Chastain Building Inspector City of Central Point, Oxegon Planning Commission September 18, 1972 Subject: Tom Whittle 1. Corner Oak and Bigham Tax lots 6100 and 6101 in (;ak Knoll Sub- division. Tax lot 6101 was recorded sr.mll.er than what was presented at the time of the int Hal request for a building permit. It was recorded January 4, 1966 at .10 acre or 4356 square feet. At that time the City required a minimum lot size of 5000 square feet. By recording this lot differently then what he presented for building permit it left a minimum lot o£ 5227 square feet. We have an ordinance stating this is not allowable to create a legal lot by leaving an illegal size to do it. This lot was a lot of an approved subdivision. (Oak Knoll subdivision) Zone R-3 required by 1967 zoning ordinance of lot area of 6000 square feet, 7000 square feet on corners with 20 feet front, 5 feet on sides, and 10 feet rear yard and 20 feet on all abutting streets. City Ordinance 10-3 IV 4.080 - undersizing is allowable provided it complied with all ordinance when it was recorded. Also see Ordinance 10-2.27 and 10-2.34 Now he wishes to be allowed to build on this regaining lot and will need to apply to Planning Commission for a variance for his back yard to be smaller so the house will fit. Mr. Whittle discussed with the Commission the problem of construction of a dwelling on an undersized lot at the corner of Oak and Bigham 2-22-66. Undersize lot and house has been sold, a legal lot remains. 2. Case 37 219 11BA Tax lot 821 - 20 Ashley Place - August, 1968. Built his foundation on City property. Planning Commission 2-24-64 - lot 1 block 2 undersize so City sold triangular piece to Whittle. 3-03-62 - Council minutes agrees to sell triangular piece to Whittle. 3. At 320 and 322 North First Street - was to build a duplex. Permit Februaxy, 1965, started building March 1966. Built two houses and planned to split the 140 x 55 lot but Building Inspector caught it and Whittle was forced to connect them by a garage thereby making it a duplex again as he had stated he had intended when applying for the building permit. At Planning Commission meeting 2-22-66 - Wanted a second dwelling on lot at N.E. corner of First and Maple. Lot in question was not approved. 4. 111 and 129 South Sixth Street divided one city lot and created two lots in 1961(1) 78 x 55 and ,(2) 62 x 55 (37 2W 2CC, #10600 and #lOgO0 tax lots). The building permit showed . a lot size of 80 x 55 for tax lot 10600 - 111 South'Sixth Street; and then Whittle recorded it at 78 x 55 lot size. 5. 195 Bigham Drive, Oak Knoll Subdivision at Chestnut and Bigham - In March 1963 a 70 x 130 lot building permit issued then changed and recorded to two lots one 60 x 55 ; and one 70 x 76 lot created in 1967. 6. August 23, 1965 minutes - Whittle deeded to the City Seventh Street portion along Came Commission property. He insisted on variance of set back so he could build more houses.
