ROLL CALL Those present were Garth Ellard, Rick Bettenburg, Jack Crumm, Dick Halley, Karolyne Hugo, Bob Matthews and Chuck Piland. Also present were George Rubaloff, City Administrative Assistant, Mark Servatius, Fire Chief/Building Official, Larry R. Blanchard, Public Works Director and Cecelia Gordon, Secretary. III. APPROVAL OF MINUTES Commissioner Piland moved to approve the January 8, 1991 Planning Commission Meeting Minutes and the motion was seconded by Commissioner Piland. Roll Call Vote: Bettenburg, yes; Crumm, yes; and Halley, Yes; Hugo abstained; Matthews, yes; and Piland, yes. The motion carried unanimously. IV. BUSINESS A. Public Hearing Resolution #216 -Conditional Use Permit For Pet Groomino Service (The Puoov's Tub) 237E Pine Within the Citv's Downtown Business District (C-3 Zone- (37 2W 3DD TL 108001. City Administrative Assistant, George Rubaloff, entered into record by reference the Notice of Public Hearing mailed to adjacent property owners, Mailing List, Certificate of Posting, Application Materials, July 20, 1982 Planning Commission Minutes, Planning Department Staff Report including Conditions of Approval dated January 28, 1991, Zoning Map, Aerial Map, Vicinity Maps, and Tax Assessor's Map, proposed Resolution approving Conditional Use Permit. George Rubaloff reviewed the Conditions of Approval with the Commission and assured the Commission that the applicants and staff had reviewed and discussed those conditions prior to tonight's Planning Commission Meeting. Two of the Commissioners, (Matthews and Bettenburg) had a conflict of interest and excused themselves from their Commission seats and joined the public in the audience. Chairman Ellard opened the Public Hearing. .. _ ~ ~. CITY OF CENTRAL POINT Planning Commission Meeting Minutes February 5, 1991 Page Two Representing the business as an employee of "The Puppy's Tub", Janet London General Delivery, Central Point, Oregon came forward to answer questions and discuss the project with the Commission and Staff members. Doris Kunce, 237 E. Pine, Central Point, Oregon, owner of the business came forward as well. Kathy Gorden, 4825 Old Stage Road, Central Point, Oregon,(wife of applicant and property owner) also came forward to respond to any concerns from the Commission or Staff. The Commission's concerns about parking space, number of pets served per average business day ten (10) pets, and business hours of operation (8 a.m. - 5 p.m.) were answered satisfactorily. The Applicants reassured the Commission that no animals are contained outdoors on the site, nor will any animal be kept over night at the site. Fire Chief/Building Official, Mark Servatius asked the applicants about the extent of any remodeling or changes in the interior of the business. Ms. London assured him that no structural changes were involved, that they just covered over cracks in an old non functioning door, in order to prevent noise and odor transferring to the PP&L Office next door through the crack. Carol Fisher, 1148 N. 5th Street, Central Point, came forward in support of the the business. No one else came forward in support of or in opposition to the Conditional Use Permit Application. Chairman Ellard closed the Public Hearing. Commissioner Piland entered the motion that the Commission approve Resolution 216 for Conditional Use Application for Pet Grooming Service (The Puppy's Tub) at 237 E. Pine - 37 2W 3DD Tax Lot 10800. (Applicant Milton Gordenl. Commissioner Halley seconded the motion. Roll call vote: Crumm, Yes; Halley, Yes; Hugo, Yes, and Piland, Yes. The Motion carried unanimously. Administrative Assistant, George Rubaloff referred to and entered into the record by reference the Planning Department Memorandum dated January 30, 1991, Vicinity Maps, Certificate of Posting for Pubiic Meeting, Site Pian Application Materials, Tax Assessor Maps, Aerial Maps, Planning Department Site Plan Review Dated January 31, 1991, Public Works Department Site Plan Review dated February 1, 1991, and Reduced copy of Site Plan for the Saxbury Furniture Store addition. Rubaloff referred to the January 31, 1991 Planning Department Report and Pubiic Works Department Report of February 1, 1991 with i:he Commission and assured them that staff had shared the Conditions with the applicants on Monday, February 4, 1991. Chairman Ellard asked if there were any conflicts of interest, there were none, Chairman Ellard opened the Public Meeting. Applicant, Bill Saxbury, 2580 Beall Lane, Central Point, Oregon came forward in support of the Application and to respond to the Commission. The Commission was concerned that since this is an application for a shell (building) only, that there may be a demand for more parking. George Rubaloff assured the Commission that staff had used a formula for the highest volume of parking spaces needed for most general commercial uses, and that there is more than ample room for any future expanded parking on applicant's property. Mr. Saxbury commended staff for their assistance and that he wanted to make sure they knew how much he appreciated their facilitating his application in such a professional manner. No one else came forward in support of or in opposition to the Site Plan Application. CITY OF CENTRAL POINT Planning Commission Meeting Minutes February 5, 1991 Page Four Commissioner Halley moved to approve the Site Plan Application based on the Conditions in the January 31, 1991 Planning Department Report, and the Public Works Department Report dated February 1, 1991. Commissioner Bettenburg seconded the Motion. Roll Call Vote: Bettenburg, Yes; Crumm, Yes; Halley, Yes; Hugo, Yes; Matthews, Yes, and Piland, Yes, and the Motion passed unanimously. V. MISCELLANEOUS 1 Central Point Population City Administrative Assistant, George Rubaloff reported that Portland State University's latest figures from their February 1, 1991 Report was that the population of the incorporated City of Central Point was 7,535. He also stated that the U.S. Census figures were very close at 7,509, and commented that City of Central Point was in a growth pattern. 2. Disclosure Information George Rubaloff, City Administrative Assistant handed out his Memorandum of February 4, 1991 for the Commission's information and review. 111 Definition of Ex Parte (2) Definition of Conflict of Interest (3) Excerpt from Central Point Municipal Code (1.24.070F) relating to Disclosure Procedure There were no further miscellaneous items. MEMORANDUM TO: Planning Commission FROM: George Rubaloff, Administrative Assistant/~!~~~ DATE: February 28, 1991 TOPIC: First Presbyterian Church Site Plan Review (37 2W lOBD Tax Lot 4100 and 37 2W lOBA Tax Lot 700) SUMMARY The Planning Commission is scheduled to conduct a public ,meeting on March 5, 1991, after which the commissioners may decide to approve or deny the site plan, or continue the review at a later date. BACKGROUND The Elder-Trustees of the First Presbyterian Church have submitted a site plan for a 3,013 square foot addition to the existing church building. The site is located at 456 West Pine in the R-1-8 zone. Churches, similar religious institutions and their accessory uses are a permitted land use within the R-1- 8 (Residential Single Family District). As illustrated in the site plan application, the addition will include a concrete slab, lap siding, engineered trusses, composition shingle roof and will conform with the architectural style of the existing church building. The addition is intended to provide primarily for classroom space with some space allocated to office, reception, storage and restrooms. ANAT.VGTS The Planning Department has reviewed the site plan for conformance with those applicable zoning standards outlined in Chapters 17.20, 17.60, 17.64 and 17.72 of the Central Point Municipal Code. Those standards relate specifically to building height, yard requirement, lot coverage, parking, landscaping, ingress and egress, signs, accessibility to firefighting facilities and architectural compatibility. Planning staff concludes that the proposed church addition conforms with all the required standards. The Department, therefore, has not recommended any specific conditions of approval. -- ~ The Public Works Director has also reviewed the site plan for conformance with the Public Works Standards and has prepared a staff report which includes specific requirements for the project. The Developer shall dedicate to the City of Central Point, an additional 10' of right of way for future street improvement from the most southerly portion of the property abutting W. Pine Street. This dedication shall be done as a part of approval of this Site Plan Review. //. Sanitary Sewer /mprovements: A. Existing Conditions: 1. An 8" Sanitary Sewer is located on the north side of W. Pine Street. Invert elevation of pipe in front of this property is 1270. B. Developer's Required Conditions: 1. Developer shall prepare a plan to show how sanitary sewer will be provided for this project prior to issuance o~ ~ building permit. 2. If a pump station is required, it shall be installed according to the latest edition of the Uniform Plumbing Specialty Code. ///. Water System /mprovements: A. Existing Conditions: 1. An 8" AC waterline is located on the north side in W. Pine Street. 2. The nearest Fire Hydrant is #256 located approximately 100' east of the church access. B. Developer's Required Conditions: 1. Afire hydrant shall be installed by the owners of the property in order to provide for a more practical access for the Central Point Fire Department. Storm Drainage System /mprovements: A. Existing Conditions: 1. No storm drainage pipe exists in W. Pine Street. A storm drainage ditch is located along the W. Pine frontage of this property. B. Developer's Required Conditions: 1. All roof drains, area drains, and crawl spaces shall have positive drainage away from the structure and shall be connected to curb drain or an approved storm sewer. This requirement shall tie to the future expansion of the storm drainage system in W. Pine Street as per Deferred Improvement Agreement. V. Additions/Requirements: A. Some of the applicants have taken it upon themselves to develop for City Council final approval, potential Local Improvement Districts to correct these deficiencies. In order to adequately provide services (i.e. Transportation, Water, Sanitary Sewer, Storm Drainage, Gas, Telephone, Electric, Cable TV) a street plan must be completed to assure that all tax lots will be considered in the Master Street and Development Plan. Attachment #1 identifies the proposed street plans which would provide the best location to accommodate drainage. Bob Blanton Engineering did the proposed plan and tried to the best of their ability to place streets evenly distributed on each side of property lines. Staff realizes that there are some areas where it is difficult to determine how property would best be served taking into consideration spacing of local streets in relationship to collector streets. Attachment #2 identifies minimum spacing requirements and its relationship for each type of street. As you can see from Table 7-3, Local Streets cannot be located closer than 300' on a collector street. These Master Plans assist the City in planning for a logical progression of development when and if it occurs. As you know, the properties in this area are within the proposed Meadow Creek Storm Drainage Basin, which is presently the topic of a potential improvement project if further development is to occur. Nldwever, in order for any project to proceed, a majority of the acreage of property in the proposed project area must agree to the improvement project(s) by formal petition. The Street Master Plan, however, is a separate process other than the proposed Meadow Creek Storm Drainage Project. A map has been attached with this letter to provide you with an outline of some of the streets that have been included to provide a drainage route for the Meadow Creek Basin. However, not knowing how same property owners would want their property served, leaves many gaps in our planning process.
