REGULAR MEETING CALLED TO ORDER Mayor Walton called the meeting to order at 7:00 p.m. II. ROLL CALL: Mayor: Bill Walton Council Members: Garth Ellard, Carol Fischer, Bob Gilkey, David Gilmour, Donna Higginbotham, and Bill Stults were present. City Administrator Jim Bennett; City Attorney Doug Engle; Public Works Director Lee Brennan; Finance Director Bill Brugger; Police Chief Mike Sweeny; Planning Director Tom Humphrey; and Deputy Recorder Deanna Gregory were also present. II1. PLEDGE OF ALLEGIANCE IV. MINUTES A. Approval of December 9, 1999. City Council Minutes Garth Ellard made a motion to approve the minutes as presented. Bill Stults seconded. Roll Call: Motion passed unanimously. V. PUBLIC APPEARANCES Tim Robbins 610 Hopkins Road. Central Point, OR Mr. Robbins stated his concern about the curb in front of his home being painted yellow. He added that he did not receive any notice from the City regarding changing the parking availability on Hopkins Road. He stated that he has teenagers that will be dnving soon and will need more area for parking. Mayor Walton suggested that Mr. Robbins contact the Public Works Department regarding this issue. Mayor Walton closed the Public Appearances portion of the meeting. VII. BUSINESS A. An Ordinance Adding Two New Chapters to the Central Point Municipal Code Relating to Tobacco Retail Licenses and Smoking Restrictions, First Reading (Engle) City 4ttorney Doug Engle explained the proposed Ordinance. He stated that the ordinance would add a chapter to the Central Point Municipal Code requiring anyone who sells tobacco products to obtain a tobacco retail license from the City. It would be a violation of this chapter for any person, business, or tobacco retailer to sell any tobacco product by means of self-service displays of any means other than vendor-assisted sales, except for vending machine sales in taverns, cocktail lounges, industrial plants, or hotels and motels. Mr. Engle explained the penalties for violation of this chapter. City otCentra/Point City Council Minutes January I3, 1000 Page 1 Mr. Engle explained that the proposed Ordinance would place smoking restrictions on most public buildings with in the City of Central Point. He stated that with a few exceptions smoking would be prohibited in public places, places of employment, or within ten feet of the entrances to these places. He also explained the penalties for violation of this chapter. Mayor Walton asked the Council if any had a conflict of interest or ex-parte communications. There were no conflicts of interest and all ex-parte communications were disclosed. Each Council Member has had contact with citizens regarding the proposed ordinance. Mayor Walton opened the meeting for public input. Central Valley, Central Point • Jo Loveland, 711 Chestnut, Central Point • Bill Perry, Oregon Restaurant Association, Wilsonville • Elizabeth Weller, Central Point • Jon Thone, 3372 Freeman Road, Central Point The following people spoke in favor of the proposed Ordinance. • Casey Garett, Crater High School Student • Bob Kennedy, Jackson County Sheriff • Shaunna Steinmetz, 539 N. 6th Street, Central Point • Dr. Jon Gell, MD, 3311 Pioneer, Medford • Antone Pederson, 4269 Grant Road, Central Point • Dennis Richardson, 55 S. 5th Street, Central Point • Domica Rice, PO Box 254, Gold Hill • Natasha Taylor-Curtis, 301 Freeman Road #10, Central Point • Addie Weersma, 2845 Hanley Road, Central Point • Dr. Mike Robinson, MD Mayor Walton closed the public input portion of the meeting and asked the Council if they would like to add any information into the record. Council Member Bill Stults stated that he understands the concerns of the citizens who spoke regarding the right of people to smoke and allow smoking within their businesses. However, he feels that the overall health of the public is far more important. He stated that the government is required to provide clean water for citizens to drink, and they are also responsible to provide clean air. He feels this ordinance will help with that responsibility. Council Member Dave Gilmour provided statistics stating the overall health problems that tobacco use has caused. He feels that government needs to help provide a save environment for youth. Council Member Donna Higginbotham related personal issues relating to the health problems associated with tobacco use and second hand smoke. Council Member Garth Ellard expressed his concerns regarding the use of tobacco and second hand smoke. Council Member Bob Gilkey read into the record a letter from Wally Skyrman, a Central Point resident, in favor of the ordinance. He understands the concerns of the citizens who spoke regarding the rights of the people to use tobacco, but feels rights do not include harming others with second hand smoke. C [ ;. 0 City olCentra/Point City Council Minutes January 13,1000 Page 3 Council Member Carol Fischer stated that government should not be allowed to slowly take away the rights of the people. She stated that this issue should be brought before the citizens of Central Point in the November election in order for the Citizens to have a chance to voice their opinion at the polls. Mayor Bill Walton explained that, as the governing body of Central Point, it is the responsibility of the Council to protect the health of its citizens. He felt that tobacco use affects the health of all people exposed to it and therefore should be restricted. Garth Ellard made a motion to pass the proposed Ordinance Adding Two New Chapters to the Central Point lillunicipal Code Relating to Tobacco Retail Licenses and Smoking Restrictions to a second reading on January 27, 2000, with the following changes:1) the effective date of the Tobacco Retail Licenses chapter to be on July 1, 2000 and the effective date of the Smoking Restrictions chapter to be thirty days following adoption of the ordinance; 2) Section 8.11.020 (8) amended to remove the provision allowing performers to smoke when smoking is part of a stage or drama production. Bill Stults seconded. Roll Call: Garth Ellard, yes; Carol Fischer, no; Bob Gilkey, yes; David Gilmour, yes; Donna Higginbotham, yes; and Bill Stults, yes. Motion passed. B. Award of Bid for Public Works Shop Expansion (Brennan) Public Works Director Lee Brennan stated that City Staff had recently received three bids for the design and construction of a metal-sided building for expansion of the City's Public Works corporation yard and shop on Fifth Street. City staff is recommending that the contract be awarded to Adroit Construction Company in the amount of $187,000. David Gilmour made a motion to award the bid forthe Public Works shop expansion to Adroit Construction in the amount of $187,000. Garth Ellard seconded. Roll Call: Motion passed unanimously. C. Liquor License for Albertson's, Inc. (Bennett) City Administrator Bennett explained that Albertson's, Inc. is about to open a new supermarket in the City of Central Point. The supermarket operation will include retail package sales of beer and wine and will require a liquor license from the Oregon Liquor Control Commission (OLCC). Council approval is required for OLCC to approve the liquor license. The Central Point Police Department indicates that its files hold no information pertinent to the request for a liquor license. Garth Ellard made a motion to approve the Liquor License Application for Albertson's, Inc. Carol Fischer seconded. Roll Call:- Motion passed unanimously. D. Planning Commission Report (Humphrey) Planning Director Tom Humphrey presented the Central Point Planning Commission Report for the regular meeting on January 4, 2000: 1. Conditionally approved a site plan introduced by the Rogue Valley Council of Governments to remodel an existing commercial building for a change of use and also construct a 1040 square foot addition. The subject property is located at 155 North First Street in the C-5 Thoroughfare Commercial zoning district. Approval was conditioned upon the applicant complying with building code requirements and entering into an agreement with the City for shared parking at the senior center across the street. 2. Conditionally approved a tentative plan introduced by Elden Smith to partition a 1.70 acre tax lot into two parcels. The subject property is located on the north side of Pittview Avenue near its intersection with Sydney Court. The property is zoned City of Central Point City Counci/Minutes January 13, 2000 Page d R-1-8, Residential Single Family. Approval was conditioned upon the applicant entering into a deferred improvement agreement for both parcels and working with the City for storm drain and water master planning as further development is proposed in the vicinity. Donna Higginbotham made a motion to approve the Planning Commission Report for the regular meeting of January 4, 2000. David Gilmour seconded. Roll Call: Motion passed unanimously. E. Proposal for Central Point Branch of Jackson County Library (Bennett) Administrator Bennett explained that the Central Point Library representatives have asked to postpone this item and return to the Council at a later date. F. Department Reports Finance Director Bill Brugger presented the Financial Report ending December 31, 1999. He also stated that the Comprehensive Annual Financial Report for 1998/1999 has been completed and distributed to the Council. He explained that there were few adjustments made by the auditors. Planning Director Tom Humphrey reminded the Council of the study session with School District #6 representatives. He stated that the meeting will be held at Crater High School at 7:00 on January 18, 2000. He also reminded the Council of the TOD Open house to be held on January 19, 2000, at Mae Richardson Elementary School. He stated that Albertson's is scheduled to open on January 26, 2000, and the Valley of the Rogue Bank will be opening on January 31, 2000. VIII. CITY ADMINISTRATOR'S REPORT Administrator Bennett reported that: • City staff have been checking the creeks and trouble spots to ensure the smooth flow of water and to try to eliminate flooding problems. The Public Works Department has ordered sand bags in preparation for flood warnings from the National Weather Service. • the newspaper article regarding Station 7:8 providing classrooms for the School District was premature. He explained that Hope Christian Church will need to come to the Council for approval prior to any change in the lease agreement. He also stated that before the building could be used for classrooms it would have to be evaluated by the Building Department to determine if structural improvements are necessary. • the City has begun planning the new park to be located on Vilas Road. However, after surveying the property, it was noted that there is a lot of debris that needs to be removed. It was suggested that this would be a good opportunity to solicit volunteers from the community to help clean up the site. • there is a three acre parcel of land for sale in the Pittview area. The Central Point Comprehensive Plan recommends a park in this area of the City. It is suggested that the City look into optioning or purchasing this parcel of land for a future park. IX. COUNCIL REPORTS Council Member Bill Stults reported that the Medford Water Commission is working on water quality to eliminate odor and taste problems associated with the use of water from the Rogue River. City of Central Point City Council Minutes January 13,1000 Page 5 ~J Council Member David Gilmour asked City staff to refine the process for Code Enforcement complaints by requiring that complaints be in writing and signed by the complainant. He also suggested that an ordinance regulating trees in the City right of way be prepared which also specifies the types of allowable trees to be planted. Council Member Bob Gilkey asked if the time for the City Council Meeting on January 27, 2000, could be changed to 6:00 p.m. He has other obligations later in the evening. Bob Gilkey made a motion to change the meeting time for the regularly scheduled City Council Meeting on January 27, 2000, to 6:00 p.m. Garth Ellard seconded. Roll Call: Motion passed unanimously. X. MAYOR'S REPORT Mayor Walton reported that: 1 • he met with the Central Point Postmaster regarding installing two postal drop boxes in Central Point at Albertson's and Ray's. • he has become a member of the Jackson County Strategic Planning Committee. • he will be meeting with the Crime Prevention Committee on January 23, 2000 to help broadcast the Drug Wars special programming. • D.A.R.E. graduation recognition will be at Mae Richardson on January 25, 2000. • the Central Point Chamber of Commerce will be having an auction on Saturday January 22, 2000. • he will be giving the State of the City Address at the Council meeting on January 27, 2000, along with the Citizen of the Month recognition. XII.
