ADJOURNMENT CONSENT AGENDA CITY OF CENTRAL POINT City Council Mee#ing Minutes June 11, 2009 I. REGULAR MEETING CALLED TO ORDER Mayor Williams called the meeting to order at 7:00 p.m. Il. PLEDGE OF ALLEGIANCE IIL ROLL CALL; Mayor: Hank Williams Council Members: Allen Broderick, Bruce Dingler, Carol Fischer, Kay Harrison, Mike .guilty, and Matthew Stephenson were present. City Administrator Phi! IV. PUBLIC ARPEARANCES Donna Miller approached the Council with a request to donate funds to help send her granddaughter Kayla to-the National Young Leaders Conference in Washington D.C. Kayla will be representing Oregon and Central Point when she attends this conference as a recognized young leader in our country. Council member Fischer asked what Kayla, has done to earn the money so far. Mrs. Miller- stated that they have approached their church to help with donations. Chief Zeliff stated that he may have some resources for her to check. She should contact him after the meeting. Staff will check the budget but the City does not normally donate city funds in these situations. V. CONSENT AGENDA A. Approval of May 213, 2009, City Council Minutes. B. Approval of Patrol Vehicle Lease with Auta Leasing Specialists, LLC C. .Approval of Mayors United Helping Feed Our Community. Proclamation D. Resolution No. 1211, A Resolution Certifying the Provision of Municipal Services by the City of Central Point, Oregon City of Central Point Council Minufes June T1, 20Q9 Page 2 Finance Director Bev Adams stated that the recommended resolution certifies the provision of City services. This is required for the City in order to receive state cigarette, liquor and highway taxes. We expect to receive approximately $900,000 from #hese resources next year. Matt Stephenson made a motion to approve Resolution No. 1211,'A Resolution Certifying the Provision of Municipal Services by the City of Central Point, Oregon. Alllen Broderick seconded. Public Hearing -Resolution No. 1212, A Resolution Electing to Receive State Revenue Sharing Funds for Fisca! Year 2009-20'10 Mrs. Adams stated that the recommended resolution requests State Revenue Sharing funds. Before approving this resolution a public hearing must be held. The Ciiy expects to receive approximately $95,000 next year. Mayor Williams opened the public hearing. No one came forward. Mayor Williams closed the public hearing. Matt Stephenson made a motion to approve Resolution No. 1212, A Resolution Electing to Receive State Revenue Sharing Funds for Fiscal Year 2009-2010. Mike Quilty seconded. Resolution No. 1213, A Resolution to Adopt the Budget; Make Appropriations; and Levy Taxes for Fiscal Year Juty 1, 2009 to June 30, 2010. Mrs. Adams stated that the recommended resolution adopts the 2009/2010 Central Point Budget, sets appropriations, and levy's property taxes. The total budget is $24,739,850 with total current and prior year property tax revenue estimated at $4,118,000. Mike Quilty made a motion to approve Resolution No. 1213, A Resolution to Adopt the Budget; Make Appropriations; and Levy Taxes for Fiscal Year July 1, 2009 to June 30, 2010. Resolution No. 1214, A Resolution Transferring Appropriations within the 2008-2009 Budget Mrs. Adams explained that the recommended resolution is to reimburse the Jackson County Expo for overpayment of water in the amount of $140,000. This amount will be paid from the water fund-operations budget. It is necessary to transfer funds #rom the water fund -debt service to the operations fund to cover this expense. City of Central Point Council Minutes June 1T, 2009 Aage 3 Ten years ago a .discrepancy was noticed in the amount of money the Expo was being charged for water. At that time the city noticed there was an error in how the expo was being billed. However, after the city reimbursed them for the overpayment, word did not reach the- billing. clerk and the discrepancy continued. The County and City have agreed on an amount for reimbursement and signed an agreement that the billing will be changed with the. billing clerk. We have included in that agreement a statement that the City and County will review the current agreement for providing water to the expo by September 2009.. Mike Quilty made a ,motion to approve .Resolution No. 1214, Transferring Appropriations within the 2008-2009 .Budget. Bruce Dingler seconded. Resolution No. 1215, A Resolution Extending the City of Central Point's Worker's ,Compensation Coverage to Volunteers of the City of Central Point Human Resources Manager Barb.Robson explained the annual resolution affirming that the city will provide worker's compensation for individuals who volunteer for the city. Providing .worker's compensation coverage to volunteers minimally impacts the city premiums. Matt Stephenson. made a motion to approve Resolution Na. 1215, A Resolution Extending the City of Central Point's Worker's Compensation Coverage to Volunteers of .the City of Central Point, Mike Quilty seconded. Resolution No. 1216, Authorizing the Execution of a Nonexclusive Cable Television Franchise Agreement with Charter Communications, Inca City Administrator Phil Messina stated that the Cable Franchise Agreement expired in 2005. Staff has been working with Charter to renegotiate the agreement. We have been operating under the 2005 agreement through resolutions to extend. The proposed resolution authorizes the .non exclusive .agreement with Charter for Cable Services for -the citizens of Central Point. The basic cable service for citizens in the city is $19.95 a month which provides channels 0 - 22. He also explained that cities do not have authority to regulate cable TV programming through a franchise agreement. The . franchise agreement allows a payment to the. city. for their use of the public right-of- ways. Charter will pay a 5% fee far the term of this agreement for use of public right of -ways. Matt Stephenson made a motion to approve Resolution 1216, Authorizing the Execution of a Nonexclusive Cable Television Franchise Agreement with Charter Communications, Inc. Mike Quilty seconded. City of Central Point Council Minutes June T1, 2009 Page 4 G. Second Reading -Ordinance No. 1929, An Ordinance Amending Central Point Municipal Code-5.06 Pertaining to Yard Sales City Administrator Phil Messina stated that this is the second reading of an ordinance to update and remove the requirement of registering yard sales with the City. At the first reading there was a questions regarding how long a person may leave yard sale signs vut•. City Recorder Deanna Casey stated that a provision was added to the Ordinance stating that signs must be removed within 48 hours of completion of the sale. Mike Quilty made a motion to approve Ordinance No. 1929, An Ordinance Amending Central Point Municipal Code 5.06 Pertaining to Yard Sales. Kay Harrison seconded. Resolution Na. 1216, A Resolution Authorizing Membership Warehouse Clubs as a Conditional Use in the M-1 Zoning District and Affirming the Planning Commission's Authorization of Such Use Interim Community Services Director Matt Samitore stated that at the Council meeting on -May 28th the Council agreed with the Planning Commission decision to allow Membership Warehouse clubs in the M-1 zone district as a conditional use. The attached resolution officially affirms that decision. Matt Stephenson made a motion approving Resolution No. 1216, A Resolution Authorizing Membership Warehouse Clubs as a Conditional Use in the M-1 Zoning District and Affirming the Planning Commission's Authorization of Such Use. Planning Commission Report Mr. Samitore presented the Planning Commission Report for June 2, 2009: • The Planning Commission approved an extension for the Bank of the Cascades request to extend the site plan previously approved for the North Valley Center which is Ivcated on Biddle Road next to the Super 8 Motel. • The Planning Commission took no action during a discussion regarding the economic, housing, and- urbanization elements of the Central Paint Comprehensive Plan. • The Commission discussed Senate Bill 3031, the Co-location on Oregon State Police ce11 tower, and a pizza parlor possibly locating in The Crossing building across from City Hall. • They discussed miscellaneous items regarding -the Twin Creeks Crossing, flood plain issues and the DLCD appeal of membership warehouse clubs. Motion approved.. IX. COUNCIL BUSINESS Council .Member Bruce Dinger stated that he has noticed that some of the parking has been changed around the. traffic circle in Twin Creeks.. Council Member Carol Fischer stated that she is not in favor of creating a landscape barrier in Flannagan Park in order to hide restrooms from neighbors across the street. She stated that is could be a .safety issue if .we created shrubs for people to hide behind. X. MAYOR'S REPORT Mayor Williams reported #hat he attended .the IrQC roundtable discussion with Mr. Messina and, Mrs. Harrison regarding communication issues with State agencies. He also attended the tour with the Medford Water Commission to Big .Butte Springs. He reminded the Council about the Mayor's United even this weekend to raise funds for ACCESS. X!. CITY ADMINISTRATOR'S REPORT City Administrator Phil Messina stated that there will. be.a Monday Study Session on Monday. Mr. Humphrey should be back- to work the first part of August. XI1. COUNCIL REPORTS Council Member Matt Stephenson stated that he will be not be able to attend the Study Session on Monday. Council .Member Kay Harrison ,reported that the Bear Creek Greenway would like a formal motion appointing her as liaison to the Bear Creek Greenway committee, she would also like a back up to attend in her place. Bruce pingler stated #hat he would be interested in the back up position. Mike Quilty made a motion to appoint Kay Harrison as liaison to the Bear Creek Greenway committee and Bruce Dingler as her back up. Matt Stephenson seconded. Council Member Allen Broderick reported that he attended the School Board meeting where they discussed a 4 day school week. He also proposed they waive the excise tax for a one year period in order to help stimulate the economy. Mrs. Adams stated that there is regulation before the state that may require cities to collect this fee, Central Point is the only city in the valley that collects the fee. She suggested we wait to see what happens at the state level. City of Central Point Council Minutes June 17, 2Q09 Page 6 Council Member Mike Quilty reported that: • He attended a West Coast Hydrogen Fuel Cell Vehicle display in the valley two weeks ago. He was impressed with the design of the vehicles. • He has been working on the RPS contract funding through MPO. • He met with the Mayor of Ashland regarding RPS and MPO issues. • ODOT announced that they need a policy maker to sit' on their board. He stated as the MPO Chair he was going to appoint himself. XIII. DEPARTMENT REPORTS Finance Director Bev Adams stated that they have been doing the fiinal touches to the budget document and they have begun work on the Audit. Police Chief Jon Zeliff reported that: • Officer Dan Brown was accepted as Oregon D,A.R.E. officer of the year. He will be traveling to a national conference to be recognized. • The,VIPS Strategic Plan has been finaiized. He presented the mission statement to the Council. -They have 91 applicants for the vacant officer position: Testing wiA be Monday, June 15'h. Parks and Recreation Manager Matt Samitore reported that: • Staff has had a motivational talk with the landscaper for Don Jones Park. They are holding him to complete the project on time. • The Friday night festival starts this week; but may be cancelled this week due to weather issues. XIV. EXECUTIVE SESSION -None XV. KULONGOSKI - Governor June 16, 2009 Mayors & City Councilors: Governor Kulongoski has proclaimed July 2009 as the Oregon National Guard month. There is a copy of the document enclosed. Governor Kulongoski hopes that your and your conununity leadership will join him in honoring the sacrif ce and service of all Oregon National Guard troops and their families. As you know, 2009 is an important year for the Oregon National Guard. This May over 2,500 men and women from the 41 gc Brigade Combat Team were mobilized for duties in Iraq. This is the largest single mobilization of National Guard troops since World War II. And it - along with previous mobilizations of Guard troops deployed for service abroad since the wars in Afghanistan and Iraq began bring the total number to over 10,000 mobilizations. It will also highlight the importance of community support for veterans. Although it is often overlooked, Oregon has over 350,000 veterans (according to the U.S. Census) living in neighborhoods spanning our state. We have veterans from conflicts spanning the past seven decades -- and veterans of every era require and deserve our assistance, help, ,and love. This July, we can make time to come together and celebrate service to community and to country. Find a way to reach out to the guard families living in your community -people that may need help but not know how to ask. Sometimes proclamations are merely words upon a page: I hope that this proclamation is something far more - a trumpet sounding the call to service - an opportunity to forge stronger ties between those that wear the uniform on our behalf, the families that support them, and the communities,that.care. I want to publicly thank Mayor Hoffman from Lake Oswego for this pxoposal. His leadership on this issue is the beginning of a statewide awareness effort that will bring people together. Even though logistics prevented a single document with signatures from every community, passing this proclamation will form an impressive patchwork quilt of support. HISTORY: At the May 14th City Council Meeting, Council instructed staff to prepare a resolution placing the local fuel tax ordinance on the September 15`i', 2009 election ballot. The Council subsequently approved the resolution on May 28`", 2009. Prior to final approval Council instructed Staff to prepare a resolution removing the local fuel tax- ordinance from the September 15th, 2009 ballot in the event that the Oregon State Legislature passed a transportation furiidir>.g bill prior to the end of the current session. Both the Oregon House and Senate have passed HB 2001, The Jobs and Transportation Act, which is still awaiting Governor Kulongoski's signature. Among its many provisions, the bill contains afour-year moratorium on cities enacting new gas taxes or amending.existing.ones beginning 91 days after the Legislature adjourns. Therefore, the local fuel tax ordinance is still a valid Council consideration: Accordingly, there are some key dates far cities to consider depending upon how they may choose to approach the enactment of a local gas tax. The Council has three options: Option 1.• Rescind the Previous Motion Pass the resolution rescinding the previous Resolution that placed a Fuel Tax measure on the September ballot. Option 2: Local Legislative Process Should the City enact a gas tax by ordinance i.e, passed by Council and signed by the Mayor without. Voter approval-it would need to do so by the 91st day following adjournment of the Legislature to avoid the Moratorium. In the event that such an ordinance is subsequently referred to the voters by petition, it is the opinion of the League of Oregon Cities that, should the referral be defeated, the date of enactment by the city council, not the date. of the.refer~ndum election, is the operative date. Assuming that the date of the next special election,- September 15; 2009, falls before the 91st day following adjournment of the Legislature {a reasonably safe assumption in the League's opinian},.that means that cities wishing to go this route must approve an ordinance to refer a gas tax to their voters by July 16, 2009. PROPOSAL: Consideration of the resolution (Attachment "A"} removing the Iocal fuel tax ordinance-from the September 15~', 2009 election ballot. FjISCAL.~MPACT: House Bi112001 is projected to provide the City of Central Point with an additional $375,000 per year in transportation related funding. POSITIVE IMPACTS: Increased revenue will result City possessing a greater ability to fund and complete both maintenance and capital transportation projects. NEGATIVE IMPACTS: This new source of revenue is not locally controlled. Furthermore, this new revenue stream includes regulations regarding the City's ability to create, implement, or collect a local fuel tax. Realistically, without the ability to create a local fuel tax during the 4 year moratorium (January 1 S`, 2010 -January 15', 2014}, -the City's Street utility fee will remain a necessity to the overall health of.the.street fund. SUBJECT: Following, the last audit of the foundation, and reviews by the Parks & Recreation Commission and Parks &' Recreation Foundation,-which included the construction of the ve#eran's war memorial and downtown beautification it was advised by our auditors that some amendments to the by-laws of the foundation be completed. SUMMARY: The purpose of this amendment is to clarify the donation and projects the foundation can do as well as better define the staff on the executive and board membership. Language has been added to clarify that downtown beautification and other city open space are. po#ential donations and projects that the foundation may complete in any given year. Staff is also recommending a split between the duties of the Parks Foundation and Parks Commission. The language added requires a minimum of a five (5) person Bvard of Directors, which only a maximum of three (3) Parks Commissions can be appointed. The reason for the split between the two is because the Foundations purpose is mainly fundraising .and event planning, while the Parks Commission's purpose is to advise the City Council. Several Parks Commissions have expressed some concerns that event planning and fundraising is not one of their interests. Las#ly, language has been added #o appoint an associate director posi#ion and clarify the treasurer position. The position will be held by whoever is the Recreation Coordinator; currently that person is Jennifer Boardman. This will allow additional check writing capabilities and the ability. to make decisions if the Executive Director is unavailable. ARTICLE N Board of Directors 3. AUTHORITY. The Board of Directors shall manage the business and affairs of the Foundation. 4. QUALIFICATIONS Board member$ must have demonstrated an interest in parks and recreation and be committed to working in cooperation with representatives of other agencies, as well as the staff, to create a successful four-dation. Any vacaricy may be filled by City Council appointment. 7. BOARD AUTHORITY TO CREATE COMMITTEES The Board may create standing or ad-hoc committees or advisory committees to promote the purposes of the Foundation. Members of these committees need not be mernbers.of the Board. Each authorized committee shall include at least on.e Baard member. 8. STANDING COMMITTEES OF THE BOARD The Baard shall establish an Executive Committee, comprised of the Officers of the Board. This Executive Committee shall be authorized to make interim decisions required to be made between full Board meetings. Those decisions required to be made by the Executive Committee shall be reviewed at the next scheduled full Board meeting. The Baard shall establish a Finance Committee that will include the City Finance Director/or duly appofnted Finance staff member, and of which tl~e Treasurer shall be a member. The Finance Committee shall oversee the disbursement of operating funds, compliance with the Foundation's budget, and other ongoing financial concerns of the Foundation. Treasurer shall report at each full Board meeting and make funding allocations only after a recommendation to Park Commission and approval of the City Council. Standing Committees established by the-Board may include the following: a nominating committee,.volunteer committee-and event committee. 9. REMOVAL Should a Director demonstrate a cause ar conduct inconsistent with the purposes of the Foundation,, such cause of conduct shall constitute grounds fora) mediation of the conflict, orb} removal by the Baard of Directors. The appropriate step to betaken shall be decided by the Board of Directors. Mediation shall be taken if a majority of Board so agrees. Removal shall not be decided unless two thirds of the Board members present vote to db so, at a meeting of which" notice of both the meeting and the issue of removal have been properly sent out in writing to all Directors 14 days before such a meeting. w.. ~" 10. CC+MPENSATLON The Directors shall receive no compensation for their services as such. This provision, however, is not intended to prohibit any payment to a Director for expenses direct#y and reasonably incurred in connection with attendance at meetings or other necessary business.of the Foundation. . 11. ANNUAL MEETINGS OF DIRECTORS The Board of Directors shall meet annually for the purpose of organization appointment of Directors,. appointment of Officers, and for the transaction of other business. REGULAR MEETINGS OF DIRECTORS The Board. of Directors shall meet from time to time as determined by-the Board to conduct the business of the Foundation. SPECIAL MEETINGS Special meetings of the Board far any purpose may be called at any time by the Chairman or by any three Directors. As used herein, the term "special meeting" shall Inc#ude a meeting in which is~conducted through the facilities of a telephone conference ,call where each participant, wherever physically located, is continuously capable of hearing, and being heard by, all-others participating in the conference call. Notice. of the time and place and nature of such special meeting shall b~ communicated to each Director personally, by mail or electronicmail sent at-least 3 days prior to any such meeting. The transactions of any meeting of the Board however called and noticed and whenever paid, shall. be as though it were at a meeting duly held after regular-call and notice, if a quorum is present or if either before or after the meeting each Director not present signs a written waiver of notice or a consent to hold such meeting or an approval of the minutes thereof. All decisions concerning the making of grants will be made by the Central Point City Council after consideration of recommendations made to the City Council by the Board. The Foundation is a conduit for funds to be obtained for the benefit of the Citizens of the City of Central Point. Part A of the pay plan (General Service Bargaining Unit) reflects implementation of the pay scale proposed by LGPI in their Wage Study final report (attached). The revised FY09-10 pay plan- incorporates all of the changes recommended in the LGPI wage study report, including a new format of pay grade and any associated changes in gosition titles and grade. Additionally, per the current collective bargaining agreement, a cost of living adjustment (COLA) has been incorporated into the 09-10 pay scale. The bargained amount of the COLA is the CPi-W January to January figure with a minimum of 3% and a maximum of 4%. The January 08 to January 09 CPI-W figure was less than3%, so the COLA is 3%. Not all employees will realize a 3%' increase in pay because the adjustment was made to the pay scale, not individual salaries. Part B of the pay plan (Police Bargaining Unit} reflects an increase of 3% over the FY08-09 salary scale, The collective bargaining agreement ratified in October, 2007 includes an annual cost of living increase based on the January to January CPI-W figure with~a minimum of 3% and maximum of 5%. The.CPI-W January 08 to January 09 was less than 3°/n, so a 3% COLA was implemented. Part C of the pay plan (Non-Bargaining Unit, Management Positions) reflects no increase to the FY08-09 salary scale for exempt, management positions. The management team offered to forego a cost of living adjustment this year due to the current economic conditions. The non-management Accountant position in Part C of the pay plan did receive a 3% cost of living adjustment. Other changes to the pay plan include moving two positions from Part A to Part C -the Accountant position was reclassified as confidential mid-year of 08-09 and that change has been codified in the pay plan. And, upon recommendation of LGPI, the Recreation Supervisor position has been reclassified as an exempt, management position. Additionally, the Accounting Supervisor position was not filled when the Accounting Supervisor ~as promoted to Finance Director, sa that title has been removed from Part A of the pay plan. And, the new Assistant City Administrator position has been added to Part C and Deputy Public Works Director has been removed. FISCAL IMPACT: Implementation of the wage study recommendations resulted in a net increase to General Service bargaining unit position pay of 2.7%, as opposed to a 3% across the board increase that would have been applied had the study not been done. The annual savings from the management group foregoing a 3% COLA is approximately $35,000. A RESOLUTION REVISING POSITION CLASSIFICATION PAY PLAN WHEREAS, Chapter 2.48 of the Central Point Code authorizes and directs the City Council to adopt rules relating to personnel matters, and the City Council having. heretofore by Resolution Number '1085 adopted and revised such rules, including the Classifica#ion Pay Plan, and WHEREAS, Policy #5.2.3 of the Personnel Policies and Procedures provide that the Council shall by resolution adjust the salaries and rates of compensation and benefits for all City officers and employees, and the City Council deems it to be in the best interest of the City to make revisions thereto; now, therefore, BE IT RESQLVEQ BY THE .CITY COUNCIL. OF .THE .CITY OF CENTRAL POINT, OREGON, that the Position Classifcation Pay Plan for bargaining: unit .and management employees, as attached, and by this reference incorporated hereto, be, and the same are, hereby ratified and adopted.
