MEETING CALLED TO ORDER at 7:05 p.m. II. ROLL CALL: Present were: Garth Ellard, Rick Bettenburg, Candace Fish, Lloyd Governor, Randy Graves, Karolyne Johnson and Chuck Pilahd. Also present were Dave Kucera, City Administrator, George Rubaloff, City Administrative Assistant, Larry R. Blanchard, Public Works Director and Cecelia Gordon, Planning Commission Secretary. Randy Graves and Lloyd Governor were not present. Lloyd Governor had called in notifying the Commission that he would not be present. III. CORRESPONDENCE -Rubaloff handed out copies of the petition packet from Mr. Olsen and Attorney Thad Guyer, for the Commission's review. IV. APPROVAL OF MINUTES Commissioner Johnson moved to approve the Minutes of the June 23, 1992 PlanningCommissionMeeting. CommissionerBettenburgseconded the Motion. Roll Call Vote: Bettenburg, yes; Johnson; yes, and Piland, yes; and the Motion passed unanimously. V. BUSINESS A. Pub/ic Meeting - Review and recommendation of a Site Plan for a commercial storage building at the Grange Supply Yard on Ash and First Streets in the C-5 Zone (372W 11 BB Tax Lots 7100 and 7400) (Applicant: James Hudson for Grange Co-op-. ~-~ 0~. CITY OF CENTRAL POINT Planning Commission Meeting Minutes July 7, 1992 -Page Two George Rubaloff outlined his Staff Report of June 30, 1992, and referred to the following items: Location/Zoning Map, Tax Assessor's Map, Certificate of Posting, Site Plan Application Materials, Public Works Staff Report (including Exhibit "A") dated June 29, 1992 and a Memo from Mark Servatius, Fire Chief/Building Official. Rubaloff described the application and entered all the above items into the record by reference. There were no conflicts of interest or ex-parte communication on the part of any of the Commissioners. Chairman Ellard opened the Public Meeting Jim Hudson, 3619 Ross Lane, Central Point, came forward in support of the site plan application. Mr. Hudson said that this plan had been discussed, when Phase I (Parking Lot) was reviewed last year. He said that the only changes were that they would use a buried gasoline tank for fuel for their fork lift, and ~, would have an above ground kerosene tank for retail use at a later time. The Commission wanted to know the maximum height of the building. Mr. Hudson explained that it was within the 35' height Iimitation.The Commission did not have any further questions of Mr. Hudson or of staff on this matter. No one else came forward in support of or in opposition to the application for the Site Plan. Chairman Ellard closed the Public Meeting. Commissioner Piland moved that the Application for a Site Plan be approved. Commissioner Bettenburg seconded the Motion. Roll Call Vote: Bettenburg, yes; Fish, yes; Johnson, yes; and Piland, yes; and the Motion carried unanimously. ,; . ~ 02 CITY OF CENTRAL POINT Planning Commission Meeting Minutes. Pub/ic Meeting -Review and determination of site plan for commercial building on Laurel Street west of where Laurel and First Streets intersect in the C-5 Zone (372W 2DD Tax Lot 2700 (Applicant: Laz Ayala). George Rubaloff, Administrative Assistant outlined his Staff Report of June 30, 1992 with the following attachments in the packet: Location/Zoning Maps, Tax, and Aerial Maps, Certificate of Posting, Public Works Staff Report of 6/29/92, Memo dated 6/29/92 from Mark Servatius, Fire Chief/Building Official, and Site Plan Application Materials, whereupon he described the Application and entered all the above items into the record by reference noting that on page two of his June 30, 1992 Staff Report, (Packet Page 21) Item 3.b. the word 'designed' should be the word 'designated'. Rubaloff also stated that the Planning Commission can recommend that the required size for landscaping be reduced from a 10 foot wide strip to a 6 foot wide strip. There were no conflicts of interest or ex-parte communication on the part of any of the Commissioners, Chairman Ellard opened the Public Meeting. Laz Ayala, 2052 Young Court, Medford, Oregon, came forward in support of the application. The Commission inquired if Mr. Ayala knew about the requirement of paving the alley adjacent to the property. Mr. Ayala replied that he had read the condition and the Ordinance 12.02 of CPMC, and felt that although he had framed in a door on that side of the building that it would not be a doorway, and therefore he would not be accessing the alley. Rubaloff handed out copies of CPMC to the Commission for their review. The Commission answered that the paving requirement applies to any new developments such as the proposed commercial building. The Commission stated that although Mr. Ayala would not be accessing the alley, that in some future time, a new owner, etc. may use that doorway and access the alley with no way for the City to impose the paving requirement at that time. The Commission also added that if Mr. Ayala chose to do so, that he could begin a process for vacating the alley, and if the alley were vacated, the City would not require that the alley be paved, since it would revert back to private property. Rubaloff stated that he would be available to explain the alley vacation process to Mr. Ayala. --~ 03 CITY OF CENTRAL POINT Planning Commission Meeting Minutes July 7, 1992 -Page Four Larry Blanchard, Public Works Director, offered some estimated costs for paving. Blanchard said that if Mr. Ayala wanted exact figures, he could provide those to him upon request. No one else came forward in support of or in opposition to the proposed Site Plan. Chairman Ellard closed the Public Meeting. Commissioner Bettenburg moved to approve the Site Plan Application subject to all conditions contained in Planning and Public Works Staff Reports to include the reduced landscape strip. and that the Developer pave the adjacent alley. Commissioner Piland seconded the Motion. Roll Call Vote: Bettenburg, yes; Fish, yes; Johnson, yes and Piland, yes. The Motion carried unanimously. VI1. ADJOURNMENT - Commissioner Piland moved that the Planning Commission adjourn. Commissioner Bettenburg seconded the motion. The motion carried unanimously on voice vote. Meeting adjourned to Study Session at 8:00 p.m. MISCELLANEOUS Study Session on Land Use Process to be held after the regular meeting adjourns. Administrator Kucera highlighted the General Land Use Decision process using the City's Subdivision Variance as an example. The Planning Commission reviewed land use terminology such as "findings of fact" and quasi-judicial hearing, and Case Law in land use matters relating to financial hardship. SINCERELY, T01~1 SO ENSEN -- 05 S T A F F R E P O R T TO: FROM: DATE: RE: Central Point Planning Commission \ /~-Y George Rubaloff, Administrative Assistant July 28, 1992 Public Meeting - Review Application for a Commercial (37 2W lOAA TL 5300) and determination of Site Plan Building located on Haskell Street BACKGROUND Barry Fronek has submitted a site plan application for an 18,750 square foot warehouse structure to be built on a 1.02 acre tax lot located on Haskell Street in the City's Industrial (M-1) zone. The site features apre-engineered metal building, a paved parking area accommodating 20 parking spaces, a loading dock and a landscaped front yard. Amy Street (unimproved alley) is located east of the property and Oak Street (unimproved) is located to the south. Mr. Fronek intends to conduct the same land uses which he is currently conducting at the Highway 99 site which includes warehousing, cold storage and distribution. The proposed use at this site is consistent with the general purpose of the M-1 zone in that it would be alight industrial use having high standards of operations of such character as to permit its location and operation in close proximity to non-industrial areas of the community. REVIEW 1. The operation is required to be conducted within a totally enclosed structure. Prior to obtaining a building permit, applicant shall submit elevations to the City to demonstrate conformance with this requirement. 2. The applicant shall pave the entire loading dock and parking area. 3. Since the- development is facing a residentially zoned property, the applicant shall provide a 10 foot landscape strip fronting Haskell Street. Said landscape strip shall be free of parking and planted in accordance with a landscape plan approved by the Planning Department. Said landscape plan shall specify plant species and irrigation system and shall be submitted by the-applicant prior to obtaining a building permit. NOTE: The proposed site plan shows an insufficient landscape strip in the front.. , Y r r Os The maximum height for buildings in the M-1 zone is 60 feet. Prior to obtaining a building permit, applicant shall submit elevations to the Planning Department to demonstrate that the proposed height of the building meets the zoning standard. 5. The proposed site plan does not show signing for the project. Prior to obtaining a sign permit for any signs installed on the site, applicant shall demonstrate that proposed signs will conform to CPMC 17.48.080 (attached) relating to any signs placed on the project site. 6. Applicant may use the compact car adjustment outlined in CPMC 17.64.070 if the applicant meets the eligibility requirements (attached) . If the applicant meets the requirements, he can take up to 5 spaces of compact size. 7 . Applicant shall delineate the required parking spaces and loading areas with painted striping upon the paved surface. 8. Prior to being issued a Certificate of Occupancy, applicant shall ensure that lighting used to illuminate off-street parking or loading areas is arranged so as to reflect the light away from adjacent streets or properties . 9 . Parking is not allowed in the required set back area or landscaping area in the front yard. Prior to obtaining a building permit, applicant shall modify the plan so that no parking spaces are within the required landscape area. 10. Prior to obtaining a building permit, applicant shall submit elevations to the Planning Department so that the Planning Department can determine if the architecture is appropriate for this area. The Central Point Planning Department has reviewed Chapter 17.48, 17.60, 17.64, and 17.72 of the Central Point Municipal Code and finds that the proposed site plan for the warehouse structure on Haskell Street meets the required setbacks, meets all clear vision requirements, provides a sufficient amount of parking spaces and loading births, meets parking aisle requirements, meets parking space size requirements, provides for on-site circulation of people and vehicles, and includes access which is sufficient for fire fighting equipment. If the applicant is able to comply with those requirements noted above, and any requirements that are included in the Public Works Staff Report, then the proposed site plan will be consistent with the City's development requirements. Signs within the M-1 district shall be limited to the following: A. 1. Permitted signs shall contain not more than one hundred square feet of surface area on any one side, or an aggregate of two hundred square feet of surface on all sides which can be utilized for display purposes; 2. Lighted signs shall be indirectly illuminated and nonflashing; ~ 3. Identification signs shall be permitted within any required setback areas provided it does not extend into or overhang any parking area, sidewalk or other public right- of-way; 4. Signs located within vision clearance areas at intersections of streets shall conform to Section 17.60.110. B. Signs advertising the property "for rent" or "for sale" shall not exceed four square feet of area on any one side and one such sign shall be permitted for each street frontage. C. Signs in the M-1 district shall be permitted and designed according to provisions of Chapter 15.24. (Ord. 1615 §18, 1989: Ord. 1436 §2(part), 1981). .... ~ o 17.64.070 Compact car adjustment. A. Any parking lot or otherwise required public parking area containing ten or' more parking spaces shall be eligible for a compact car ad-- justment, provided all requirements of this chapter are ade- quately met. B. Up to, but not exceeding, twenty-five percent of the total number of required parking spaces may be designed and provided for the parking of compact cars. C. Compact car parking spaces shall be not less than eight feet in width and not less than fifteen feet in length. All maneuvering and driveway areas shall remain standard size, as provided in Section 17.64.100. D. All compact car parking spaces shall be clearly marked as such, with such marking to be of the type found to be most appropriate by the planning commission. Oak Street and Amy Street shall be improved to the standards established in the Public Works Standards and Central Point Municipal Code to include curb/gutter, sidewalk, streetlights, storm drainage, subsurface/baserock improvements, paving improvements and traffic control installation, unless the developer applies to and receives approval by the City Council for vacation of Oak Street and Amy Street. 2. CPMC 12.02, 17.60 Safety Improvements. TF3 a. Construct the improvements necessary to provide for proper sight distance and vision clearance as stipulated in CPMC 17.60 for ingress/egress from Haskell Street. TF3 b. Due to P.U.C. requirements, it may be necessary to close the Amy Street in- gress/egress to West Pine Street because of its close proximity to the South Pacific Railroad Signal Crossing/and Right-of-Way. No ingress or egress shall be taken from the property included in this Site Plan from/to Amy Street fromlTo West Pine Street. Any improvements required to meet this condition shall be constructed prior to issuing a Certificate of Occupancy for this property. 3. CPMC 17.64 -Parking TF3 a. Offstreet parking construction shall be installed according to the rules established in CPMC 17.64. 4. CPMC 12.04, 15.40 -Sidewalk Improvements. TF3 a. Install a 5' concrete sidewalk as required by the Central Point Public Works Department along property abutting Haskell Street. 5. CPMC 14 -Sanitary Sewer Improvements. TF3 a. The Developer shall construct a sanitary sewer service to this property, sized to meet the plumbing requirement for this use. TF7 b. Regional Sewer Development Charge -The Developer shall pay a SDC for connection of this facility to the Regional System. Cost of this connection shall be as defined in the Sewer System Development Charge Report. This shall be paid as a part of taking out any City permit(s) for this project. TF7 c. Local SDC - as required by CPMC Title 14. TF2 d. Industrial Waste Permit -The Developer shall complete an application for sewer use and submit it as a part of the building permit process. This application will determine if standards will be established for industrial discharge to the Sanitary ~ Sewer through a permit issued by the Wastewater Treatment Plant Superinten- dent. 2i Exhibit "A" -Page Two Fronek Warehouse 6. CPMC 12.02 -Storm Drainage Improvements TF3 a. Make the proper storm drainage connection based on the type of pipe from the property service to the mainline. TF3 b. Continue the 12" storm drain through this project to connect to the ditch located on Amy Street. This improvement shall be a condition of vacating Amy and Oak Streets. TF2 c. Storm Drainage Property Service -The Developer shall provide a complete set of design calculations for both roof drainage and lot drainage to assure proper sizing for the connection point to the storm drainage system. TF3 d. Catchbasin Locations -All roof drains, area drains, and crawl spaces shall have positive drainage away from the structure and shall be connected to a curb drain or an approved storm sewer. TF2 e. Developer shall provide the building's finished floor and property topographical elevations to determine that all structures in this Development will drain properly. 7. Water System Improvements -CPMC 13 TF3 a. Install a new fire hydrant and fire hydrant assembly at the south west property corner. TF2 b. Water System Property Service -Developer shall provide design calculations in order to determine the size of meter(s) required for this development. TF2 c. Backflow -The Developer shall provide the necessary information regarding internal plumbing so the City can determine if a backflow device will be required. 8. Street Light Improvements TF3 Install a 9500 Lumen High Pressure Sodium Vapor street light at the northwest property corner. 9'. Developer shall install or cause to be installed, conduits for utilities at intersections, or locations determined by utility companies. TF3 Developer shall also provide conduit crossings for utility companies who will not install their services until after the facility is constructed. The Developer will be responsible for all costs associated with the installation of these conduit crossings. 22 EXHIBIT "B" FRONEK WAREHOUSE PUBLIC WORKS CONDITIONS All construction for utilities, streets, and other structures discussed herein, within rights of way owned, or to be owned by the City of Central Point, shall be done so according to all rules, regulations, ordinances, resolutions and other applicable requirements of the City of Central Point for the construction of this development. 2. This review for the Site Plan Review, submitted by Barry Fronek was done so in accordance with all the rules, regulations and ordinances in effect as of the date of this review. Any modifications by the Developer of this project after City Planning Commission and/or City Council approvals, could require resubmittal of an application and approval by the City Planning Commission and/or City Council. 3. All costs associated with this Development and the conditions placed on this Development shall be the sole responsibility of the applicant/owner. 4. No construction will begin on this project or any building, until such time as plans and specifications have been reviewed and approved by the Public Works Department and other required departments of the City and a Permit has been issued for each portion of the project requiring a permit, or unless authorization to do so has been granted that.
