ROLL CALL: Mayor: Bill Walton Council Members: Duane Christensen, Garth Ellard, Carol Fischer, David Gilmour, Donna Higginbotham, and Bill Stults were all present. City Administrator Jim Bennett; City Attorney Doug Engle; Public Works Director Lee Brennan; Finance Director Bill Brugger; Police Chief Mike Sweeny; Building Official Lois DeBenedetti; Planning Director Tom Humphrey; and Administrative Secretary Deanna Gregory were also present. III. PLEDGE OF ALLEGIANCE IV. INTRODUCTION OF GUESTS V. MINUTES A. Approval of January 7 1999 City Council Minutes Garth Ellard made a motion to approve the minutes as presented. Carol Fischer seconded. ROLL CALL: Motion passed unanimously.. VI. PUBLIC APPEARANCES Bill Johnson 8464 Carolina Drive, Central Point, OR Mr. Johnson expressed his concerns regarding the over crowdin~ of the schools in District #6. He o es that the Council and the School board wi I be able to work together to solve this problem. Chuck Root from BCVSA Mr. Root stated that he looks forward to another successful year working with Council and City Staff. Mayor Walton closed the Public Appearances portion of the meeting. VII. BUSINESS A. Transit Oriented Design Presentation (RVCOG) Dan Moore ftom the Rogue Valley Council of Governments explained the Transit Oriented Design (TOD) and Transit Corridor Development Strategies for the Rogue Valley Transportation District. He explained that Transit Oriented Development describes development influenced by and oriented to transit service, and responsive to the market created by transit patronage. Elements of TOD projects include good pedestrian access, moderate to high density housing, and mixed uses such as offices, retail businesses and services, all concentrated within strategic areas linking the transit system. The concentrating of development at or near transit stations decreases our dependence on automobiles reducing air ppollution, traffic congestion, and curbs urban sprawl. Creating an environmentwherepenple can live, work, shop, and be entertained within walking distance of each other decreases our dependence on the automobile. Appointments to Planning Commission, Park Commission, Citizens Advisory Committee and the Budget Committee (Bennett) City Administrator Jim Bennett explained that he received letters of interest for the following vacancies: Planning Commission: Paul Lunte, Nancy Ihde, Wayne Riggs, Mik Johnson, and Earl Mix. Park Commission: Council Member Carol Fischer Budget Committee: Michael Quilty Citizens Advisory Committee: David Martin David Gilmour nominated Paul Lunte to the Planning Commission. Donna Higginbotham seconded. Carol Fischer nominated Earl Mix. Motion died due to lack of a second. Roll call: Duane Christensen, yes; Garth Ellard, yes; Carol Fischer, abstain; David Gilmour, yes; Donna Higginbotham, yes; and Bill Stults, yes. David Gilmour nominated Carol Fischer to the Park Commission. Garth Ellard seconded. Ordinance No. 1800, An Ordinance Amending Chapter 2.04 of the Central Point Municipal Code Regarding City Council Meetings (Bennett) Administrator Bennett presented the proposed ordinance for first reading. The present ordinance establishes the regular meeting date ofthe City Council as the third Thursday of each Month. Presently the Council also meets on the first Thursday. The proposed ordinance changes the regular meeting dates of the City Council to the second and fourth Thursdays of each Month. David Gilmour seconded. Roll call: Duane Christensen, abstain; Garth Ellard, yes; Carol Fischer, no; David Gilmour, yes; Donna Higginbotham, yes; and Bill Stults, yes. Motion carried. D. Census 2000 Proclamation (Bennett) Administrator Bennett explained that the 2000 Census is vital to our community in that it determines the apportionment of seats in the United States House of Representatives, our state legislature, and is the basis forthe allocation of billions ofdollars of Federal, State, and County funds for social and other programs. The proposed proclamation states that the City of Central Point is committed to a full and accurate census count. Carol Fischer made a motion to adopt the Proclamation declaring Census 2000 a - priority in Central Point. David Gilmour seconded. ROLL CALL: Motion passed unanimously. E. Liquor License Application for Ivy's Cafe (Bennett) Council Member Duane Christensen withdrew from the discussion stating conflict of interest. Administrator Bennett explained the location of Ivy's Cafe. He stated that this is a new application for a liquor license. There was discussion of concern for the number of establishments that are already serving liquor within a two block radius on Pine Street. Mayor Walton opened the discussion to the public. Larry Thornton, Center Cafe - Mr. Thornton is concerned with the safety of his customers. He stated there are plenty of liquor serving businesses downtown now, and the Council should not approve this application. Mr. Thornton stated that the kind of clients that this type of establishment attracts contribute to litter, gambling, and vandalism. Louise Dunn, Central Point Beauty Salon - Ms. Dunn stated that she is also concerned with the safety of her clients and herself. She said that she often works late hours and worries about intoxicated people roaming around when she is leaving. She reminded the Council of Goal #1 from the Strategic Plan: To enhance the downtown area to make it a place where residents and visitors can conduct consumer activities in pleasant, inviting surroundings. She asked that the Council deny the application or postpone it until the City Attorney can recommend an alternative course of action. Glenna Thornton, Center Cafes -Asked if it would be possible for the City to deny the business license. There was discussion on safety along Pine Street, and the options available for Council to take regarding this situation. Council members stated that they would like to see Ordinances controlling the number of liquor establishments in the downtown. Carol Fischer made a motion to deny the Liquor License application for Ivy's Cafe. Bill Stults seconded. Roll call: Duane Christensen, abstain; Garth Ellard, yes; Carol Fischer, yes; David Gilmour, yes; Donna Higginbotham, yes; and Bill Stults, yes. Motion passed. F. Addition to City Historic Building Inventory (Humphrey) Planning Director Tom Humphrey presented a request from Deana Sims to add a house located at 434 Manzanita Street to the City inventory of significant historic buildings. The Leever house was built in the 1890s and meets all the criteria for historic designation. Donna Higginbotham made a motion to approve the addition of the Leever House in the City's historic building inventory. Garth Ellard seconded. ROLL CALL: Motion passed unanimously. G. Building Department 2"d Quarter Report (DeBenedetti) Building Official Lois DeBenedetti updated the Council on current construction projects around the City explaining that several of the new residential subdivisions will be built in phases over the next 3 to 5 years. She stated that the number of residential building permits issued each year has stayed relatively the same over the last five years. H. Department Reports Finance Department - Finance Director Bill Brugger presented the six month financial report. Planning Department - Planning Director Tom Humphrey reported on: • the recognition of the Downtown Revitalization Plan by local media. • the meeting of the Community Response Team on 1/14/99 and its recommendation for a Farmers Market to be located in Central Point. • Rite-Aid Corporation's request to vacate a portion of 9th~Street. • the progress School District #6 is making in redrawing the boundaries for District schools. Police Department - Sgt. McPherson reported for Chief Sweeny who was out of town at a seminar. • There will be more officers doing establishment walkthroughs in orderto be more visible to the downtown merchants. VIII. CITY ADMINISTRATOR'S REPORT City Administrator Jim Bennett reported that: • the City Administrator, Planning Directorand Police Chiefwill be participating in a Jr. Achievement program and visiting Elementary Schools to talk about City Government. • a few local committees have requested alternate members be appointed in the event the appointed individual can not make the meeting. Council appointed Tom Humphrey to RVACT, Bill Stults to Sewer Rate Committee, and Carol Fischer to Greenway as alternates. • a grand opening is scheduled for February 1, regarding the new addition to the RV Manor and all Council Members are invited. • he introduced the idea of a regional sports park at the Fair Board meeting last week. • a consensus has been reached by all property owners regarding the 1St Street ROW vacation. He stated that a 50/50 split has been agreed upon with the property owners and staff is ready for a recommendation from the Council on how they would like to proceed. • there have been several situations regarding street trees in the ROW. He suggested that the Council consider a program for Street Tree Planting. It was suggested that the municipal code be revised regarding trees in the right-of-way. • Jackson County Commissioners have approved Order No. 6-99 adopting a policy regarding jurisdiction of county roads, main roads, and local access roads within urban growth boundaries and city limits. This Orderwill require each city to request road jurisdiction at the same time that land is annexed into the city. He explained the impacts this will have on the city. Council Member David Gilmour presented the following proposals: David Gilmour made a motion that City Staff research and bring back to Council a proposal to control the numberof establishments in the downtown thatsell alcoholic beverages. Carol Fischer seconded. Roll call: Duane Christensen, abstain; Garth Ellard, yes; Carol Fischer, yes; David Gilmour, yes; Donna Higginbotham, yes; and Bill Stults, yes. Motion carried. David Gilmour made a motion that City Staff research and bring back to Council on April 8, 1999, a proposal to establish Storm Drain and Street Utility Fees with an exception for low income homeowners based on Oregon Health Plan eligibility criteria. David Gilmour made a motion that City Staff research and bring back to Council a proposal to exempt infill projects within the "historic" portion of Central Point from SDC's. Projects exempted would have to be architecturally compatiblewith historic neighborhoods. Bill Stults seconded. David Gilmour made a motion that City Staff research and bring back to Council a proposal to establish barrier and buffering standards for new development. Donna Higginbotham seconded. David Gilmour made a motion that City Staff research and bring back to Council a proposal to establish developmentstandards within the 100 & 500 year flood plains. Donna Higginbotham seconded. Council Member Donna Higginbotham reported on the Medford Water Commissionmeetivg. The Commission suggested that the City look into SDC charges to reserve water rights at Lost Creek Reservoir. Council MemberGarth Ellard reported ontheCentral PointChamberofCommercemeeting. He reminded the Council about the open house and invited all to attend. ~I Council Member Carol Fischer stated that all of the local committees keep the City informed without City Council or staff having to attend them. They are all good at sending out minutes and newsletters. Council Member Duane Christensen stated that he really appreciates the City staff and hopes that the staffwill not be overwhelmed by all of the new proposals that the Council is asking them to work on. City of Central Point City Council Minutes January 21, 1999 Page 6 X. MAYOR'S REPORT - Mayor Walton presented a copy of meeting dates for all the council members to have. He also gave them a listing of administrative staff telephone extensions. Council Member David Gilmour made a motion to continue past 10:00 p.m. Donna Higginbotham seconded. ROLL CALL: Motion passed unanimously. Lee Brennan presented the Council with a preliminary proposal for the creation of a regional park. Staff would like Council approval to present the proposal to the County. The site is located on Jackson County Expo property on Gebhard Road. The park would have soccer fields, baseball fields, basketball courts, play equipment, tennis courts, concession stands, a BMX bicycle track, skateboard park, nature trails and possibly an indoor pool. XI. ADJOURNMENT Garth Ellard moved to adjourn, David Gilmour seconded, all said "aye" and the Council Meeting was adjourned at 10:10 p.m. The foregoing minutes of the January 21,1999, Council meeting were approved by the City Council at its meeting of February 4, 1999.
