This contract, made and entered into this lb day of �w� u 2012, by and
between the CITY OF CENTRAL POINT, OREGON, hereinafter called the "OWNER", and
Pacific Pipeline, Inc., hereinafter called the "CONTRACTOR".
WITNESSETH;
Said Contractor, in consideration of the sum and/or unit prices to be paid to him/her by the
Owner, and of the covenants and agreements herein contained, hereby agrees, at his own proper
cost and expense, to do all work and furnish all materials, supplies, supervision, labor, tools,
equipment, transportation and incidentals, and shall pay all applicable taxes and fees necessary
for the completion of the construction of the Peringer Road to Bear Creek Waterline Extension
in the City of Central Point, Oregon, for said Owner, to the extent of the Proposal, with unit
prices filled in made and submitted by the Contractor on the 10`t' day of July, 2012, all in full
compliance with CONTRACT DOCUMENTS, which includes: The Advertisement for Bids, the
Information and Instructions for Bidders, the Bidders Proposal and the Bid Bond, the
Performance and Payment Bond, the General Conditions, the Special Provisions, Special
Specifications and the applicable portions of the City's Public Works Standard Specifications
and Details, included herewith, and in accordance with the Plans prepared by Public Works
Management for the City of Central Point, Public Works Department, dated Summer 2012,
entitled: Peninger Road to Bear Creek Waterline Extension which Plans and aforementioned
Contract Documents are hereby referred to, and by reference made a part of this CONTRACT
FOR CONSTRUCTION as fully and completely as if the same were fully set forth herein, and
are mutually cooperative herewith. In consideration of the faithful performance of the work
herein set forth, and in accordance with the directions of the Engineer, and to his satisfaction as
provided herein, the Owner agrees to pay to the Contractor the amounts bid in the Proposal,
$334.689.00, adjusted in accordance with the General Conditions, and to make such payments in
the manner and at the times provided for in the General Conditions.
Before starting work, the Contractor and subcontractors shall each file with the Construction
Contractors Board, and maintain in full force and effect, a separate public works bond, in the
amount of $30,000.00, unless otherwise exempt, as required by ORS 279C.836 and
OAR 839-025-0015. The Contractor shall verify subcontractors have filed a Public Works Bond
before the subcontractor begins work.
The Contractor agrees to complete the work within the time limits as specified herein and to
accept as full payment the amounts set forth in the Proposal and computed in accordance with
the Contract Documents.
It is agreed that the Contractor shall complete the work in all respects by the following schedule:
Complete all work by September 15, 2012.
In the event the Contractor shall fail to complete the work within the time limits or the extended
time limits agreed upon, liquidated damages shall be paid to the Owner in the amount of $250.00
per day until the work is completed as set forth in the Contract Documents and to the satisfaction
of the Engineer. Sundays and legal holidays will be excluded when determining days in default.
The Contractor agrees to hold harmless the City from, and to repair and replace (as directed by
the City's Public Works Director) any and all defects and deficiencies which develop in
workmanship and/or materials for a period of one (1) year or as stated in the special
specifications after the date of the written notice from the Engineer of the final acceptance of the
project by the City.
