R E P O R T--- To: Planning Commission Date: September 29, 1988 From: Randy Kugler, Administrative Assistant & Acting Planning Director Re: Public Meeting - Site plan review for the expansion of the Jehovah's Witness Church at 434 Oak Street in a C-2 zone (37 2W-11BB, tax lots 100 _ and 200) This proposal calls-for the construction bf a 560 square-foot addition on the east side and a 924 square-foot additidn on the south side of the existing church. Chapter 17.72 contains standards required for a site plan to which the Planning Commission may refer for their review. All yard setbacks including vision clearance areas have been provided for. Landscaping has already been established in the front and Fifth Street side yard area. The proposed expansion creates a need for 47 parking spaces which will be met by. the existing spaces provided and the addition of 12 spaces on the western adjoining tax lot 200. This lot is in the process of being deeded to the church and a lot line adjustment is also being processed by the County Assessor so that all parking areas will be associated with tax lot 100. The applicant has agreed to .pave the remainder of the alley between Oak and Alder. The applicant will need to enter into a deferred improvement agreement for future street related improvements for 0ak and Fifth Street. As a condition. of approval, the Public Works Director requests that the appli- cant submit a design for the parking lot including connection to the City storm drain system prior to the issuance of a building permit. The applicants' propose to meet all existing zoning code requirements for the facility including paving of all vehicle storage areas that are presently graveled and the installation of site screen- ing fencing along,. Freeman Road to provide a vision buffer for the adjoining residentially zoned ;properties .. Theproposal_meets all yard; lot coverage, building height, ahd on-site park- ing requirements. The applicants-have requested an extension on the paving of the parking areas due to upcoming cold weather. The proposed resolution adopt- ` ing the findings. provides for a mutually agreeable-date to be determined. The applicants will need to enter into a deferred improvement agreement for future street related improvements for Beall Lane and Freeman Road. Central Point Municipal Code Section 17.76.040 outlines the requirements for consideration by the Planning Commission while reviewing the conditional use application: Staff has prepared a resolution adopting findings for this request. BY DON BALL AND ROY BATES WHEREAS, an application for a conditional use permit for an automotive repair and alignment service in a C-5 zone has been submitted by Don Ball and Roy Bates, said business to be located at 1100 Bea11 Lane within the City; the .location more particularly described as Jackson County Tax Assessor's map page 37 2W 1C, tax lot 4500; and WHEREAS, the Central Point Planning Commission has reviewed and approved the application at a public hearing held on the fourth day of October, 1988; now, therefore, BE IT RESOLVED BY THE PLANNING.COMMISSION OFTHE CITY OF CENTRAL POINT,OREGON, AS FOLLOWS: Section 1. The relevant criteria applicable to the within application is as followed: (a) The Comprehensive Plan designates the site as thoroughfare commercial. (b) The Zoning Ordinance designates the site as C-5. (c) Central Point Municipal Code Chapter17.76 describes the conditions which the Planning Commission must consider in order to grant a conditional use permit. Section 2. The Planning Commission hereby finds as follows. The proposal meets the City's urbanization goal for commercial land uses found in the Comprehen- sive Plan because the east side of Highway 99 (Front Street) is the primary thor- oughfare commercial district (C-5). This area is developed primarily for auto related businesses and services. The C-5 zoning recognizes these types of uses which will strengthen this corridor while providing locations for these uses that are often not compatible with commercial uses in other zones. Section 3. The Planning Commission hereby finds as follows. The proposal meets the requirements of the City's Zoning Ordinance for a C-5 zone because: {a) Automobile service and repair is a conditional use (b) The proposed use meets all height, yard and lot coverage requirements. (c) No evidence was submitted supporting a conclusion that the proposed expan- sion would generate conditions that would adversely impact surrounding properties. /~ (d) Asight-obscuring fence will be installed along the Freeman Road property line to lessen the visual impact on the neighboring residential properties. PLANNING COMMISSION RESOLUTION N0. - Page 1 (e) All areas utilized for parking, access and maneuvering of vehicles shall be paved. Section 4. The Planning Commission finds that the record herein and the findings therefrom support the conclusion that the proposal is in compliance with the City's Comprehensive Plan and the applicable standards of the City's Zoning Code. The proposed conditional use is hereby approved subject to: (a) Compliance with the relevant requirements of the Uniform Building Code and the Uniform Fire Code. (b) Entering into a deferred improvement agreement fdY future storm drainage systems, sewer, water, streetlights, curbs, gutters, sidewalks, and paving and street improvements, that may benefit the subject property.. Kenyon This request for a museum expansion involves the attachment of a 50' x 12' open viewing area that will contain exhibit materials that are presently stored on .site. As museums are a conditional use in this R-1 zone, any expan- sion requires a review and hearing. An original conditional use permit was issued in March of 1985.'. At that time Mr. Wes Riley indicated 13 paved parking spaces would be provided. At this time seven spaces are available. The Commission should refer to Exhibit G and consider establishing a mutually agreeable timetable for completion of this requirement. The museum is also in the process of consolidating tax lots which will be helpful when considering future building projects. A deferred improvement agreement for future street related improvements on Scenic Avenue, Parkwood Avenue and Dobrot Way will need to be entered into by the museum. Central Point Municipal Code Section 17.76.040 outlines the requirements for consideration by the Planning Commission while reviewing the conditional use application. Staff has prepared a resolution adopting findings for this condi- tional use. Revisions for Periodic Review As we discussed previously, the City .of Central Point will begin.. the periodic review of its Comprehhensive Plan at the end of February, 1989. .This is a time when several parts of the Comprehensive Plan will need some editing and minor updating while other parts need extensive revisions. -The elements needing major work and:substantial issues to be addressed are: ELEMENT SSSUES Urbanization Update findings, growth rate, and-adjust land use balance. Housing Analyze data and address several recent state laws to assure that the city provides for needed hoaxing types. Environmental Management Update several sections on air quality, noise, etc, and create a separate History element for historic sites. Public Facilities Economics Circulation/Transportation Land Use Update and comply with administrative rule for public facility planning Update and comply with administrative rule for economic development. Update and comply with administrative rule for public facility planning Analyze current data and consider other plan elements to assure a balance of land uses within the city and UGB. -1- 9 September 29, 1988 Memo to Central Point Planning .Commission In addition to the updating text of the elements we also need to review and update the Comprehensive Plan policies. The policies .-are in many ways the most important statements in the'Plan. Policies are the City's commitments and statements of intent in regard to land development and resource conservation. Policies are also the link between the plan and implementing ordinances (zoning and land division). State statute and case law 'establish the Comprehensive Plan and its policies as the governing document for land use actions. Ordinances must be consistent with the Comprehensive Plan. - In light of the code revisions that the Planning Commission has considered,-we can evaluate how well various policies are implemented by code provisions and what further adjustments may be needed. At the core of-the .plan review process is considering how well the 'document states.the-.goals of the community and how rea istically it sets policies to acheive those goals. The minimum requirements of the state for periodic review provide a framework that L believe the City should expand upon in order to improve its plan. A suggested starting point for the review of plan policies is to review those policies that call for further planning. It will help us consider progress to date. and what priorities should. -guide the periodic review effort. Attached are Central Point Comprehensive Plan policies that call for further planning. The plan is an ambitious document and not everything has been _-done. In the review process I would hope we can evaluate what still needs to be done and get plan policies more focussed on specific implementing measures and a coherent program for implementation.. _ ~y _2_ CENTRAL POINT COMP PLAN POLICIES THAT CALL FOR FURTHER PLANNING HOUSING 1-1. (Page V-34) "Undertake an analysis of housing needs to determine whether or not any adjustments should be made to the proposed residential balance of this plan. (This should be done with the aid of Census or other statistical data as available and should include factors related to the ability of present and future residents to afford housing of various types.)" This policy will be met during updating. Could be replaced with a general policy on updating by the next periodic review, HOUSING 2-1 (Page V-35) "Undertake a complete housing condition survey of the city to determine the overall condition of the housing stock and to 'identify specific housing units or neighborhoods that are in need of assistance. This survey should be done to HUD guidelines for possible later use in a housing assistance grant application to HUD or another granting agency." HOUSING 3-3 (Page V-36) "Develop requirements and guidelines, to be included in the Zoning Ordinance, pertaining to enemy'conservation' in all new residential construction, including standards for insulation, solar orientation, and solar energy systems for residential structures." City has developed a profile sheet and .brochure. Economic Development Department developed state and national trends reports. ECONOMICS (Assembly and Disposal of Land 2) (Pg IX-25) "Study the benefits of developing 'concept plans' for the coordinated development of critical areas, such as the Seven Oaks interchange are and other industrial sites along the railroad." _ Not implemented. Seven Oaks is outside the UGB and other sites are not in city limits. CIRCULATION/TRANSPORTATION 1 (Page XI-26) "This. Circulation/Transportation Element should be reviewed and updated. periodically in coordination with local and regional comprehensive plans and area-wide transportation plans." This policy will be met during updating. Could be replaced with a general policy on updating by the next periodic review. LAND USE (Commercial Development 2) (Page XII-19) "Undertake an indepth study of the downtown business district and develop a comprehensive improvement plan that would include such considerations as traffic circulation and off-street parking, pedestrian and bicycle facilities and access, structural design guidelines, and guidelines for landscaping and signing." LAND USE (Commercial Development 6) (Page XII-19) "Undertake a study of the Highway 99 commercial areas between Beall Lane and the High School to determine what specific actions are needed to .improve this corridor, improve traffic circulation, and improve the overall visual and aesthetice character of the area."
