City Council Meeting Minutes
October 12, 2000
1. REGULAR MEETING CALLED TO ORDER
Mayor Walton called the meeting to order at 7:00 p.m.
11. ROLL CALL: Mayor: Bill Walton
Council Members: Garth Ellard, Carol Fischer, Bob Gilkey, David
Gilmour, Donna Higginbotham, and Bill Stults were all present.
City Administrator Jim Bennett; City Attorney Doug Engle; Public
Works Director Lee Brennan; Finance Director Bill Brugger; Police
Chief Mike Sweeny; Building Official Lois DeBenedetti; Planning
Director Tom Humphrey; and Administrative Secretary Deanna
Gregory were also present.

A. Approval of September 28, 2000 City Council Minutes
Bill Stults made a motion to approve the minutes as presented. Donna Higginbotham
seconded. Roll Call: Motion passed unanimously. Garth Ellard Abstained.
B. Approval of October 3, 2000, City Council Minutes
Garth Ellard made a motion to approve the minutes as presented. David Gilmour
seconded. Roll Call: Motion passed unanimously.
VI. PUBLIC APPEARANCES
Mike Quilty, Central Point Resident
Mr. Quilty presented the Council with his concerns about Light Pollution. He stated that
light pollution has spread so much in the last few decades that it compromises our view of
the stars. He stated that this type of pollution is controllable with a few set standards.
Mayor Walton suggested that he provide this information to the Planning Department and
they can try incorporating this concept into the updated zoning ordinances.
Mayor Walton closed the Public Appearances portion of the meeting
VII. BUSINESS
A. Presentation on Proposed Jackson County Expo Amphitheater
City Administrator Bennett explained the nature of the presentation by the Jackson County
Fairgrounds on the proposed outdoor amphitheater. He introduced Lee Johnson, president
of the Fair Board.
Mr. Johnson explained something of the history of the amphitheater project as it relates to
'' the Fairgrounds Master Plan which was adopted about 25 years ago. He stressed that the
Fair and the City have had a good relationship in the past and that they wanted to work in
partnership with the City on the project. He said they would address the issues and
concerns raised by the City relating to traffic and noise.

Council Member Bill Stults asked Mr. Johnson about the total number of concerts that
would be held in the new amphitheater annually. Mr. Johnson replied that it added up to
17; but could be one more or one less. He then introduced the Fair Manager, Chris
Borovansky.
Mr. Borovansky briefly reviewed the amphitheater plan and went over the qualifications of
the architects, designers and engineers that have been hired to design the amphitheater
and to address the issues of noise and traffic. He told the Council that everything would
be done right to satisfy everyone's concerns or it wouldn't be done at all.
The Mayor and City Council then engaged in some discussion of the project before opening
the floor to the public.
The following individuals voiced their questions, concerns and suggestions regarding the
amphitheater project:

Mayor Walton closed the public portion of the discussion. He asked the Fair to provide the
City with a list of three amphitheaters that had been built in urban residential areas so that
he and other Council Members could visit them and determine first hand the impacts of the
development on their respective communities. The Council took no furtheraction atthis
time.
B. Appeal of Planning Commission Decision to Approve a Site Plan Review for
an AT8tT Cellular Telephone Tower
Planning Director Tom Humphrey stated that the parties appealing this decision have
requested that this item be continued until the October 26, 2000, Council Meeting.
C. Resolution No. 894, A Resolution Certifying Results of the September 19,
2000, Measure Election to Annex the City of Central Point into the Bear Creek
Valley Sanitary Authority District
City Administrator Jim Bennett explained that City Charter requires the Council to canvass
the results of all elections held within the City at the first regular meeting following the
receipt from the County Clerk of the certification of the election results. ORS 198.867
further requires that, when a city approves annexation to a special district, the city must
certify to the Board of County Commissioners the fact of the approval of the annexation.
The proposed resolution satisfies these requirements. The effective date of the annexation
to Bear Creek Valley Sanitary Authority is January 1, 2001.
Bob Gilkey made a motion to approve Resolution 894, Certifying Results of the
September 19, 2000, Measure Election to Annex the City of Central Point into the
Bear Creek Valley Sanitary Authority District. Carol Fischer seconded. Roll Call: Motion
passed unanimously.
D. Resolution No. 895, A Resolution Certifying Results of the September 19,
2000, Measure Election to Annex the City of Central Point into Jackson
County Fire District #3
Mr. Bennett stated that the Council is required to canvass the results of all elections held
within the City at the first regular meeting following the receipt from the County Clerk of the.
certification of the election results. ORS 198.867 further requires that, when a city approves
annexation to a special district, the city must certify to the Board of County Commissioners

The fact- of the approval ofi the annexation. The proposed- resolution satisfies- these
requirements. The effective date of the annexation to Jackson County Fire District #3 is July
1, 2001.
Donna- Higginbotham made a motion to approve Resolution- 895, Certifying Results
of the September 19, 2000, Measure Election to Annex the City of Central Point in to
Jackson County Fire District No: 3: Bill Stults- seconded. Roll Call:- Motion passed
unanimously.
E. Resolution No: 896, A Resolution Certifying- Results- of the- September 19;
2000, Referendum Election on City Ordinance No. 1806
Mr: Bennett explained that the City Charterrequires the Council to canvass thecesults of
all elections held within the City at the first regular meeting following the receipt from the
CountyClerkofthecertification oftheelection results. The attached resolutionsatlsfiesthls
requirement. The effective date of Ordinance 1806, was September 25, 2000, the date that
the election results. were certified by the Jackson County Clerk.
City staff- have visited the businesses that- are affected by the tobacco licensing
requirements of the ordinance providing a copy of the license application and explain that
alt tobacco products must- be out of the reach of customers until a store employee has
completed a sale. Business owners have been very cooperative. Staff are also working with
employers on getting approved "No Smoking" signs. installed at businesses.
Bill Stults made- a motion to approve Resolution No: 896, Certifying Results of the
September 19, 2000, Referendum Election on City Ordinance No. 1806. Bob Gilkey
seconded. Roll Call: Motion passed unanimously.
F. Review of Street Utility Fees
Mr: Bennett stated that at the regularmeeting ofiJune 22, 2000, the City Council considered
a proposal to implement street utility fees within the City of Central Point. These fees would
be used to provide revenues used for the maintenance, repair- and- improvement- of-City
streets and rights-of-way. At that time the Council felt the fees suggested would be too
high forCentral Point: Street#ees would need to be consistentwith-tkose charged by other
jurisdictions in Jackson County and not be an unreasonable burden on the average citizen
or business owner: The CityCouncil postponed anyaction on-the adoption of a streetutility
fee and directed staff to work on a revised street utility fee program.
Mr: Bennettprovided alist-with-revised rates. Asingle-family residence-would-pay $3.00
per month. He stated that the list is not an all-inclusive list of land uses within the city. New
uses are constantlycropping up that-may need to be categorized. It is recommended-that
any street utility fee program should allow for staff interpretation of new and unlisted uses
forthe purpose of establishing the apprpP~iat~ fee: It would-also be appropriate to provide
an appeal mechanism that would allow a customer to challenge the methodology used to
calculate the fee if it can be shown that a rrpre equitable methodology exists.
The council- decided to hold a-Study Session on November 14, 2000; at 7:00 p.m. to
further discuss this issue. They are still concerned that these fees will be too high for the
Downtown businesses, and they would like to discuss exempting- schools and- non-profit
organizations. They would also like to see a hardship clause in the program for low income
families.
G. Review of Left Turn Movements on E. Pine Street
Planning Director Tom Humphrey stated thatthe city planning staff have done preliminary
traffic counts for the intersections at the 3rd and 4th Street signals. The counts reflect the
number of vehicle turning movements made between the hours of4:00 and-6:00; p.m. on
October 75, 1999. Left turn movements during this "peak period" account for fairly small

percentages ofthe total west and eastbound-traffic volumes. West bound vehicles turning
left at Third Street (north) account for the highest numbers.
Staff is prepared to do further studyon this-issue ifithe Council requests it. However; once
traffic calming measures are introduced on Pine Street with the revitalization project, new
signals-will betterregulate vehicle turningmovements in the future. The'Councildeci~ed
to wait on the "No left turn" signs at this time.
H. Planning Commission Report (Humphrey)
Planning DirectorTom Humphrey presented the Central Point Planning Commission Report
for the regular meeting on October 3, 2000:
t. Recommended thatthe CityCouncil withdrawthe Jones property (1.43 aicres) from
Jackson County Fire Protection District No. 3 following its annexation to the City of
Central Point:
2. Recommended that the City Council approve a proposed Comprehensive Pfan Tezt
and- Map Amendment to define the Central Point- Transit Oriented Development
(TOD) boundaries and land uses including the expansion of the TOD boundary and
design standards into the Downtown.
3. Recommended- that the City Council approve a proposed Zoning Ordinance Text
and- Map Amendmentto create regulations governing zoning; development review
and standards for the Central Point Transit Oriented Development (TOD) and
associated TOD Corridor: The' Commission supported- ahalf- dozen specific new
zoning districts and a corridor overlay zone. They also recommended approval, of
newcirculation and' access standards; site design- standards; common open spice
design standards; sign construction standards; building design standards and a set
of-new zoning definitions.
4. Recommended that the City Council approve a proposed Transportation System
Plan- (TSP) ofiwhich the TOD is a component. The recommendation included the
addition and incorporation of maps and street cross-section diagrams.
A Planning Commission meeting was not scheduled for the second Tuesday in October.
Garth Ellard made a motion to approve the Planning Commission- Report for the
regular meeting of October 3, 2000. Bob Gilkey seconded. Roll Call: Motion passed
unanimously.
H. Department Reports
Planning Director Tom Humphrey reported that:
• staff has almostcompleted the updates on-the zoning ordinances regarding-sound
abatement, fence requirements and misc other changes.
• staff- has been working on grants forthe Planning and- Public Works- Departments
regarding sidewalks.
• the Planning Department will have an intern helping overthe next few months to do
mapping projects.
• NancyHansenhasexcepted the-Parks and RecreationCoordinatorpositiorrand-will
begin work on November 1, 2000.
Finance Director Bill Brugger reported that:
the Financial Statementfor the Month- ending September 30, 2000 looks good and
the city is within budget.
the City has begun paying- the Utility Fees at the Sr: Center; this should help the
center out by approximately $300 a month.

Public Works Department Report:
• the sidewalks along 10th Street and around Jewett school have-been designed and
will be constructed within thirty days.
• the construction for the sidewalk project along Front Street should begin within the
next few weeks. This project is a partial grant assisted project and must be
completed by the end of 2000.
• the survey work on the Vilas Road Park area has begun. Development of the park
will hopefully start next spring
• the design for the park on Gatepark Drive has been sent to W.L. Moore
Construction for a cost estimate. They hope to complete as much of the park as
possible before the weather gets too bad.
• the Public Works Department will be conducting interviews next week for Public
Works Technician. At this time this positions is part time, he asked the Council to
increase this position to full time.
Bob Gilkey made a motion to increase one Public Works Technician position to a full
time position making a total of 3 full time Public Works Technician positions. Garth
Ellard seconded. Roll Call: Motion passed unanimously.
VIII. CITY ADMINISTRATOR'S REPORT
City Administrator Jim Bennett reported that:
• as of January 1, 2001, BCVSA will be a utility company using City right-of-ways.
The Council might consider charging BCVSA a franchise fee as it does other
utilities.
• LOC registration forms should be turned into Deanna by close of business Monday,
October 16, 2000.
• there has been a complaint from a citizen on 9th Street regarding Semi-Truck
traffic. These trucks ignore the signs that are posted and she would like something
more permanent done to prevent the trucks from going up 9th Street.
• he has received a letter from a family in the Flanagan Park area requesting that the
City provide a portable toilet at the park. He suggested that the City locate portable
toilets on a seasonal basis at Flanagan and Van Horn parks. The Council agreed
that this was a service that should be provided.
• he has received a request to yellow curb a small section on the east side of 10th
Street by Bee Gee's restaurant. The Council agreed to yellow curb this section
of 10th Street.
• there will be a joint Study Session with the Planning Commission on Wednesday,
November 8, 2000, at 7:00 p.m. to discuss the Annexation of the TOD area.
• there will be a Study Session on November 14th to discuss the Street Utility Fees.
IX. COUNCIL REPORTS
Council Member Donna Higginbotham stated that she received complaints from citizens
regarding the speed on Old Upton Road going over Interstate 5. Mr. Bennett replied that
the City will work with Jackson County to get the proper signs in place.
Council Member Carol Fischer stated that she attended the 50th Anniversary of Crater High
School.
X. MAYOR'S REPORT
The Mayor stated that:
• he would like the City Administrator to send a letter to the county requesting the
names of three amphitheaters similar to the one proposed at the Expo. He will go

visit the surrounding area to see if the sound abatement measures really do work
and report back to the Council.
on October 31st the Medford Chamber will host a presentation on Drugs in Our
Valley.
XI. ADJOURNMENT
Garth Ellard moved to adjourn, Bill Stults seconded, all said "aye" and the Council
Meeting was adjourned at 10:00 p.m.
