered the
public hearing closed. Motion was made by Pinery, seconded by Lees to table
this issue to a study session to be held on June 3, 1975 at 7:30 P.M. '#ith all

Mr. Bob Barrows home occupation conditional use permit for an office to
conduct business was discussed by the Planning Commission. Adminstrator
Young read the requirements of Section 17.60.160 from the Central Point
Municipal Code:
A. The occupation shall be carried on within a dwelling or building
normally accessory thereto, only by members of 'th'e�sfamily occupying

the occupation conducted in such manner as not to give an outward
appearance nor outwardly manifest any characteristic of a business
in the ordinary meaning of the term.
C. No sign larger than one square foot in area identifying the business
shall be permitted except as required by law.
D. No occupation creating loud and unusual sounds, or causing smoke or
odors or other nuisances detrimental to the residential character of
the peighborhood shall be permitted.

stated that the minutes should show that this permit is for "office use only.,,
Discussion was held regarding the Iynn Haven Rest Home Plan Peyi.e*.r-;_Motion was
made by Griffin, seconded by Emery to approve the plans with the conditions
set forth by the City Staff and must comply with the Fire Marshal's report.

McManama., yes; Phillips, yes; Banks, yes. With all in favor, motion carried.
The Planning Commission discussed the 7-%11 Southland Corporation Store plan
review for 7-11 store to be located at the corner o ron s Meets.
Chairman Banks recognized Mr. Frank Pulver, representative for the 7-11
Southland Corporation. Motion was made by Curry, .seconded by Lees to accept
the plazib' rith thefdonditions set forth by the City Staff and to include to
the conditions traffic signs regulating turning movements and drainage facil
itites to handle run-off. Roll call vote: Cu�rgy,yes; Finery, yes; Griffin,
yes; Lees, yes; Loveland, yes; McManama, yes; Phillips, yes. Banks, yes.
With all in favor, motion carried.
The Pine Court Subdivision preliminary plat was brought up for discussion.
With no questions raised, motion was made by McManama, seconded by Loveland
to approve the preliminary plat with the recommendations made by the Staff.
Roll call vote: Curry, yes; Emery, yes; Griffin, yes; Lees, yes; Loveland,
yes; Phillips, yes; McManama, yes; Banks yes. With all in favor, motion
carried.

The Myra Lynn Subdivision final plat was brought up for discussion.
Since the final plat and 'improvement drawings were not submitted prior
to the meeting, this issue -was withdrawn from the agenda and will have to
be c�omtinued)at the next1regular:LPlanni.ng Commission meeting.
With no further business to be brought before the Planning Commission, a
motion was made by Lees, seconded by Loveland to adjourn until the next
regular Planning Commission meeting. With all in favor, meeting was
adjourned at 9:30 P.M.
