As both Fire Chief/Building Official Servatius and myself were .not with the City during this period of time, we are unable to comment on this matter. Former Fire, Chief/Building Official Paul has_also been unable :to provide assistance. Central Point Municipal Code Section 17.64.040, A., 1., requires not less ahan two covered"'parking spaces for a single-family dwelling. Section 17.80.010 spQCifies the conditions which must be met in order for the Planning Commission to grant a variance. After several, visits to city hall we were told that the best and most obvious place to put our one covered parking space would be on the north side of our home. We then proceeded to have our contractor lay concrete to accommodate this space. Stage Two of our plan was to build the covered space, adding a small shed to the rear of it to accommodate the storage we would lose in converting our garage. -After completion we were informed_by the building dept. that the information we had been given earlier by the city was incorrect and that we needed. two. covered spaces in order to convert our garage to living space. Our plans however,. were - already in progress and funds had already been spent to complete Stage Two. We don't have the space to have two covered, parking spaces nowt and if we had known that-this was to be the case we- ' _-wouldn't have added the carport but simply put our home up .for sale and moved to a larger one. However, our saving have already . been spent on two third's of this project _and we would like to be granted a variance to convert with the existing parking space we have now. A RESOLUTION ADOPTING FINDINGS AND CONCLUSIONS AND APPROVING THE VARIANCE OF THOMAS AND JOANNA LOWS WHEREAS, an application for a variance for the reduction of the required num- ber of covered off-street parking spaces from two to one at 745 Hemlock Court with- in the City and more particularly described as valley Estates Unit 3, lot 13, block 2;-and WHEREAS, the. Central Point Planning Commission has. reviewed and approved the application at a public hearing held on the seventh day of June, 1988; now, therefore, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1. The relevant criteria applicable to the within application is Central `Point Municipal Code Chapter 17:80 which describes the conditions the Planning Commission must consider in order to grant a variance. Section 2. The Planning Commission hereby finds as follows. The request meets or is not applicable to the criteria for granting a variance because: 1. Not applicable 2. Not applicable 3. Not applicable 4. Npt applicable 5. The variance will not have any adverse impact upon the neighborhood be- cause the applicants will follow all requirements of the Uniform Building Code and Uniform Fire Code. 6. The variance will involve utilization of R-1 zoned property and still pro- vide an area for four off-street parking spaces. Section 3. The Planning Coirunission finds that the record herein and the 'findings therefrom support the conclusion that the proposal is in compliance with the appli- cable standards of the City's Zoning Code. The proposed variance is hereby ap- proved subject to compliance with the relevant requirements of the Uniform Building Code and the Uniform Fire Code. Due to some apparent violations of the Central Point Municipal Code (i.e. open storage of various materials in the rear yard area, unpaved areas that were being utilized for vehicle parking or maneuver- ing, and storage of vehicles and vehicle parts in the rear yard area), I was direct- ed to check on the prior Planning Commission review of this particular use. I determined that a conditional use permit was not applied for or reviewed by the Planning Commission at the time of the site plan review which is not consistent with Central Point Municipal Code Section 17.46.030, A., in that auto and truck service and repair requires a conditional use permit. Mr. Schafer has completed a substantial portion of his sight-obscuring fencing and has indicated that he-plans to add to the aphalted parking in the front yard area. With the addition of this improved parking area, adequate parking per CPMC require- ments will be available. = A deferred improvement agreement for future street related improvements has already been completed by Mr. Schafer. The Public Works Director has no concerns with this development and the State Highway Department also reviewed this proposal at the time of the site plan review. Central Point Municipal Code Section 17.76.040 outlines the requirements for consid- eration by the Planning Commission while reviewing the conditional use application. Staff has prepared a resolution adopting findings for this conditional use. The proposal meets the City's urbanization goal for commercial land uses found in the Comprehen- sive Plan because. the east side of Highway 99 (Front Street) is the primary thor- oughfare commercial district (C-5). This area is developed primarily for auto related businesses and services. The C-5 zoning recognizes these types of uses and will strengthen this corridor while providing locations for these uses that are often not compatible with commercial uses in other zones. Section 3. The Planning Commission hereby finds as follows. The proposal meets the requirements of the City's Zoning Ordinance for a C-5 zone because: (a) Automobile service and repair is a conditional use. (b) The proposed use meets all height, yard and lot coverage requirements. (c) No evidence was submitted supporting a conclusion that the proposed use would generate conditions that would adversely impact surrounding properties. (d) Asight-obscuring fence will be installed along the property line to lessen the visual impact on the neighboring residential properties. In addition to the expansion of the original structure, a four-car carport-will be constructed with paved access. Public Works Director Larry Blanchard has prepared a report addressing the need for a deferred improvement agreement and dedication of two feet of additional right-of- way along Tenth Street. In additional to these issues,-the Planning Commi.ssiofl may attach as conditions of approval any of those standards contained in Section 1'7.72.040. The following exhibits are included: . Sanitary Sewer Service Each unit should have separate sanitary sewer service in the event the units are sold-or to segregate potential plugs ups.. 2. Water System Service The Fire Department shall review the requirements for fire, life, and safety issues.. Each unit shall have a water meter. 3. Storm Drainage A storm drainage system is not presently available to adequately drain this. project. The developer shall meet the requirements of the Building Department for on-site storm drainage. A 24-inch storm drainage system is required to be installed in Tenth Street ° prior to any paving improvements. The developer shall agree to participate in the cost of construction of .this storm sewer system when required. 4. Street Improvements This street section is designated as a secondary arterial (SAS) with a present width of 32 feet and a right-of-way width of 60 feet. Future street width is 48 feet with a 64-foot right-of-way. An additional two feet of right-of-way is required from this property. The developer will be required to install sidewalks and curb cut said insta]la- tion shall be completed when street widening is done. This shall be included in a deferred improvement agreement. Streetlighting will also be included in a deferred improvement agreement. In most cases one access is allowed for each separate facility; however, joint access, whenever possible, is recommended. If the duplex is ever sold, it may be necessary to create a separate access unless an agreement is signed by both property owners. It shall be included in the deferred improvement agreement that if the duplex is sold and if joint access is no longer agreeable to both parties, then a new access to City standards will be constructed by the owner of the property. At present these uses are allowed in the R-2 and R-3 zones. This particular request would not involve the addition of any school staff or creation of additional traffic in the neighborhood.
