A RESOLUTION IMPLEMENTING A THREE-PERCENT (3%) CITY OF CENTRAL POINT WATER
SYSTEM FEE IN-LIEU OF LICENSE OR FRANCHISE
RECITALS:
A. Per City code, entities who operate a utility franchise in the City’s rights -of-way pay a
franchise fee or license fee for use of the City's streets, alleys, and public places based on gross
revenues, subject to limitations in other state or federal laws.
B. The City of Central Point owns and operates a municipal water utility which operates
within the City's streets, alleys, and public places.
C. On November 13, 2008, the City Council adopted Resolution No. 1195, establishing a
five-percent (5%) fee in-lieu of a license or franchise fee on the City's water system for a period
of ten (10) years. By its own terms, that fee terminated in November 2018 without further
action of the City Council.
D. Council has continued to charge the municipal water utility a fee for use of the City’s
rights of way as part of the City’s adopted budgets.
E. Council finds that the City municipal water utility should continue to pay a fee in lieu
of a franchise fee or license for use of the City’s rights -of-way and that the City would benefit
from adoption of a fee for future budgeting, rather than setting the fee each budget cycle.
F. Consistent with the City's Long-Term Financial Plan, the City Council desires to
establish the fee in-lieu of a license or franchise fee on the City's municipal water system at a
rate of three percent (3%) of gross revenue
THE CITY OF CENTRAL POINT RESOLVES AS FOLLOWS:
SECTION 1. For the right to operate in, upon, and under the right-of-way and street system of
the City, a fee in-lieu of a license or franchise fee is hereby imposed upon and shall be collected
annually from the Water Fund of the City, and shall be entirely dedicated to the Street Fund.
The fee shall be in an amount equal to three percent (3%) of the gross revenue from the water
charges collected within the City after deductions have been made for all outstanding Water
Fund debt service obligations.
SECTION 2. The fee established by this Resolution shall take effect July 1, 2027, and shall
remain in effect until amended or repealed by resolution of the City Council.
