REGULAR MEETING CALLED TO ORDER
Mayor Williams called the meeting to order at 7:00 p.m.
II. PLEDGE OF ALLEGIANCE

Harrison were present. Allen Broderick, Kelly Geiger, and Ellie
George were excused.
City Manager Phil Messina; City Attorney Paul Nolte; Parks and
Public Works Director Matt Samitore; Finance Director Bev
Adams; Assistant City Manager Chris Clayton; City Recorder
Deanna Casey; and the majority of the Central Point Police
Department were also present.
IV. PUBLIC APPEARANCES - None
V. SPECIAL PRESENTATION — Change of Command
Police Chief Jon Zeliff presented Captain Kris Allison with his Chief pins. Mayor
Williams then swore in Chief Allison and presented her to the audience. Chief Allison
then swore in Captain Brian Day, Lieutenant Jarod Pomeroy, and Officer Aaron
Grissom. Captain Allison also swore in three new reserve officers Joseph Vargas,
Jamie Dorsey and Brian Munoz.

Bruce Dingier made a motion to approve the Consent Agenda as presented. Kay

VIII. PUBLIC HEARINGS, ORDINANCES AND RESOLUTIONS
A. Public Hearing — Ordinance No. 1961, An Ordinance Amending Chapter
11.16 of the Central Point Municipal Code for the Purpose of
Establishing the Water Quality Program Fund and the Water Quality
Utility Fee
Parks and Public Works Director Matt Samitore stated that this is the second reading
of an ordinance which will set up a water quality program fund and authorize the
water quality utility fee. This will allow the city to transfer the existing $1 fee from

Rogue Valley Sanitary Services to the City of Central Point Utility bills. Citizens will
pay the same amount, and any credits have been worked out with RVSS and the city
finance software. There were no changes recommended at the first reading.
Mayor Williams opened and closed the public hearing. No one came forward.
Bruce Dingier made a motion to approve Ordinance No. 1961, An Ordinance
Amending Chapter 11.16 of the Central Point Municipal Code for the Purpose of
Establishing the Water Quality Program Fund and the Water Quality Utility Fee.
Carol Fischer seconded. Roll call: Bruce Dingler, yes; Carol Fischer, yes; Kay
Harrison, yes; and Hank Williams, yes. Motion approved.
B. Public Hearing — Ordinance No. 1962, An Ordinance Amending Chapter
8.28 of the Central Point Municipal Code to Provide for a More Efficient
and Timely Drainage Channel Maintenance and Obstruction Abatement
Mr. Samitore stated that one change was recommended at the first reading of an
ordinance revising the drainage channel maintenance within the city limits. At the first
reading council suggested that citizens be allowed to come before them for any final
appeal. The proposed ordinance will set up a structure similar to the weed abatement
program. This will help eliminate issues in the creeks and prevent obstructions that
could cause flooding.
Mayor Williams opened and closed the public hearing. No one came forward.
Kay Harrison made a motion to approve Ordinance No. 1962, An Ordinance
Amending Chapter 8.28 of the Central Point Municipal Code to Provide for a
More Efficient and Timely Drainage Channel Maintenance and Obstruction
Abatement. Carol Fischer seconded. Roll call: Bruce Dingler, yes; Carol Fischer, yes;
Kay Harrison, yes; and Hank Williams, yes. Motion approved.
C. Public Hearing — Resolution No. 1839, A Resolution to Approve a
Supplemental Budget for the 2011/12 Fiscal Year
Finance Director Bev Adams presented a resolution approving a supplemental budget
for the 2011 — 2012 Fiscal Year. Unexpected expenses such as Chief Zeliff retiring
and a request to replace existing analog radios with digital radios have caused the
Police Department budget to be very close to their limit. The attached resolution will
transfer appropriations from the General Fund revenues and carryover.
Mayor Williams opened and closed the public hearing. No one came forward.
Carol Fischer made a motion to approve Resolution No. 1839, A Resolution to
Approve a Supplemental Budget for the 2011/12 Fiscal Year. Kay Harrison
seconded. Roll call: Bruce Dingler, yes; Carol Fischer, yes; Kay Harrison, yes; and
Hank Williams, yes. Motion approved.

Mayor Williams reported that he volunteered and attended the Battle of the Bones
event all three days, everyone seemed to have a good time even with the bad
weather. He also attended a Medford Water Commission meeting.
X. CITY MANAGER'S REPORT
City Manager Phil Messina reported that he worked all three days at the Battle of the
Bones. Even with the rain it seemed to be a successful event.
XI. COUNCIL REPORTS
Council Member Kay Harrison reported that she attended an RVSS meeting and
volunteered for the Battle of the Bones.
Council Member Bruce Dinger stated that he volunteered to work the Battle of the
Bones event, and looks forward to volunteering again next year.
Council Member Carol Fischer reported that she volunteered for the Battle of the
Bones and has heard nothing but good things about the event.
XI 1. DEPARTMENT REPORTS
Parks and Public Works Director Matt Samitore reported that the Council will be
awarding a bid at the next meeting. However, the bids do not get opened in time to do
a complete report with a recommendation. He will be in attendance and provide a
recommended award recipient on July 12, 2012.
Assistant City Manager Chris Clayton reported that he will be contacting the Rail
company to see if they will be paying for part of the Twin Creeks Crossing with the
grant that they received to improve the rail line in Southern Oregon.
XIII. EXECUTIVE SESSION - None
XIV. ADJOURNMENT
Kay Harrison moved to adjourn, Carol Fischer seconded, all said "aye" and the Council
Meeting was adjourned at 7:53 p.m.
The foregoing minutes of the June 28, 2012, Council meeting were approved by the City
Council at its meeting of July 12, 2012.

SUMMARY:
The City has water meter parts that we no longer use as we have upgraded our water meter system. In
order to re -coup some of the costs with these outdated parts we have found a neighbor, the City of
Gold Beach, who still uses the other system. Since there is limited buyers for this type of equipment
staff is suggesting selling it to them at 50% off the market value.

AGENDA ITEM: Public Contracting Rules Update
1. Ordinance Amending Chapter 2.40 of the Central Point Municipal Code.

BACKGROUND:
Substantial changes to Oregon's public contracting rules were instituted this past January.
More specifically, chapter 279 of the Oregon Revised Statutes was revised to require public
agencies to employ a Qualifications Based Selection (Q.B.S.) methodology when selecting
professional consultants (i.e. Architects, Engineers, Planners, Surveyors, etc.).
Historically, chapter 2.40 of the Central Point Municipal Code has governed the City's public
contracting procedures. However, in an effort to become compliant with the State's recent
revisions, staff is proposing the elimination of certain portions of Chapter 2.40 followed by
the adoption of a public contracting rules resolution (following the 2nd reading of Ordinance
Amending Chapter 2.40 of the CPMC). As the council is aware, adopting these rules and
procedures via a resolution, provides both the staff and council with greater flexibility when
future revisions become necessary.
ORDINANCE AMENDMENT RECITALS:
A. Public contracting rules by the city were previously adopted by ordinance and codified
in the Central Point Municipal Code Chapter 2.40. Each legislative session the state
legislature amends the rules required to be followed by the city and the city is then
required to update its rules to conform to legislative changes.
B. In addition, the Attorney General is required to modify the Model Rules adopted in
compliance with the statutory changes made by the legislature and each change in the
Model Rules is required to be followed by the city unless the city opts otherwise.
C. Neither state law nor the Model Rules require the city to adopt its public contracting
rules by ordinance. It is much more efficient to adopt and update rules by resolution
and the code amendments set forth in this ordinance allow the city to adopt and to
revise its public contracting rules by resolution.

authorities of the purchasing agent under this chapter may be delegated and
subdelegated by written directive.
0- C. Mandatory Review of Rules. Whenever the Oregon State Legislative
Assembly enacts laws that cause the attorney general to modify its model rules,
the purchasing agent shall review the public contracting rules, other than the
model rules, and recommend to the city council any modifications required to

Intergovernmental Agreement (IGA) between the City of Central Point and the City of Talent for the
combined Congestion Mitigation Air Quality (CMAQ) parking lot(s) projects.

BACKGROUND
The Cities of Central Point and Talent applied and were awarded a grant from the CMAQ program to
design and construct three parking lots; two of them in Central Point and one in Talent. The city's
match for the project is approximately 11 % of the total costs. Central Point will serve as the lead
agency and will be in charge of paying the Oregon Department of Transportation for the match
requirements. Based upon the type of work being completed, Central Point will bill the City of Talent
monthly for their portion of the project. A breakdown of the percentages is included within the IGA.
RECOMMENDATION
Approve the Intergovernmental Agreement between the City of Central Point and City of Talent for the
shared administrative and construction costs of the CMAQ grant for three parking lots.

Recitals
A. The City of Central Point (Central Point) and the City of Talent (Talent)
have each received a Congestion Mitigation and Air Quality (CMAQ)
Program grant from the State of Oregon Department of Transportation for
paving certain areas within their respective cities.
B. Special grant provisions require each city to provide preliminary
engineering and design work to produce final plans, preliminary /final
specifications and cost estimates. It also requires monies for the
construction of the project and construction management services.
C. Both cities desire to split the cost of the preliminary engineering,
construction and construction management for their projects and ORS
190.010 permits units of local government to enter into intergovernmental
agreements for the performance of any or all functions and activities that a
party to the agreement has authority to perform.
Central Point and Talent agree:
1. Central Point will engage an engineer to conduct the necessary preliminary
engineering for both Central Point and Talent. The cost split for the preliminary
engineering shall be the City of Central Point shall pay 72% and the City of
Talent 28 %.
2. Talent shall pay its share of the cost of construction. The cost split shall be
Talent 43% and Central Point 57 %. Payment is due within 30 days of billing.
3. Talent shall pay its share of construction management services. The cost
split shall be Talent 33% and Central Point 67 %. Payment is due within 30 days
of billing.
4. Talent shall not pay any portion of the required right -of -way acquisition or
contaminated soils that are specific to the Central Point parking lot locations.

SUMMARY:
The Public Works Department will be opening bids for the Bear Creek Waterline, Beebe Road to
Penninger Road project on Tuesday, July 10, 2012. Normally staff would delay the award of the bid to
the next scheduled council meeting in the month, but because of the short time period for in- stream
work staff will present the low bidder to the City Council at the meeting. All in stream water work must
be completed by September 15, 2012.
RECOMMENDATION
Approve the low bidder for the Bear Creek Waterline, Beebe Road to Penninger Road project.

The following items were presented by staff and discussed by the Planning Commission at a
regularly scheduled meeting on July 3, 2012.
A. Consideration of Comprehensive Plan Amendment including 1) adoption of a new
Regional Plan Element; 2) adoption of a new Land Use Map designating Urban
Reserve Areas (URAs); 3) approval of an Urban Reserve Management Agreement
and 4) amendment of the Zoning Ordinance adding Section 17.71 Agricultural
Buffering. File Nos. 09017 and 12015. The Amendment was initiated by the City
Council to comply with the Greater Bear Creek Valley Regional Problem Solving
Agreement and a directive (letter) from the Department of Land Conservation and
Development (DLCD) regarding the manner in which the Regional Plan is adopted.
The Planning Commission conducted a public hearing and received testimony from
property owners who expressed a desire to be in a URA and from others who would
like to be removed. Citizens were advised that Jackson County has already adopted the
Regional Plan and the new URAs and that the work being done in each City is merely
to acknowledge the Plan and the URA Boundaries. The Commission recommended
approval of the Amendment to the City Council.
