Reciitals
Whereas, A g~nerai city election was held on November 4, 2008, during which
time legal voters- of the City of Central Point considered the election of City
officers;
Whereas, Pursuant to state law, the Jackson County Clerk was the official
election officer -for the City and has certified the results of said election, said
certification having -been issued on the 24"d day of November, 2008, which is
attached to this resolution as "Exhibit A"; and
Whereas, The City Charter requires that the City Council meet and canvass the
returns of said election a#-the first regularly, scheduled meeting following receipt

City Council Study Session
November 18, 2008
I. MEETING CALLED TO ORDER
Mayor Williams palled the meeting to order at 6:00 p.m.
II. ATTENDEES Mayor: Hank Williams
Council Members: Dick Halley, Matt Stephenson, Bruce Dingier,
Kay Harrison, Mike Quilty were ..present. Walter Moczygemba was
absent. Council Elect Carol Fischer and Allen Broderick were also
present.
City Administrator Phil Messina; Interim Community Development
Director Matt Samitore; Assistant Public Works Director Chris
Clayton; Planning Technician Dave Jacobs; and City Recorder
Deanna Casey were also present.
BUSINESS
A. Transportation Systems Plan
Interim Community Development Director Matt Samitore and Planning Technician Dave
Jacobs provided an overview of the Transportation Systems Plan (TSP). The Council
needs to be in agreement with the goals and objectives of the TSP. This is intended to
be a living docurent and will be reviewed on a regular basis. This document would be
used to defend Founcil decisions on land use litigation.
Mr. Jacobs stated that this is a draft copy. Changes can be made prior to council
adoption. The TSP is intended to be a living document with regular updates.
Chapter 1: looks at what we have now. The TSP Strategic Plan, Urban Reserve,
Regional Transportation plans have all been included in this document. Chapter 1
explains the public involvement portion and approval process.
Chapter 2: explains the how the TSP is consistent with all applicable federal, state,
regional and IoGal transportation plans.
Chapter 3: acknowledges the relationship within the city's Comprehensive Plan between
land use and transportation planning. There are four elements in the Comprehensive
Plan that have a noticeable impact on transportation planning. Those elements are the
Land Use Element the Population Element, the Housing Element and the Economic
Element. Chapter 3 explains how the TSP links these elements together.
Chapter 4: The Transportation Rule requires that all transportation system plans include
an inventory of existing transportation facilities and services by function, type, capacity,
and condition. This chapter inventories the condition of the City's existing transportation
system.
Chapter 5: Addresses-transportation management best practices. This explains the
opportunities' that are available to help manage our system.
Chapter 6: The contents of this chapter are intended to provide a basis for the
development and implementation of parking, regulations for the City, of Central Point. It
addresses objectives and strategies for the management of the City's parking supply
and integrates land use planning and best practices.
Chapter 7: Explains the street system which contains over sixty miles of roadways
serving a variety ofi functions ranging from local streets, collectors and arterials providing
a broad range of transportation services for the City's residential, commercial, and

industrial needs. Chapter 7 talks about the intersections that are key to traffic flow, which
ones will survive and which ones will need to be replaced.
Chapter 8: The goal of this chapter is to provide guidance in developing transportation
alternatives through-the design and implementation of a comprehensive, convenient,
accessible and safe system of bike and pedestrian ways throughout the City.
Chapter 9: This chapter explains-how public transit will be incorporated into the TSP. It
explains the incorporation of RTP; RVTD, and strategies for improvement to the systems
that are currently available.
Chapter 10: Explains options available for Central Point regarding railroads and aviation.
Although those options are not currently a transportation element in Central Point there
could be future.. use.
Chapter 11: Efficient truck movement plays a vital role in the City's transportation
element. The establishment of truck routes provides for efficient movement while at the
same time maintaining livability, public safety, and minimizing maintenance cost of the
roadway system.
Chapter 12: This_chapter presents the city's financing program. Expense and revenue
estimates presented in this chapter are in terms of 2008 dollars. Funding has been
estimated. over the duration of this TSP.
Conclusion: This plan is tied to growth and receiving state and federal grants to help
ficance the projects listed in it. Staff will return to Council in December
with an Ordinance to adopt the Central Point Transportation System Plan
2008. - 2030..
B. Central Point Gas Tax
Assistant Public Works Director Chris Clayton explained future programs, problems,
needs and goals of the Street Fund. Staff would like to introduce a .03 cent local gas tax
for Central Point, He explained the street life cycle; which streets are the worst in the city
and how much i~ will cost to make improvements to those streets. The current street fund
revenue from the state is not enough to cover Central Point's street preservation and
maintenance needs. A lack of revenue has created a backlog. of deferred maintenance
that will be more costly to repair at a future date.
Mr. Clayton explained the current resources of revenue that can be used for street
maintenance and repair are State gas taxes, street utility fee, and System Development
fees. Property taxes are not used for ongoing maintenance of Central Point streets.
The State of Oregon currently charges a .24 cent per gallon gas tax and is projecting a
.02 cent increase. He explained that 30 gallons of gas produces $7.20 in State tax. This
tax is distributed according to population. Below is the breakdown of where that tax gets
distributed:

Central Point receives less than 1 penny for every dollar of state gas tax. If Central Point
were to impose a local gas tax of 0.03 cents per gallon the entire amount would go into
the Central Point Street fund. He explained current revenue for gas stations around the
valley. He explained average driver annual gas consumption and local gas tax
payments. He expects the average Central Point Citizen to pay $16.80 annually on a .03
cent local gas tax. The estimation of the local gas tax is $500,000 annually.
There was discussion about adjusting the Street Utility Fee for Central Point residents.
Staff is not in favor of eliminating the fee if the Local Gas tax is implemented. They
would like to see a reduction of the fee over two years. If the utility fee is eliminated and
we do not receive the expected amount in the gas tax we would be in worse shape than
we currently have.
There are several cities in the State that have local gas tax. He presented the list of
cities and their annual cevenue_for 2002-2003.
Mr. Clayton presented the five year capital construction plan:

The City of Central Point needs to create our own solutions to preserve area streets and
control the fate pf our transportation system. We cannot continue to rely on the State gas
tax.
There was discussion regarding the Street Utility Fee. Some Council members would
like to see the utility fee go away completely. once the local tax is in place. They are
concerned with the fiact that during the public portion of adopting the Utility Fee they told
the citizens that if other options were found they would revisit the Utility Fee. Staff is
concerned that the revenue from the gas tax will not be enough to complete the projects
that are listed above. With the addition of the street utility fee, and the water franchise
fee we should be able to complete the five year capital construction projects.
Staff suggested that upon adoption of the local gas tax the street utility tax would be
progressively reduced by 1/3 each year until it was gone, as long as the local gas tax
brings in the revenue we anticipate. Council approved of this idea for residential only.
The businesses woultl still be charged the full amount of the utility fee. Revenue from the
gas tax would be tied to the TSP and projects indicated in that document.
Conclusion: Staff will return to the December 16th Council meeting with more
discussion on the local gas tax. At that time he will explain the revenue
-projections of the utility fee reduction.

Chapter 5.33,;whfch is to read.as follows:
Chapter 5.33
MERCHANT POLICE AND PRIVATE DETECTIVES
5.33.010 Definitions.. For the purposes of Sections 5.33.010 to 5.33.170,
the following terns, phrases, words, and their derivations shall
..have the following meaning:
(1) "Shall", is always mandatory and not merely directory.
(2) "Private detective" is a person who accepts employment-for
hire, fee, or. reward to furnish or supply information as to
the personal character or actions or identity of a person or
as to the character or kind of business or occupation of a
person. The term shall not include within its meaning a
private investigator employed exclusively by one employer in
connection with a business. Nor shall it include a detective
or officer belonging to the la ;a enforcement agencies of the
United States or of any state, county, or city. Nor shall i*_
. include any insurance adjuster licensed by the State of Oregon
when the adjuster is operating in the capacity of and for
' adjusting of insurance for any company whatever... -
(3) "nerchant police" meana any firm, person, partnership, or
corporation engaged in the business of watching, guarding, or
protecting premises, property, or persons; provided, however,
that the-terms shall not include any individual who has only
one employer and who is employed to watch, guard, or protect
only the premises property, or person of that employer, or
any common carrier engaged in interstate commerce, or any
individual employed by such carrier or carriers to watch, guard,
or protect premises, property, or peasans for such carriers.
(4) Armored car service means any firm, person, partnership, or
corporation engaged in the business of transporting cash or
other valuables by means of armored cars; provided, however,
that term shall not include any armmored car service while
engaged in interstate commerce.
(5) Safe and lock companies means any firm, person, partnership,
or corporation engaged in the sale,. service, repair, or main-
. tenance of safes and locks; provided that for the purpose of
this definition the term "locks" includes only those, locks used
in connection with safes.

5.33.040 Investigation by the Chief of Police. Within 15 days after recQipt
of an application as provided for hereiny the Chief of Police shall
cause an investigation to be made of the applicant and his proposed
operation.
5.33.050 Standards for Issuance of License. The Chief of Police shall issue
a license hereunder when he finds:
(1) That the applicant has never been convicted of a felony or any
misdemeanor involving acts questionable to applicant's character
and integrity. ..
(2) That the applicant is a natural born or a fully naturalized
citizen of the United States. '

5.33.060 Standards Applicable to Lmalovees.
All employees of any person
having or applying fora license hereunder shall meet the
standards set forth in Section 5.33,030 above and shall be subject
to all regulations of Sections 5.33.010 to 5.33.170. In the case
of a safe and lock company, the requirements of this sections shall
apply only to those employees who actually engage in the repair,
maintenance, adjustment, setting or installation of safe locks
and safes,
5.3.3.070 Notice of Rejection. The Chief of Police shall act .upon the
application within 30 days after the fi-ling thereof. If"the Chief
of Police disapproves the application, he shall mail to the
applicant within 35 days after the date upon which the application
`` was filed a natice of his action, stating the reasons for his
denial of the permit..
5.33.080 Appeal Procedure.;: Any person aggrieved shall have the right to
appeal the denfal or revocation of a. private detectives license
or a merchant patrolman~s license to the City Council.:.,
5,33,090 License Fee. A license shall be issued to each successful applicant
upon payment. of a license fee of $15.00, The license fee shall be
.the same whether for a portion of a year or the whole thereof,
.5.33.100 Conditions of Licensin
(1) Transferability. Licenses issued hereunder shall nbt be
transferable. .
(2) Revocation and suspension. Licenses issued hereunder shall be
subject to revocation or suspension by the Chief of Police for
,violation of any of the provisions of Sections 5.33,Oi0 to -
5.33.170"or misconduct by the licensee or his employees, after
reasonable notice and an opportunity to be heard has been given
the licensee. The Chief of Police shall immediately notify
any licensee, by personal seryice~-or such suspension or revocation.
(3) Renewah, The Chief of Police shall issue renewal licenses to a11:
licensees whose licenses have pat been suspended at the time
said licenses have expired,' upon payment of the license fee.
(4) Term of license. AlI licenses issued hereunder-shall be for a
term of one year, from January 1,to December 31 of each year.
5.33,110 Bond Required.
(1) No license shall be issued hereunder unless the applicant files
,- with the city a surety bond executed by such applicant with two
or more sureties, or by a surety company authorized to do
business"in the State of Oregon in the sum of $2,000.00, or arch
other"financial security as may be approved by the city attorney
of the city, conditioned upon the careful, faithful, and honest
conduct of the services to be performed by the applicant or his
employees. Such bond shall be approved by the city attorney of
the city as to form, execution and sufficiency of sureties.
(2) The bond or approved security required herein shall be taken in
the name of the people of the city, and every person injured by
the negligent, willful, malicious or wrongful act of the prin-
cipal, his agent, servant, or employee, in the conduct of
business or private detective or merchant patrpl., may bring an
action on the bond in his own name to recover damages for such .
negligent, willful, malicious, or wrongful act.
C3) The Chief of Police shall suspend any license. when the. bond
_ or other approved financial security required herein shall
have lapsed or is reduced by reason of a judgment thereon,-
- or for-any other reason is no longer in full force and e~Efect.
. 5.33.129 Promulgation of Regulations by Chief of Police. The-Chief of
Police shall have the authority to enact and enforce reasonable
rules and regulations for the operation: of private detectives and
merchant patrolmen in the interest of the public safety, morals,
and welfare and to .effectuate the general purpose of Sections
5.33.010 to 5.33,170.
' 5,33:.130 Information and. False P,eports. No private detective, merchant
patrolman, armored car service, safe and lock company or burglar
alarm salesman holding a license granted under the provisions of
Sections 5.33.010 to 5.33.170 shall divulge to anyone other than
his employer, except as may be required by-law, any information
obtained by'.him in such employer's service. No private detective,
merchant patrolman, armored cer service, safe and lock company or
burglar alarm salesman holding a license granted under the provi-
sions of .Section 5.33.Oi0 to 5.33.170 shall make a false report or
account to his employer.
5,33.140 Notice of Employee's Status Change. Within three days of_the
,termination of employment of any employee or other person of any
lfcensee, notice of such termination shall he given by the licensee
in writing to the Chief of Police. Failure to comply with this
section shall result in reIIOCation of the license of private detec-
tive, merchant patrolman, armored car service, safe and lock company,
ar burglar alarm sale~rnan.
5.33.150. Subsequent Revocation._ If at any time new facts arise or become
- known to the. Chief of Police which. would be sufficient to warrant
refusal or withholding of a licensee under the terms of Sections
5.33.010 to 5.33.170, the Chief of Police shall notify the licensee-
of the facts and further inform the licensee that unless the same
are satisfactorily explained and Section 5.33.010 to 5.33.170

5.33.160 Liniforms. No licensee regulated by Sections 5.33.010 to 5.33.170.-
and not a member of the police or fire department shall wear a
uniforms a cap, badge, or buttons at the time in use by the members
of the police or fire departments. A person desiring to provide goy.;
service regulated by this chapter shall use no distinctive uniform,
cap, badge, or buttons to be worn. by any:-.such person or employee
thereof until the form, design, and color thereof shall have been
first submitted to and approved by the Chief of Police.
5.33.170 Carry and Post License Certificates. The licensees hereunder shall
cause a certificate of such. license to be displayed at all times in.
a conspicuous place in or on his-place of business described in suoh
license. The licensee and his employee shall carry on his person
at all times when performing services as a licensee under this chapter
a certificate of the license issued hereunder. The license hereunder
shall furnish to the Chief of Police a current list of all employees
employed by him at all tines,
The Council hereby finds that an emergency is declared to exist
affecting the health and welfare of the City of Central Point and this ordinance
is hereby declared to .take effect upon its passage. ~ -.
