ROLL CALL Those present were Garth Ellard, Rick Bettenburg, Jack Crumm, Karolyne Hugo, and Chuck Piland. Dick Halley had informed the Commission that he would be out of town, and Bob Matthews had called.. to request that he be excused from attendance due to business demands. Commissioner Jack Crumm attending his first Planning Commission meeting after being sworn in during the August 16, 1990 Central Point City Council Meeting. III. APPROVAL OF MINUTES A. Commissioner Hugo moved to approve the August 7, 1990 Planning Commission Meeting Minutes as written, and was seconded by Commissioner Bettenburg. Roll Call Vote:. Bettenburg, yes; Crumm, yes; and Hugo,. yes. The motion carried unanimously. B. Correspondence -.None. IV. BUSINESS A. City Administrative Assistant, by reference the Certificate Report, Proposed Resolution, Application for Final. Plat. Blanchard gave a short report c and that storm drainage is onf developer. Chairman Ellard opened the Public Meeting. Dave McGee, 3734 Scenic Avenue, Central Point came forward to represent the applicant Bob Schipper. Mr. McGee assured the Commission that the applicant was fully aware of the conditions required, and. that the: last phase of sidewalk would be installed in the near future. Mr. McGee reported that Mr. Schipper really appreciated the way that Staff and the Commission has worked with him to implement the Subdivision process. There were no further appearances .in favor of,~or in opposition to the-matter. Chairman E11ard closed the Public Meeting. Commissioner Pland moved to approve Resolution #204 as written, Commissioner Hugo seconded the Motion. Roll Call Vote: Bettenburg, Yes; Crumm, Yes; Hugo, Yes; and Piland, Yes. The Motion carried unanimously. B. Administrative Assistant, George into the. record by reference the Map, Tax Assessor Map, Aerial proposed Resolution. He also rev Commissioners. He explained that soon as a surveyor could prepare proposed for vacation. Rubaloff referred to and entered Certificate of Posting, Vicinity Map, vacation Application and iewed the matter for the two new Exhibit "A" would be provided as a legal-description of the alley There was no conflict of interest on the part of any of the Commissioners. Chairman Ellard opened the Public Meeting. No one came forward in support of, or in opposition to the proposed Resolution. Chairman Ellard closed the Public Meeting. Commissioner Bettenburg moved that they approve Resolution #205 as written. Commissioner Crumm seconded the Motion. Roll Call Vote: Bettenburg, Yes; Crumm, Yes; Hugo., Yes; and Piland, Yes. Public Meetina - Resolution #206 - TL 100) Applicant - Garv Whittle for Thurman O. Barnes. City Administrative Assistant George Rubaloff entered -into the record by reference, the Certificate- of Posting, Mihor Land Partition Staff Review containing existing site conditiohs and proposed conditions of approval, Application for Minor Land Partition, Vicinity Map, Tax Assessor Map, Aerial Map, Proposed .Minor Land Partition Preliminary Map, Proposed Resolution recommending approval bf Partitioh. Rubaloff 'also stated that there would be some amendments to the existing conditions and conditions of approval in the August 21, 1990 Minor Land Partition Staff Review some items' which were no longer in effect 'with the change. of the configuration 'of Parcel No.2.'and a typo would be corrected to show item Y2 on Page 29 to read Thurman 0. Barnes and Helen Barnes (not Thomas 0. Barnes as written). There were no conflicts of interest. Chairman Ellard opened the Public Meeting. Gary Whittle, 843 W. Maih, Medford, Oregon and Herb Farber, 102 Corcoran Lane,'Central Point; Oregon came forward to respond to questions from staff and the Commissioners. Mr. Barnes was in the audience. There was some discussion about the amendments in the wording in the August 21, 1890 Minor Land Partition Staff Review and Staff .agreed to making the following amendments: 1. Item No. 5 under Existins Conditions 'was corrected to specify that building sizes wee approximate and amended a stated 625 square foot outbuilding to read 850 square feet. 2. Item No. 6 uhder Existing Conditions is deleted. Item No. 1 under Conditions of Abproval was clarified such that applicant, owner or assignee may defer making the specified street or street related improvements until such time as Phase I of Stonecreek No. 4 Subdivision is under way or uhtil such time that a LID is formed for same, whichever should come first. Item No. 7 under Conditions of Approval was clarified such that parcel one shall take access from the existing driveway on Beall Lane and that in event Stonecreek No. 4 dogs not develop completely or at all, the developer shall provide access to parcel No. 2 from Beall Lane. 5. Item No. 11 under Conditions of Approval was clarified such 'that the particular condition applies to new construction. There were no further appearances in support of or ih opposition to the proposed Minor Land Partition. Chairman Ellard closed the Public Meeting. Commissioner Bettenburg moved that the Resolutioh be approved as amended. Commissioner Piland seconded the Motion. Roll Call Vote: Bettenburg, Yes; Crumm, Yes; Hugo, Yes; and Piland; yes. All members voted in favor of the Motion, and the Motion carried unanimously. D. Publlc Meeting - Zone. George Rubaloff entered into the record by reference the following attachments: Item A - Notice of Public Meeting and Public Hearing and Certificate of Posting, Item B - Vicinity Map, Item C - Zoning Maps, Item D - CPMC Chapter 17.54. Rubaloff highlighted an August 29, 1990 Staff Report which provided background relating to the School District No. 6's request for inclusion into the urban growth boundary and annexation, and a discussion relating to specific concerns raised at City Council level about the keeping of animals at the School District's Land Lab. There were no conflicts of interest. Chairman Ellard opened the Public Meeting. No one came forward in support of or in opposition to the change in the zoning ordinance. Chairman Ellard closed the Public Meeting. Upon reviewing the Staff Report dated August 29, 1990, Commissioner Piland moved that the Commission recommend through Minute Motion that the City Council make amendments to the zoning ordinance text relating to the Bear Creek Greenway zone to provide for an authorized Bear Creek Greenway zone and language allowing educationally based animal husbandry as a conditional use in the Bear Creek Greenway zone. Commissioner Bettenburg seconded the Motion. Roll Call Vote: Bettenburg, Yes; Crumm, Yes; Hugo, Yes; and Piland, Yes. MTSCELLANEOUS For the benefit of new Commissioners, Staff briefly reviewed the projects and developments that are under way 'in Central Point, such as the .Oregon State Police facility, Mahar's Meadowcreek Subdivision,_Sentry Market expansion, the proposed shopping center and the I-5 new interchange. VI. ADJOURNMENT Commissioner Piland moved that the meeting be adjourned. Commissioner Bettenburg seconded the Motion. Brittsan) Applicant E.C. Brittsan of 5394 Teresa Way has applied for a conditional use permit to place a mobile home on his property for occupancy of the applicant's parent. Said occupancy will facilitate the caring of the applicant's infirm parent who is unable to maintain a residence or a separate property. Section 17.60.055 of Central Point Municipal Code provides for temporary placement of mobile homes under such circumstances. Upon review of the application, staff has determined the following: 1. Applicant's property is 1.02 acres and therefore exceeds the minimum lot size of an area for temporary mobile home placement. 2. The nature of the infirmity has been certified appropriately by a medical doctor and said infirmity is due to physical and mental impairment. 3. Prior is issuing permits, City will ensure by inspection that water and sewer hookup for the mobile home will meet City and State requirements. 4. Applicant has agreed to obtain appropriate mobile home set-up permits and comply with all applicable requirements for the temporary placement. 5. The applicant has indicated that the trailer unit is registered with the State of Oregon. 6. As illustrated on a plot plan submitted by the applicant, the initial and future site of temporary placement conforms with setback requirements for the R-1 zone and in relationship with the other primary structure on the property. The applicant agrees to discontinue use of the infirm living quarters for the. conditional use after the unit ceases to be used by the person for which the permit is issued, however, since the infirm living quarters is an 8 x 29 foot travel trailer, the applicant wishes to store the travel trailer on his property in conformance with applicable rules and regulations of the City. 9. The applicant has agreed to install .appropriate skirting around the entire perimeter of the temporary infirm living quarters (trailer). 10. The applicant has agreed that there will be no land partitions or subdivisions on subject property for the life of the permit issued for the proposed infirm mobile home placement. 11. The applicant understands that the temporary permit may be revoked by the City for violation of any of the conditions of approval for .this permit. Central Point Planning Commission will conduct a public hearing and decide on a conditional use permit application submitted by E.C. Brittsan. The mobile home must be currently registered by the State Department of Motor Vehicles with X-plates; g. The location of the mobile home must conform ..with setback requirements for primary buildings as established by the city zoning ordinance. The .creation of an imaginary property line between the mobile home and. the original residence on the property will determine the necessary setbacks as though the mobile home was a primary structure; ,h. The applicant shall bear the responsibility of certifying that the placement of the mobile home. does not violate any of the provisions of any deed restriction or sub- division covenant for the property; i. The applicant has agreed to remove the mobile home within forty-five calendar days after the unit has ceased to be used for the person for which the permit was issued; j. The placement of temporary mobile homes shall require skirting around their entire perimeter; k. The applicant shall not apply for a land partition or subdivision for the life of this permit which would separate the temporary mobile home from the primary ..structure for which the temporary mobile home would be _ accessory to. 3. Notice. Upon verification that the application is complete, the city administrator shall cause the scheduling of the conditiohal use permit application and notice to be given in accordance with Section 1.24.060(2) of the Central Point Municipal Code. 4. Revocation. A temporary mobile home permit may be revoked by the city for violation of any of the conditions in this section. (Ord. 1552 §1, 1985). 17 60 060 Lot size requirements--General excepcivu. If a lot or the aggregate of contiguous lots or land parcels held in single ownership and recorded in the office of the clerk of Jackson County at the time of passage of the ordi- nance codified in this title has an area or dimension which does not meet the lot size requirements of the district in which the property is located, the lot or aggregate holdings may be occupied by a use permitted outright in the district subject to all other requirements, provided it complied with all ordinances when it was recorded. A conditional use permit shall lapse and become void one year following the date on which it became effective unless,. by conditions of the use permit, a greater or lesser time is prescribed as a condition of approval, or unless prior to the expiration of one year, a building permit is issued by the building inspector and con- - struction.is commenced and diligently pursued toward com- pletion. The planning commission may extend a use permit for an additional period of one year, subject to the re- quirements of Section 17.76.040 of this chapter. (Ord. 1436 c2 (Part), 1981). 17.76.070 Revocation. A. (See Attached Copy of Deed) LOCATION OF SUBJECT PROPERTY: Subject property has a current address of 4410 Rogue Valley Highway and is currently a vacant fairly level site with no vegetation adjacent to the Crater High School. It is in the Northern sector'of Central Point in an area .bounded Crater-High School, Crown Avenue and North 3rd Street. Access to the area is provided by a service road for Crater High School to the west off of North 3rd Street at the farmost Northeast section of the campus. The development around subject property is primarily residential to the North with the Crater High School Football field abutting to the West and the Crater High School parking lot to the South and the Crater High Tennis Courts to the East. The nearest commercial development occurs on Highway 99N (also known as Rogue Valley Boulevard) at the Southwest section of the campus. There is further commercial development off North'3rd at the intersection with North 10th and more as you proceed to the downtown area to the South. (See Central Point City Map) SITE DATA: Proposed subject. has no frontage on any current street but is within the Crater High School property. The portion of area to be used for the project has a depth of 65 feet along the east and west and 200 feet along the north and south boundary which is a very small portion of the total computed size of the property which is 30.87 acres. The property is on the Crater High School Campus in the Northern section and holds a fairly level grade for approximately 367 feet. The property is fairly uniform and gentle,. and creates no construction and/or development problems. The property is served by Central Point City Sanitary, Pacific Power and Lights, etc.. for .utilities. The Crater High School service road'is a paved surface entering from North 3rd Street and extending the full length of the current parking area. The property has water and sewer lines that run the along North 3rd and also within the Crater High Campus (See Utility Plan) and are easily accessible. Also there are 2 fire hydrants within a 1 block location on the Crater High Campus with additional fire hydrants on the corner of North 3rd and Kings Way, Kings Way and Crown, Kings Way and Convent and Hazel and 2nd.) (See Fire Safety Plan) ~~`~,~ m The portable building. .(mobile classroom) that would be brought in would be built to UBC for an E3 occupancy and will carry an Oregon State Gold Label. (See Attachment for Gelco Space). The site preparation for the portable building, playground, parking, etc. would be completed by a local licensed contractor with appropriate, licenses and insurance. DESCRIPTION OF PROGRAM: Southern Oregon Head Start is a nonprofit, federally funded preschool program that serves 320 children in 9 center sites throughout Jackson and Josephine Counties. This site would serve approximately 36 four-year-old children. Children attend the center 4 days per week for 4 1/4 hours per day. Since the program is only part-day,. Children's Services Division exempts Head Start centers from licensing (See .Attached Letter). Centers do have to follow strict federal-regulations and are inspected regularly by fire and health officials. Federal regulations require providing a minimum of 35 square feet per child indoors and 75 square feet per child of outdoor space. The proposed center site-and proposed outdoor play area exceed the minimal space requirements. FINDINGS: A.- .Federal and state regulations require providing a minimum of 35 sq. feet of inside space for children and 75 sq. feet of outside space. The proposed building is 36 X 75 with a total of 2,340 sw. feet and the proposed playground is 65 X 65 with a total of 4,225 sq. feet. This far exceeds the amount of space needed for 36 children of 1,260 sq. feet of inside space and 2,700 sq. feet of outside space. B. There is 1 vehicle access point for Crater High at this point and we would share this with Crater High as an entrance ahd exit. Head Start would arrange with Crater High School the dismissal time for the Head Start center to coincide with the nonbusiest time of the lunch schedule of the Crater High students. (See Parking and Traffic Flow Plan). Approximately 1/2 of Head. Start children (18) are bussed to and from the .Head Start center by a Head Start bus, thus leaving the other l/2 of the children (18) to be brought to and picked up at the Head Start center by Head Start parents, this small amount of traffic will not affect the current traffic flow at Crater High School. No improvements to the street or right-of-way would be required, but .Head Start would improve the drive from the existing paved section back to and including the proposed parking area of the Head Start center. i t,:.) ;i There are currently no parking facilities for the proposed center, but Head Start would plan for 16 spaces 10 X 20 and 2 bus spaces 10 X 20 for a total of 18 {1 for every employee and 1 for every 5 children), this exceeds the amount required of 14. There is additional space if needed within the Crater High School parking. lot and this would therefore require no off street parking. This would provide a very adequate parking area for Head Start purposes. Also the parking could be used by parents attending Crater High School functions during non Head Start time. C. With the proposed building and playground set as far away as it is proposed from Crater High School main buildings to the South. and with a 36 foot area between the proposed building and the existing homes to the North. Thus the proposed use will have no adverse affect on abutting property. D. Southern Oregon Head Start is a federally funded preschool for children of age 4 and only operates 1/2 day. The use of the proposed building will have not be detrimental to the health, safety or general person residing or working the surrounding neighborhood and will not be detrimental or injurious to the property and improvements in the neighborhood or to th'e general welfare of the community. If anything it will enhance a portion of Crater High School property that is currently a non used area with no vegetation or improvements of any kind slated for the near future. E1. Head Start proposes to install a playground with a park like setting with chain link fencing (4-5 feet high) that is approximately 65 feet on the North and South sides abutting up to the proposed building on the East and the existing fence on the West, with a 12-14' drive gate and 3 walk gates. Within this play area there would be 2 storage sheds, a sandbox, a small paved area for trikes, a large play structure and a sodded section and a large mound with a culvert running through it. Head Start employees would care for the playground and any existing trees and landscaping in the proposed use area. Head Start use of the property would have no adverse effect on the natural resources of the property. (See Playground Plan) There are no current existing buildings on the proposed section of property indicated. The sheds within the play area (See Playground Plan) are 8 feet in height and are of wooden construction and are constructed locally. (The play structure is approximately 25 feet long and 7 1/2 feet high.) E2. See #B E3. See #B E4. See.#B E5. See E1 - We are not proposing any additional outdoor lighting at the present time. :y-; E6. Head Start would place a sign near North 3rd Street,'designating that there is a Head. Start center on Crater High School property, and that the sign would meet all City of Central Point sign regulations. This sign would not be lighted. E7. See E1 E8. Head Start would use the facility as a preschool center for 4 year old children from the Central Point area. The children would attend the center from approximately 8:30-12:'45; 4 days per week. Since the children are only at the center 4 1/4 hours per day and mostly inside except for a 1/2 hour outside play time, the noise should be greatly minimized. There would be no other detrimental environmental effects. E9. Head Start wishes to be operational with the.•proposed building on or before January 2, 199. E10. Head Start, if required would purchase a bond for removal of such use, but would not like to spend any additional money than needed to due the amount of budget limitations.. Head Start currently carries an enormous amount of insurance with Aetna which does include a couple of different type of bonds. F. The attachment from Gelco Space is for a building that is 24 X 60 but the actual building that Head Start. is proposing is 36 X 60, but would meet all the same requirements. It would be built to UBC for an E3 occupancy and will carry an Oregon State gold Label. (See Attachment from Gelco Space) cpsite ..ri;.~.~rF APPLICATION FOR CONDITIONAL USE PERMIT FOR THE RELOCATION OF THE CENTRAL POINT HEAD START CENTER FROM 115 GIBBON ROAD TO CRATER HIGH SCHOOL PROPERTY. Southern Oregon Child and Family Council, Inc. (Southern Oregon Head Start) has been suggested by our Regional Office to relocate from the 115 Gibbon Road site in Central Point because of'the unsuitable and degenerating 'condition of those premises. 'Head Start has attempted to locate another suitable site for years, but nothing suitable in the Central Point area has been found. We' were very fortunate in approaching Central Point School District #6 and found that they were indeed very interested. At the suggestion of our Regional Office, we developed a proposal to relocate into temporary (mobile) classrooms. This proposal has not been fully accepted as of this date, but we are hoping that it will be accepted very soon and that the relocation process will be completed by January 1, 1991. We have located an excellent site and secured it with a promise from Central Point School District #6 (See Attached Letter). We have located and will be purchasing state approved commercial coaches (trailers) for the classroom, office and kitchen. We have selected licensed contractors for each phase of the project, and incorporated their input in this application. Due to the relative simplicity of the project and due to budget constraints, we have assembled and prepared the necessary drawings and specifications from many helpful'sources, ourselves, and we believe we have satisfied the many requirements of this t his application. There is no new; permanent construction, but we will need to connect up to city .water, sewer and resources, we will have offsite parking and a minimal morning traffic flow.. We also plan to contract. all. adjacent landowners to explain what Head Start is about and answer any. questions. All of the work-will be performed by. licensed contractors working under proper :permits and inspections ahd agencies. After assembly, the site and center must pass stringent state licensing laws and regular fire and sanitation inspections. The proposed building is 36 X 75 with a total of 2,340 sw. feet and the .proposed playground is 65.X 65 with a total of 4,225 sq. feet. This far exceeds the amount of space needed for 36 children of 1,260 sq. feet of inside space and 2,700 sq..feet of outside space. B. There is 1 vehicle access point for Crater High at this point and we would share this with Crater High as an entrance and exit. Head Start would arrange with Crater High School the dismissal time for the Head Start center to coincide with the nonbusiest time of the lunch schedule of the Crater High students. (See Parking and Traffic Flow Plan). Approximately 1/2 of Head Start children (18) are bussed to and from the Head Start center by a Head Start bus, thus leaving the other'1/2 of the children (18) to be brought to and picked up at the Head Start center by Head Start parents, this small amount of traffic will not affect the current traffic flow at Crater High School. No improvements to the. street or right-of-way would be required, but -Head Start would improve the drive from the existing paved section back to and including the proposed parking area of the Head Start center. There are currently no parking facilities for the proposed center, but Head Start would plan for 16 spaces 10 X 20 and 2 bus spaces 10 X 20 for a total of 18 (1 for every employee and l for every 5 children), this exceeds the amount required of 14. There is additional space if needed within the Crater High School parking lot and this would therefore require no off street parking. This would provide a very adequate parking area .for Head Start purposes. Also the parking could be used by parents attending Crater High School functions during non Head Start time. C. With the proposed building and playground set as far away as it is proposed from Crater High School main buildings to the South and with a 36 foot area between the proposed building and the existing homes to the North. Thus the proposed use will have no adverse affect on abutting property. D. Southern Oregon Head Start is a federally funded preschool for children of'age 4 and only operates 1/2 day. The use of the proposed building will have not be detrimental to the health, safety or general. person residing or .working the surrounding neighborhood, and will not be detrimental or injurious to the property and improvements in the neighborhood or to the general welfare of the community... Head Start proposes to install a playground with a park like setting with chain link fencing (4-5 feet high) that is approximately 65 feet on the North and South sides abutting up to the proposed building on the East and the existing fence on the West, with a 12-14' drive gate and 3 walk gates. Within this play area there would be 2 storage sheds, a sandbox, a small paved area for trikes, a large play structure and a sodded section and a large mound with a culvert running through it. Head Start employees. would care for the playground and any existing trees and landscaping in the proposed use area. Head Start use of the property would have no adverse effect~on the natural resources of the property. (See Playground Plan) There are no current existing buildings on the proposed section of property indicated. The sheds within the play area (See Playground Plan) are 8 feet in height and are of wooden construction and are constructed locally. Head Start would place a sign near North 3rd Street, designating that there is a Head Start center on Crater High School property, and that the sign would meet all City of Central Point sign regulations. The children would attend the center from approximately 8:30-12:45, 4 days per week. Since the children are only at the center 4 1/4 hours per day and mostly inside except for a 1/2 hour outside play time, the noise should be greatly minimized. There would be no other detrimental environmental.effects. E9. Head Start wishes to be operational with the proposed building on or before January 2, 199 . E10. Head Start, if required would purchase a bond for removal of such use, but would not like to spend'any additional money than needed to due the amount of budget limitations. Head Start currently carries an enormous amount of insurance with Aetna which does include a couple of different type of bonds. F. The attachment from Gelco Space is for a building that is 24 X 60 but the actual building that Head Start is proposing is 36 X 60, but would meet all the same requirements. Any improvements made to Parcel 2 which requires a building permit shall require the conditions below to be completed. 2. On site storm drainage shall be designed to handle a 10 year. storm runoff. Zeeb, on behalf of Northwest Construction Company, has submitted an application for a minor land partition of a 7.25 acre parcel, .located at 1000 North Pacific Highway (Hwy 99) just north of Crater High School (37 2W 3B TL 1500), and WHEREAS, the Planning Commission of the City of Central Point held a public meeting upon said application for minor land partition on October 2, 1990 pursuant to Central Point Municipal Code Section 1.24.020C, and having at said public meeting received and reviewed the City staff report and testimony, and being .fully advised, now therefore, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS:: Sectioh 1. Based upon the staff report, evidence, and record relating to said application, the Planning Commission hereby finds that said application meets the requirements for minor land partition, that said minor land partition as proposed is in compliance with the City's comprehensive plan and zoning code, and if the conditions set forth hereinafter are met, said application meets the City's requirements for minor land partition. Section 2. The Planning Commission hereby recommends approval of the minor land partition application submitted by Clayton D. Zeeb, subject to the conditions set forth in Exhibit A, attached hereto and by this reference expressly made apart of the within resolution. RESOLUTION NO. In accordance with Central Point Municipal Code Chapter 1.24, this resolution of the Planning Commission, including the conditions set forth in Exhibit A, shall be forwarded to the City Administrator who shall schedule a public hearing before the City Council. After conducting said public hearing, recording and reviewing the city staff report and testimony, the City Council may decide in the matter of said minor land partition.
