MEETING CALLED TO ORDER
Chairman Ellard called the meeting to order at 7:05 p.m.
ROLL CALL
Present were Chairman Garth Ellard and Planning commissioners Dave Gilmour,
Karolyne Hugo, Jerry Mattey, Bob Matthews, Chuck Piland.
Also present were Public Works Director Larry Blanchard, Planning Director Randy
Kugler and Fire Chief/Building Official Mark Servatius.
APPROVAL OF MINUTES
Chairman Ellard noted a typo on page 1 of the December 6, 1988 minutes which
should read "...which are also conditional uses in a C-5 zone."
Commissioner Piland made a motion to approve the minutes of the 3 January 1989
Planning Commission meeting. Commissioner Gilmour seconded the motion. Ro11 call
vote: Gilmour, yes; Hugo, abstain; Mattey, yes; Matthews, yes; and Piland, yes.
All of the Commissioners were in favor of motion and the motion carried.
CORRESPONDENCE AND PUBLIC APPEARANCES
There were none at this meeting.
BUSINESS
Planning Commission Position #6 Vacancy
Planning Director Kugler updated the Commission regarding the vacancy on the Com-
mission created by the expiration of Nancy Blood's position. Chairman Ellard
commended Mrs. Blood for her fine job during her tenure.
Public Hearing -
Planning Director Kugler gave a background on the Greenbriar Conditional Use re-
quest and read into the record the following exhibits: Exhibit A, Notice of Pub-
lic Hearing; Exhibit B, Certificate of Posting of Notice of Public Hearing; Exhib-
it C, Assessor's Map; Exhibit D, Aerial Map; and Exhibit E, Public Works Director
Staff Report.
No conflicts of interest on the part of the Planning Commission were recorded.
Public Works Director Larry Blanchard explained .for the Commission the ISO ratings
and the need for as-builts for the Mobile Home Park.
The hearing was opened by Chairman Ellard. Carl Biskelborn of 301 Freeman Road,
space 36, came forward. Mr. Biskelborn indicated that he has copies of the water
line as-builts as well as other services. Mr. Biskelborn explained the reasons

for the requests and indicated that adequate RV storage areas remain to meet this
requirement.
Commissioner Piland made a motion to approve the request for expansion of
Greenbriar Terrace Mobile Community at 301 Freeman Road, applied for by Carl
Biskelborn and directing staff to prepare the appropriate resolution including
conditions of approval as outlined in the staff report from Planning Director
Kugler dated 30 December 1988 and the staff report from Public Works Director
Blanchard dated 3 January 1989. The motion was seconded by Commissioner Mattey.
Ro11 call vote: Gilmour, yes; Hugo, yes; Mattey, yes; Matthews, yes; and Piland,
yes. A11 of the Commissioners were in favor of the motion and the motion carried.
Discussion on Kinasland Manor Subdivision and the Village Planned Unit Develop-
ment
Planning Director Kugler gave a background on the Kingsland Manor Subdivision and
the Village Planned Unit Development. Mr. Kugler stated that staff is not pre-
pared at this date to make recommendations but will be coming back to the Planning
Commission at a later date when more information is available.
Public Works Director Blanchard gave an overview of both projects and what remains
to be completed.
The Commission will await further staff review before making any recommendations
to the City Council. The consensus was that the Commission would like to review
the projects before any development takes place.
MISCELLANEOUS
Land Use applicants failure to appear for scheduled hearings
Chairman Ellard discussed possible ordinance revisions that would require land use
applicants that fail to appear for the scheduled hearings to re-file an applica-
tion. The consensus of the Commission was that a re-filing fee of half the origi-
nal filing fee would be appropriate and should be included in revisions that Plan-
ning Director Kugler is presently working on.
Mr. Kugler advised the Commission that Rusty McGrath. has requested an extension pn
his Conditional Use hearing.
Commissioner Piland made a motion to continue Rusty McGrath's Conditional. Use
request hearing to February 7, 1989. The motion was seconded by Commissioner
Hugo. Roll call vote: Gilmour, yes; Hugo, yes; Mattey, yes; Matthews, yes; and
Piland, yes. A11 of the Commissioners were in favor of the motion and the motion
carried.
Proposal from Bi-Mor and the Corner Club
Director Kugler reviewed a proposal by Bi-Mor and the Corner Club involving a land
swap that will result in paved off street parking areas for both businesses. Two
Minor Partitions with variances would be necessary.

Commissioner Hugo made a motion to adjourn the meeting. Commissioner Mattey sec-
onded the motion. A11 of the Commissioners were in favor of the motion and the

repair and parts and accessories sales facility at 820

applicant
This request involves the location of an A.T_V. repair shop that will
also supply parts and accessories for retail sale. The business will
be located in the former PennySaver building on South Front which has
a large paved parking area to accommodate customer traffic.
The Planning Commission has previously approved ATV sales, service and
repair as a Conditional Use in a C-S zone. The Building Official
wishes to remind the Planning Commission and the applicant that the
facility must meet building code and fire and life safety requirements
if any repair activities are conducted utilizing welding or open flame
equipment.
Central Point Municipal Code Section 17.46.060 (B) requires that any
open storage of materials be screened by a sight-obscuring 6` fence.
Section 17.76.040 outlines the requirements for consideration by the
Planning Commission while reviewing the Conditional Use application.
Based on the Planning Commission decision, Staff can prepare the appro-
priate Resolution adopting findings for approval at the next regular
meeting.

RE: Public Hearing for a variance request from Robert Hays and Michael
Moran for the creation of a lot through a minor land partition of
less than the required minimum depth of 100 feet for a C-5 zone.
Said property is described as Jackson County Tax Assessor's map
page 37 2W 3DD, tax lot 9406.
Central Point Municipal Code Section 17.46.050 requires a minimum lot depth
in a C-5 zone of 100 feet. The proposed partition would create a new tax
lot approximately 56 feet deep which would serve as an off street parking lot
off of 1st Street for the Corner Club.
The applicants would retain the remaining westerly portion of tax lot 9406
for their proposed reconstruction of the Bi-Mor gas station. The applicants
anticipate consolidating ali of their tax lots (9400, 9600, 9407, 9406 and
9700) into a single tax lot once their .reconstruction project is completed.
Central Point Municipal Code Section 17.80.010 specifies the conditions
which must be met in order for the Planning Commission to grant a variance.
The applicant .has. provided findings which address the criteria in support of
the variance. These findings are contained in the proposed resolution sup-
porting the request.
The Fire Chief and the Public Works Director have reviewed the proposal and
have no concerns. Property owners within 200 feet of the property have also
received notice of the Public Hearing.

PLANNING COMMISSION RESOLUTION
A RESOLUTION ADOPTING FINDINGS AND CONCLUSIONS AND
APPROVING THE VARIANCE OF ROBERT HAYES AND MICHAEL MORAN
WHEREAS, an application for a variance for the creation of a lot
through a minor land partition of less than the required minimum depth of
100 feet for a C-5 zone within the City and more particularly described as
Jackson County Tax Assessor's map page 37 2W 3DD, tax lot 9406; and
WHEREAS, the Central Point Planning Commission has reviewedand
approved the application at a public hearing held on the seventh day of
February; now, therefore,
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. The relevant criteria applicable to the within appli-
cation is Central Point Municipal Code Chapter 16.44.060 which describes the
conditions the Planning Commission must consider in order to grant a vari-
ance.
Section 2. The Planning Commission hereby finds as follows. The
request meets the criteria for granting a variance because:
1. The variance will provide advantages because the existing
graveled parking immediately west of the Corner Club will
be incorporated into the entire blacktop lot of the station/
convenience store improvement.
2. The variance will provide beautification to the city by
eliminating the gravel parking lot.
3. Safety to the neighborhood will be improved by better
lighting.
4. Better protection will be created by increased lighting,
resurfacing.
5. The variance will. not have any adverse impacts on the
neighborhood.
6. The variance will utilize property with the intent and
purpose of the zone district.

Section 3. The Planning Commission finds that the record herein
and the findings therefrom support the conclusion that the proposal is in
compliance with the applicable standards of the City's Subdivision.

RE: Public Meeting - Review and recommendation to the City Council
regarding a minor land partition request submitted by Robert
Hays and Michael Moran for property known as tax lot 9406, on
Jackson County Assessor's map page 37 2W 3DD.
The applicants propose to partition the existing parcel into two lots of
approximately 3,360 s.f. and 2,986 s.f. Upon completion of the proposed
partition, ownership of the 2,986 s.f. parcel would be transferred to the
Corner Club for use as an off street parking area with access from 1st
street. The remaining parcel will be utilized as a part of Bi Mor's recon-
struction project.
As a condition of approval, staff recommends that a Deferred Improvement
Agreement be required for any future street related improvements along 1st
Street.

A RESOLUTION OF RECOMMENDATION OF APPROVAL TO GRANT A MINOR LAND
PARTITION
WHEREAS, on January 13, 1989, Robert Hayes and Michael Moran
filed an application for a minor partition of land described as Jackson
County map page 37 2W 3DD, tax lot 9406; and
WHEREAS, the agenda including the public meeting was posted at
the Central Point Public Library, Central Point Post Office, Central Point
Fire Station, and the Central Point City Ha11; and
WHEREAS, at their regular meeting on February 7, 1989 the P1ann-
ing Commission held a review of the proposal, provided opportunity for
testimony from proponents and. opponents, and received a planning staff
report; and
WHEREAS, subsequent to the review and public hearing, the Plann-
ing Cormnission made a motion to provide recommendation for approval to the
City Council; now, therefore;
BE IT RESOLVED that the City of Central Point Planning
Commission recommends to the City of Central Point City Council that the
minor partition of land be approved subject to the following condition:
That the applicant execute a deferred improvement agreement
consenting to inclusion in any future local improvement
districts for storm drainage, streetlights, curbs, gutters,
sidewalks, or street improvements, or any combination of the
same on First Street further agreeing not to remonstrate
against any such improvements, and providing that the same
shall be recorded in the Jackson County Deed Records and
shall be binding upon applicant's heirs, successors or assigns
and shall run with the land hereinabove described.

RE: Public Hearing for a variance request from Gerald and Kathleen
Perkins for the creation of a lot through a minor land partition
of less than the required minimum width of 50 feet for a C-5 zone.
Said property is described as Jackson County Tax Assessor's map
page 37 2W 3DD, tax lot 9701.
Central Point Municipal Code Section 17.46.050 requires a minimum lot width
in a C-5 zone of 50 feet. The proposed partition would create a new tax lot
of approximately 33 feet in width. Subject to approval of the variance and
minor partition request ownership of the westerly portion of the existing
tax Lot would be transferred to Bi-Mor for use as a paved on-site parking
area as a part of the Bi-Mor reconstruction project.
Central Point Municipal Code Section 17.80.010 specifies the conditions
which must be met in order for the Planning Commission to grant a variance.
The applicant has provided findings which address the criteria in support of
the variance. These findings are contained in the proposed resolution
supporting the request.
The Fire Chief and the Public Works Director have reviewed the proposal and
have no concerns. Property owners within 200 feet of the property have also
received notice of the Public Hearing.

A RESOLUTION ADOPTING FINDINGS AND CONCLUSIONS AND
APPROVING THE VARIANCE OF GERALD AND KATHLEEN PERKINS
WHEREAS, an application for a variance for the creation of a lot
through a minor land partition of less than the required minimum width of SO
feet for a C-5-zone within the City and more particularly described as Jack-
son County Tax Assessor's map page 37 2W 3DD, tax lot 9701; and
WHEREAS, the Central Point Planning Commission has reviewed and
approved the application at a public hearing held on the seventh day of
February; now, therefore,
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. The relevant criteria applicable to the within appli-
cation is Central Point Municipal Code Chapter 16.44.060 which describes the
conditions the Planning Commission must consider in order to grant a vari-
ance.
Section 2. The Planning .Commission hereby finds as follows. The
request meets the criteria for granting a variance because:
1. The variance will provide advantages because the existing
graveled parking immediately west of the Corner Club will
be incorporated into the entire blacktop lot of the station/
convenience store improvement.
2. The variance will provide beautification to the city by
eliminating the gravel parking lot.
3. Safety to the neighborhood will be improved by better
lighting.
4. Better protection will be created by increased lighting,
resurfacing.
5. The variance will not have any adverse impacts on the
neighborhood.
6. The variance will utilize property with the intent and
purpose of the zone district.

THE CONDITIONAL USE APPLICATION SUBMITTED BY CARL BISKEBORN
WHEREAS, an application for a conditional use permit for expansion
of Greenbriar Terrace Mobile Community in a R-3 zone has been submitted by
Carl Biskeborn, said mobile home park located at 301 Freeman Road within the
City; the location more particularly described as Jackson County Tax Asses-
sor's map page 37 2W 2D, tax lot 1700; and
WHEREAS, the Central Point Planning Commission has reviewed and
approved the application at a public hearing held on the third day of
January, 1989; now, therefore,
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. The relevant criteria applicable to the within
application is as followed:
(a) The Comprehensive Plan designates the site as medium density
residential.
(b) The Zoning Ordinance designates the site as R-3.
(c) Central Point Municipal Code Chapter 17.76 describes the
conditions which the Planning Commission must consider in order to grant a
conditional use permit.
(d) Central Point Municipal Code Chapter 5.32 describes the stan-
dards which the Planning Commission must consider in order to grant an expan-
sion to a mobile home park.
Section 2. The Planning Commission hereby finds as follows.
The proposal meets the City's housing goal to provide for a range of housing
types, styles and costs including single family homes, condominium, rental
housing and mobile homes.
Section 3. The Planning Commission hereby finds as follows.
The proposal meets the requirements of the City's Zoning Ordinance for a R-3
zone and the standards for a Mobile Home Park because:
(a) Mobile Home Parks are a conditional use.

(b) No evidence was submitted supporting a conclusion that .the
proposed expansion would generate conditions that would adversely impact
surrounding properties.
Section 4. The Planning Commission finds that the record herein
and the findings therefore support the conclusion that the proposal is in
compliance with the City's Comprehensive Plan and the applicable standards
of the City's Zoning and Mobile Home Code. The proposed conditional use is
hereby approved subject to:
(a) Compliance with the relevant requirements of the Uniform
Building Code and the Uniform Fire Code.
(b) Two covered parking spaces for each mobile home space. Park-
ing area can not be within a required setback area. Parking areas can not
be used for recreation vehicle storage.
(c) Walkways to storage buildings and from the patio to the road-
way shall be not less than 3 feet in width.
(d) Each mobile home space shall have one shade tree and two
hosebibbs for. maintenance and watering purposes.
(e) Underground utilities.
(f) Carports with attached storage sheds of not less than 36 s.f.
for each mobile home space.
(g) Provide the City with copies of existing water and sewer
facilities.
(h) Provide a metes and bounds legal description of the property.
(i) Have the property owner sign and return a Deferred Improve-
ment Agreement for future street related improvements along Freeman Road.
