AN ORDINANCE AMENDING SECTION 12.20.020(A)(2)
OF THE CENTRAL POINT MUNICIPAL CODE TO ADD
A PROVISION ALLOWING PARKLETS AND SIDEWALK CAFES WITHIN THE
PUBLIC RIGHT-OF-WAY WHEN A PERMIT IS ISSUED BY THE CITY
RECITALS:
A. Pursuant to CPMC, Chapter 1.01.040, the City Council may from time
to time make revisions to its municipal code which shall become part of
the overall document and citation.
B. The City allows limited items within the public right-of-way. Specifically
sidewalk cafes are allowed within sidewalks pursuant to CPMC
Chapter 5.10 but there are no provisions allowing seating within city
streets as many jurisdictions now allow.
C. City Council directed staff to establish a Downtown Parklet Program to
be adopted on a trial basis.
D. Upon review, the staff and city attorney determined that amendment to
the prohibited items in the public right-of-way is necessary to allow
pedestrian-oriented amenities, such as parklets and other similar
structures, when permitted by the City.
E. Words lined-through-are to be deleted and words in bold are added.
