A RESOLUTION AUTHORIZING TONING AND TANNING SALONS AS A PERMITTED USE IN A C-1 ZONE WHEREAS, Gigi Moser and Faye Mallory desire to expand their existing Beauty Salon business to include toning and tanning at 752 Hopkins Road in Central Point, which is located in the City's Neighborhood Convenience Shopping District (C-1); and, WHEREAS, toning and tanning salon is not a permitted use in the C-1 zone and the City of Central Point Planning Director has requested a determi- nation for allowing said use in the C-1 zone; now, therefore, BE IT RESOLVED BY THE CITY OF CENTRAL POINT PLANNING COMMISSION AS FOLLOWS: Section 1. Toning and Tanning salon use is not specifically . named as a permitted use in any zoning district chapters of the Zoning Title of the City Municipal Code. Section 2. The use was not anticipated or known in 1982 when Section 17.32 of the Central Point Municipal Code was codified because ton- ing and tanning services were not available to the community Section 3. The use is consistent with the general purpose of the C-1 zone in that it provides a convenient and necessary service to the sur- rounding neighborhoods. Section 4. The use has characteristics common to all uses in the C-1 zone and is capable of operating in harmony with said uses. PLANNING COMMISSION RESO NO. I C1USE/PORES a Section 5. The physical fitness/conditioning center; martial arts schools use listed in the City's C-3 Zone (Downtown Business District) and the C-5 Zone (Thoroughfare Coccunercial District) is found to be more intensive than the toning and tanning use and is not consistent with the general purpose of the Neighborhood Convenience District. Therefore, the Planning Commission's determination .shall be noted as Toning and Tanning (excluding Physical Fitness/Conditioning Center, Martial Arts Schools). Section 6. A record of this similar and compatible determination shall be kept by the City as required by Central Point Municipal Code Sec- tion 17.60.140 Passed by the Planning Commission on by me in authentication of its passage this _ ATTEST: Planning Commission Secretary 1990 and signed day of 1990.
