MEETING CALLED TO ORDER AT 7:00 P.M
II. ROLL CALL: Present were Garth Ellard, Dick Halley, Karolyne Hugo, Bob
Matthews, Chuck Piland and Candace Rayburn.
Rick Bettenburg was absent. Also present were George Rubaloff,. City
Administrative Assistant, Mark Servatius, Fire Chief/Building Official, Larry R.
Blanchard, Public Works Director, and Cecelia Gordon, Secretary.
III. APPROVAL OF MINUTES
A. Commissioner Piland moved to approve the April 2, 1991 Minutes, and the
motion was seconded by Dick Halley. Roll Call Vote: Halley, yes; Hugo,-yes,
Matthews, abstained and Rayburn abstained. The Minutes were approved.
IV. CORRESPONDENCE
None
George Rubaloff, City Administrative Assistant took this occasion to welcome
the new Planning Commission Member, Candace Rayburn.
V. BUSINESS
~ Public Hearing Resolution 218 -Review and determination of a

There were no conflicts of interest on the part of the Commission, Chairman
Ellard opened the Public Hearing.
George Rubaloff, City Administrative Assistant referred to his Staff Report of
April 29, 1991 on the Proposed Resolution.
Rubaloff also referred to the following exhibits and entered them into the record

approving Conditional Use Permit:
Applicant, Sharon Wilder, 1245 Mt. Vievv Orive, Eagle Point, came forward in
support of the proposed Conditional Use Permit. The Commission asked her
if she understood and agreed to all the conditions set forth by staff. She
agreed to all. conditions, but asked- for a time period of 6 months to have
sidewalks installed, because of financial considerations.' Also she asked that
the landscaping strip only be 6 feet instead of 10 feet in width:
In answer to the Commission's question aboutfiours of business, Mrs. Wilder
stated that it vvould be normal business hours, 8 a.m: 'to 5 p.m. The
Commission informed her a change of tenant would be reviewed
administratively through the City's Business Application process.
No one else came forward in support of, or in opposition to the Conditional Use
Permit. Chairman Ellard closed the Public Meeting.
The Commission stated that they would be agreeable to changing the
requ)remenf of the landscaping strip width to 6 feet: They also stated they
would agree to a period of six months (commencing om date of approvaq in
which Mrs. Wilder would be required to install the sidewalks:
Commissioner Rayburn moved that'they approve Resolution 218 as amended
for the Conditional Use Permit for Automotive Repair Service at 27 Bush Street
(37 2W 11BC TL 3900.) Applicant Sharon Wilder.
Roll Call Vote: Halley, yes; Hugo, yes; Matthews,' yes; P)land, yes and
Rayburn, yes. The Motion carried unanimously.

Ellard opened the Public Meeting.
George Rubaloff referred to his April 25, 1991 Staff. Report. He also referred
to and entered into the record by reference the Vicinity Map, Certificate of
Posting. for Public Meeting„ and Public .Works Staff Report, dated April 23,
1991...
Mike Mahar, 1014 N. Riverside, Medford, Oregon came forward in support of
the .Master/Development Plan.. Mr. Mahar stated that the homes would be
quality homes in the 1500, 1600 sq. ft. size, with shake roofs, etc.
The Commission asked staff if .there was storm drainage for this proposed
subdivision. Larry Blanchard said that there was and that it was adequate and
in place.
No one else came forward in support of or in opposition to the proposed Master
Rlan. Chairman Ellard informed Mr. Mahar that he could stay in front because
the next Agenda item also covered the proposed Subdivision.
Chairman Ellard then closed the Public Meeting. ,Commissioner Piland moved
to approve the Master/Development Plan for Green Park Village Subdivision
(Applicant: Pacific Trend Development Company) (37 2W 12C Tax Lots
800,807, 3100 .and. 3400) Itormerly Meadow- Creek Subdivision in the
southeast quadrant of the City). Commissioner Matthews seconded the
Motion. Roll Call Vote: Halley, yes; Hugo, yes; Matthews, yes; Piland, yes; and
Rayburn, eyes. The Motioncarried unanimously..
C. Public Meeting Resolution 219 Review and Recommendation to City Council

There were no conflicts of interest. Chairman Ellard opened the Public Meeting.
George Rubaloff referred to his Staff Report of April 25, 1991, and exhibits,
and entered into the record by reference: a Vicinity Map, Certificate of Posting,

Larry Blanchard, Public Works Director referred to his Staff Report dated April
25, 1991, and informed the Commission that the number of acres in Phase I
would be 14, and number of lots would be 44. He also referred to item 11 in
Exhibit "A" of his Staff Report to read "Fire Hydrants shall not be spaced
greater than 300 feet final spacing......" The Commission did not have any
questions.
Mike Mahar was still seated in front and was available to the Commissioners
for any .further concerns they might have. Mr. Mahar .took the .occasion to
compliment staff for their professional manner and efficient processes. There
were no further questions. No one else came forward in support of or in
opposition to the Preliminary Subdivision Plat. Chairman Ellard closed the Public
Meeting.
Commissioner Halley Made a Motion for approval of Resolution #219
` recommending that The City Council approve a Preliminary Subdivision Plat for
Phase 1 of Green Park Village. (Applicant, Pacific Trend Development Company).
Commissioner Rayburn seconded the Motion.. Roll Call Vote: Halley, yes;
.Hugo, yes; Matthews, yes; Piland yes, and Rayburn, yes.. The Motion carried
unanimously.

Chairman Ellard asked if there were any conflicts of interest. Bob Matthews
stated that he was related to Mr. Rietmann by marriage, but that he did not
have any conflict of interest in the matter. Chairman Ellard opened the Public
Meeting.
George Rubaloff referred to his Staff Report dated April 26, 1991, and
attachments, Map illustrating general area, Certificate of Posting, April 5 letter
to Rietmann, April 11, 1991 letter to Rietmann, Vacation Application materials,
April 16, 1991 Notification to Utilities, Public Works Staff Review dated April

Steve Reitmann, applicant, 3697 Highway 238, Jacksonville, Oregon came
forward in support of the vacation of the alleyways.
The Commission had a concern about how the City had missed the location of
the alley, when they did their review process. Staff explained that the alley
was not marked on the present maps, but had been included in the original
town plat.
No one else came forward in support of or in opposition to the vacation of the
alleyways.. Chairman Ellard closed the Public Meeting. Commissioner Piland
moved that they approve the Resolution recommending the Vacation of Certain
Alleys located within Amy and Harbaugh's Addition,' a subdivision Platted in
1889, Located Generally North of West Pine, East of haskeii Street, South of
Taylor Street and West of the Southern Pacific Railroad in Central Point,
Oregon. Commissioner Hugo seconded the Motion. Roll Call Vote: Halley,
yes; Hugo, yes; Matthews, yes; Piland, yes, and Rayburn, yes. The Motion
carried unanimously..

Larry Blanchard, Public Works Director, showed the public present a map of the
Master StreeYPlan on the overhead projector. He referred to his Staff Report
dated April 25, 1991, and .entered it into the record by reference. He explained
that this was'not a Public Meeting, but that he would be sending out notices
when the Planning Commission includes the next Public Meeting om the
.Meadow Creek Master Street and Development Plan. George Rubaloff, had
been handed a letter from Di Grensky relating to her opposition to Meadow
Creek Lid,. in the beginnirig of the Meeting, and entered this letter into the
record.'

George Rubaloff, Administ~ative'Assistant, referred to his Staff Report of April
25, 1991, vvith attachments: Vicinity Map, Certificate of Posting, Preliminary
Plaf Application, Assessors Map;' Public Works Staff Report dated April 25,
1991, Proposed Resolution recommending approval of the preliminary Plat and
a colored map dated May 3, 1991 showing the change in lot configuration,
which was labeled Item G, all of `which were entered into the record by
reference. .The number of lots were reduced by two (2) to line up with the
sewer line easement and would create a more desirable lot frontage on the cul-
de-sac on Josephine Court.
Applicant, Tom Malot, 525 Renee's Circle, Central Point, Oregon came forward
in support of the Preliminary Subdivision Plat. Mr. Malot said he had reviewed
the conditions as set forth in 'the Public Works Staff Report dated April 25,
1991' and agreed to the same.
No one else came forward in support of or in opposition to the Preliminary Plat
approval. Chairman Ellard closed the Public Meeting:
Commissioner Halley moved for the Resolution Recommending a Preliminary
Subdivision Plat for Jackson Creek Estates Unit No. 3, Phase I. Commissioner
Rayburn seconded the Motion. Roll Call Vote: Halley, yes; Hugo, yes;
Matthews, yes; Piland, yes and Rayburn, yes. The Motion carried unanimously.

within a subdivision known as Amv Harbaugh's addition generally located north
of West Pine east of Haskell Street and west of Southern Pacific Railroad
(Apolicant: Tri-Arc. Inc. -Crater High Students.)
Chairman Ellard asked if there vvas a conflict of interest; and being none opened
the Public Meeting. George Rubaloff referred to his Staff Report of April 25,
1991, with Parking Design Standards Ordinance, Vicinity Map, Certificate of
Posting, Tax Assessor and Aerial maps, Public Works Staff Review dated April
29, 1991, Site Plan and Application Form, and entered them into the record by
reference. Gordon Hancock, 8839 Hardy Way, Gold Hill, Oregon, and Jason
Jenkinson of 395 Gold Hill Highway, Gold Hill, Oregon, Applicants (Crater High
Students) came forward in support of the Site Plan Review.

The Commission had concerns about what type of businesses would be tenants
in the proposed Industrial Park. Mr. Hancock assured them that there would
be no hazardous materials stored on the. premises. The loading and unloading
configurations were discussed. When asked which .kind of material the
structure would be constructed of, ahe applicants answered that it would be
concrete block. ,Fire Chief/Building ;Official, Mark Servatius advised the
applicants that in a complex of this size,. they would be required to build in fire
support hookups. Landscaping and parking areas were also discussed.
No one else came forward in support of or in opposition to the Mock Site Plan
Review. Chairman Eliard closed the Public Meeting.
Commissioner Halley. moved that they approve the Mock Site Plan Review of
Industrial Park located within a subdivision known as Amy and Har6augh's
additional generally located north of West Pine, east of Haskell Street and west
of Southern Pacific Railroad. -.Applicant: Tri-Arc, Inc. -Crater High Students).
Commissioner Matthews seconded the Motion.

Commissioner Piland moved that the meeting be adjourned, Commissioner
Halley econded the Motion, the Motion carried unanimously, and the. meeting
adjourned at 9:55 p.m.

SUMMARY
A public meeting has been scheduled for June 4, 1991, during which Staff will
present the Planning ComnLission with a Staff Report regarding the proposed
expansion of Grange Co-Op. After receiving the report and public input, and
discussing the plan, the Commission can decide on site plan proposal.
BACKGROUND
On behalf of the Grange Cooperative Supply Association, Jim Hudson, General
Manager, has submitted a site plan to the City proposing a retail supply yard
in the C-5 (thorough fare commercial) zone. The proposed supply facility is
incidental to the principle retail use, conforms to established patterns of land
usage or customary business practice for uses of like nature, and is therefore
an acceptable accessory use in the City's C-5 zone.
The .69 acre site is bordered by Ash Street on the north, Cedar Street on the
south, First Street on the east and butts up against a north-south alley on the
west. The two tax lots (7100 and 7400) were once separated by a 20 foot east-
west alley until March 22, 1991, when the Central Point City Council adopted
Ordinance No. 1655 vacating said alleyway.
The project features a paved surface, fencing, a future building site, Ash Street
entrance, First Street exit, high pressure sodium lighting, landscaping with
automatic sprinklers, and kerosene storage tank.
Planning, Public Works and Building Department Staff reviewed the proposed site
plan and pertinent zoning and development standards, and have prepared. reports
which outline the recommended conditions of approval.

ORDINANCE NO. 1642
AN ORDINANCE-AMENDING THE ORDINANCE
RELATING TO THE OBSTRUCTION OF STREETS
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS
FOLLOWS:
Section 1. Section 12.20.020 of the Central Point Municipal
Code is hereby amended to read as follows:
12.20.020 Prohibited. It is unlawful for any .person to place or
allow in or over any alley, street or sidewalk, or any street or
alley right-of-way, whether improved or not, any of the
following:
(a) Any garbage or refuse of any nature, provided,
however, that garbage or refuse in enclosed containers may be
temporarily placed within the street right-of-way upon garbage
collection days.
(b) Any building, fence or other structure, including
items which are by design intended to be portable, provided
however, that mailboxes may be placed in a right-of-way, at the
owners' expense, if the same do not impede either the use of said
right-of-way or sight distance necessary for the safe use
thereof, and further provided that the same shall be removed upon
the request of the.City.
(c) Any sports equipment or structures.
(d) Any vehiale, for a period of longer than six (6)
hours, except in the following circumstances:
(1) In a location where parking is otherwise
allowed, subject to the restrictions of such
allowance; and
(2) When said vehicle is attended by a driver
who is in the immediate vicinity and capable
of immediately removing the vehicle,
whereupon said vehicle may be parked for
loading or unloading for a period reasonably
necessary for said purpose, provided that the
driver thereof shall forthwith move the same
upon request in order to permit ingress or
egress to other premises, or upon request of
a peace officer or fireman.
(e) Any trees, shrubs or other landscaping growing, .
encroaching or overhanging said alley, street, sidewalk or right-
of-way, provided, however, that landscaping consisting of grass
or groundcover not in excess of 10 inches in height may be placed
in an unimproved portion of a right-of-way, at the adjacent
property owner's expense, if the same does not impede sight
distance necessary for the safe use of the street, alley or

sidewalk by vehicular or pedestrian traffic, and further provided
that said landscaping shall be removed by said property owner at
the City's request, and may be removed by the City at any time.
Section 2. Section 12.20.030 of the Central Point Municipal
Code is hereby amended to read as follows:
12.20.030 Penalty. Any person or persons violating any of the.
provisions of this chapter shall upon conviction be punished in
accordance with the general penalty ordinance of the City..
Section 3. Chapter 12.16 of the Central Point Municipal
Code is hereby repealed.

Upon reviewing applicable zoning regulations., staff has outlined the following
`'requirements which shall be met by the developer as a condition of site plan
approval for the project:
1. Landscaping (CPMC 17.46.050D)
Ih exchange for a reduction of the ten (10) foot front yard landscape
strip, developer shall landscape a six (6) foot strip, plus that
portion of right-of-way between the property line and the inner edge
of the sidewalk. Said landscape installed onto the public right-
of-way shall be low growing and shall conform to CPMC 12.20 (revised

standards and the applicable parking design requirements which are
applicable to outdoor sales areas at that particular time in the
future.
Explanation: The applicant proposes to use the site as an
accessory storage area for approximately one year.
The applicant will then operate the site as a
storage and customer loading facility. The
applicant does not plan to conduct sales
transactions at the facility. At that time,
merchandise will be stored in rows along the side
and a large open area in the middle of the site
will provide for loading, ingress and egress. The

service sizing and potential industrial waste connections to the

SUMMARY
A public meeting has been scheduled for June 4, 1991, during which staff will
present the Planning Commission with a Staff Report regarding the proposed
Automatic Car Wash. After receiving. any public input, the Planning Commission
can then make a determination regarding the Site Plan Application for the
proposed project.
BACKGROUND
Applicant James Ross has submitted a site plan to the City proposing an Automatic
Car Wash facility in the C-5 (thoroughfare commercial) zone. The proposed land
use is a permitted C-5 use listed in Section 17.56.020 (12) of the Central Point
Municipal-Code. The specific site is a 53.33 X 120 foot tax lot located north
of the paved parking lot behind the Corner Club Tavern and directly east of the
China Boat Restaurant. The project calls for an approximate 756 square foot
structure to house the washing equipment and provide for soap sumps, office. and
restroom. The project also features a completely paved surface to provide for
customer traffic and a chain link fence around the perimeter of the site.
Approximately 333 square feet of area will. be dedicated to landscaping. Vehicles
(customers) are proposed to enter and exit onto from First Street in a loop
movement as illustrated on the applicant's site plan.
Pursuant to 17.72.040(G) of the City code, the Planning Commission shall. base
site plan decisions upon aesthetic and architectural compatibility with adjacent
properties, the surrounding neighborhood and the Central Point area. While
aesthetics is a matter of taste and preference with regard to what looks good,
staff suggests that during the Public meeting, the Commission and the applicant
engage in discussion regarding this particular standard. The proposed

development is not adjacent to any structures which are on the City's inventory
of historic places, however, some such buildings are within the general vicinity.
The Planning Commission has the authority to impose development standards upon
a developer such as, but not limited to, height, setback, and visual buffering
in order to ensure land use compatibility.
A 100 X 20 foot east-west alleyway once traversed the southerly portion of the
tax lot. The alley was vacated on May 12, 1955 and recorded by official record
number, Volume 410 Page 300.
Planning, Public Works and Building Department staff reviewed the proposed site
plan and pertinent zoning and development standards, and have prepared report's
which outline the recommended conditions of approval.

The C-5 zoning property has been approved for a car wash of which is located
on North 1st street. The proposed building will be 17' X 36'. This building
is necessary to accamnodate a fully automatic car wash, this unit will wash
both cars and trucks in approximately 3-4 minutes.
The floor arna will be condrete'slab with a 6" curb above finished slab slopped
to water drain. The south wall located 5' from property line will extenR 36"
above roof line, construction will be 2.X.6 studs covered. with 5/8 " fireboard
outside and inside wall, the outside wall will be capped with 26 gauge metal.

The business area will be enclosed with metal chain link fence with height to meet
city regulations.
The waste water from the car wash: will only be polluted with dirt and etc., no
cleaning of auto motors and eta will be done.

its outlining areas.

Upon reviewing applicable zoning regulations, staff has outlined the following
requirements which shall be met by the developer as a condition of site plan
approval for the project:
1. Landscaping .(CPMC 17.46.050(d))
Due to the vehicular egress and ingress of the proposed use,
landscape would be more practically located along the sides and
within island areas upon the site. Developer shall provide and
maintain an equivalent of 333 square feet of landscaping area in side
areas and island planters such that it is visible from the front of
the property.
2. Setback (CPMC 17.46.OSOE)
Applicant shall provide minimum 5 foot setback between the structure
and the side property line
3. Illumination and signs (CPMC 17.46.070 A,B,C and 17.72.040D)
Applicant shall ensure that lighting and illuminated signs are
designed so that direct rays are not toward or parallel to the public
right-of-way or directed toward any residentially zoned property:
Applicant shall apply fora separate sign permit prior to installing
signs on the project site..
4. Projections (CPMC 17.60.100)
Applicant shall ensure that all architectural features of the
structure project no more""then eighteen (18) inches into the required
setback area.

Applicant shall maintain clear vision area on either side of the
driveway approaches equal to the triangular area formed by connecting
points which are a 20 foot distance from the intersection of the

7. Parking (CPMC 17.64.040)
The City does not have a specific standard for an automatic car wash
facility. Based upon other commercial standards, the developer shall
provide two 9 X 20 foot striped and marked spaces (employee and
service vehicles). Said parking spaces' sha1T be designed in'
accordance with City Ordinance 15.12, a copy of which is attached
hereto and made a part of this document...
8. Driveway (CPMC 17.64.080 (6 and 7))
Applicant shall construct commercial driveways to a width of no less `
than twenty (20) feet and no more than thirty (30) feet measured
from driveway approach.
9. Vehicular movement (CPMC 17.72.040E & C)
Developer shall ensure that customers drive off immediately after
wash, as the plan does not appear to provide adequate room .for
interior cleaning and detailing. Developer shall also include a plan
for customers to depart from the customer queue and exit the facility
before going through the wash.

within rights of ways owned, or to be owned by the City of Central

Point for the construction of this development.
