MEETING CALLED TO ORDER
Chairman Ellard called the meeting to order at 7:05 p.m.
ROLL CALL
Present were Planning Commission Chairman, Garth Ellard, and
Planning Commissioners, David Gilmour, Dick Halley, Karolyne Hugo
and Chuck Piland. Absent were Jerry Mattey and Bob Matthews. Bob
Matthews called and reported that he would be unable to attend
because of illness. Also present were, City Administrative
,4ssistant, George- Rubaloff, Director of Public Works, .Larry
9lanchard, Fire Chief/Building Official, Mark Servatius, and
Secretary, Cecelia Gordon.
APPROVAL OF MINUTES
Commissioner Halley made a motion to approve the minutes of the
Planning Commission Meeting held December 5, 1989 as presented.
Commissioner Hugo seconded the motion. Roll call vote: Gilmour,
yes; Halley, yes; Hugo, yes; and Piland yes, and the Motion
carried.
CORRESPONDENCE AND PUBLIC APPEARANCES
There were none presented at this meeting.

Tom Malot, 525 Reno's Circle came forward and responded to
questions from the Commission. Mr. Malot stated that had just been
informed that the City +•~culd require him to install a temporary
'turn around on Brandon Street. Public Works Director, Larry P..
Blanchard explained that this +vould just be temporary turr. around
as Brandon Street will be extended on as a through street, and that
any gravel puL '~o+•~n could be used later as a base for curbs,
sidewa`iks, etc.
Mr. Malot expressed a concern for the land that taouid be used for
the turn around is now an agricultural field with.an existing rye
crop. Mr. Malot felt it would be an economic hardship on the
farmer growing the crop if that portion of the field was graded 'and
^raveled before harvest. But that it would not be a problAm after
harvest in late August, 1990.
In responding to questions from the Commission. Tom Malct .stated
that most 1 i ke 1 y the 1 as';, t+•~o 1 ots , 1 ets 49 and 50 wou 1 d not be
constructed until after the crop was harvested.
The Commission requested that Public Works Director, Larry R.
Blanchard modify the Conditions in his Director's Report to state
that the temporary turn around would be installed by the developer
by September 1, 1990 cr upon issuing building permits on lets 49
and 50, whichever came first.
Ne one else came 'orward to speak in favor of or in opposition
the resolution.
Commissioner Halley made a motion to approve Resolution 179, a
Resolution to adopt findings and conclusions and recommend approval
of the preliminary plat for Jackson Creek No. 2, a subdivision
located at the easterly extensions of Brandon and Vincent Streets.
Commissioner Piland second the motion. Roll call vote: Gilmour,
yes; Halley, yes; Hugo, yes; Piland, yes. All the Commissioners
voted yes and the Motion carried unanimously.
Public Meeting-Review and make recommendation to the City Council
There were no conflicts of interest expressed by the Commission in
this matter. Chairman Ellard opened the public meeting.

City Administrative Assistant, George Rubaleff discussed his Staff
Report dated December 27, 1989, which included the Certificate of
Posting, Proposed Planning Commission Resolution, Public Works
Director's Report, Preliminary Plat Application and reduced copy
of the tentative plat.
Herb Farber, Surveyor, 102 Corcoran Lane, Central Point, came
forward. He informed the Commission that he knew of the City
requirement as stated in item #21 in the conditions contained in
the Public Works Director's Report. He stated that Gary Whittle
would be installing a temporary 30' radius turn around on Sno!~ry
Butte as required.
The Commission expressed concern that the addition of 8 new iots
on Timothy could cause excessive traffic on Snowy Butte Lane.
Larry R. Blanchard, Public Works Director explained that there
would be no through traffic er,cept for those lots that front on
Snowy Butte Lane.
No one else came forward to speak in favor of or in opposition to
the resolution.
Commissioner Piland made a motion to approve Resolution -179
adopting Findings and Conclusions and recommending approval. of the
preliminary plat for phase IV of Stenecreek No. 3 Subdivision.
Commissioner Gilmour seconded the motion. Roll call vote:
Giimour, yes; Hailey, yes; Hugo, yes; and Piland, yes. All
Commissioners voted in favor of the motion and the motion carried
unanimously.
There were no conflicts of interest expressed by the Commissioners
on this matter. Chairman Ellard opened the public meeting.
George Rubaloff, City Administrative Assistant, summarized his
staff report dated December 29, 1989 which included a Certificate
of Posting, City Council Resolution No'. 530, Planning Commission

Mr. Scheuneman referred to -Exhibit "A" of Planning Commission
Resolution No. 172, in which the City would require the developer
to improve Freeman and Hopkins Roads. Mr. Scheuneman stated that
he would like to conduct a traffic study, which he felt may
generate unique and useful data.
Larry R. Blanchard, .Public Works Director, agreed. that an actual
traffic study conducted by Mr. Scheuneman would be a valid basis
for determining the actual traffic flow, considering the type of
residents locating in the new development and resulting traffic
trends
No one else came forward to speak in favor of or in opposition to
this matter.
Commissioner Piland made a motion that the final development plan
be recommended for City Council approval. Commissioner Halley
seconded the Motion. Roll call vote: Gilmour,-yes; Halle`l, yes;
Hugo, yes; and Piland, yes. All Commissioners voted yes, and the
Motion passed unanimously.
MISCELLANEOUS
Informational report on annexcation df School District No. 6 area.
George Rubaloff, City Administrative Assistant, referred to his
Staff. Report dated December 27, .1989, ,and gave some .brief
background on it to the Commission. He stated that the School
District has requested this action because of their need for City
water at the regular rates that are available for water users in
the incorporated City limits.. He also informed the Commission that
this matter would be coming before the Commission as an annexation
application review within-the next couple of months, and wanted
them to be informed in advance.

Mobile home park location schematics.
The Commissioners agreed that the Mobile Home parks should
cooperate with City Fire and Police Departments with regard to
providing those agencies with adequate locater schematics for the
public safety and life support response.
ADJOURNMENT
Commissioner Gilmour moved that the meeting be adjourned.
Commissioner Halley seconded the motion. Rell call vote: Gilmour,
yes; Halley, yes; Hugo, yes; and Piland, yes. .41i voted it favor
of the motion and the motion carried unanimously.
Chairman Ellard adjourned the meeting at 8:35 p.m.

Administrative Assistant, George Rubaloff, summarized his Staff
Report highlighting the proposed resolution.
No one came forward to speak in favor of or in opposition to the
resolution. Chairman Ellard closed the Public Meeting.
Commissioner Halley moved to adopt Resolution No. 181, Authorizing
Toning and Tanning Salons as a Permitted Use in a C-i Zone.
Commissioner Matthews seconded the motion.
Roll Call Vote: Halley, yes; Mattey, yes; Matthews, yes; and
Piland, yes
ADJOURNMENT
All the commissioners voted unanimously to adjourn.
Chairman Ellard adjourned the meeting at 7:20 p.m.

DATE: 2 February 1990
The applicants propose to partition the existing 1.54 acre parcel into three par-
cels. The property is zoned R-3 residential multiple family with a minimum 6,000
square foot lot area, and a minimum lot width of 60 feet. The proposed lots meet
all minimum area and width requirements.
Conditions of approval (Exhibit D) are being prepared and address such things as a
deferred improvement agreement for future street improvement, segregation of tax
lot assessments, access, sidewalk improvements, park development fees, and utili-
ties. The conditions were not available at the time of distributing the commis-
sion's agenda packets and will be distributed at the meeting on Tuesday evening.

A RESOLUTION RECOMMENDING APPROVAL TO GRANT
A MINOR LAND PARTITION
WHEREAS Johnnie L. Scott has submitted an application for a minor land
partition of a 1.54 acre parcel, located at 334 and 338 North Tenth Street (372W
2BC TL 1500), and
WHEREAS the Planning Commission of the City of Central Point held a pub-
lic meeting upon said application for minor land partition on :February 6, 1990,
pursuant to Central Point Municipal Code Section 1.24.020C, and having at said
public meeting received and reviewed the City staff report and testimony, and
being fully advised now therefore,
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:

Section 1. Based upon the staff report, evidence, and record relating
to said application, the Planning Commission hereby finds that said application
meets the requirements for minor land partition, that said minor land partition as
proposed is in compliance with the City's comprehensive plan and zoning code, and
if the conditions set forth hereinafter are met, said application meets the City's
requirements for minor land partition.
Section 2. The Planning Commission hereby recommends approval of the
minor land partition submitted by Johnnie L. Scott, subject to the conditions set
forth in Exhibit A, attached hereto, and by this reference expressly made a part

ing, recording and reviewing the city staff report and testimony, the City Council

Conditions of Approval
MINOR LAND PARTITION
Applicant: Johnnie Scott
(37 2W IBC Tax Lot 1500)
1. Prior to final approval, applicant shall be required to construct five
foot wide sidewalk to City standards along the entire frontage of the
property being partitioned.
2. Applicant shall provide an access of no less than twenty feet in width of
paved surface which adequately serves all lots created under this minor
land partition.
3. Pursuant to Chapter 11.08 of Central Point Municipal Code, applicant
shall submit the appropriate application form to the City requesting
the City to make a just and equitable segregation of the assessment for
the lots being created by the minor land partition.
4. Applicant shall enter into a deferred improvement agreement consenting to
inclusion in any future local improvement districts for storm drainage,
streetlights, curbs, gutters, or street improvements, or any combina-
tion of the same on 10th Street further agreeing not to remonstrate
against any such improvements, and providing that the same shall be re-
corded in the Jackson County Deed Records and shall be binding upon appli-
cant's heirs, successors, or assigns and shall run with the land
hereinabove described.
5. Each individual lot created by this minor land partition shall have
individual water, sanitary sewer, and storm sewer discharge services.
6. Applicant shall pay a $200 per lot parks development fee prior to obtain-
ing a building permit for construction on any of the lots created by this
minor land partition.

Donald Stuckey sold .the land comprising Cambridge Court Subdivision
to Bob Schipper of Schipper Construction. Mr. Schipper is assuming
all the conditions of approval and City requirements associated to
the subdivision development. As stated in the attached letter, Mr.
Schipper is proposing that the. subdivision be renamed Sydney Estates
and that the proposed street be renamed Sydney Circle.
Staff has reviewed the street names and finds that the proposed name
change will not duplicate or confuse any other street or subdivision
names within the City.
ACTION
In accordance with Section 16.12.130 of Central Point Municipal
Code, Planning Commission approval is required for Mr. Schipper's
proposed name change. The Commission can make this determination by
minute motion.

WHEREAS, the City of Central Point, Oregon, has adopted a Zoning Ordi-
Hance Text and Map which established land uses up to twenty years in advance of
actual planned development, and as a result, many land uses become nonconforming
uses; and
WHEREAS, the City of Central Point Municipal Code Chapter 17.56 requires
that all nonconforming uses within the City of Central Point, Oregon, shall be
classified by the Central Point Planning Commission as either Class "A" or Class
"B" nonconforming uses; and
WHEREAS, City staff has encountered a nonconforming use at 150 North
Front Street within the Thoroughfare Commercial District (C-5) of the City and
may initiate a classification by the Central Point Planning Cor[miission,
NOW THEREFORE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, ASFOLLOWS:
Section 1. Based upon a staff investigation, the Planning Commission
hereby finds that said use does not meet the classification criteria for a Class
"A" nonconforming use outlined in Section 17.56.030 (A) of the Central Point
Municipal Code.
Section 2. Pursuant to Central Point Municipal Code Section 17.56.030
(B), the Planning Commission hereby designates the use at 150 North Front Street
in Central Point, as a Class B, nonconforming use, subject to conditions set
forth in Exhibit A, attached hereto, and by reference expressly made a part of
the within resolution.

1. The nonconforming use .described as an apartment dwelling shall in no A
case, be enlarged or expanded.
2. If said nonconforming use is destroyed by any cause to an extent exceed-
ing 50 percent of the appraised value, future structures or land use on
said property shall conform to the zoning regulations for the district in

ISSUE: Site plan and conditional use applications for a proposed
Oregon State Policy facility have been scheduled for Planning
Commission review and action on February 6, 1990.
I. BACKGROUND
Zeeb's Investment Company has an option to purchase seven acres
located on North Highway 99, approximately north of Crater High
School and has submitted applications to the City of Central Point
for a site plan review and conditional use permit for a proposed
public facility to serve as The Oregon State Police District Three
Headquarters. The site is located within the residential two-
family district (R-2 Zone). Section 17.24.030 (D) provides for
such a public building under a conditional use permit.
The proposed project must be what the Department of General.
Services calls a "design built facility". This means that the
facility remains in the Lessor's name (Zeeb's Investment Co.) and
Oregon State Police (OSP) becomes a tenant under a long term lease.
The Central Point location is preferred by OSP because of its
freeway access and because the site is adequate in size and shape
to accommodate the use.

The proposed development consists of approximately 30,000 square
feet of building space which would be completed in two phases.
Phase One would consist of the Crime Lab, the Identification
Bureau, and a pre-engineered metal outbuilding. Phase Two would
consist of approximately 15,000 square feet and is tentatively
scheduled for construction after July 1;1991. Phase Two will also
provide for divisions of the Department of State Police.
Central Point City Building, Planning, and Public Works staff have
reviewed the site plan and conditional use application and worked
closely with the applicants. The following sections of this report
address concerns from each of .the City departments:
II. ZONING
A. While the proposed development is not an outright
permitted use within the residential two-family district (R-2), the
use does merit special consideration as a conditional use within
that zone. Upon reviewing the applications for site plan review
and conditional use, staff has determined that the proposed
development would be consistent with the conditions outlined in
Section 17.76.040 of the Central Point Municipal Code. Moreover,
the project would meet or exceed specific and general zoning
requirements such as building height, set backs and yard
requirements, lot coverage, landscaping requirements, visual
screening, off-street parking, utilities installation, and egress
and ingress.

V. .CONDITIONS OF APPROVAL
A. Planning Conditions
The following items listed 1 through 7 should be included
as conditions of approval for the proposed conditional
use.
1. On site outdoor lighting and lighted signs shall not
impact adjacent properties or interfere with a traffiic
signals or traffic control signing.
2. Off street parking design shall be consistent with
Section 17.64.090 of the Central Point Municipal Code
and City Ordinance No. 1512.
3. Project shall comply with all applicable local, state
and federal laws.
4. Deviations from plans approved by the Central Point
Planning Commission must be approved by the City's Chief
Building Official or the City's Public Works Department.
5. A conditional use shall expire three years from the
date on which it became effective, unless prior to the
expiration of three years, a building permit is issued
by the City Building Official and construction is
commenced and diligently pursued toward completion.
Pursuant to CPMC Section 17.76.060, the Planning
Commission may extend this use permit for an additional
twelve months subject to the findings and conditions
outlined in CPMC Section 17.76.040.
6. Sight-obscuring fence and/or sight obscuring land-
scape shall be installed by the developer on all sides
and the rear of the property so as to provide an adequate
buffer between the development and the adjoining land
uses.
7. The pre-engineered metal outbuilding and the impound
parking lot shall always function as a secondary or
incidental use to the primary use of the public buildings
which collectively serve as District Three Headquarters
for the Oregon State Police.
B. Fire/Building Conditions
1. All buildings to be designed and built to comply with
the 1990 Edition Oregon Structural Specialty Code and the
1990 Edition of the Oregon Mechanical Specialty Code.
2. All flammable liquids storage and dispensing to
comply with the 1989 Edition of The Oregon Fire Code
Article 79.

comply with article 80 of the 1989 Edition of the Oregon
Fire Code:
4. Facilities to comply with General Provision for Fire
Safety per Article 10, 1989 Edition Oregon Fire Code as

location and number as well as Fire Department access.
C. Public Works Conditions
1. Presently Highway 99 is an SO foot right of way and
a 50 ft. street section. The CPMC Code requires a 60
ft. street section at this location. Widen the street

4. Curb and gutter section on Highway 99 shall be
designed to provide drainage to the nearest drainage
chanhel.
5. A soils engineer must evaluate the strength of the
soil (R-values) to determine the street section design.
The City's engineer shall be used, and the developer
shall pay for the cost of these services. A design life
for Highway 99 shall be 20 years with average daily
traffic of 20,000 vt/d, and 20% truck traffic.
6. A street lighting plan shall be included in the
construction documents according to the requirements of
the Public Works Director. All ingress/egress locations
shall be illuminated. Developer to install-all pads and
conduits for street lights as a part of the construction
of this project. The developer shall also pay for street
lights and the installation of all street lights by PP&L.
7. The developer shall install or cause to be installed,
conduits for utilities at intersections or locations
determined by utility companies and utility companies who
will not ihstall their services uhtil after this project
is constructed. The developer shall be responsible for
all costs associated with the installation of these
conduit crossings.

All utility construction (i.e. .power, telephone, gas,
cable t.v.) shall be constructed according to the
requirements of the governing utility, and the franchise
agreements with the City for each utility.
8. This development shall not impact the 100 year flood
capacity of Griffin Creek or the Scenic Avenue bridge.
If improvements are required, they shall be done
according to the plans completed by Developer's engineer
and approved by the Central Point Public Work's
Department.
Developer shall design the storm drainage system to
provide for discharge of properties in future phases or
within the drainage service area of this project's storm
.drainage system.
On site storm drainage shall be designed to handle a 10
year storm runoff.
9. According to CPMC 8.24 and 8.28, the owner of the
property adjacent to a 100 year flood plain or a drainage
channel is required. to maintain their portion of the
channel free from obstructions that would affect the 100
year flood elevation or block flow in the channel. The
developer shall provide access to Griffin Creek a minimum
of 15 ft. for equipment to maintain the Griffin Creek
channel.
Developer shall construct the storm drainage system to
meet the requirements set forth by the Department of
Environmental Quality for biochemical oxygen demand,
suspended solids, ammonia, and phosphorus. Any
correction to the storm drainage system shall be
completed during the construction of this project.
10. The on site sanitary sewer shall be tapped at a
location and in a method which meets with the approval
of the Bear Creek Valley Sanitary Authority and the City
of .Central Point. Minimum-size shall be an 8" PVC pipe
D3034.
11. Developer shall pay a systems development charge
(SDC) based on the .number of fixtures and the type of
discharge to the sanitary sewer.' A meeting with the
waste water treatment plant staff will be established in
order to determine the amount of the SDC.

72. Developer shall construct an adequately sized water
line to the property mentioned herein. Cost sharing for
water improvements to this property must be approved by
the Central Point City Council.
13. On site water system serving fire hydrants shall be
8" ductile iron (DI).
14. Fire hydrants shall be located as approved by the
Central Point Fire Department.
15. A backflow device which is capable of protection
based on the degree of hazard shall be installed at the
meter. All costs associated with this installation shall
be the responsibility of the developer.
16. The on site water system providing domestic service
shall be designed according to the requirement of the
most recent addition of the Oregon Plumbing Specialty
Code.
17. Construction permit fees for Building and
Public Works -shall be the responsibility of the
developer.
18. This Review was done in accordance with the rules,
regulations, and ordinances ih effect as of the date of
this review. Any modifications by the developer which
would cause this project to NOT meet the standards set
forth in the Central Point Municipal Code shall require
a new. review and approval of the modifications by the
City of Central Point.

My client's intend to divide this property into two (2) parcels of approximately 4
acres and 3 acres, respectively. They intend to develop the 4 acre parcel first. The first
phase will include approximately 15,000 square feet of building space which will be used
by the Oregon State Police (SIC Code 9221). The second phase on the 4 acre parcel will
be constructed after July 1, 1991, and will include approximately 10-15,000 square feet. This
space will also be occupied by divisions of the Oregon State Police.
The 3 acre parcel will be developed over the next 3 years. We have several potential
tenants. All of the potential tenants would be public uses that are described in SIC Codes
91, 92 (excluding 9223), -and 95 (from Standard Industrial Classification Manual (1987)).
Please accept this letter and the enclosures as my clients' application for conditional
use permit for the uses described above. Pursuant to your Central Point Municipal Code
17.76.060, this permit should be effective for 3 years. The enclosed maps and site plans
show that the site is adequate in size and shape to accommodate the use and that the site
has adequate access to public roads. The proposed use will have no adverse effect on
abutting property. In addition, the proposed uses will not be detrimental to the health,
safety or general welfare of the neighbors. In contrast, this development will be a very
desireable addition to the area. My clients recently completed a similar project in Salem.
The project was in a high crime and economically depressed area. As soon as this
development began, the prostitutes and drug dealers left the area. Property values have

A RESOLUTION APPROVING A CONDITIONAL USE APPLICATION
SUBMITTED BY ZEEB INVESTMENT COMPANY AND NORTHWEST
COMMERCIAL CONSTRUCTION, INC. FORA STATE POLICE FACILITY
WHEREAS, Zeeb Investment Company has submitted an application for a
conditional use permit for a State Police Facility to be located approximately
north of Crater High School along Highway 99 in Central Point, Oregon further
described as Jackson County Tax Assessor's Map Page 37 2W 3B, Tax Lot 1500, and
WHEREAS, the Planning Commission of the City of Central Point held a
public hearing upon said application for conditional use permit on February 6,
1990, pursuant to Central Point Municipal Code Section 1.24.020B, and having at
said public meeting received and reviewed the City staff report and testimony,
and being fully advised now therefore,
~ _ BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS:
Section 1. Based upon the staff report, evidence, and record relating
to said application, the Planning Commission hereby finds that said application
meets the requirements for conditional use, that said conditional use as proposed
is in compliance with the City's Comprehensive Plan and Zoning Code, and if the
conditions set forth hereinafter are met by the applicant, said application meets
the City's requirements for conditional use.
