HomeMy WebLinkAboutConsent to Annex - 4707 Table Rock Rd- 95=19'36 CONSENT TO ANNEXATION AGREEMENT This agreement, made and entered into this // day of ~~~Iil.i~_ 1994, by and between the City of Central Point, Oregon, an Oregon municipal corporation, hereinafter referred to as "City", and David Judd, hereinafter referred to as "Owner". ~7~w~~- Recitals 1. Owner owns real property located within City's Urban Growth Boundary, described as follows: Beginning B rods South of the Northeast corner of the Southeast quarter of the Northwest quarter of Section 1, Township 37 South, Range 2 West, Willamette Meridian, Jackson County, Oregon; thence West,. 40 rods; thence South, 16 rods; thence East, 40 roads; thence ,~~ North, 16 rods, to the point of beginning. EXCEPTING ~'Z~iB'~ THEREFROM the following: Beginning 16,0 rods South of the Northeast corner of the Southeast quarter of the Northwest quarter of Section 1, Township 37 South, Range 2 West, Williamette Meridian, Jackson County, Oregon; thence West, 40 rods; thence South 8.0 rods; thence East, 40.0 rods; thence North, 8.0 rods, to the point of beginning. 2. Owner has been granted a land use approval by the Jackson County Planning Department; one of the conditions attached to such approval is that Owner shall request and consent to annexation into City. NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: 1. Warranty of Ownership. Owner hereby warrants that he is the owner in fee or contract purchaser of the real property described hereinabove, and that he has authority to obligate said property to annexation as set forth hereinafter. Owner will supply written evidence to City's satisfaction of said ownership upon request. 2. Comprehensive Plan Amendment and Annexation. Owner hereby gives continuing written and irrevocable consent to, and request for, the annexation of the property described hereinabove to City, and does hereby petition City for such annexation. In connection therewith, Owner certifies that there are no electors residing on the subject property; Owner waives ORS 222.173, which /,5'~ I - CONSENT TO ANNEXATION AGREEMENT (030294) ~5-19'7;36 limits the duration of the annexation agreement to one year, and agrees to sign a separate document, as required by said statute, waiving said time until the property is annexed; and Owner's consent and waiver are continuing and binding upon the heirs, successors and assigns of the Owner, including, but not limited to, lessors, lessees, renters, and any other occupants of the property. Owner agrees to pay all costs in connection with the annexation, to be paid to the City upon request, and to participate fully in all City land use procedures necessary or advisable for the annexation, and the establishment of a zone for said property. Owner's cooperation shall include, but not be limited to, testifying and otherwise presenting evidence in favor of the annexation. 3. Attorney Fees. In the event of any suit, action, claim, or other legal proceeding to enforce any of the terms or provisions of this agreement, including recission or declaratory judgment, the prevailing party in such action shall be entitled to recover its reasonable attorney fees incurred therein, including any appeal, in a sum to be determined by the Court.
