HomeMy WebLinkAboutJuly 29, 1971 Planning Commission Regular Meeting July 29, 1971 The meeting was called to order by Chairman Byron Backes at 8:00 P.M. Present: Commissioners R. George, L Burton, M. Hull, R. Novasad, and Chairman B. Backes, Absent: Commissioners B. McManama and H. Tally. By common consent of those members present, the Minutes of the regular meeting held June 29, 1971 and mailed to each member was approved as mailed. This being the date, time and place for a public hearing .on the applica- tion of Dale Bartley, 920 East Pine Street, Central Point, Oregon for a Conditional Use Permit to allow a custom meat cutting, wrapping and inci- dental retail sales from that location which is in a C 74 (Commercial-Tourist) Zone; the hearing was opened by Chairman Backes. Mr. Bartley was called on by the chair to explain his application and describe the proposed opera- tion. Comments from those in the audience was then called for by the chair. Mr. "Swede" Wernmark, 140 North Sth, spoke to the effect that he was against any encroachment into the present zone and was also against rezoning; and alluded to the undesirability of a "jerry-built" building when converting residence buildings to commercial use. Mrs. W. Vern Kight, 917 East Pine ' Street, then voiced her opposition because of the potential dangers. of additional flies caused by the operation. Mrs. Ruth Johnson, 90 South 9th Street ' : , ;:i., indicated her opposition because of the potential increase in the number of flies and her belief that there was not sufficient room on the lot for the proposed operation. Mr:.Don Turner, 86 Freeman Road, indicated he had no objection to the issuance of a conditional use permit and conveyed the same feeling for a Mrs. Clark living on Freeman Road who was out of the City. Mr. Lewis Cox, 117 Rachel Drive, Mr. & Mrs. Max Burd, 1014 East Pine Street; M. H. Parson, 58 Bigham Drive, and Mrs. Don Turner indicated that they had no objection to the issuance of a conditional use permit for the operation as proposed. After invitation for additional com- ments from the audience and none appeared, the hearing was declared closedd* by the Chairman. After considerable discussion of the good and bad features of the granting of the permit and thorough discussion of alternatives, a motion was made by Commissioner Hull, seconded by Commissioner Burton, that the application be denied as the granting would be "poor" zoning and would encroach upon the residential development of the area which, for all practi- cal purposes, was complete-- at the same time, the permitted uses for the C-4 Commercial-Tourist) Zone was also not compatible with the present development of the area. At this same time, it was pointed out that there was an apparent need to redefine the permitted uses in the C-4 (Commercial- Tourist)}Zone was also not compatible with the present development of the area. Roll call: Affirmative, Commission all. The request of Al Marrs, Agent for Northwest Printed Circuits, for a variance from the Building Code to .allow a 10-foot marquee 40 feet long instead of the authorized maximum length of 25 feet was continued to the meeting of August 31, 1971; because of the absence of Mr. Marrs. Consideration and discussion was then held on the referral to the Commission by the Central Point City Council regarding the problems of an excessive number of dogs and kennels within the City and the Police and legal problems inherent thereto . On a motion by Commissioner Burton, second by Commissioner Hull and an affirmative vote of all commissioners present, the Commission recommends to the Central Point City Council: "That Ordinance No. 893 (10-3, Article 1, Section 1.030 - "Definitions (12) ) be amended to define a kennel as any lot or premises on which four or more dogs and/or cats at least six months of age are kept, boarded, or trained whether in special buildings, runways or not. 10-3 Article III, Section 3.090 (3) should be amended to provide for a kennel as a "Limitation on permitted Uses" as a conditional use (M-1 or Industrial Limited District) . 10-3 Article III, Section 3. 100 (4) should be amended to provide for a kennel as a "Limitations on permitted and conditional uses" as a conditional use (M-2 or Industrial General District) . Ordinance 443 (5-3.5) should be amended to define a kennel and indicate that such is not permitted in the City except as a conditional use in an M-1 - Industrial Limited District or M-2 - Industrial General District Zone. A kennel in any other City Zone should be classified as a nuisance." The matter of a period of time necessary to abate present circumstances which would be in violation of these recommendations should be referred to the City Attorney for his opinion. It is suggested that the City Attorney inform the City Council of the steps necessary to accomplish these changes if same are acceptance to the City Council. City Administrator Hutton presented details of H.B. 1801 also known as "Oregon Motorists Information Act of 1971" which had too recently been received to be acquainted with the details. This in general relates with outdoor advertising signs in the State of Oregon including the cities. This matter was continued to the regular meeting to be held August 31 , 1971. Discussion of a new meeting date was held due to the fact that the Central Point City Council will be meeting on the 2nd and 4th Tuesdays starting with the Month of August. It was decided not to change the date and time at this meeting and conduct the August meeting with the City Council; if this be their desire. Editor's note: City Council Meeting will be on August 24, 1971, the regularly scheduled Planning Commission Meeting would be held on August 31,, 1971.) Chairman Backes suggests the Commission meet with the City Council on August 24, 1971 and dispense with the regular meeting of the Commission on August 31, 1971. R.W. Hutton Acting Secretary
