May 16, 1972
Meeting was called to order at 8:10 P.M. by Chairman Backes. Present
were Banks, Bradshaw, Mills, McManama, and Chairman Backes. Absent were
Hull, Burton, Dixon and one vacant'.
A public hearing was held as advertised and noticed on the applicatim of
Lawrence L. and Nora M. Kottke, 261 North Fourth Street for a Conditional
Use permit to conduct a business as a doll hospital at that residence.
Letters for approval from Mr. and Mrs. C.W. Thompson, 438 Maple Street,
Emily Glass, 322 North Third Street and Eunice Jones, 235 Laurel Street
were noted. There were no comments from members of the audience, wo
nor members of the Commission. The hearing was
closed and a brief discussion held reviewing all information on hand. On
a motion by McManama, seconded by Banks and a unanimous affirmative vote
of the Commissionmembers present, the Conditional Use permit was granted.
Three petitions for annexation to the City which were referred by the City
Council for recommendation as to desirability and recommended zoning were
next considered. The petitioners were the owners of the Anhorn, Lamb and
Kincaid properties situated on Freeman Road (east side just south of Pine
Street. After a general discussion it was deteffined that the annexations
were reasonable and desirable and since these properties adjoin property '
presently in the City and zoned C-4 (Commercial-Tourist) , and were only
two properties away from the property of Harry Elmore which was zoned
C-4 with a conditional use as a Mobile Home Park, it was reasonable that
these properties be zoned C-4 (Commercial-Tourist). Motion by Banks,
seconded by Mills and unanimous affirmative vote of Commission members
present confirm this recommendation.
Next item on the agenda was delayed to allow Dan Hayes, 632 Manzanita
Street a clarification as to whether he could conduct a home occupation
as an upholsterer at that address. After discussion of the request, the
circumstances and the ordinance provisions, it was decided that the loca-
tion being in a C-4 (Commercial-Tourist) zone complied with the purpose
of the Zone. It is 1/2 block from C-3 (Commercial-General) and was not
an objectional use of the property. On a motion by Banks, seconded by
McManama and affirmative vote of Commission members, it was decided to
allow the use as a permitted use for 90 days to allow clarification of
the situation by the City Attorney at that time (approximately August 15,
1972) ; the business will be terminated or reconsidered for continuance.
The matter of requests of the City to allow fences in the zoning setback
area was discussed. This referred to fences to be constructed as view
barriers rather than being a part of an enclosure or property boundary
determination. After a general discussion, it was the general consensus
that the fence ordinance as presently constructed should prevail. This ,
information will be relayed to those making the inquiry.

The City Administrator made a brief verbal report on the implications that
a street breaking moratorium would place upon utility companies. Since a
report was not specifically requested by the City Council, a decision was
continued until additional information can be obtained.
It was noted that the Jackson County Planning Staff would be in attendance
at the joint meeting of the City Council and City Planning Commission to
discuss the Jackson County General Land Use Plan. All are urged to attend.
