Adjournment "I ~~. , i City of Central Point Planning Commission Meeting March 6, 1990 Page 1 MEETING CALLED TO ORDER Chairman Ellard called the meeting to order at 7:10 p.m. ROLL CALL Present were Planning Commission Chairman Garth Ellard and Planning Commissioners Dave Gilmour, Dick Halley, and Chuck Piland., Absent were Karolyne Hugo and Bob Matthews. Commission Chairman Ellard reported that Bob Matthews had called to say he could not attend. Also present were City Administrative Assistant, George Rubaloff, Fire Chief/Building Official, Mark Servatius, Public Works Director, Larry Blanchard, and Secretary Cecelia Gordon. APPROVAL OF MINUTES Commissioner Piland made a motion to approve the minutes of the Planning Commission Meeting held February 6, 1990 as presented, Commissioner Gilmour seconded the motion. Roll call vote: Gilmour, Yes, Halley, yes; Hugo, yes; Piland, yes. All the Commissioners voted in favor of the motion, and the motion carried unanimously. CORRESPONDENCE AND PUBLIC APPEARANCES City Administrative Assistant, George Rubaloff referred to Item A, the announcement from the Central Point Chamber of Commerce, inviting Commissioner members to the Town Hall Meeting/Greeter's Mixer to be held March 28, 1990. George Rubaloff also noted that Item B, concerning the minor urban growth adjustment (Schodl District #6), formerly scheduled for this evening Commission meeting was cancelled because of procedural requirements, and would be placed on the agenda of a future Commission Meeting, and the Commissioners would be notified. 0 City of Central Point Planning Commission Meeting March 6, 1990 Page 2 BUSINESS Public Meeting - Resolution #185. Preliminary plat for Maple Grove Estates Subdivision (37 2W 11D Tax Lot 2401) - Applicant Maple Grove Partners c/o Ed Dautzenbera) Administrative Assistant, George Rubaloff referred to his February 21, 1990 Staff Report which addressed the location and outlined the type of subdivision the applicant would be developing. Public Works Director, Larry R. Blanchard then reviewed his staff report of February 23, 1990. He felt that the language needed to be clarified concerning the overall storm drain master plan for Mingus Creek and Elk Creek and thereby read into the record the following amendments to the Conditions: IV. Water System A. Existing Conditions An 8" water main exists on Beall Lane. VI. Storm Drainage 7. The developer shall be required to construct or participate in the construction of an 8" sewer mainline constructed to the northeast corner of this property from the mainline existing in Pittview Avenue approved for construction by the City, approximately 1600' north of this property prior to issuing a construction permit for this subdivision. The developer shall analyze all downstream structures on Elk Creek through the meadows to determine if these structures are capable of providing capacity for the storm water runoff from this development. Developer shall provide a storm drainage design which -will meet satisfaction of the City of Central Point in regards to the overall drainage basin. U0~ City of Central Point Planning Commission Meeting March 6, 1990 Page 3 Larry Blanchard responded to questions from the Commission- concerning depending on the long term fiscal responsibility of the Developer to pay the expense of developing appropriate storm drainage as required due to the subdivision runoff. The Commission asked if the City should require Deferred Improvement Agreements from each individual residential owner. Larry Blanchard also said the development would be planned in such a manner as to place the sanitary sewer and storm drainage systems in the public right of way. Chairman Ellard asked the Commission if there were any conflicts of interest, and being none, opened the Public Meeting. The Developer, Ed Dautzenberg's agent, David Edwards, P.E., 1014 E. Pine, Central Point came forward. David Edwards told the Commission that the Developer was willing to lose one lot for a better design plan for the sanitary sewer and storm drainage systems. He explained that Ed Dautzenberg's plan was to develop this subdivision in 3 phases, and would include ` quality built residences, for his income as rentals. David Edwards also explained that if Mr. Ed Dautzenberg did sell some lots to other builders, that there would be a Deferred Improvement Agreement on each of those lots to guarantee payment to the City. Janet Sowell of 3363 Marilee, Central Point, came forward to review the Plat Map and to express her concerns about the homes in the proposed development being used for rental property. Mrs. Sowell felt that based on other rental property she has seen in Central Point, that this development could become run down and cause the surrounding properties to lose value. David Edwards, P.E. responded that the development was designed for better quality single family residences and that the developer would be based locally and would have tight quality control over the types of homes built, the general landscaping and appearance of the project. No one else came forward to speak in favor of or in opposition to the proposed Maple Grove Estates Subdivision. Chairman Ellard closed the Public Meeting. ~'U' v City of Central Point Planning Commission Meeting Marcn 6, 1990 Page 4 Commissioner Piland made a motion that Resolution 185 for a preliminary plat for Maple Grove Estates Subdivision (37 2'r{ 11D Tax Lot 2401) Applicant: Maple Grove Estates, be approved with the recorded amendments to Larry elanchard's staff report. Commissioner Dick Halley seconded the motion. Roll Call Vote: Gilmour, yes; Halley, yes; and Piland, yes. All Commissioners voted in favor of the motion and the motion passed unanimously. Road Applicant- 5 in 1 Development - Neil Scheuneman. George Rubaloff, City Administrative Assistant, reviewed his staff report, dated February 22, 1990, and called attention to the maps enclosed in the packet. The Commission expressed their concern for the problems with vehicles that would have to maneuver and back on to Linda Lane from the parking lot serving the proposed multi-use building. There were no conflicts of interest, so Chairman Garth Ellard opened the Public Meeting. Neil Schuenaman, (5 in 1 Development), 555 Freeman Road, Central Point, Oregon came forward. He explained that this is an extremely low traffic area, a 40 foot wide street with no divider. He also said that the existing multi-use building traffic backs onto the street at a corner intersection. No one else came forward to speak in favor of or in opposition to the proposed multi-use building. Chairmah Ellard closed the Public Meeting. Commissioner Gilmour made a motion that the Commission approve the Site Plan review for the construction of a multi-use building with the added condition that the parking spaces on the south side of Linda to face toward Linda Lane and the parking spaces on the north side of Linda to face toward the north and said spaces shall be no less than 29' deep. Commissioner Piland seconded the motion. Roll call vote: Gilmour, yes; Halley, yes; and Piland, yes. All the commissioners voted in favor of the motion and the motion carried. Garv T. Whittle. George Rubaloff referred to his Staff Report dated February 21, 1990, and the related enclosures. (1" v City of Central Point Planning Commission Meeting March 6, 1990 Page 5 Larry R. Blanchard then reviewed his Staff Report dated February 25, 1990, showing the preliminary plat requirements and related conditions. There were no conflicts of interest, and Commissioner Chairman Garth Ellard opened the Public Meeting. Herb Farber, 102 Corcoran Lane, Central Point, came forward as Gary T. Whittle's agent. There was then a discussion between Larry R. Blanchard and Herb Farber about the condition #10 on Page 37, concerning the developer's responsibility to provide an adequate storm drainage system. No one else came forward to speak in favor of or in opposition to the proposed Stonecreek #3, Phase V, preliminary plat. Garth Ellard, Commission Chairman, closed the Public Meeting. Commissioner Halley moved to pass Resolution #186, a Resolution recommending approval of preliminary plat for Phase V of Stonecreek No. 3 Subdivision. Commissioner Piland seconded the motion. Roll call vote: Gilmour, yes; Halley, yes; Piland, yes; and the motion carried unanimously. district George Rubaloff, City Administrative Assistant, referred to the proposed Resolution, which contained the list of permitted uses in a community shopping center, that the Commission had requested staff to prepare. The Commission had concerns regarding including fast food, drive- in, sit down, restaurant, noting that such use would require a conditional use permit. There were no conflicts of interest, and Chairman Ellard opened the Public Meeting. Ron Grimes, Architect, 1060 Crater Lake Avenue, Medford, Oregon representing the developer came forward. Mr. Grimes said that going through a conditional use process would take time, and could be considered an obstacle to the developer. Commissioner Piland moved that the Resolution #187 be approved as presented. Commissioner Halley seconded the motion. Ro11 call vote: Gilmour, yes; Halley, yes; Piland, yes; and the motion carried unanimously. George Rubaloff reviewed his February 23, 1990 Staff Report with the Commission. There were no conflicts of interest, and Chairman Ellard opened the Public Meeting. Dennis Hoffbuhr, 219 N. Oakdale, Medford came forward and gave an overall description of the proposed project. There were concerns from the Commission regarding traffic circulation in this development. Public Works Director, Larry R. Blanchard, explained that the conditions listed in Preliminary Plat requirements addresses the traffic flow. Mike Mahar, Pacific Trend Building Co., 1014 N. Riverside, Medford, Oregon, came forward. He wished to express his appreciation for the City of Central Point Planning Staff for the professional and expedient manner in which they have processed this application. He reported that they are ready to start construction as soon as possible. He also stated that they intend to build quality homes, and nice fencing and buffer separating the homes from the freeway. No one else came forward to speak in favor of or in opposition to the Resolution. Chairman Ellard closed the Public Meeting. Commissioner Halley moved that Resolution #188 be approved. Commissioner Gilmour seconded the Motion. Pacific Highway, Central Point came forward to ask the Commission and Staff about the plans for the Oregon State Police facility, and how it would impact his privacy and quality of life. Staff informed Mr. Skyrman that the plans were still in a very early stage, and that they would make certain to provide him with information as soon as it becomes available concerning the landscaping, burm and buffers, etc. Th2rc Were nG further mlSCellanE0U5 items. The proposed use falls within the broader catagory of pet sales and related supplies and is a conditional use within the C-3 zone. Central Point Municipal Code sec- tion 17.40.030 requires that this particular use may be permitted under the au- thority of a conditional use .permit. Mr. Dorey and Ms. Smith have submitted a conditional use permit application which includes a statement of findings and conditions. Staff has reviewed the condi- tional use permit application and has determined that said application conforms with the requirements in Chapter 17.76 of the Central Point Municipal Code. Blanchard - Public Works Director ~-~~ RE: Stonecreek - Subdivision No. 3, Phase IV Final Plat Approval The following items need to be completed by the developer prior to submitting to the City Council for Final Plat Approval. 1. Storm drainage system shall be TV inspected to review line and grade. 2. Payment of the inspection and administration fee in the amount of $ 3. Payment of The Park Development Fee in the amount of $1000.00 4. Submittal of the as-built drawings for the subdivision, and approved by the Public Works Department. 5. Two (2) 25 MPH signs to be installed by the City at location determined by the. Public Works Department. 6. All street lights shall be installed on Snowy Butte Lane and Joseph Street. 7. Need sign off of the utility installation for this subdivision on the`as-builts by power, telephone, cable TV and gas companies. 8. A 1' access reserve strip shall be conveyed to the City of Central Point at the south end of this subdivision as a part of the final plat. 9. If Stonecreek No. 3, Phase V is not completed within the 6 month period from the preliminary plat approval, the developer may be required to install the temporary turn- around as mentioned in the subdivision agreement. 10. The ditch inlet type catchbasin will also be installed if the turn-around in item 9 above is required. 11. The fire hydrant valve nut shall be opened and closed to assure proper operation, and to make sure the valve assembly is free from debris. 12. Complete lot finish grading so that all lots have positive drainage from the building footing area towards the street. 13. Jack hammer out 7 feet in back of curb for Fuentes driveway and compact rock and pave to make curb tapers and throat match grade. 1~. Blanchard - Public Works Director RE: The Meadows - Phase IV Final Plat Approval The following items must be 'completed by the developer prior to the submittal for approval of the final plat for this development: 1. TV inspection of the two storm sewer systems on Hopkins Road. 2. The developer shall pay the City for reimbursement of Inspections and administrative cost for the approval of t~is development. 3. Construction as-built shall be submitted to the City for the entire project. 4. Turn lane acceleration lanes, turn arrows, striping, markings and signing shall be installed on Hopkins Road and Freeman Road.' 5. The street light shall be installed on Hopkins Road at the access to The Meadows IV. 6. Sidewalks shall be installed on Hopk ins Road and Freeman Road as required in the plans by the developer. 7. Complete the paving of Hopkins Road and Freeman Road. Prior to paving, crack sealing will be completed by the City and paid for ¢y the developer. I 8. A sign off is required by the utility companies for all utility installations, and placed on the as-built drawings. This includes power, telephone, cable t.v. and gas. 9. Test the backflow device, and approve its installation. 10. The city comprehensive plan also designates this area low density. 2. Minimum R-L Lot area is 15,000 square feet. The applicant is propos- ing the creating of two (2) lots from the 1.03 acre parcel. Parcel one is 20,038 square feet (.46 acre) and parcel two is 24,829 square feet (.57 acre). 3. Minimum R-L lot width is 75 feet. The applicant is proposing two triangle-shaped lots. Parcel one is 179.44 feet along its front and Parcel two is 133.49 feet along its front 4. A ten foot Public Utility Easement runs north and south long the eastern lot line of Parcel two 5. A 25 x ZS foot pump house/shop is located along the east lot Line of Parcel two 6. Upton Road, which runs adjacent to Parcel two, is a 24 foot wide secondary arterial that is in generally fair condition and that is recommended for eventual widening. Raymond Way is a 18 foot wide local street which fronts parcel one is in poor condition and is recommended or eventual improvements. Both streets are under County Road jurisdiction. The streets have gravel shoulders and ditch drainage. Curb, gutter and sidewalk is nonexistent in the general area of Boes Subdivision. 7. No known special assessment (LID) entries were discovered in the City's Lien Docket Summary record for this parcel. 8. City Sanitary sewer mains and water mains are located in Raymond Way. Property does have individual city water and sanitary services to one lot. The additional lot will require new service laterals to be installed. A private well is located on parcel one. Pursuant to CPMC 16.44.040 applicant or assignee shall provide for storm drainage, street lights, curbs, gutters or street improvements or any combination of the same on that portion of Raymond Way and Upton Road which fronts property. Pursuant to CPMC Sections 12.02.010 and 12.04.015, the conditions noted above are hereby waived provided that applicant consents to inclusion in any future local improvement districts for the improvements stated above.Applicant shall further agree not to remonstrate against any such improvements. A deferred improvement agreement reciting these conditions shall be recorded in the Jackson County Deeds and Records and shall be binding upon applicant's heirs, successors, or assigns and shall run with the land herein above described for each lot of this minor land partition. 2. All costs associated with this development shall be the sole respon- sibility of the applicant or owner. The review done on this Minor Land Partition utilized the rules and regulations in effect as of May 1, 1990. Any modifications to the Minor Land Partition will require a new review and requirements set forth herein can be modi- fied based on any proposed changes. 3. All construction within Public Rights of Way, easements or storm drainage systems shall be built according to the City's and/or Coun- ty's public Works' Standards in effect at the time of application for permits. 4. Applicant or assignee shall pay a $200 per lot parks development fee prior to obtaining a building permit for construction on any of the lots created by this minor land partition. 5. Each individual lot created by this minor land paztition shall have individual water, sanitary sewer, and storm sewer discharge services. 6. Pursuant to Chapter 11.08 of Central Point Municipal Code, applicant or assignee shall submit the appropriate application form to the City requesting the City to make a just and equitable segregation of the assessment for the lots being created by the minor land pazti- tion, if an LID exists on subject property. 7. No construction or placement of structures within a public utility easement (except for fences by permit only). 8. Contractor shall be responsible to protect property corner monu- ments. If monuments are disturbed, damaged or removed, the contrac- tor shall replace monument prior to certificate of occupancy being issued. The contractor may want to verify location of property lines prior to construction. 9. All construction material and debris shall be removed and/or cleaned up at the end of each work day. In any event, the public works department shall require immediate response by the contractor to remove all debris from the street that will or may obstruct the street. This phase of the development con- sists of (65) sixty-five lots which range between 8000 and 16,.200 square feet. Average lot size in the subdivision is approximately 9800 square feet. Phase three is located in the southwest quadrant of the city where Vincent Avenue and Brandon Street extend easterly and southeasterly from Unit 1 and 2 of Jackson Creek Estates. The property is zoned single-family residential (R-1-8). While the proposed preliminary plat is somewhat different than the conceptual Jackson Creek Neighborhood Development Plan adopted in April 1985 (Planning Commission Resolution No. 95) all of the same opportunities exist within the proposed subdivision layout for traf- fic circulation. The proposed plat does follow the master utility plan prepared on March 11, 1988 and received by the City on May 6, 1988. Staff has processed the plat in accordance with the procedure out- lined in Central Point Municipal Code Chapter 16 and has reviewed the plat for consistency with City development codes. Street name signs including posts, labor and equipment for installation of street signs shall be paid for by the developer of this subdivision, and the installation shall be completed by the City. 2. A traffic control signing plan shall be included as part of the final construction plans, and will be installed by the City and all costs associated with traffic control sign installation shall be paid for by the Developer. A soils engineer must evaluate the strength of the soil (R-value) to determine the street section design. The City's engineer shall be used, and the developer shall pay for the costs of these services. A design life for Vincent Street in the subdivision with a minimum 20 year life, given a daily traffic volume not to exceed 1000 vehicle trips per day and 2% truck traffic shall be used. A design life for Brandon Street shall be a minimum 20 year life given a daily traffic volume of 2500 vehicle trips per day and 2% truck traffic. All other streets shall be designed for a 20 year life, a daily traffic volume of 1000 vehicle trips per day and 2% truck traffic. 5 - u~`~ 4. A street lighting plan shall be included in the construction documents according to the requirements of PP&L. All intersections shall be illuminated. Street light shall be located no greater than every 300 ft. Developer to install all pads and conduits for street lights as a part of the construction of the subdivision. The developer shall also pay for street lights and for the installation of all street lights in this subdivision. 5. The developer shall construct a valve at the end of the street in this phase for the future connection of the next phase of this development. 6. Ladder rungs shall be installed in each sanitary sewer manhole of a depth greater than 3.0 feet to the flow line of the manhole. Developer shall use ladder rungs approved by the Central Point Public Works Department. 7. There is a small seasonal stream which flows through this property at its northern property line. Developer shall construct a storm drainage system which collects the flow from this subdivision and carries through this subdivision in such a manner as to not cause flooding of any lot in a drainage area of this seasonal stream. 8. According to the Master Plan for Jackson Creek Estates, a 15" storm pipe would cross between Lot 69 and 70. The storm sewer will cross lot 70 and 71 and discharge directly to Griffin Creek. Also a 24" storm pipe would cross the park property between Lot 80 and 123. This storm pipe shall be located 10' north of the north property line of lot 123. 9. Catchbasins must be located no greater than 350 feet for any section of curb and gutter. 10. Developer shall design the storm drainage system to provide for discharge of properties in future phases or within the drainage service area of this subdivision's storm drainage system. The developer shall follow the storm drainage plan done as a part of the Stonecreek Subdivision No. I Master Plan, a copy of which may be obtained at Public Works Department in Central Point City Ha11. 11. As originally approved in Jackson Creek Estates Unit #1, the developer shall provide park land in lieu of paying a $200.00 per lot development fee for property located along Griffin Creek as a part of the Park Master Plan. This property is to be dedicated as the requirements set forth in Title 16.20. Based on Title 16.20, 700 square feet per lot or a total of 45,500 square feet (65x700 = 45,500 square feet) shall be dedicated. 12. The developer shall install or cause to install conduits for utilities at intersections or locations determined by utility companies and .utility companies who will not install their services until after the subdivision is constructed. The developer shall be responsible for all costs associated with the installation of these conduit crossings. 6 -l1 ~~ issuing a permit for construction of this subdivision. 14. All construction for utilities, streets and other structures discussed herein within rights of ways owned or to be owned by the City of Central Point, shall be done according to all rules, regulations, ordinances, resolutions, and other applicable requirements of the City of Central Point for construction of this Subdivision. 15. The final plat for this Subdivision shall not be approved by the City Council until all conditions as herein stipulated and as approved for this Subdivision have been met. 16. The preliminary plat review for the preliminary plat submitted herein by Tom Malot Construction was done in accordance with the rules, regulations and ordinances in effect as of the date of this review. Any modifications by the developer which would allow this Subdivision not to meet standards set forth in the Central Point Municipal Code or would require staff to complete a new preliminary plat review, shall require a new submittal of preliminary plat for City approval. 17. If it is determined that 1000 gpm is not attainable for fire flow in this subdivision, the developer shall make the necessary corrections to the existing water system within this subdivision to obtain the required fire flow. The correction(s) shall be. 'completed as a part of the construction of this subdivision. 18. The developer shall indicate direction of Griffin Creek flow. 19. The developer shall propose the name for the new streets in the Subdivision for City of Central Point approval. 20. The developer must remove the 1 ft. reserve strip from Unit No. 2. 21. On January 18, 1990, the City Council approved the Final Development Plan for this phase of the project. Shortly after the Council's approval, The Meadows entered into a facili- ties Improvement Agreement with the City. The agreement specified the conditions under which the developer is required to complete the construction for Phase 4. The developer has completed 90 percent of the improvements and is now seeking final subdivision plat approval from the City. Since a preliminary subdivision plat was not processed at the same time the City was reviewing the Final Development Plan, the applicant is submitting the prelimi- nary plat and the final subdivision plat applications to the Planning Commission for concurrent review. COURSE OF ACTION The Planning Commission is scheduled to conduct a public meeting during which the Commission can receive the reports, hear testimony, review the plats and then formulate two separate recommendations to address the preliminary and the final plat. Public Works Director Larry Blanchard has reviewed the subdivision agreement and has identified those items that will need to be completed prior to final City Council approval of the final plat. Staff has also ensured that the final plat is technically correct and that it is consistent with the preliminary plat which was granted tentative Council approval on January 18, 1990. The subdivision layout is currently in progress. Staff will monitor the project activities up until Tuesday evening's Planning Commission meeting and will present a Director's Status Report at that time.
