,x< ~e °~i RESOLUTION NO. f~ A RESOLUTION DECLARING THE ANNEXATION OF 1.8 ACRES OF LAND LOCATED NORTH OF TAYLOR ROAID AND EAST OF VALLEY OAK BOULEVARD, INTO THE CITY OF CENTRAL POINT, OREGON (37 2W 03CD Tax Lots 2900 and 3000) WHEREAS, ORS 222.125 provides that when all of the owners of land in the territory proposed for annexation and not less than 50% of the electors residing in such territory have consented in writing to the annexation of the land in the territory and file such written consent with the City Council, the property may be annexed without the requirement for an election or a public hearing; and WHEREAS, on July 10, 2008, the City of Central City Council conducted aduly-noticed public hearing on the annexation application, at which time it reviewed the City staff report and heazd testimony and comments on the application; and WHEREAS, the owners of the property proposed for annexation aze Rayma, Bazbaza and Jan Bateman, and there is sole consent to the annexation. Such written consent is on file at Central Point City Hall, 140 S. Third Street, Central Point, Oregon; and WHEREAS, the property to be annexed consists of two (2) tax lots and Taylor Road right- of-way totaling approximately 1.8 acres, and is more particularly described as follows: Beginning at the Quarter Corner common to the Sections 3 and 2, and the center line of Taylor Road, Jackson County, Oregon; thence North 00° 18'27" West, 30 feet to the Northerly Right of Way to Taylor Road, thence; North 00°17'01" West, 149.98 feet to the existing city limits of Central Point, Oregon, thence; North 00°18'23" West, 50.02 feet to the boundary of the pazcel described in Instrument Number 1998- 026939, thence; North 00°18'25" West, to said city limits, thence South 89°49'38" West, 214 feet, to said city limits, thence; South 00° 18'24" East, 336.00 feet to the Northerly Right of Way to Taylor Road, thence South 00° 18'24" East; 29.99 feet to the center line of Taylor Road, thence; North 89°49'38"East, 214 feet along the centerline of Taylor Road to the point of beginning. Containing 1.80 Acres, more or less WHEREAS, the property is not within the City of Central Point's current corporate boundaries, but is contiguous to the City's existing corporate boundary and is within the Central Point Urban Growth Boundary (LJGB); and WHEREAS, annexation of the described property is consistent with the City's ability to provide facilities and services to the real property, as required by the City's Comprehensive Plan; and WHEREAS, after duly considering the annexation application, it is the City Council's determination that the application does comply with applicable standards, criteria; and WHEREAS, the City Administrator, or his designee, shall transmit a copy of this resolution to the Oregon Secretary of State, and this annexation shall be effective when filed with the Oregon Secretary of State pursuant to ORS. 222.180; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Central Point, Oregon, that property as set forth in Exhibits "A" and "B ", which are attached hereto by reference and incorporated herein, shall be and hereby, annexed into and made part of the City of Central Point, Oregon.
