A RESOLUTION OF INTENT TO INITIATE AN AMENDMENT TO THE LAND USE
ELEMENT OF THE COMPREHENSIVE PLAN CLARIFYING THE APPLICATION OF
RESIDENTIAL (R) ZONES AND THE TRANSIT ORIENTED DEVELOPMENT (TOD)
OVERLAY TO LANDS WITHIN THE URBAN GROWTH BOUNDARY, DIRECTING
STAFF TO PREPARE THE AMENDMENT FOR PUBLIC HEARING IN
COORDINATION WITH THE RESIDENTIAL CODE STANDARDS FOR PARKS,
OPEN SPACE, AND MULTIMODAL CONNECTIVITY ALREADY UNDER
DEVELOPMENT
RECITALS:
A. An amendment to the Comprehensive Plan and the Central Point Municipal Code
(Land Divisions and Zoning) may be initiated by adoption of a resolution of intent
by the City Council (Chapter 17.96.200 and 17.10.200, respectively); and
B. The Land Use Element applies the Transit Oriented Development (TOD) Overlay
zones to lands added to the Urban Growth Boundary (UGB), and the TOD
Overlay development standards do not permit manufactured dwelling parks as a
housing type; and
C. Because the current framework applies the TOD Overlay to lands brought into
the UGB by default, that prohibition extends to those lands even where transit is
neither present nor planned, and property owners in UGB areas acknowledged in
2022 have expressed interest in developing manufactured dwelling parks as a
means of providing affordable housing; and
D. The City Council considered the issue at its June 16, 2026 Study Session and
finds that conventional residential (R) zones, which permit manufactured dwelling
parks, should apply to lands within the UGB unless the City Council designates
the land within the TOD Overlay by legislative action, consistent with feedback
from the Planning Commission and the Citizens Advisory Committee to continue
excluding manufactured dwelling parks from the TOD Overlay; and
E. The proposed amendment does not eliminate the TOD Overlay or diminish its
standards, but changes only how and where the Overlay is applied; and
F. The City Council emphasized that moving away from the TOD Overlay as the
default designation should not reduce the livability amenities residents would
otherwise receive, and directed that residential development provide connected
bicycle and pedestrian networks and parks and open spaces so that residents
enjoy an equitable quality of life regardless of proximity to transit; and

G. The City Council has directed staff to prepare companion amendments to the
residential zoning standards already under development to establish clear and
objective standards for residential open space and multimodal connectivity,
carrying out the direction described above; and
H. The City Council determines that the public necessity, convenience, and general
welfare support consideration of such amendments.
The City of Central Point resolves:
Section 1. By this resolution, the City Council authorizes the Community Development
Department to proceed with preparation of a proposed amendment to the
Comprehensive Plan Land Use Element, and associated amendments to Central Point
Municipal Code Titles 16 (Land Divisions) and 17 (Zoning), to:
● Clarify that conventional residential (R) zones apply to lands within the Urban
Growth Boundary unless the City Council designates the land within the
Transit Oriented Development Overlay by legislative action;
● Establish clear and objective standards for residential open space and for
bicycle and pedestrian connectivity, including standards for residential
pedestrian accessways; and
● Make conforming amendments to the residential zoning and land division
standards necessary to carry out the amendment, including: CPMC 16.10,
17.20, 17.22, 17.57, 17.72, 17.75, and any other additional chapter or section
identified as requiring amendment to carry out the changes.
Section 2. Prior to formal adoption of the amendments described in Section 1, the
requirements of Chapter 17.96 and 17.10 et seq. of the Central Point Municipal Code
shall be met, including public notice, hearings, notice to the Department of Land
Conservation and Development, and Planning Commission review and
recommendation.
