HomeMy WebLinkAboutOrdinance 1399ORDINANCE NO. 1~ AN ORDINANCE ESTABLISHING A FEE SCHEDULE FOR VARIOUS POLICE: AND FIRE SERVICES WHEREAS, it is the intention of the City Council to place cost for the provision of various municipal services upon the users thereof, and studies by the police and fire departments of the city have determined the use by other municipalities of a schedule of charges for various services, and WHEREAS, following study and public hearing of such schedules of charges, the Council has determined the same are just and equitable and in the best interests of the citizens of the City of Central Point, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. There is hereby added to the Municipal Code of the City of Central Point Chapter 3.16 which is to read as followsc Chapter 3.16 CHARGES FOR POLICE AND FIRE SERVICES 3.16.010 Purpose. The purpose of this chapter is to minimize the cost of police and fire services to the taxpayers of the city in cases in which the service is of a non-emergency nature and in which a specific benefit is derived by the person served or the service could have been avoided by the use of reasonable care on the part of the person served, by imposing the cost, or a portion thereof, upon the person served. 3.16.020 Definitions. Unless the context requires otherwise, the following words shall be defined as follows in this chapter: A. "User" means the person, persons or entity, including businesses, partnerships and corporations, to whom a service is provided. B. "Service" means the provision of employee time, Page 1 - Ordinance No. 13~~ equipment or materials provided by the police department or fire department, in the manner specifically referred to in this chapter. C. "Alarm business" means any business. providing bur- glar, fire or any other alarm or warning systems within the city. D. "Engine hour" refers to an hour, or any fraction thereof, that a fire engine is out of the fire station on a call. For the. purposes of this ordinance, engine hour shall be determined by the senior fire department employee responding to said call and shall be timed from the departure of the engine from the fire station to its return. 3.16.030 Police Department Charges. The following charges shall be collected by the police department, in the manner specified, for the following described services, A. Office services. (1) Applicant fingerprinting $3.00 per person (2) Bicycle license fees (3) Copies of reports B. Equipment use. (1) Use of property engraver (2) Use of automatic light timer C. Investigative (1) Vehicle accident inves- tigations occurring on private property (when no citation for traffic crime is issued) $1.00 per year $10.00 for first page, $5.00 for each additional page $2.00 for two con- secutive days use by one-party one week or less $2..00; two weeks $3.00; three weeks $4.00; four weeks $5.00 services. $15.00 per inves- tigation (2) Investigation of bad $10.00 for first check cases on request check, $3.00 for of victim (where victim each additional declines to prosecute check or dismisses) D. Response to alarms. Response to fires caused by stoves installed after April 1, 1978 without permit. $200.00 per engine Payable by user on hour billing 3.16.050 Collection. In the event of a failure by any user to pay for services rendered in accordance with the schedule of fees and charges contained herein, the police or fire department may refuse to provide the service requested or may request the City Administrator to commence appropriate proceedings for collec- tion of such fees or charges. These remedies shall be non-exclusive and in addition to any other rights and. remedies available under law. Section. 2. This ordinance being necessary for the immediate preservation. of the public peace, health and safety of the City of Central Point, Oregon, due to the commencement of the 1980-81 fiscal year and the need for the revenues set forth herein- above for the operation of the police and fire departments of the Page 4 - Ordinance No. 13 city, an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage..
