Adjournment ---STAFF REPORT--- To: Planning Commission Date: January 26, 1988 From: Randy Kugler, Administrative Assistant & Acting Building Official Re: Site Plan Review - Commercial office addition at 60 North Fourth Street in a C-2 zone (37 2W 2CC, Tax Lot 1500) submitted by Lee Niedermeyer, State Farm Insurance Company Lee Niedermeyer has submitted a site plan for a proposed addition to his coimner- cial building at 60 North Fourth Street. Chapter 17.72 of the Central Point Munic- ipal Code (CPMC) contains standards required for a site plan which the Commission may refer to for. their review. The proposed addition would extend to the east property line as permitted by CPMC Section 17.36.050, F., and comprise approximately 456 square feet. The site plan indicates five offstreet parking spaces. CPMC Section 17.64::040 requires that five spaces be provided. `~ In order to comply with Section 8.04.070, the applicant will need to design a roof gutter system to deliver storm water runoff directly into the street gutter. Public Works Director Larry Blanchard will be working with the applicant to pro- vide this system and to incorporate this feature in the needed repair of two side- walk sections. Staff recommends as a condition of approval that this work be included in the final building plans. Central Point Municipal Code. The revisions begin with changing the name of the title to "Land Divisions" from "Subdivisions" since the title also covers partitioning and it is suggested that it also address lot line adjustments. The revisions to Chapter 16.04, General Provisions are attached along with a revised variance section, proposed new sections on staff approval of some minor land partitions, and a formal procedure for lot line adjustments. Upon meeting with the Public Works Director it became apparent that most of the existing subdivision title (which dates from 1963) needs to be extensively updated. The standards cited in places have been superceded by new techniques or are contradicted by standards adopted in other titles. It is also suggested that Central Point no longer require city council approval of partitions or subdivisions, except on appeal. I suspect this code provision dates back to before the time when the city had a planning commission. Central Point is one of the few cities that has not already delegated this function to the planning commission. Revised sections incorporating these and other changes should be ready for the March planning commission meeting. As before deletions from the text are in (brackets], and the proposed additions underlined. All subdivision plats and all streets or ways created for the purpose of dividing [partitioning] land shall be approved by the planning commission in accordance with these regulations. Minor land partitions, minor variances, and lot line adiustments may be approved by the city administrator in accordance with these reQUlations. The ordinance codified in this title is adopted pursuant to ORS 92.044 and applies [only] to [sub] land divisions [and land partitions which is] subject to approval under ORS 92.010 to 92.150. 0 -16.04.030 Penalties and Enforcement. [formerly 16.44.070"] Failure to comply with any provisions of this title [chapter] shall, upon conviction, be punished in accordance with Section 1.16.010 of this code, said section being in the general penalty section. In addition to such penalties, it is declared that any failure to comply with any provision of this chapter by any person seeking to divide land constitutes a public nuisance and that the city shall have the right to abate the same upon suit for injunction, mandatory or otherwise, as the circumstances may require, in the circuit court of the state for Jackson County. c' Chapter 16.36 VARIANCES 16.3b.010 Variances. A. General. A variance-may be granted, as prod ded in this chapter,-where the strict application of the provisions of [chapter] Title 16 would result in unnecessary hardship. In granting a variance, the city may impose conditions similar to those provided for conditional uses under the Zoninp,,_Title in order to protect the interests of the surrounding propert[y]ies, the neighborhood, or the city as a whole. B. Application and Review, Applications and review of a variance shall conform to the provisions of Chapter 1.24 and all applicable laws of the state. This application shall be accompanied by a fee of one hundred dollars. C. Information Required. An application shall be .accompanied by a legal description of the property, plans and elevations necessary to show the proposed development. D. Consideration for Granting Variance. A variance may be ~" granted if findings are made that the following considerations will either result from a granting of -the. variance or the following considerations do -not apply to the requested application: 1. The variance will provide added advantages to the neighborhood or the city, such as beautification, or safety; 2. The variance will not have any significant adverse impacts upon the neighborhood; 3. The variance will utilize property within the intent and purpose of the land division title [zone district], 4. Date: January 28, 1988 From: Randy Kugler, Administrative Assistant & Acting Building Official Re: Site Plan Review Process I have recently had an opportunity to examine the site plan review process with other staff members and would like to share some of these observations with the Planning Commission. I would like the .Commission to think about the role this. particular review process plays in the City's planning program and if some changes might be in order. As presently structured, the process is basically a design review for new construc- tion. Unless the application also involves a conditional use or variance request, the Commission has limited legal authority to attach any conditions of approval to the project.- The standards that the Commission does consider involve Public Works, Uniform Building and Fire Codes which are not land use issues and, there- fore, have not traditionally been subjects of review for Planning Commission: I will attempt to describe several options in detail that the Commission may want to consider at the meeting. s RK/mah PCWORK SR/STPLN /3 ---. Date: January 28, 1988 From: Randy Kugler, Administrative Assistant & Acting Building Official Re: Request for Modified Carport Structure In early January, Rick Helmes of 518 Glenn Way enclosed his existing garage with- out first contacting the City to obtain a building permit. I advised Mr. Helmes that CPMC Section 17.64.040, A., 1., requires a two-car garage or carport for residential dwellings and that in addition to working without a building permit, he had created a zoning code violation. Mr. Helmes wishes to meet the covered parking requirement by providing an end-to- end carport rather than the traditional side-by-side carport structure (please see diagram). The reason for this arrangement is that the five-foot sideyard setback cannot be met with the traditional structure. As the code is silent on the design question and this situation will establish a precedent, I am seeking the Commission's. input. The relevant criteria in need of interpretation is CPMC Section 17.64.10, F., and to what extent, if any, this design would constitute a nuisance or hazard. I have advised Mr. Helmes to cease work on the garage pending review and decision by the Planning Commission on the submitted carport design. On page 3 is the framing and construction of the 9 ft. by 40 ft.eovered parking area. .Basically 4 x4 posts on 4 ft. centers. Front has a 6'9•' by 9' opening with a 4x6 header. The outside is 7'3"'tall with redwood lattice exterior. The inside is 8" high connected to the existing wall of the garage .by a 2x6 ledger bolted in place to the existing stud wall, with 5/16 by 5-inch lag bolts. As the inside wall is 40 ft. long, and the existing inside wall is only 24 ft. long, the additional 16 ft. on the backyard side is ~' held in place by 4x4 posts attached at the top by the ledger and inbetween at the double top- plates supported on both sides by 2x4 studs.(all on pressure treated 2x4) The roof had 2x4 rafters 24" O.C. held in place with joist hangers to the ledger. Covered by 1x4 strapping then with felt, followed by the wood shingles to match the existing roof. Metal flashing seperate~existing garage wall from proposed roof shi gles. (6" up the wall beneath the covering).
