PROPOSED ORDER
Pursuant to ORS 824.202, the Oregon Department of Transportation, Commerce and
Compliance Division (Department) has authority over the construction, alteration, and protection
of railroad-highway crossings in the State of Oregon. On December 7,2021, the Oregon
Department of Transportation, Region 3 made application under ORS 824.204 and ORS 824.206
seeking authority to construct the subject railroad-highway grade crossing (hereafter "crossing").
The affected railroad is the CentralOregon & Pacific Railroad (CORP). The affected public
authority in interest is the Oregon Department of Transporlation, Region 3 (ODOT). The public
authorities of interest are the City of Central Point (City) and Jackson County (County).
A diagnostic meeting where all parties were represented was conducted on September 1,
2020. The proposed changes discussed during that diagnostic are represented in the ordered
provisions and the Appendix to this Order.
The Appendix to this Order depicts the scope of the proposed crossing project. The
average daily traffic (ADT) volume at the crossing is estimated at o2,600 vehicles. The
statutory/posted speed of vehicles is 45 miles per hour (mph). The roadway intersects the track at
an angle of x120 degrees. There is a daily average of four freight trains over the crossing. The
maximum authorized speed on this track is 25 mph.
New vehicle traffic signals (WS) will be installed at the intersection of Scenic Ave and
Rogue Valley HWY as depicted in the Appendix to this Order. The WS will be interconnected with
new automatic signals at the crossing, consisting of one Cantilevered Flashing-Light Signal, one
Flashing-Light Signal, and two Automatic Gates. The interconnection will provide train
preemption of traffic signal phases, with a pedestrian clear-out interval (PCOI) and a vehicle
clear-out interval (VCOI), to permit vehicular traffic to clear the tracks before a train enters the
crossing. The VCOI will use a GREEN signal aspect. The interconnected crossing and WS
systems shall operate such that when an approaching train is detected, the normal operation of
the pedestrian signals will be preempted, and a PCOI of rv28 seconds will be provided
From the foregoing, the Department finds that the requested crossing alterations are
required by the public safety, necessity, convenience, and general welfare in accordance with ORS
824.206(1)(2). The Department proposes that the application be granted upon the following terms:
1. Alterations shall be substantially in progress within two years from the entered date of the
Final Order. No authority to establish a Quiet Zone is granted by the Final Order.

2. Applicant(ODOT)shall
a. Alter and maintain that portion of the crossing lying outside lines drawn
perpendicular to the end of ties to accommodate the roadway configuration and
sidewalks depicted in the Appendix to this Order, and bear all the costs. The
roadway approaches shall comply with OAR 741-120-0020(1X2X3X4) and the
sidewalks shall comply with OAR 741-120-0025(1X2X3).
b. Furnish, install, and maintain WS at the intersection of Scenic Avenue and Rogue
Valley HWY to accommodate the train preemption operations described above in
the body of this Order and as depicted in the Appendix to this Order, and bear all
the costs. The WS shall include one part-time-restriction (PTR) 'NO RIGHT TURN
ACROSS TRACKS' sign. The PTR sign shall only be visible during train preemption
and shall operate as depicted in the Appendix to this Order.
c. Furnish, install, and maintain an interconnection between the WS and ordered
crossing signals, and bear all the costs. The interconnection shall consist of an
interface box equipped with contact terminals attached to the crossing signal
house. The interconnection shall provide train preemption of the normal operation
of the traffic signals, as described above in the body of this Order.
d. Relocate two guardrails adjacent to the ordered automatic signals at the crossing,
as depicted in the Appendix to this Order, and bear all the costs.
e. Bear allthe cost of the work listed in paragraphs 4.a.,4.b., and 4.c. below
3. Jackson County shall:
a. Maintain the guardrails mentioned in 2.d above
Railroad (CORP) shall:
a. Subject to reimbursement by applicant, construct that portion of the crossing lying
between lines drawn perpendicular to the end of ties to accommodate the roadway
configuration and sidewalks depicted in the Appendix to this Order. The roadway
shall comply with OAR 741-120-0020(1X2X3X4) and the sidewalks shall comply
with oAR 7 41-120-0025(1 X2X3).
b. Subject to reimbursement by applicant, furnish and install one Flashing-Light Signal
and one Automatic Gate at the crossing according to OAR 741-110-0030 (3)(a) and
OAR 741-110-0030(3Xd), respectively. Locate the devices as depicted in the
Appendix to this Order. Activate the devices in accordance with
oAR 741-110-0070.
c. Subject to reimbursement by Applicant, furnish and install one Cantilevered
Flashing-Light Signal and one Automatic Gate at the crossing according to OAR
741-110-0030(3Xa) and OAR 741-110-0030(3Xd), respectively. Locate the devices
as depicted in the Appendix to this Order.
d. Maintain the ordered items in paragraphs 4.a.,4.b., and 4.c. and bear allthe costs

e. Notify the Department in writing not less than five working days prior to the date that
the ordered automatic signals will be activated and placed in service.
4 Each party shall notify the Depaftment in writing upon completion of its portion of the
project.
All previous Orders of the Public Utility Commission or the Department relating to the
subject crossing, not in conflict with this Order, remain in full effect.
Using Section 130 federal funds and other contributions by interested parties, the
Department shall bear 100 percent of the cost of work items listed in paragraphs 2.a., 2.b.,
2.c.,2.d., and 4.a., 4.b., and 4.c. above.
NOTICE OF RIGHT TO REQUEST A HEARING
You are entitled to a hearing as provided by the Administrative Procedures Act (ORS
chapter 183). lf you desire a hearing, you must file a written request with ODOT within 30 days
from the date of this Order. You may use the Request Form attached to this Order. lf you would
like an opportunity to meet with the Department to discuss the application and proposed terms
of approval, check #3 on this form. This will preserve your request for a hearing.

The Preemfrtion Sequence is as Follows:
I . When Pedestrian lnhibit (Advance Preemption RR lnput) is initiated:
a) No change to vehicle phase sequence.
b) All active pedestrian phase walk intervals immediately
advance to and complete the flashing DON'T WALK interval.
c) All pedestrian phase calls are inhibited from being serviced.
d) Railroad Preemption PTR sign remains OFF.
2. When Railroad Preemption (Simultaneous Preemption RR lnput) is initiated:
a) Railroad Preemption PTR sign turns ON.
b) All active pedestrian phase flashing DON'T WALK intervals
immediately advance to solid DON'T WALK.
c) Any active Vehicle Clear Out phase displaying GREEN remains
GREEN and all non-Vehicle Clear Out phases displaying GREEN
terminate by advancing through their YELLOW and RED clearance intervals.
d) Once all Vehicle Clear Out phases display Green simutaneously, the
controller programmed VCOI interval is timed followed by the vehicle
Clear OUT phases advancing through their YELLOW and RED clearance intervals
e) All programmed Limited Service vehicle phases and their associated pedestrian
phases are serviced in their normal sequence based on demand.
3. Afterthe railroad preemption inputs return to non-preempt status (normal signaloperation):
a) Railroad Preemption PTR sign turns OFF
b) Normal intersection operation and sequence resumes.PED 2
