CONSENT TO ANNEXATION
Property identification: On Table Rock Road approximately 400 feet north of
where Shultz Road intersects with Table Rock Road (37 2W 1B TL 1800)
This agreement between the CITY OP C$NTRAL POINT, hereinafter referred to as
"City", and VaI J. Dutson, being the owner of that certain real property described as
follows:
Co®encing at the northeast corner of Southeast Quarter of the
Northwest Quar[er of Sec[ion 1, Township 37 South, Range 2 West
of the Wi'_lamette Meridian, Jackson County, Oregon• thence
South 0°03'40" WesC along the North South cen[erline of said
Section 1 a distance of 800.67 feet; thence South 89°44'30"
West 29.16 feet to a 5/8 inch iron pin and the point of
beginning; thence continuing South 89°44'30" West 300.84 feet
to a 5/8 inch iron pin and [he northeast cornerof that tract
described in Volume 540 Page 289 of the Deed Records of Jackson
County; Chence South 0°03'40" Wes[ along the east line of said
tract 132.00 feet to the northeast corner of that tract
described in instrument No. 75-16128 of the Official Recorda of
Jackson County; thence North S°34'x6" East 10.21 feet to the
nor[hwea[ corner of that tract of land described in instrument
No. 66-05039 of the offical records of Jackson County; thence
East along the north line of said instrument No. 66-05039 a
distance of 299.90 feet to a point on the westerly Right of Way
of Table Rock Road, said point being West of a 5/8 inch iron
pin 0.17 feet; thence North 0°02'20" East along said Right of
Way 123.20 feet to the point of beginning.
do hereby consent that the same be annexed to the-City of Central Point, Oregon. This
consent is irrevocable and shall be binding upon our heirs, successors, and assigns
forever, being a covenant running with the land. The Ciry of Central Point may annex
said property at any time it deems proper in its sole and absolute discretion.

WAIVER OF ONE-YEAR TIME LIMIT ON
CONSENT TO ANNEXATION
This agreement made this ~ day of ~cfa~ ~~
1993, in connection with, but separate from, the parties'
"Consent to Annexation Agreement", affecting the following-
described property:
Commencing at the northeast corner of Soucheast Quarter of the
Northwest Quarter of Section 1, iownahip 37 South, Range 2 West
of the Willamette Heridian, Ja~cson County, Oregon; thence
South 0°03'40" Weat along the North South centerline of said
Section 1 a distance of 800.67 feet; thence South 89°44'30"
West 29.16 feet to a 5/8 inch iron pin end the point of
beginning; thence continuing South 89'44'30" West 300.84 feet
Co a S/8 inch frog pin sad the northeast corner of that tract
described in Volume 540 Paga 289 of the Deed Records of Jackson
County; thence South 0°03'40" West along the seat line of eaid
tract 132.00 feet to the northeast corner of that tract
described in instrument No. 75-16128 of the Official Records of
Jackson County; thence North 5°34`x6" East 10.21 feet to the
northwest corner of that tract of land described in instrument
No. 66-05039 of the offical records of Jackson County; thence
East along the north line of eaid.fnstrument No. 66-05039 n
distance of ?99.90 feat to a point oa the westerly Right of Nay
of Table Rock Road, eaid point being Reat of a 5/e inch fron

ORS 222.173 provides that only statements of consent to
annexation which are filed within any one-year period shall be
effective, unless a separate written agreement waiving the one-
year period has been entered into between an owner of land and
the City. This agreement is intended to accomplish a waiver of
the one-year period as set forth in ORS 222.173. It is,
therefore, agreed as follows:
1. Val J. Dutson hereby waives the one-year limitation on
his consent to annexation into the City of Central Point, and
agrees that such consent to annexation shall be effective
indefinitely; ,
2. The parties agree that their "Consent to Annexation
Agreement" shall be in effect until the property is officially
annexed into the City of Central Point; and

3. The consent and waiver of Val J. Dutson are continuing
and binding on the heirs, executors, administrators, personal
representatives, successors and assigns of Val J. Dutson
including, but not limited to, lessors, lessees, zenters and any
other occupants of the property.
