CITY OF CENTRAL POINT Planning Commission Meeting Minutes November 6, 1990 Page 1 MEETING CALLED TO ORDER at 7:05 p.m. II. ROLL CALL Those present were Garth Ellard, Rick Bettenburg, Jack Crumm, Dick Halley, Bob Matthews and Chuck Piland. Absent was Karolyne Hugo. Also present were George Rubaloff, City Administrative Assistant, Larry R. Blanchard, Public Works Director, Mark Servatius, Fire Chief/Building Official, and Cecelia Gordon, Secretary. III. APPROVAL OF MINUTES -October 3, 1990 Meeting A. City Administrative Assistant, George Rubaloff gave out copies of a corrected Page Three, final paragraph to read "but may receive funding sometime later next year, replacing "but would probably would be receive this funding sometime later next year." Commissioner Bettenberg moved to approve the October 2, 1990 Planning Commission Meeting Minutes as amended, and was seconded by Commissioner Crumm. Roll Call Vote: Bettenburg, yes; Crumm, yes; Halley, yes; Matthews abstained, Piland, yes; and the motion carried. B. Correspondence: George Rubaloff, Administrative Assistant, announced the following informational items: 1. The City had sent a letter dated October 30, 1990 to a Debbie Rodriguez of Jackson County Planning Commission containing review comments regarding a conditional use permit application (90-35 C.U.P.) for a recreation center within the City's Urban Growth Boundary. That Chapter 16 (subdivision) of the Central Point Municipal Code has been revised as a housekeeping effort and the draft ordinance is scheduled for. first reading by, the City Council on November 15, 1990, and that staff will send the Commission a copy of the Draft. 3. Some draft documents for periodic review of the City's Comprehensive Plan he+vebeen prepared by Rogue Valley Council of Governments staff. -Staff plans to initiate the review process soon. That process will involve the Citizen's Committee, Planning Commission and City Council. IV. BUSINESS A. P~~blic Meeting -Resolution #210 -Final Subdivision Plat Approval Stonecreek 4 Phase II -More Specifically Described as Jackson County Tax Assessor May 37 2W Page 10DA Tax lots 100 200 and 400 City Administrative Assistant, George Rubaloff, entered into record by reference the Certificate of Posting (Public Meeting Notice), Proposed Resolution, Vicinity Maps, Final Plat Map and Application for Final Plat. Rubaloff also referred to his Staff Report dated 10/24/90 on Page 6 of the packet. None of the Commissioners had a conflict of interest. Chairman Ellard opened the Public Hearing. Applicant, Gary Whittle, 843 E. Main, Medford, Oregon came forward to answer questions and .discuss the project with the Commission and Staff members. The Commissioners did not have any questions. No one else came forward in support of or in opposition to the Resolution. City Administrative Assistant, George Rubaloff stated for the record, that Resolution #210 would be amended to read Cashier's Check for 537,000 to be filed with City Hall by November 14, 1990. (in place of Letter of Credit) to assure performance of Conditions of Approval of Stonecreek No. 4, Phase II Subdivision. ~~~ CITY OF CENTRAL POINT Planning Commission Meeting Minutes November 6, 1990 Page 3 In addition to the requirements in the Resolution Larry R. Blanchard also commented that the Applicant would be required to .pay 5200 per lot - 16 lots = 53,200 for Park Fees by the close of the business day, November 14, 1990. Commissioner Bettenburg moved to approve the Resolution #210 as amended, and Commissioner Halley seconded the motion. Roll call vote: Bettenburg, yes; Crumm, yes; Halley, yes; Matthews, yes; and Piland, Yes. The Motion carried unanimously. B. Public Meeting Resolution #211 Vacation of ten foot portion of Oak Street ho*ween South Front and- South First Street adjacent to Tax Lots 1900 and 2000 of Jackson Countv Tax Assessor Mao 37 2W 10AA IApplicant~ Warren 0o er .Administrative Assistant, George Rubaloff referred to and entered into the record by reference copies of his Staff Report dated October 31, 1990, the Certificate of Posting for Public Meeting ,and the Vicinity Map, Tax Assessor Map, Aerial Map, Vacation Application Materials and proposed Resolution. There were no conflicts of interest on the part of any of the Commissioners. Chairman Ellard opened the Public Hearing. Applicant, Warren Cooper, 1130 Rose Valley Drive, Central Point came forward. The Planning Commissioners did not have any questions for Mr. Cooper. Mr. Cooper did not have any questions for Staff, nor did Staff have any questions for Mr. Cooper. The Commission inquired if the vacation would involve any of the property on State right of way. George Rubaloff assured the Commission that Staff would research and make certain that the portion of right of way vacation would only involve property in the City's jurisdiction. Chairman Ellard closed the Public Hearing. Commissioner Halley moved that they approve Resolution #211 as presented. Commissioner Pitand seconded the Motion. Roll Call Vote: Bettenburg, Yes; Crumm, Yes; Halley, Yes;. Matthews, Yes; and Piland, Yes. The Motion was approved and carried unanimously. MISCELLANEOUS: The Commission commended Staff for the new changes in the format and professional bold .print of the documents in the Planning Commission Packet. The Commissioner Halley wanted to know if the Planning Commission needed to review the newly revised CPMC Chapter 16 on zoning previous to it going before the City Council for approval. George Rubaloff, City Administrative Assistant stated that the changes are mainly "housekeeping" changes, and that although it was not legally necessary for the Commissioner to review, that it would be advantageous to get the Commission's input before final approval. The new Ordinance goes before the Council for its first reading November 15, 1990, and the 2nd reading December 20, 1990. There were no further items discussed. Bettenburg moved that the meeting be adjourned, Crumm seconded the motion. All were in favor and the meeting was adjourned at 7:55 p.m. ~,u STAFF REPORT TO FROM: DATE: Planning Commission George Rubaloff, Administrative Assistant December 4, 1990 SUBJECT: Determination regarding Conditional Use Permit Application, Planned Unit Development Application and Site Plan for West Park Place Project (37 2W 11D TL 2200) (Applicant: Roger Richardson) West Park Place Project is a proposed ten-unit townhouse development located at the northeast corner of Beall Lane and Bursell Road. In July and August, 1990, staff explained in reports to the Planning Commission that, in order to avoid flooding of downstreet properties and improvements, development should not occur in Meadow. Creek Drainage Basin until adequately financed and designed area-wide storm drainage improvements were made to that basin. The Commission postponed making a determination on the application with the anticipation that within the required timeframe, adequate progress would be made towards area-wide drainage system improvements. Since the applicant has not requested an extension of time for processing the applications, and since a decision has not yet been made within the allowable time frame for land use applications, staff recommends-that the Commission deny the Conditional Use Permit request without prejudice for the West Park Place Project. Contained within the attached resolution are statements of fact and conclusion regarding the storm drainage issue and upon which the denial of the project is based. By virtue of a denial of the Conditional Use Permit, the Commission would also be denying the request for a Planned Unit Development Permit and Site Plan review. A RESOLUTION DENYING A CONDITIONAL USE PERMIT APPLICATION-FOR THE WEST PARK PLACE PROJECT - A TEN-UNIT PLANNED UNIT DEVELOPMENT LOCATED AT THE NORTHERN CORNER OF BUASELL ROAD AND BEALL LANE (37 2W 11DD Tax Lot 2200) WHEREAS, on June 26, 1990, Agent L. Calvin Martin submitted Conditional Use Permit, Planned Unit Development Permit and Site Plan Applications for West Park Place, a project consisting of ten townhouse units with enclosed parking and further characterized by clustered housing units and open space on a 1.41 acre parcel on the approximate northeast corner of Bursell Road and Beall Lane, and, WHEREAS, on July 3, 1990, the Central Point Planning Commission conducted a public hearing to receive testimony on the application for Conditional Use Permit for West Park Place, after which, the Planning Commissioners unanimously agreed to consider the applications for Conditional Use Permit, Planned Unit Development Permit and Site Plan after the master storm drainage plan was in place, and, WHEREAS, on August 7, 1990, staff delivered a report to the Planning Commission emphasizing the necessity for developing a master plan, area wide design,. and LID financing for the Meadow Creek Drainage System prior to approving development within that drainage basin, and Planning Commission unanimously agreed to postpone making a decision on the applications to allow time for the developers to make progress on meeting the storm drainage requirements, and, WHEREAS, section 1.24.075 of the Central Point Municipal Code requires that City take final action upon permit applications within 120 days after said application is deemed complete, October 25, 1990 was the 120th day after the agent submitted the Land Use Applications to the City for West Park Place Project, and no request for extension has been received from the applicant. BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. The Planning Commission hereby makes the following findings of fact: A. Pursuant to Section 17.76.040(E)(11) and 17.68.120 of the Central Point. Municipal Code, the City may impose conditions of approval upon developers which are found necessary to protect public health, safety and general RESOLUTION NO. Unchecked development in the Meadow Creek Drainage Basin will result in flooding of properties and improvements within that basin. C. Central Point Public Works Department Staff Report dated July 3, 1990 proposed a required condition stating that all on-site storm drainage shall be collected from roofs and catchbasins and connected to pipes and discharged according to the Master Plan to be adopted as a part of the Meadow Creek Storm Drainage Plan developed by Blanton Engineering and approved by the City of Central Point. No building permits will be issued until the storm drainage issue is resolved. D. On March 15, 1990, the City Council postponed its decision to grant preliminary subdivision approval for Maple Grove Estates Subdivision located within Meadow Creek Drainage Basin, until developer submits an acceptable plan for correcting storm drainage deficiencies associated to the project. Maple Grove Developer is still working on the formation of said LID. E. Robert.Blanton Consulting Engineering has confirmed that the private storm drainage system which serves The Meadows, Planned Unit Development, was not designed to provide for future development in the Meadow Creek Basin and is near or at capacity; the following are two approaches to providing drainage-for future development in Meadow Creek Basin: 1. Install diversion pipe under I-5 to Bear Creek to provide for an area-wide storm drainage system and finance system via formation of an LID. 2. Require all developers in Meadow Creek Drainage Basin to develop on-site retention system. F. On-site storm drainage retention systems do not provide for increased runoff from upstream properties which are located outside of Central Point's jurisdiction. G. An on-site storm water retention system has the potential of discharging contaminants into existing water tables. H. West Park Place developer has indicated that the project site has capacity to handle on-site drainage retention RESOLUTION NO. PARK.PLACE/RESO (03/11/29/90) ~1V system. I. West Park Place developer has indicated that he would eventually participate in LID for area-wide drainage system. J. West Park Place developer has indicated that he would design on-site system to tie and feed into future area- wide system in Meadow Creek Drainage Basin. Section 2. .The Planning Commission hereby makes the following conclusions: A. An area-wide storm drainage system is necessary for the Meadow Creek Drainage Basin and the installation of a diversion pipe. under I-5 to Bear Creek financed with an LID will more efficiently and effectively serve drainage needs than a patchwork of on-site retention systems. B. Approving the West Park Place Development, or any other development prior to formation of LID for storm sewer improvements within the Meadow Creek Drainage Basin, would not be considered fair treatment to any other property owners or developers within the Meadow Creek Drainage Basin. C. Once the precedent is set for on-site storm drainage retention, an emergence of on-site systems could potentially reduce the number of participants in an LID for an area-wide drainage system thereby, increasing the cost to individual property owners, and making an LID less attractive to participants. D. While the West Park Place developer is agreeable to designing the on-site retention system so that it will tie into a future area-wide storm drainage system, such an approach would not be possible at this time since an area-wide system has not yet been designed or approved for the Meadow Creek Drainage Basin. E. As a planning agency, the City is responsible for ensuring that public facilities are designed, constructed and operated so that they effectively protect property owners and provide for future growth. The Meadow Creek Basin requires a plan which will give the City overall guidance for the development of an area-wide storm drainage system. If the West Park Place project is approved and allowed to have an on-site drainage system, properties and improvements within the Meadow Creek RESOLUTION NO. (03/11/29/90) PARK.PLACE/RESO l,il Drainage Basin are subject to potential flooding and the master plan approach to developing a Meadow Creek Storm Drainage System will be at risk. Section 3. Based upon the foregoing findings of fact and conclusion, the Planning Commission. hereby denies the Conditional Use Permit application for West Park Place. Section 4. Based upon denial of the request for Conditional Use Permit for the West Park Place Project, the Planning Commission cannot review and deliberate on the merits of the applications for Planned Unit Development Permit and .Site Plan for said project. BACKGROUND A Conditional Use Permit 'was granted to Southern Oregon Head Start on October 2, 1990, for placement of an early, childhood .facility at.Crater High School. Since the Federal-funding for that project will not be available to the applicant in the immediate future, the applicaht has made arrangements with'the Gloria Dei Lutheran council to operate the Head Start'program at the ohurch, and is seeking another Conditional Use Permit ao operate the facility. On September 4, 1979, the Central Point Planning Cpmmission granted Wilma John a Conditional Use permit to gperate an early childhood education school at the Gloria Dei Lutheran Church site. City records indicate that the Conditional Use.- Permt lapsed and 'became void one. year following the date of issuance. Hence, the'sppligant may not operate the'fscility under the previously issued permit. The proposed head start activities would be conducted within the existing church , building, parking lot and playground area: The.. project: calls for mihimal improvements to the playground area. ::Such improvements` would< include the placement of two .8 X 10 foot storage sheds.- The appropriate notices have been distributed within a 100 foot radius of the proposed site. As of this data, no written comments have :been received by the City'.' V.4V ANALYSIS Planning and Public Works staff have reviewed the. proposed Conditional Use in - accordance with those standards outlined in Chapters 17.20,: 17.60,'17.64, 17.72 and 17.76 of the Central Point Municipal Code and applicable- Public -Works standards. Since the project involves minimal improvements with the R-l,xone, the'site plan has been reviewed and approved by staff. Staff's overall finding, is that the proposed land .use would be consistent with the City's rules and regulations subject to the applicant meeting oertain conditions ofapproval which are, included as exhibits to 'the proposed Planning Commission Resolution. (Southern Oregon Head Start) has been suggested by our Regional Office to zelocate from the 115 Gibbon Road site in Central Point because of the unsuitable and degenerating condition of those premises. Head Start has attempted to locate another suitable site for years, but nothing suitable in the Central Point area has been found, until recently. We were very fortunate in approaching Central Point School District #6 and found that they were indeed very interested, so we filed for and received a Conditional Use Permit. At the suggestion of our Regional Office, we developed a proposal to relocate into temporary (mobile) classrooms, which was not funded at this present time due to budget constraints. So we approached Gloria Dei Lutheran Church and found that the congregation was indeed very interested •~ so here we are again, asking for a second. Conditional Use Permit and. to -have the site operational by January 2, 1991.- ° We have located an excellent site and secured it with a promise from Gloria Dei Lutheran Church (See Attached Letter). We have selected licensed contractors for each phase of the project (playgound development, moving, etc., and incorporated their input in this application. Due to the relative simplicity of the project and due to budget constraints, we have assembled and prepared the necessary drawings and specifications from many helpful sources, ourselves, and we believe we have satisfied the many requirements of this this application. All of the work will be performed by licensed contractors working under proper permits and inspections and agencies. There is no new permanent construction-needed, we will have no offsite parking and a minimal morning and afternoon traffic flow. We also plan to try to contact all adjacent landowners to explain what Head Start is about and answer any questions. After approval and moving, center must pass stringent fire and sanitation inspections. It is in the Northern sector of Central Point in an area bounded by North 10th Street and residential homes. Access to the area is provided by North-10th Street on the East side of property. The development around subject property is primarily residential to the 'North, West and East, with Seventh Day Adventist Church to the South. The nearest commercial development occurs North 10th at the intersection with .North 3rd the the North and at North 10th and Pine Street to the South. The portion of area to be used for the project has a total computed size of 1.75 acres. (For Further Site Data See Deed Copy) The property is on and owned by Gloria Dei Lutheran'Church in the Northern section of Central Point. The property is fairly uniform and gentle, and creates no construction and/or development problems. The property is served by Central Point City Sanitary, Pacific Power and Lights, etc. for utilities. The entrance, exit and all parking is on a paved surface entering from North 10th Street and extending around the entire building to be used for the center. The property has water and sewer lines that run the along the north side of North 10th Street (See Utility Plan) and are easily accessible. Also there are 9 fire hydrants within a 1 block location and additional fire hydrants on the corner of (See Fire Safety Plan) ~iw~ DESCRIPTION OF PROGRAM: Southern Oregon Head Start is a nonprofit, federally funded preschool program that serves 320 children in 9 center sites throughout Jackson and Josephine Counties. This site would serve approximately 36 four-year-old children. Children attend the center 9 days per week for 9 1/9 hours per day. Since the program is only part-day, Children's Services Division exempts Head Start centers from licensing (See Attached Letter). Centers do have to follow strict federal regulations and are inspected regularly by fire and health officials. Federal regulations require providing a minimum of 35 square feet per child indoors and 75 square feet per child of outdoor space. The proposed center site and proposed outdoor play area exceed the minimal space requirements. FINDINGS: A. Federal and state regulations require providing a minimum of 35 sq. feet of inside space for children and 75 sq. feet of outside space. The Gloria Dei Lutheran Church building is 120 X 72 for a total of 8,640 sq. feet, with Head Start using only 4,5,26 sq. ft. (classrooms, kitchen, bath, etc.). and the proposed playground is 102 X 70 X 118.9 X 95.5 for a total of fi,785 sq. feet. (See Playground Plan) This far exceeds the amount of space needed for 36 children of 1,260 sq. feet of inside space and 2,700 sq. feet of outside space. There are 2 bathrooms, each with 2 stalls which provide for adequate plumbing and toilet facilities: B. There are 2 vehicle access points for Gloria Dei Lutheran Church which would both be used as an entrance and exit. Head Start would arrange with Gloria Dei Lutheran Church the dismissal time for the Head Start center to coincide with other Gloria Dei Lutheran Church activities. (See Parking and Traffic Flow Plan). Approximately 1/2 of Head Start children (18) are bussed to and from the Head Start center by a Head Start bus, thus leaving the other 1/2 of the children (18) to be brought to and picked up at the Head Start center by Head Start parents, this small amount of traffic will not affect the current traffic flow on and off of North 10th Street. No improvements to the street or right-of-way would be required as a 20 foot driveway circles the building and is entirely paved and marked with more than the required 14 parking spaces needed. The entrance ~ and exit has no obstructions to vision. The playground is set back across the parking lot and is within full view of traffic, which provides safe access for children. There are approximately 75 parking spaces within the Gloria Dei Lutheran Church Property, which far exceeds the required amount for Head Start usage of 14 spaces (1 for every employee and 1 for every 5 children). There is plenty of additional space if needed and this. would therefore require no off street parking. This would provide a very adequate parking area for Head Start and Gloria Dei Lutheran Church purposes. Also the parking could be used by parents attending Gloria Dei Lutheran Church functions during non Head Start time. V Nr~ C. With the Gloria Dei Lutheran Church building already in use and playground already in place and set as far away as it is from North 10th Street to the East and the existing homes to the North, West and South, thus the proposed use will have no adverse affect on abutting property. D. Southern Oregon Head Start is a federally funded preschool fox children of age 4 and only operates 1/2 day. The use of the Gloria Dei Lutheran Church building will have not be detrimental to the health, safety ox general person residing or working the surrounding neighborhood and will not be detrimental or injurious to the property and improvements in the neighborhood ox to the general welfare of the community. El. Head Start proposes to further develop the existing playground with a park like setting within the current chain link fenced area (4-5 feet. high) that is approximately 70 feet on the North, 45.5 feet on the South, 102 feet on the East and 118.9 feet on the West. There is an existing wood fence on the West, with a 12-14' drive gate and 2 walk gates. Within this play area there would be a sandbox,-3 large play structures (one owned by the Church and already installed and. one owned by Head Start to be installed), a possible sodded section and a possible large mound with a culvert funning through it. Head Start employees would care for the playground and any existing trees and landscaping in the proposed use area. Head Start use of the property would have no adverse effect on the natural resources of the property. (The play structure Head Start owns is approximately 25 feet long and 7 1/2 feet high.) (See Playground Plan) There is one existing building on the Gloria Dei Lutheran Church property, (besides the church building) which is being used as a storage shed for the church. Head Start would like to install 2 storage sheds next to the current existing shed owned by the church. The children would attend the center from approximately 8:30-12:45, 4-5 days per week, Monday through Friday. Since the children are only at the center 4 1/4 hours per day and mostly inside except for a 1/2 hour outside play time, the noise should be greatly minimized. There would be no other detrimental environmental effects. E9. Head Start wishes to be operational with the proposed building on or before January 2, 1990. E10. Head .Start, if required would purchase a bond for removal of such use, but would not like to spend any additional money than needed to due the amount of budget limitations. A backflow device (DCVA FEBCO 805 #23908) is located on the irrigation system and not the domestic meter. B. Developer's Required Conditions 1. A backflow device, as it pertains to the hazard, shall be required on the domestic meter if food will be served on a regular basis at this facility.
