IV. SPECIAL PRESENTATIONS
1. DIRT Intern Recognition
DIRT Executive Director Taneea Browning presented the DIRT Intern Recognition to
the Council, introducing two interns, Olivia and Nico. They have participated in over
200 hours working on the Creekside Project, partnering with Fire District 3, reducing
ladder fuel, removing invasive species, and supporting the native habitat at our
Creekside Project.
V. PUBLIC COMMENTS
Jim Carden - with the Meadows Community, wanted to thank the City Council, City
Attorney, and Police Chief for all the work on the Gambling Ordinance.

VIII. PUBLIC HEARING
A. Ordinance Vacating a Portion of Boulder Ridge Street - South of Twin Creeks
Crossing
Parks and Public Works Director Matt Samitore presented to Council the Ordinance
vacating a portion of Boulder Ridge Street - South of Twin Creeks Crossing. Boulder
Ridge Street, south of Twin Creeks Crossing right-of-way was dedicated to the City
with platting of Twin Creeks Crossing, Phase 1, in 2006. City staff has determined
that this southerly extension of Boulder Ridge Street is not necessary or planned for
further right-of-way connection given the layout of existing development. As such,
staff recommended that Council Initiate a hearing to vacate the public right-of-way.
Mayor Williams opened the Public Hearing; no one came forward and the public
hearing was closed.
Taneea Browning moved to forward to a second reading the Ordinance
approving vacation of a portion of Boulder Ridge Street public right-of-way
- south of Twin Creeks Crossing and accepting reservation of easement of
to City.

A. Ordinance Amending Title 9 - Gambling and Social Gaming
City Attorney Sydnee Dreyer presented to council the second reading of an
Ordinance Amending Title 9 - Gambling and Social Gaming. There were no changes
made since the first reading.
Mike Parsons moved to approve Ordinance 2104 an Ordinance amending in
part Central Point Municipal Code Chapter 9.32 - Gambling and adding
Chapter 9.33 establishing Social Gaming.

B. Resolution Calling for Repeal of Measure 110
City Manager Chris Clayton presented a Resolution calling for the Repeal of
Measure 110 to the Council. Jackson County recently adopted a proclamation
expressing concerns with the impacts of Ballot Measure 110 and urging the
legislature to take whatever steps are necessary to repeal the provisions of Ballot
Measure 110 immediately. Clackamas County has sent two referendums to its
voters to determine whether there is support for Ballot Measure 110. If supported by
multiple jurisdictions, these steps may encourage the legislature to consider
repealing the law.
The Council had concerns over the repeal not fixing the issue but is hopeful that this
will help to reach a middle ground as to how to achieve the result that will resolve the
issue.
Jackson County Commissioner Dave Dotterer spoke to the Council regarding the
county commissioner’s goal of repealing Measure 110 and the hope that repealing it
will put the steps in place on how to proceed to fix the problem. Mr. Dotterer
believes that the City of Rogue River and the City of Phoenix are in the process of
doing something similar.
Rob Hernandez moved to approve Resolution No 1759, a Resolution
proclaiming the City of Central Point’s call for the repeal of the provisions
enacted pursuant to Oregon Ballot Measure 110 (2020).

X. BUSINESS
A. Discussion - Consideration of Future Annexations
City Attorney Sydnee Dreyer presented to Council properties that could be
considered for future annexations. Several properties are outside the City limits
despite potentially receiving city services.
Council and staff discussed the pros and cons of proceeding with the force annexing
the island properties into the City. Council wanted to ensure consistency in the
process moving forward, and agreed to consider pursuing annexing the island
properties. Staff will provide more detailed information on these properties at the
next council meeting.

XII. CITY MANAGER'S REPORT
City Manager Chris Clayton reported that:
House bill 2805 was codified and goes into effect after the first of the year; cities with a
budget of greater than $1,000,000 must ensure public officials are trained in open
meetings law at least once during their term.
Human Resources rolled out the Paid Leave Oregon changes to staff this week.
There was meeting at ECSO regarding their fees, current funding of the program is
not covering their costs. Steve Weber attended this meeting along with other staff
from other jurisdictions.
Tom Humphrey will be the Interim City Manager for City of Talent.
Mayors United Dinner is coming up; please let Rachel know if you would like to
attend.
Both Amazon and State Police projects are moving along.
SOREDI released a press release regarding Josephine County's decision not to
renew their membership.
Sydnee and Rachel are working on getting information for the City Newsletter and
Website regarding the Camping Ordinance.
XIII. COUNCIL REPORTS
Council Member Neil Olsen had nothing to report.

He attended the Fair Board meeting - Friends of the Fair will be donating $25,000 to
fix the lights
Council Member Mike Parsons reported that:
He attended a Resident Council meeting at Pear Valley Senior Living to reintroduce
the Central Point Police Volunteers Guardian Angels program.
He attended the Rogue Valley Sewer Services Board of Directors and Luncheon.
He attended the study session.
Council Member Melody Thueson reported that:
She attended the school board meeting.
She attended the study session.
A Crater High School Biz student will be attending the next Council Meeting.
XIV. DEPARTMENT REPORTS
Police Chief Scott Logue reported that:
They are working on the hiring processes for the current four police officer
vacancies; one new lateral will be starting on September 11, 2023.
Reminder that on September 9, 2023 the Made in Southern event is going on as well
as the Police Department Open House.
Parks and Public Works Director Matt Samitore reported that the Myrl Jacobsen
project is complete, and came in $25,000 under budget
Planning Directory Stephanie Holtey reported that:
Planning Commission meeting on September 5th, on the agenda is a site plan
architectural review for Grocery Outlet, and a Partition and Site Plan review for a
Medical Office
They received a pre-application for a new school that is coming into Central Point,
Chesterton Academy.

TERMS
o "Real property'' means the real estate (land) and generally whatever is erected or affixed to the land
(for example, the buildine) at the business address.
o "Common area" is a privately owned area where two or more parties (property tenants) have
permission to use the area in common. Examples include the walking areas between stores at a
shopping center, lobbies, hallways, patios, parking lots, etc. An area's designation as a ,,common area,,
is typically identified in the lease or rental agreement.

BACKGROUND INFORMATION:
Boulder Ridge Street, south of Twin Creeks Crossing right-of-way, was dedicated to the City
with the platting of Twin Creeks Crossing, Phase 1, in 2006. City staff has determined that this
southerly extension of Boulder Ridge Street is not necessary or planned for further right-of-way
connection given the layout of existing development. As such, staff recommended that Council
initiate a hearing to vacate the public right-of-way.
The Council approved a Resolution of Intent to vacate the public right-of-way at its July 13, 2023
meeting. Based on that Resolution, the proposed vacation was scheduled for public hearing on
August 24, 2023. Per ORS Chapter 271, notice of the hearing was published in the Rogue
Valley Times once per week for two weeks prior to the hearing on August 10, 2023 and August
17, 2023. Additionally, the City posted required notices at or near each end of the proposed
vacation on August 10, 2023.
Vacation of the right of way is appropriate given that there is no need, or ability, to extend the
right-of-way given current development, and the public interest would be better served by
adding this area to the local taxable land base. Moreover, the abutting property owners have
provided written consent to the proposed vacation.
If this Ordinance is approved, the vacated right-of-way will be deeded back to the two adjacent
property owners via Quit Claim Deed.
At its August 24, 2023, meeting the Council considered the Ordinance and made a motion to
forward the Ordinance to second reading.

The council may adopt the Ordinance vacating the Boulder Ridge Street right-of-way upon a
finding that: 1) proper notice was issued; 2) a public hearing was held to consider objections; 3)
no written objections were received from a majority of the area affected, computed on the basis
provided in ORS 271.080, 4) the proposed vacation does not impact market value of abutting
property owners; and 5) it is in the public interest to vacate this property.
COUNCIL GOALS/STRATEGIC PLAN ANALYSIS:

GOAL 4 - Attract unique and quality businesses to the City of Central Point. GOAL 5 - Support
business development and entrepreneurship.
STRATEGY 4 – Promote market-driven workforce and affordable housing necessary to meet
the needs of current and future residents through user-friendly, reasonable regulations, efficient
land development review process, and incentive programs that provide partial or full tax
abatements, SDC payment deferral and/or credits or waivers, public/private partnerships, etc.
(refer to Community Investment Goal 6).

AN ORDINANCE APPROVING VACATION OF A PORTION OF BOULDER RIDGE STREET
PUBLIC RIGHT-OF-WAY - SOUTH OF TWIN CREEKS CROSSING AND ACCEPTING
RESERVATION OF EASEMENT TO CITY
RECITALS:
A. WHEREAS, Boulder Ridge Street, south of Twin Creeks Crossing was dedicated to the
City of Central Point for roadway purposes in conjunction with the platting of Twin
Creeks Crossing, Phase 1, recorded on January 4, 2006, in Volume 33 at Page 01, of
the Plat Records of Jackson County, Oregon.
B. WHEREAS, Oregon Revised Statutes (ORS) Chapter 271 provides for the vacation of
public rights-of-way.
C. WHEREAS, the City has determined that the southerly extension of Boulder Ridge
Street is not necessary or planned for further connection given existing development
and street layout.
D. WHEREAS, on July 13, 2023 the City Council adopted a Resolution of Intent to initiate
vacation of the subject property, more fully described at Exhibit “A”, incorporated
herein by reference.
E. WHEREAS, a duly noticed public hearing was held before the City Council on August
24, 2023.
F. WHEREAS, after due consideration, the City has made certain findings in connection
with the request for vacation of City property and subsequent statutory procedures
for the vacation process, which findings are attached hereto and incorporated herein
as Exhibit “C”;
G. WHEREAS, based on the attached findings, the City of Central Point determines that
it is in the best interest of the public to grant the vacation request.
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
SECTION 1. Vacated Property. The Boulder Ridge Street right–of-way located south of Twin
Creeks Crossing, consisting of approximately 8,354 square feet, more or less, as described in
Exhibit “A” and depicted at Exhibit “B”, attached hereto, is hereby vacated, and title to the
vacated property shall be returned and belong to the owners of the adjacent property
pursuant to Oregon law.
SECTION 2. Findings. The Council adopts the Findings attached to this Ordinance set forth

SECTION 3. Reservation of Easement. A public utility easement is hereby reserved for the
benefit of, and conveyed to, the City of Central Point, its successors and assigns, under,
through, over and across the entire area of the vacated property in which to construct,
operate, maintain, repair, replace, improve, and enlarge utility systems for purposes of
transmission, distribution, and sale of such utilities. This grant of easement extends to
providers of public utilities for such purposes. The City and such utilities shall also have
reasonable rights of ingress and egress to and from such easement across the vacated
property. Public utilities that may use this easement include, but are not limited to, storm
drainage, sanitary sewer, water, gas, electric, telephone and cable television.
SECTION 4. Deed. The vacated property shall be conveyed to the abutting property owners
by Quit Claim Deed, in substantially the form provided at Exhibit “D”. Conveyance shall be
subject to the conditions set forth in this ordinance and applicable law.
SECTION 5. Conditions of Vacation. The vacation is conditioned upon the adjacent property
owner (owner whose property abuts the vacated property) executing any and all necessary
documents to effectuate this vacation.
SECTION 6. Filing. Certified true copies of this ordinance shall be recorded in the office of the
County Clerk of Jackson County, Oregon, and with the County Assessor and County Surveyor
of Jackson County, Oregon.
SECTION 7. Effective Date. For purposes of transfer of ownership of the property covered by
the vacation, this Ordinance shall be effective upon completion of the conditions provided
herein.

FINDINGS TO AN ORDINANCE VACATING A PORTION OF BOULDER RIDGE STREET
PUBLIC RIGHT-OF-WAY - SOUTH OF TWIN CREEKS CROSSING, CENTRAL POINT,
OREGON AND ACCEPTING RESERVATION OF EASEMENT TO CITY
In connection with the ordinance vacating a portion of Boulder Ridge Street public
right-of-way located south of Twin Creeks Crossing, the Council finds:
1. That the southerly extension of Boulder Ridge Street is not necessary or planned
for further connection given existing development and street layout, that the proposed
vacation area is not a significant asset to the City, and that the proposed vacation area
provides more value to the public by being added to the local taxable land base than
remaining in its current state.
2. The Council reviewed the staff report; conducted a public hearing on the proposed
vacation on August 24, 2023; and found the vacation of the southerly extension of Boulder
Ridge Street to be in the public interest.
3. The City provided notice of the proposed vacation pursuant to ORS 271.110, by
publication in the Rogue Valley Times, a newspaper of general circulation published in
Jackson County, Oregon. Notice was published once per week for two consecutive weeks
with the first publication on August 10, 2023 and the second publication on August 17, 2023.
4. Said notice provided, among other things, that a hearing before the City Council
concerning the proposed vacation would be held on August 24, 2023 in the City Council
Chambers in Central Point, Oregon, which was the time and place when objections to such
proposed vacation would be considered and heard.
5. The City Council convened at the time and place specified in the public notices and
no objections were made to said vacation.
6. On August 10, 2023, the City posted at or near each end of the portions of land
proposed to be vacated, a copy of the notice provided for in ORS 271.110.
7. The Council determined that the proposed vacation would not substantially affect
the market value of the property owners abutting the open space to be vacated.
8. Vacation of the subject property will be in the public interest. It will add property
to the tax rolls, and will potentially decrease City costs and liabilities associated with the
maintenance of unnecessary public right-of-way.
9. The vacated property will be deeded to the abutting property owners subject to the
reservation of a public utility easement for the City of Central Point for construction,

BACKGROUND INFORMATION:
The lease purchase of two (2) new police vehicles is included in the City’s 2023-25 biennial
budget. The City has received a 5-year lease proposal from Government Capital Corporation
for the purchase of the patrol vehicles. The proposed structure of the lease has been included
as Exhibit A and falls within the amount budgeted. Government Capital Corporation is
requesting the adoption of a resolution approving the structure of the lease and authorizing the
City Manager or the City Manager’s designee to execute the contract. The attached resolution
meets their request.
FINANCIAL ANALYSIS:
The initial lease payments has been included in the City’s 2023-25 biennial budget and each
subsequent annual lease payment will be included in future City budgets.

A RESOLUTION REGARDING A LEASE PURCHASE AGREEMENT FOR THE
PURPOSE OF FINANCING POLICE VEHICLES
Recitals:
City of Central Point desires to enter into that certain Lease-Purchase Agreement by and
between Government Capital Corporation and the City of Central, for the purpose of
financing Police Vehicles. The City of Central Point desires to designate this Agreement as a
“qualified tax exempt obligation” of the City of Central Point for the purposes of Section 265
(b) (3) of the Internal Revenue Code of 1986, as amended. The City of Central Point desires
to designate Chris Clayton, City Manager, as an authorized signer of the Agreement.
Therefore, the City of Central Point resolves as follows:
Section 1.
That the City of Central Point enters into a Lease Purchase Agreement with Government
Capital Corporation for the purpose of financing Police Vehicles in an amount not to exceed
$170,500.00 (equipment cost + 10% contingency).
Section 2.
That the Lease Purchase Agreement by and between the City of Central Point and
Government Capital Corporation is designated by the City as a “qualified tax exempt
obligation” for the purposes of Section 265 (b) (3) of the Internal Revenue Code of 1986, as
amended.
Section 3.
That the City of Central Point will designate City Manager or the City Manager designee, as
an authorized signer of the Lease Purchase Agreement by and between the City of Central
Point and Government Capital Corporation as well as any other ancillary exhibit, certificate,
or documentation needed for the Agreement.
Section 4.
That should the need arise, if applicable, the City will use loan proceeds for reimbursement
of expenditures related to the Property, within the meaning of Treasury Regulation § 1.150-
2, as promulgated under the Internal Revenue Code of 1986, as amended.

RECOMMENDATION:
The Central Point Planning Commission met at their regular meeting on September 5, 2023.
The following three (3) items were on the agenda:
Site Plan and Architectural Review for a supermarket and two fast food restaurants with
drive-through facilities at 4243, 4251 and 4259 Table Rock Road;
Tentative Plan to partition a 3.19 acre lot into two (2) parcels, including dedication of
right-of-way and partial construction of a public road with connections on Biddle Road,
Table Rock Road, Orchardview Drive and Ridgeway Avenue. The project site is located
at 4404 Biddle Road within the Commercial Thoroughfare (C-5) zoning district; and,
Site Plan and Architectural Review application to develop proposed Parcel 1 at 4404
Biddle Road with a 3,200 square foot urgent care facility together with parking and
landscaping improvements.
SITE PLAN AND ARCHITECTURAL REVIEW (4243, 4251 AND 4259 TABLE ROCK RD):
The Planning Commission conducted a continued public hearing and considered a Site Plan &
Architectural Review application for a commercial shopping center on three (3) lots consisting of
a 17,305 square foot supermarket, and a 2,300 s.f. and 2,400 s.f. fast food restaurant with drive-
through. The proposed development includes a newly proposed right-in access from Table Rock
Road with remaining access being from an internal network of existing private retail streets. The
plans included revisions adding more pedestrian connections between the uses and adjoining
public right-of-way, revised configuration of the access lane from Table Rock Road and
revisions to the architecture addressing issues identified by staff. Comments were added into
the record from the City’s contract engineer recommending that the circulation plan near the
reconfigured access lane be revised to dead-end the southeast parking area to avoid confusion
and low speed collisions. After hearing from the Applicant on this issue, another option was
identified to stripe and sign the parking lot egress lane and stop bars to better direct traffic and
avoid further revisions. No other testimony was received during the public hearing. The Planning
Commission unanimously approved the application with a revised condition to sign and stripe
the southeast parking lot egress lane as one-way and provide other directional signage.

TENTATIVE PARTITION PLAN (4404 BIDDLE RD):
The Planning Commission conducted a public hearing and considered a tentative partition plan
to divide a commercial property into two parcels. The tentative plan identified existing and
proposed right-of-way to be dedicated along the west and north property boundary with
connections to Biddle Road, Table Rock Road, Orchardview Drive and Ridgeway Avenue.
Several items of correspondence were provided to the Planning Commission, including a
petition and letters all in opposition to the proposed street connection and commercial land
development proposal on Proposed Parcel 1. Concerns raised included increased traffic from
vehicles and transients, loss of the small town feel, and negative impacts to the safety and
quality of life experienced in the existing residential neighborhood. There was confusion about
the road construction because the tentative plan illustrates the dedication area but not the plan
for construction. It was noted that road construction occurs prior to final plat typically but
applicants have the option of entering into a development agreement and bonding for the road.
After the public hearing was closed, the Planning Commission unanimously approved the land
division based on its conformance with the land division and zoning standards that apply to lot
dimensions.
SITE PLAN AND ARCHITECTURAL REVIEW: URGENT CARE (4404 BIDDLE RD):
The Planning Commission conducted a public hearing and considered a Site Plan and
Architectural Review application to develop Proposed Parcel 1 with a 3,200 square foot medical
office building for urgent care use, twenty-five (25) off-street parking spaces and landscape
improvements. The proposed site and landscape plans also illustrate the future roadway layout.
Several items of correspondence were provided to the Planning Commission including a petition
and several letters all in opposition to the proposal. Oral testimony was in opposition to the
project proposal and included concerns about the street connectivity and associated increase of
vehicle and transient traffic There were concerns about commercial development immediately
adjacent to the residential neighborhood. Testimony was offered by Fire District #3
recommending the development because the street connection will provide another emergency
egress for Central Point East and Beebe Woods. Evidence from the Fire Code and
Transportation System Plan was presented indicating that the existing routes out of Central
Point East and Beebe Woods are undersized to serve the neighborhood in the event of an
emergency. The Deputy Fire Marshal noted that it took some residents over an hour to
evacuate during the September 2020 fire. Residents asked for the new road to be blocked from
the residential streets. At the conclusion of the meeting, the Planning Commission continued the
hearing as necessary for staff and emergency response agencies to take another look at
options to address citizen concerns and fire, life, safety needs.
The meeting adjourned at 9:05 p.m.

BACKGROUND INFORMATION:
The Franchise Agreement between the City of Central Point and Rogue Disposal allows for an
annual consumer price index (CPI) rate adjustment. The City must review any adjustment
proposal to ensure mathematical accuracy and compliance with all franchise agreement
provisions. Having reviewed Rogue Disposal and Recycling's proposed (August 31, 2023) 3.8%
rate increase proposal and the current franchise agreement requirements, I have found the
proposed increase to be both accurate and compliant with the current franchise agreement
language.
The specific calculation required by the franchise agreement includes measuring the CPI from
July 2022 to July 2023, which increased from 296.276 to 305.691, or 3.178%. The calculated
CPI is multiplied towards non-disposal costs by 70% and then added to the increase in disposal
costs (which were 5.2%) and multiplied by 30% as follows:
(3.178% x .7) + (5.2% x .3) = 3.8% beginning 1-1-24.
A copy of the new Rate Schedule is attached hereto, along with correspondence from Rogue
Disposal outlining these changes.
FINANCIAL ANALYSIS:
The proposed 3.8% CPI rate adjustment has the following impact on Central Point residential
customers beginning January 1, 2024:
35-gallon cart @ curb $25.42/month
65-gallon cart @ curb $42.63/month
95-gallon cart @ curb $59.84/month
Commercial and specialty rate information is included in the attached rate schedule.

LEGAL ANALYSIS:
7.5 Annual Adjustment of Approved Service Rate Schedule
(Current Franchise Agreement Language).
On each Anniversary Date (other than an Anniversary Date that is immediately preceded by a
Fifth Anniversary Rate Review), commencing with the Anniversary Date that falls on January
1, 1998, there shall be an annual adjustment of the Approved Service Rate Schedule pursuant
to and in accordance with this Section 7.5. If the City and the Contractor agree, the annual
adjustment pursuant to this Section 7.5 may be waived for any year.
Unless such annual adjustment for a given year is waived by the Contractor and the City, the
Contractor shall be required to deliver to the City, not less than 120 days prior to such
Anniversary Date, a detailed calculation of the adjustment to each Rate Category Rate in the
Approved Service Rate Schedule then in effect calculated in accordance with the Annual Rate
Adjustment Formula set forth in this Section 7.5, together with all supporting information. The
City Administrator shall review such information and not less than 90 days prior to the related
Anniversary Date, the City shall inform the Contractor as to whether or not it agrees with the
Contractor's calculation of such adjustment. The City shall specify to the Contractor in writing
the particulars of any disagreement with the Contractor's calculation of such adjustment, and
the City and Contractor shall meet in order to resolve any such differences. Effective as of
each Anniversary Date for which an annual adjustment is made pursuant to this Section 7.5,
each Rate Category Rate in the Approved Service Rate Schedule shall be adjusted in
accordance with the Annual Rate Adjustment Formula set forth in this Section 7.5.

Paragraph 7.5 of the Solid Waste Collection Franchise Agreement (Franchise) between
the City of Central Point (City) and Rogue Disposal & Recycling, lnc., (Rogue), provides for
an annual adjustment of the approved service rate schedule based on thechange in the
Consumer Price lndex (CPl) during the previous year. Please accept this letter as Rogue's
implementation of the 7.5 provisions. Set forth below is Rogue's detailed calculation of
the adjustment to each "Rate Category Rate" (RCR) in the improved service rate schedule,
then in effect, calculated in accordance with the Annual Rate Adjustment Formula set
forth under Section 7.5.
The CPI change between July 2022 (296.276) and July 2023 (305.691) equals a percentage
change of 3.L78o/o. The annual disposal increase was5.2%. Please see enclosed table
taken from the Bureau of Labor Statistics Data setting forth the Consumer Price lndex-All
Urban Consumers for years 7022 and 2023.

BACKGROUND INFORMATION:
Summary
This report reviews and analyzes the process, requirements, and potential benefits of annexing
territories into the City. It focuses on the types of annexation processes, including Island
Annexation, Contract Annexation, and Annexation without Consent, along with the timing,
requirements, and after-effects of such annexations.
Benefits of Annexation:
1. Economic Development: Annexation can promote economic growth, bring in commercial
entities and expand the tax base.
2. Controlled Development: City jurisdiction allows for better planned and sustainable
development according to the City's long-term goals.
3. Increased Services: Newly annexed areas may benefit from City services such as
improved emergency services, road maintenance, and other utilities.

Types and Processes of Annexation (summarized from attached legal memorandum):

Requirements: The property must be surrounded by the City's corporate boundaries.

is not required.
2. Contract Annexation:
Requirements: Property must be contiguous to City limits or separated by public right-of-
way, stream, etc.
Process: Deemed as written consent to annexation.

3. Unanimous Landowner Consent:
Requirements: 100% of property owners and at least 50% of electors in the territory
must consent.
Process: No public hearing or election is required. The City sets final boundaries and
proclaims annexation.
4. Annexation Without Consents:

Process: A public hearing and territory election is required. Territory can be annexed by
ordinance after the hearing.
Timing for Annexation:
For residential properties, effective dates for annexation must be between 3 and 10
years from the approval date (island annexation only).
Notices must be recorded and sent to County authorities within specified time limits.
Post-Annexation Obligations:
The City Recorder must notify all utilities, cooperatives, and carriers by certified mail
within ten working days.
Any boundary changes must be reported to the county clerk and assessor.
City must notify the Oregon Department of Revenue.
Non-Conformity:
Properties under County jurisdiction can maintain their existing activities even if they
don't meet City regulations, subject to certain limitations.
Conclusion:
Annexation can offer various benefits to both the City and the annexed territories. It is crucial to

The City may only annex properties that are contiguous to City limits and only if it is
“reasonable” to do so. To be contiguous means there must be some connection to the City, either
by a narrow strip of land or by annexing right-of-way that extends to the property proposed for
annexation.
Absent an exception, an annexation must be approved by a majority of City electors and a
majority of the territory proposed for annexation. The two elections may be held concurrently,
or within 12-months of each other. Best practice often would be to hold the territory election
first, to see if it passes, and only then have the more costly City election. However, in many
instances the City may dispense with one or both of the election proceedings as further explained
below.
Island Annexation (Shown in Blue on Map)
The City may annex property with or without the consent of a property owner where that
property is surrounded by the corporate boundaries of the City. A property is an “Island” if it is:
“surrounded by the corporate boundaries of the city, or by the corporate boundaries of the city
and the corporate boundaries of another city, the ocean shore, a river, a creek, a bay, a lake or
Interstate Highway 5….” However, if the subject property is bordered in part by public right of
way (other than I-5) such right-of-way may not constitute more than 25% of the property’s
boundaries. If greater than 25% of the boundary is right of way (other than I-5) then the City
cannot use the Island Annexation process. If the City seeks to annex an island, it must annex the
entire “island” territory. Annexing a portion of the island is not permitted.

a) Process to Annex.
The City may annex the territory pursuant to ORS 222.750 after holding at least one public
hearing on the subject for which notice has been mailed to each record owner of real property in
the territory proposed to be annexed. Consent of the owner or resident of the subject property is
not required.
The annexation may be by Ordinance or Resolution and is subject to referendum meaning that
registered voters in City limits may seek to reject the Ordinance or Resolution by election, using
the referendum process.
b) Timing for Annexation.
For property zoned for, and in use as, residential at the time the annexation is initiated, the City
must specify an effective date for the annexation that is not less than 3 nor more than 10 years
from the date of the approval of the annexation.
Within 60-days following approval of the annexation, the City recorder must record with the
County a notice stating that the annexation is delayed and specify the effective date of such
annexation. Additionally 90-120 days before the annexation takes effect, the City recorder must
notify the County clerk of the annexation.
If the property is sold during the period of delayed annexation, the property becomes part of the
City immediately upon transfer of ownership. It is advisable to include such language in the
notice recorded with the County.
Contract Annexation (Property shown in Orange on map).
A requirement for any annexation is that the property be contiguous to City limits, or separated
from the City only by public right-of-way or a stream or other body of water. Properties that
have signed annexation agreements, but are not yet contiguous to City limits, are not candidates
for annexation at this time.
In determining what procedures apply, a contract annexation is also deemed a written consent to
annexation. As such, the discussions below regarding consent to annexation are applicable to
contract annexations as well.

Unanimous Landowner Consent.
If 100% of the property proposed for annexation has consented, (and at least 50% of the electors
in the territory) then the City can annex the territory without a public hearing or an election and
may by resolution or ordinance set the final boundaries of the area to be annexed by a legal
description and proclaim the annexation.
Annexation without Consents (All other eligible properties shown in green).
The City may initiate the annexation process by motion of the Council regardless of whether the
City has received consents to annex or a petition to annex. In that event, the City is not required
to hold a City election if the City holds a public hearing, which is noticed once each week for
two successive weeks prior to the day of the hearing in a newspaper of general circulation in the
city, and shall cause notices of the hearing to be posted in four public places in the city for a like
period.
After the public hearing, the City may adopt an ordinance annexing the territory. The Ordinance
would provide that either: a) the territory is annexed to the city where electors or landowners in
the contiguous territory consented in writing to such annexation, as provided in ORS 222.125 or
222.170, prior to the public hearing; or that b) the territory is annexed upon the condition that a
majority of the votes cast in an election of the territory is in favor (the latter applies if there are
insufficient consents to avoid the territory election).
The City may include a special rate of taxation for the new territory that is a ratio of the highest
rate of taxation applicable to property in the city for a term of up to 20-years (note if the
annexation is initiated by petition of the property owners the term of the special taxation rate is
limited to 10-years). The special rate may increase from fiscal year to fiscal year pursuant to a
proposed schedule. If the annexation is approved, the city cannot tax the annexed territory at any
other rate than the special rate for the term that is in effect. Notwithstanding the foregoing,
during the term of fiscal years provided for, the ratio shall be 100 percent for property that is sold
or transferred to new ownership, beginning with the first property tax year that begins after the
sale or transfer.
In determining whether there are sufficient consents to avoid a territory election, the following
apply:

A statement of consent (unlike a contract annexation) is only valid for 1-year unless a longer
period of time is expressly stated.
Effect of Annexation on Uses.
Annexation may result in some non-conformity. Typically, if what was occurring on the property
while it was under County jurisdiction was legal, it can continue once the property is annexed,
even if it does not fully meet City regulations. Any non-conforming activity is subject to the
provisions in CPMC, meaning discontinuing or abandoning a use can result in having to comply
with City regulations.
Post Annexation Obligations.
If annexation is approved by the Council, the City Recorder must, within 10-working days after
passage of the resolution or ordinance, provide by certified mail to all public utilities, electric
cooperatives and telecommunications carriers operating within the city each site address to be
annexed as recorded on county assessment and tax rolls, a legal description and map of the
proposed boundary change and a copy of the city council’s resolution or ordinance approving the
proposed annexation. ORS 222.005.
In addition the Recorder must report to the county clerk and county assessor of the county within
which the city is located all changes in the boundaries or limits of the city. The report shall
contain a detailed legal description of the new boundaries established by the city. The report
shall be filed by the city within 10 days from the effective date of the change of any boundary
lines. ORS 222.010.
For purposes of ad valorem taxation, a boundary change must be filed in final approved form
with the county assessor and the Department of Revenue as provided in ORS 308.225.
