HomeMy WebLinkAboutCouncil Resolution 1324RESOLUTION NO. A RESOLUTION TO ANNEX PUBLIC STREET AND RAILROAD RIGHT-OF-WAYS WITHIN THE URBAN RENEWAL BOUNDARY RECITALS: A. Certain portions of the public street and railroad right-of-ways located within the Urban Renewal Boundary, and generally illustrated by Exhibit A, are deemed to not be within the City of Central Point city limits. The Central Point City Council (the Council) is authorized under ORS 222.120 to hold a public hearing for annexation proceedings without an election for annexation. B. On February 9, 2012 the Council conducted a duly noticed public hearing on the annexation application, at which time it reviewed the City staff report, heard testimony and comments on the application to annex those public street right-of-ways within the proposed Urban Renewal Boundary specifically described in attached Exhibits "A" Graphic Illustration of Boundary and Affected Right-of-ways, Exhibit "B" Urban Renewal Boundary Written Description and Exhibit "C" Right-of-ways for Public Streets Described. C. The City Manager, or designee, will transmit a copy of this resolution to the Oregon Secretary of State, and this annexation is effective when filed with the Oregon Secretary of State pursuant to 0 RS. 222.180. D. This annexation qualifies as a full consent annexation since the property annexed is publicly owned or consists of public or railroad right-of-ways. For purposes of determining the number of owners required to consent to a full consent annexation, ORS 222.170(4) provides "Real property that is publicly owned, is the right of way for a public utility, telecommunications carrier as defined in ORS 133.721 or railroad or is exempt from ad valorem taxation shall not be considered when determining the number of owners." No owner of such property has filed an objection to the annexation. The City of Central Point resolves: Section 1: The public right-of-ways described in the above recitals and set forth in attached Exhibits "A", "B"and "C" are proclaimed to be annexed to the City of Central Point.
