HomeMy WebLinkAboutOrdinances 2144ORDINANCE NO. 2144 AN ORDINANCE AMENDING TITLE 6 - TO AMEND IN PART CHAPTER 6.06.010 AND ADD CHAPTER 6.07 TO ALLOW MINIATURE POT-BELLIED PIGS IN CITY LIMITS RECITALS: A. Pursuant to CPMC, Chapter 1.01.040, the City Council, may from time to time make revisions to its municipal code which shall become part of the overall document and citation. B. The City Council received a request from a member of the public requesting consideration of an ordinance amendment to allow miniature pot-bellied pigs in City limits. C. The City Council finds that it is in the public interest to allow such animals in City limits, subject to limitations as to the number and size of such pets . D. Words lined through are to be deleted and words in bold are added. THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: SECTION 1. Central Point Municipal Code § 6.06.010 Prohibited Animals is amended in part to read: No horse, mule, donkey, pony, cow, pig, goat, sheep, llama, rooster, or animal raised for commercial purposes shall be kept within the city limits. Notwithstanding the foregoing, miniature pot-bellied pigs that are not being kept for commercial breeding purposes are permitted inside city limits subject to the conditions in Chapter 6.07. (Ord. 1901 § 2(part), 2007) SECTION 2. Central Point Municipal Code Title 6 is hereby amended to add a new Chapter 6.07.010 Miniature Pigs to read as follows: 6.07.010 Miniature Pigs Miniature pot-bellied pigs are permitted inside the city limits subject to the following: A. A maximum of two miniature pot-bellied pigs, commonly referred to as Vietnamese, Chinese or Asian Pot-Bellied pigs, or such other domesticated miniature pot-belly pig, may be kept within or upon any parcel of land or dwelling unit within the city limits provided that Docusign Envelope ID: 302B2C56-3F2E-8BD7-83DC-6C803E158FCA Ord. No.2144; (City Council Meeting 08/13/2026) Page 2 each pig’s maximum adult height is no greater than 22-inches at the shoulder and it weighs no more than 150 pounds. B. Prior permission must be granted by the owner of such land or dwelling unit in which a miniature pot-bellied pig is kept or maintained. C. Any male miniature pot-bellied pig over four months old must be neutered. Any female miniature pot-bellied pig over four months old must be spayed unless the owner provides a written statement signed by a licensed veterinarian that spaying would endange r the life of the pig. D. Any person or persons owning or having charge, care, custody, or control of any miniature pot-bellied pig shall not cause, permit, or allow the same to be upon any public place or private property, other than the property of the person having charge, ca re, custody, or control unless such pig is restrained by a substantial leash not exceeding six feet in length and is in the charge, care, custody or physical control of a competent person. E. Any person or persons owning or having charge, care, custody or control of any pot -bellied pig shall not be in violation of Chapter 6.08.010.D. F. Any person owning or having charge, care, custody, or control of any miniature pot -bellied pig shall be responsible for removing and cleaning up such pig feces on any public or private property, other than the property of the person having charge, custod y, or control of such pig. G. Notwithstanding the above, no such pigs shall be allowed in any park. H. No breeding of miniature pot-bellied pigs is permitted in the city. SECTION 3. Codification. Provisions of this Ordinance shall be incorporated in the City Code and the word "ordinance" may be changed to "code", "article", "section", "chapter" or another word, and the sections of this Ordinance may be renumbered, or re-lettered, provided however that any Whereas clauses and boilerplate provisions (i.e. Recitals A-C) need not be codified and the City Recorder is authorized to correct any cross-references and any t ypographical errors. SECTION 4. Effective Date. The Central Point City Charter states that an ordinance enacted by the Council shall take effect on the thirtieth day after its enactment.
