CITY OF CENTRAL POINT Planning Commission Meeting Minutes August 7, 1990 Page 1 MEETING CALLED TO ORDER Chairman Garth Ellard called the meeting to order at 7:05 p.m. II. ROLL CALL Present were Planning Commission Chairman Garth Ellard and Planning Commissioners, Dick Halley, Karolyne Hugo, and Chuck Piland. Also present was the newly appointed Commissioner Dick Bettenburg. Absent was Bob Matthews who left a message that his recent-,dental work had made him too ill to attend. Also present were City Administrative Assistant, George Rubaloff, Public Works Director Larry Blanchard, ahd Planning Commission Secretary, Cecelia Gordon. City Administrator Dave Kucera joined in the meeting later, attending the first part of the meeting in the general audience. III. APPROVAL OF MINUTES Commissioner -Halley moved. to approve the June 5, 19~J0 Planning Commission Meeting .Minutes as amended and the July 10, 1990 Planning Commission Minutes as presented. Roll Ca11 Vote: .Halley, yes; Hugo, yes; Piland ,..yes. A11 the Commissioners voted in favor of the motion, and the motion carried unanimously. IV. ADMINISTRATIVE MATTERS Planning Commission Chairman, Garth Ellard administered the Oath of Office to Rick Bettenburg. V. BUSINESS A. Resolution# 202 - Sentrv Market Expansion Pro.iect. This-item of business was carried over from the July 10, 1990 Planning Commission Meeting. Having reviewed the application the Commissioners were prepared to vote on the Resolution. Commissioner Piland moved that the Resolution be approved as presented, Commissioner Halley seconded the motion. Roll Call Vote: Bettenburg, yes; Halley, yes; Hugo, yes; Piland, yes. All the Commissioners voted in favor of the motion and the motion carried unanimously. UU1 CITY OF CENTRAL POINT Planning Commission Meeting Minutes August 7, 1990 Page 2 B. George Rubaloff referred to the August 2, 1990 Staff Report from Planning and Public Works, which emphasized the necessity to develop a Master Plan and area wide design and LID financing for Meadow Creek Drainage System and which offered the two alternatives for proceeding with the above application: Either to postpone a decision to approve or deny the application without prejudice. Commissioner Bettenburg moved that they postpone making a decision on the application to allow time for research and review. Commissioner Piland seconded the Motion. Ro11 Ca11 Vote: Bettenburg, yes; Halley, yes; Hugo, yes; Piland, yes. All' the Commissioners voted in favor of the motion and the motion carried unanimously. The next two items on the Agenda. Item C. - Public Meeting for site plan review - West Park Place, and Item 0. - Public Meeting to review and recommend the preliminary development plan for West Park Place were automatically tabled with the postponement of Item B: E Proaerties.) City Administrative Assistant, George Rubaloff entered into the record by reference the Certificate of Posting, Vicinity Maps, Tax Assessor Map, Aerial Map, Reduced version of Tentative Plat Map, Reduced Version of Tentative-- Master Plan, Application for Preliminary Plat, Director's Report regarding Preliminary plat review, Proposed Planning Commission Resolution. He also entered the correction of the Tax Lot numbers from' TL 100 and 200 to TL 100, 300 and 400. There was no conflict of interest on the part of the Planning Commission. Commission' Chairmah, Garth Ellard opened the Public Meeting.. Herb Farber, 102 Corcoran Lane,'Central Point, Gary's Whittle's agent and land surveyor came forward to respond to any questions from Staff or the Commissioners. .,..qo i~, CITY OF CENTRAL POINT Planning Commission Meeting Minutes August 7, 1990 Page 3 No one else came forward in favor of, or in opposition to this application. Commission Chairman Ellard closed the public meeting. Commissioner Halley moved to approve Resolution #203 as corrected. Commissioner Bettenburg seconded ..the motion. Roll Call Vote: Bettenburg, yes; Halley, yes; Hugo, yes; and Piland, yes. The motion carried unanimously. F Assistant Administrator ..George Rubaloff referred to and entered into the record the Planning Department Site .Plan Review, Public Works Department Site Plan Review, Certificate of Posting, Site Plan Application, Vicinity Map, Tax Assessor Map, Reduced Copy of Site. Plan, and rendering of proposed Multiple-Family Structure. There was no conflict of interest. Chairman Ellard opened the Public Meeting. Applicant, Ron Collins, 3207. Old Military Road, Central Point, Oregon, ,:came forward. to address the matter of the Laurel Street road Improvement conditions inherent in developing this parcel. Larry Blanchard, Public Works Director, reviewed conditions in, the May 31, 1990 Staff .Report, covering the. required Laurel-Street paving, curb/gutters, sidewalks, storm drains, .streets lights, sanitary sewer and water lines. Mr. Collins responded to questions from the Commission and stated that he ,was willing to abide by these conditions, and would-take the responsibility of he cost (through an LID, etc.). Mr. Collins stated that development of this site plan would be the first of three phases of construction on the three adjoining parcels. There were no further appearances either in favor of, or in opposition to this plan. Garth Ellard, Commission Chairman closed the public meeting. Commissioner Piland moved .that the Commission approve the conditions in the .,Planning and Public Works Report, giving the applicant maximum time allowable for compliance. Commissioner Bettenburg seconded the motion. Roll Call Vote: Bettenburg, yes; Halley, yes; Hugo, yes; and Piland, ,yes. The motion passed unanimously. ;.~ F ~~~ CITY OF CENTRAL POINT Planning Commission Meeting Minutes August 7, 1990 Page 4 G Martin Gates) Administrative Assistant, George Rubaloff referred to and entered into the record a Certificate of Posting, Planning Department Site Plan Review, Public Works Department Site Plan Review, Site Plan Application, Vicinity Map, Tax Assessor Map, Reduced Copy of Site Plan. Commission Chairman Ellard opened the public meeting after it was determined there were no conflicts of interest on the part of the Commission. Applicant/Agent Jim Cochran, 1354 Grand, Medford, Oregon came forward to ask questions and respond to the Commission. He took exception to Item #6 in the Planning Department Site Plan Review, concerning a-six foot buffer (fence or hedge) on the north property line, since the use of the property to the north is commercial rather than residential. Staff agreed that this condition would not be required. Mr. Cochran expressed his proposed convenience store would not generate alley traffic, therefore, he should not be required to share in the cost of paving the alley with adjacent property owners who would be using the alley for a car wash business. David P. Hyatt, 3371 Old Stage Road, Central Point, Oregon, who will have a vested interest in the convenience store, came forward to ask staff questions about the paving of the alley. After some clarification by staff, both Mr. Cochran and Mr. Hyatt agreed that they would comply by paving the alley the full width of their property. There were no further appearances in favor of, or in opposition to the matter. MISCELLANEOUS - There were no miscellaneous items. VII. ADJOURNMENT Commissioner Hugo made a motion to adjourn the meeting. Commissioner Bettenburg seconded the motion. Bob Schipper has submitted an application to the City for final subdivision plat approval for Sydney Estates. Sydney Estates was previously known by the commissioners as Cambridge Court Subdivision and is located on Pittview Avenue f in the Southeast quadrant of the City. Public Works Director Larry Blanchard has reviewed the subdivision agreement and has identified those items that will need to be completed prior to final City Council approval of the:finaT plat. The alley is 100 feet in length and extends through half of the City block. Grange Co-op is proposing the vacation to facilitate a planned expansion of its retail operation. On August 16, 1990, the City Council- received the vacation application, set a public hearing for the Council's October 18, 1990 meeting and authorized staff to proceed with processing the vacation request. .The City Council will review. the' Planning Commission's -recommendation regarding this request at the public hearing scheduled in October; 1990. The alley .way in question contains no utilities and is not anticipated to ever be improved or utilized for public use. If approved by the City Council after conducting the October 18, 1990 public hearing, the title to the vacated alley way shall attach to the adjacent tax lots 7100 and 7400 in equal portions. City zoning is R-1-6 (Residential Single Family) which provides for urban low-density .residential environment., The City Comprehensive plan also designates this area low density. 2. Minimum R-1-6 lot-area is 6,000 square feet. The applicant is proposing the creation of two (2) lots from the 4.78 acre parcel. a) Parcel No.l is 15,552 square feet (.36 acre) b) Parcel No. 2 is 192,728 square feet (4.42 acres) 3. Minimum R-1-6 lot width is 60 feet. The proposed lots meet this requirement. 4. A sanitary sewer line runs north and south along the western lot line of the entire property. 5. Parcel No. 1 fronts along Beall Lane and includes a 1,470 square foot dwelling and an 850 square foot cutbuilding. Parcel No. 2 includes a 560 square foot outbuilding. A 625 square foot outbuilding lies upon the proposed lot line of both Parcel No. 1 and Parcel No. 2. The latter two outbuildings are proposed to be removed by the developer. 6. Parcel No. 1 take access from an existing driveway. Parcel No. 2 will take its access from Glenn Way which is proposed to run south from the existing Glenn Way street end to Beall Lane within the Stohecreek No. 4 subdivision development. The proposed partition map also illustrates a revised. tentative master plan for Stonecreek No. 4 Subdivision and therefore shows the relationship between the proposed land partition and said development. 8. The City Lien Docket reflects a (Senior Citizen Deferral) special assessment (LID) to Thurman and Helen Barnes (1576 Beall Lane) .for an eight inch sewer main and a twelve inch water main constructed in the early 1980's (City Ordinance No. 1476). 9. Beall Lane, which runs adjacent to Parcel 1 and 2, is a 36 foot wide secondary arterial that is in generally fair condition. The City's street system inventory. recommends continued monitoring for eventual placement on the City Five Year Plan when pavement reaches fair condition. Beall Lane has gravel shoulders and ditch drainage. 10. Under the preliminary. ..plat approval granted by the City Council on August 16, 1990 for Stonecreek No. 4 Phase I subdivision, the developer is required to construct curb/gutter, sidewalk, street lights and driveways on the Lots abutting Beall Lane and design the street for 10,000 VT/d 10~ truck traffic with a full street width of 48 feet. CONDITIONS OF APPROVAL 1. Applicant, owner or assignee shall provide for storm drainage, street lights, curbs, gutters, driveways or street improvements or any combination of the same on that portion of Beall Lane which fronts property. Street design. shall accommodate 10,000 vt/d 10~ truck traffic. Full street width is expected to be 48 feet Applicant, owner or assignee shall also dedicate an additional 10 feet of property for Beall Lane street right- .. of-way. 2. All costs associated with this development shall be the,sole responsibility of the applicant or owner. The review done on this Minor Land Partition utilized the rules and regulations in effect as of August 21, 1990. Any modifications to the Minor Land Partition will require a new review and requirements set forth herein can be modified based upon any proposed changes. 3. All construction within Public. Rights of Way, easements or storm drainage systems shall be built: according to the Public Works Standards in effect at the time of application for permits. 4. Applicant or assignee shall pay a $200 per lot parks development fee prior to obtaining a building permit for construction of any of the lots created by the minor land partition. 5. In the event that Stonecreek No. 4 does not develop completely and Glenn Way is not improved such that it provides access to Parcel No. 2, then applicant or assignee shall provide paved access to Parcel No. 2 no less .than twenty (20) feet wide. Said paved access shall be built to City standards. 8. No construction or placement of structures within a public utility easement (except for fehces by permit only). 9. Contractor shall be responsible for protecting property corner monuments. If monuments are disturbed, damaged or removed, the contractor shall .replace monument prior to certificate of occupancy being issued. George Rubaloff, dministrative Assistant DATE: August 29, 1990 SUBJECT: Public Meeting - Review and make recommendation to the City Council regarding amendments to the zoning ordinahce text relating to the Bear Creek Greenway (BCG) zone. SUMMARY The Central Point Citg Council has declared its intent to amend the zoning ordinance to include Bear Creek Greenway as a classification and to amend the conditional uses allowed within that particular zone. Pursuant to Central Point Municipal Code 1.24.020(c), the Planning Commission is required to review proposed amendments to the zoning ordinance and then formulate and forward a recommendation to the-City Council. BACKGROUND A series of public hearings, including a joint city-county hearing, were conducted earlier this year to address Jackson County School District No. 6 request for inclusion of a particular parcel of land within Central Point Urban Growth Boundary and annexation of the same parcel to the City. The current land use on the District's property is the Future Farmers of America Land Lab, the Mel Anhorn Baseball Field, and the development of a Rogue Eco System Park and Learning Center. Due to an inadequate supply of water at this site, the District has made application for amending the UGB and annexation so that the District can eventually utilize municipal services to operate its facilities. The consensus which has materialized thus far, is that the School District's Land uses would appropriately fit within the City's Bear Creek Greenway zone. Moreover, during a mandated joint meeting of City and County Planning Commissions, the Jackson County Planning Commissioners voted unanimously to recommend that the Minor Urban Growth Boundary Adjustment be approved by the governing bodies subject to the new territory being placed within a zone such as the City's Bear Creek Greenway Zone to protect and preserve the Greenway area surrounding agriculturally zoned lands, riparian environment and the pastoral qualities associated to the area. city >~,; The City Council reviewed the School District Urban Growth Boundary Adjustment and annexation requests on June 21, 1990, then on August 16, 1990, the City Council declared an intent to amend the zoning ordinance as follows to facilitate the eventual inclusion of said property within the UGB and subsequent annexation: 1. List the Bear Creek Greenway Zone, described in CPMC 17.54 in the list of zone classifications contained in CPMC Section 17.12.020. 2. Revise the specific language under conditional uses within the Bear Creek Greenway Zone (CPMC Section 17.54) to allow agricultural uses, excluding livestock unless the same are maintained as part of an animal husbandry program for educational-purposes by a public school. During the August 16th Council meeting, a concern surfaced which related to the potential conflict which might arise between the District's Land Lab Use, in particular the keeping of animals, and existing and future residential uses. Upon examining this particular issue, staff describes the land in question and surrounding land. as follows: 1. The. School District's 23 acre parcel, and lands to the north, east and southeast are .zoned exclusive farm use (EFU) under the Jurisdicton of Jackson County. State law (ORS 215.203 2A) defines "farm .use" as piece of land, often with dwelling and outbuildings, upon which crops and animals are raised. The permitted uses within the EFU zone also includes breeding, boarding, and training of dogs and horses. 2. South of the School District's parcel is Bear Creek which forms a natural boundary. 3. To the northwest is a residentially zoned area of the City, generally known as Boes subdivision. This particular area is zoned residential-low density (R-L). The District's property is separated by a 90 foot right of way upon which lies Upton Road, a secondary arterial street. 4. Directly to the west of the District's property and across Upton Road, is an area zoned Bear Creek Greenway. Items 3 and 4 above, describe areas and land use zones which are both in the City. Items 1 and 2 describe the majority of the land area surrounding the District's parcel and is not within the City's Urban Growth Boundary. Two conclusions may be drawn from facts outlined above. First, it appears likely, due to the County's policy of protecting rural lands, that the surrounding land area will remain within the County EFU zone for quite some time into the future, and will not, in the short or long term, transform into residential development. The southern edge of the District's property features a natural boundary, Bear Creek, and this would not be subject to any conflicting land uses. The only adjacent residential land use is the southeastern corner of the R-L zone on Old Upton Road south of Boes subdivision which is separated from the Land Lab activity by a 90 foot right-of-way. U~U ~E~ The second conclusion which can be drawn from this information, is that animal husbandry is an outright permitted use in the County's EFU zone and the City currently .has no control over such land use. With the District's property included within the City's UGB, annexed to the City and zoned BCG, said land would then be subject to the City's rules and regulations. While it appears that the District's animal husbandry activities would not result in current or future land use conflicts, Central Point Municipal Code, Section 17.76.040(e) gives the City authority to place. conditions of approval for conditional use permits which are deemed necessary to protect public health, safety and general welfare. Such conditions may include time limits or periodic reviews of the conditional use as residential development occurs in the vicinity of the School District's Land Lab, thus giving the City authority for added protection. .CONCLUSION The particular matter at hand, relating to the Bear Creek Greenway, deals with a minor legislative housekeeping item. However, the efforts which have been made on behalf of the School District for eventual annexation, are focused upon the District's need for water and the avoidance of any related public health problems. Once .the territory is annexed to the City, the City will gain jurisdictional control for the Land use on that property; however, based upon the surrounding zoning and the future of development in that area, the problem of animal husbandry and its potential land use conflict does not appear to pose any short or long rang problems. The Hear Creek Greenway zone is intended to provide for environmental preservation and limited development within the portion of the Bear Creek Greenway that lies within the City limits and urban growth boundary. The B.C.G. .district is intended to provide for environmental preservation and limited develop- ment within the portion of the Bear Creek Greenway that lies within the city limits and urban growth boundary of Central Point. This district is intended to protect .the public . health and safety, preserve the natural environment of the Bear Creek corridor, encourage the implementation of the greenway plan, provide for limited recreational uses, and ensure the continued preservation of fish and wildlife habitat within.the riparian environment of the creek. (Ord. 1531 §1 (part), 1984). 17.54.020 Permitted uses. -The following uses are per- mitted in the B.C.G. district: A: Public parks. and nature study areas; B. Public recreational or stream-oriented facilities or activities other than .parks and nature study areas that are consistent with the greenway plan and with the city's comprehensive plan; C. Paths and trail systems for the use of pedestrians, bicyclists and equestrians but not including motorized vehicles; ' D. Uses or structures that are customarily appurtenant to a permitted use such as off-street parking, maintenance buildings, signs, and public improvements. (Ord. 1531 §1 (part); 1984). 17.54.030 Conditional uses. The following uses are permitted in the B.C.G. district when authorized in accord- ance with Chapter 17.76: A. Privately developed or operated recreational or stream-oriented facilities or activities that the planning commission may find to be compatible with the purpose of this section and consistent with the city's comprehensive plan and the Bear Creek greenway plan; 279-3a (Central Point 1/85) ~~~: 17.54.040--17.54.080 B. Public or municipally owned facilities or utilities that the planning commission determines to be compatible with the purpose of this section and with area plans; C. Agricultural uses other than livestock; D. Mining or aggregate removal. (Ord. 1531 §1 (par t), 1984) .. 17.54.040 Height regulations. All buildings and struc- tures shall be designed to be as inconspicuous as possible and any such structure proposed to exceed fifteen feet in height shall be subject to planning commission review and approval. (Ord. 1531 $1{part), 1984). 17.54.050 Area, width and yard requirements. All areas within the greenway are in public ownership or proposed for public acquisition. No minimum lot requirements are neces- sary for the types of development that might occur within this district, except that special setback requirements may apply as specified in Section 17.60.090. (Ord. 1617 §27, 1989: Ord. 1531 §1(part), 1984). 17.54.060 Geheral requirements. The area designated on the comprehensive plan'map and zoning map of the city as Bear Creek Greenway shall be preserved to the maximum extent practicable i.n its natural condition. No person, firm, or corporation, whether public or private, shall cause or permit any excavation, fill, stream diversion, removal of vegetation, or other alteration of the natural environment of the greenway, nor encroach upon any part thereof with buildings, footings, retaining walls, bridges, piers, abut-_ ments, dams, diversion weirs, riprap, or any other physical feature without-first securing the express written consent of the Central Point planning commission. .Application for such consent shall be made in writing and any conditions of approval shall be based on the purposes of this section. (Ord. 1531 §1(part), 1984). 17.54.070 Signs. All signs shall be designed for maxi- mum visual and aesthetic compatibility with the greenway en- vironment and are subject to planning commission review and approval, and the requirements of Chapter 15.24 and Section 17.60.110. (Ord. 1615 §20, 1989: Ord. 1531 §1(part),'1984). 17.54.080 Fences, walls, hedges, and screen plantings. Physical. improvements that are obviously manmade and would impair the free movement of people or wildlife within the greenway are ,discouraged, but may be permitted when required to solve a specific problem or serve a special purpose, and when designed to be visually and aesthetically compatible with the greenway environment. Any fence, wall, hedge, or screen planting is subject to review and approval by the :planning commission. Off-street parking shall be required as a part of any recreational or other Facility that could reasonably be expected to generate automobile trips or require automobile access. The number of parking spaces will be determined by the planning commission on a case-by-case basis and on the basis of statistical or other evidence of parking needs as provided by city staff or the applicant.
